This article is devoted to the certain aspects of protection of liberty of thought, conscience and religion in the meaning of Art. 9 of the Convention for the Protection of Human Rights and Fundamental Freedoms. We have studied the complexity of the key concepts interpretation, the essence of which is guaranteed by the Convention, due to the lack of extensive practice of the European Commission on Human Rights and the Human Rights Court. It is noted that for a long time in a significant number of complaints the Convention body has come to the conclusion that the issues raised in the complaints, might be considered through the prism or Art. 10, as they concerned freedom of expression, or fell within the limits of Art. 11 of the Convention, which guarantees freedom of assembly and association. At the same time, the values protected by Art. 9 are related to those ones, which are provided in Art. 8 and demand the respect for privacy. It is also closely linked to the right of parents to provide such education and training as it is consistent with their religious and ideological beliefs, as guaranteed by Art. 2 of the First Protocol to the Convention.This article illustrates the fact that the conventional understanding of these complex, deep and multifaceted concepts at the present stage is formed with the development of the case law of the European Human Rights Court, which in its activities is guided by the principle of effective and dynamic interpretation of conventions and other related principles, which ensures the protective mechanism effectiveness. As the time is extended, the Court case-law has developed an approach that allows to assess the views that the petitioners plan to benefit from the protection of the Convention for the Protection of Human Rights and Fundamental Freedoms. Such views in the meaning of Art. 9 must, first of all, be to some extent "convincing, serious, holistic and meaningful" and, secondly, be "compatible with human dignity".Taking into consideration the compiled content of the right guaranteed by Art. 9, viz. that it contains two aspects such as forum internum (internal) and forum externum (external), the article notes that regulation can be involved only in the case of forum externum. As long as liberty of thought, conscience and religion remains within a human being, this right is considered to be absolute. The state has a negative obligation not to interfere in such a right.In the framework of this article, the author considers it appropriate to state the position of the European Union on the attitude and ways to effectively address these issues. As the subject of international law and one of the most influential international organizations based on the values of human dignity, freedom, equality and respect for human rights (Art. 2 of the Treaty on European Union), the EU advocates for their real protection, which requires the development of specific legal instruments.Therefore, both the EU internal and international activities are based on the principles that underlie its creation. It is the foreign policy aspect of the EU human rights activities that is the subject of our article that is reflected in the "European Union Guiding Principles on the Promotion and Protection of Religious Freedom or Belief".The article draws a number of conclusions. First of all, the right of liberty of thought, conscience and religion is one of the key principle of a democratic society and the value in European cultural and historical heritage. The issue of violation of the right to freedom of religion or belief is interrelated with freedom of expression, freedom of assembly and association. The issues of combating various forms of discrimination are not set aside. Additionally, the right, guaranteed by Art. 9, is a fundamental right and one of the democratic society foundations and the value in the law of the European Union. Moreover, the EU identifies problematic issues in the field of protection of liberty of conscience and religion as those ones that require particular attention, and the EU makes efforts to address them not only within its borders, but as well as in the foreign policy relations and initiatives ; Статья посвящена отдельным аспектам защиты свободы мысли, совести и религии в понимании ст. 9 Конвенции о защите прав человека и основных свобод. У роботі досліджуються особливості правових відносин, що виникають у ході імплементації практики ЄСПЛ в судочинстві України. Аргументуються причини та позитивні сторони поширення прецедентного права на практику діяльності ЄСПЛ і національних судів держав континентальної Європи. Аналізуються проблеми та причини неналежного сприйняття й адаптації українськими судами рішень ЄСПЛ в українській судовій практиці. ; The article investigates the peculiarities of the legal relations arising in the implementation of practice of ECHR in courts of Ukraine. The problems and causes of inadequate perception and adaptation by the Ukrainian courts of decisions of the ECHR in Ukrainian judicial practice are analyzed.Thus, the general legal issues relating to the activities of the ECHR can be divided into two groups: legal issues pertaining to the perception of the provisions of the Convention and ECHR judgments, and the problems of applying ECHR rulings in domestic legal practice in Ukraine. These problems include:1. There is a mixed attitude to the recognition by the courts of Ukraine of the mandatory interpretation and application of the Convention in all matters.2. Creates a problem and a dual interpretation of Article 17 of the Law of Ukraine "On the implementation of decisions and application of the European Court of Human Rights practice", which obliges Ukrainian courts to apply the Convention and the practice of its application as an independent source of law.3. Despite the reforms undertaken, the Ukrainian courts are not completely independent, which does not allow them unconditionally to use in their legal practice all provisions relating to the interpretation and application of the Convention. In Ukrainian reality, there are still some attempts of influence and pressure on judges by government officials, prosecutors, people's deputies, etc.4. An urgent problem is the qualitative theoretical retraining of judges in order to increase their legal consciousness and legal culture in order to reorient them to natural-law ideas based on high humanistic potential, which is based on justice, freedom, equality of all before the law, etc.5. The problem just raised, in turn, raises the problem of judicial practice: the rejection and some- times neglect by some judges of the positive experience in the consideration of the ECHR case concerning the violation of the rights and freedoms of the individual.6. Need to improve and implement the decisions of the ECHR in Ukraine, which differ from the principles of enforcement of decisions of national courts, first of all, prompt execution, impulsiveness, priority and completeness, etc.The solution of the newly identified problems concerning the perception and adaptation of ECHR judgments by the courts of Ukraine will contribute to ensuring the rule of law as the main social value of the state and turning it into a full-fledged subject of not only constitutional but also international law.Such a person's status in Ukraine will ensure the effective progress of our state towards integration into the European political, legal and cultural space, and the adoption of modern, more advanced standards for the implementation of judicial and law enforcement activities in the field of human rights, since appeals to the ECHR for a person are the last hope of justice and protection his or her rights and freedoms after exhausting all possible legitimate national remedies.

В статье рассмотрены антропологические истоки и природа прав человека, а также производных от них феноменов власти и государства в их взаимосвязи с естественными правами и интересами человека. Сделан вывод о генетически обусловленном характере основных прав человека, а их удовлетворение определено основной функцией правового государства. При этом государство и власть выступают в качестве социетального механизма для справедливого распределения людских ресурсов и социального воспроизводства общества ; The article examines the anthropological origins and nature of human rights, as well as derivatives of the phenomena of power and State in their relationship with the natural human rights and interests. Concluded that genetically inherent nature of fundamental human rights, and their satisfaction with primary function is defined by the rule of law. The State and power serve as a social mechanism for equitable distribution of human resources and social reproduction of society.Neoinstinctual approach to understanding power as a mechanism for sorting and distribution of values gives clear answers to such questions. Thus, elders individualized power seems primarily as ownership and capacity to manage these essential resources of life, the wisdom of generations, historical experience, the ability to forecast revenues and allocate time primary resources of life – values-things. Personified power of a charismatic leader is extremely scarce possession of spiritual values, aims, in particular, hope and faith in the "bright future" confidence to overcome any adversity. Since the extension of jurisdiction of the European Court of Human Rights toUkraine, when European Convention on Human Rights and Fundamental Freedomscame into force (11 September 1997; ratified on July 17 of the same year), there areexamples of estimation of norms of Ukrainian legislation in General, and Art. 8,which is the subject of our consideration, from the point of compliance with theprovisions of the Convention. Unfortunately, the annual practice of the StrasbourgCourt demonstrates the discrepancy of the legislation of Ukraine with the provisionson protection of rights guaranteed by the Convention itself and the Protocols thereto.Ukraine is consistently among the top five on amount of applications on theprotection of violated rights to the European Court of Human Rights, taking into theaccountand the fact that object to the appeal against Ukraine could be violationscommitted since 11 September 1997. On the contrary, there is consistently lowpercentage of enforcement of the European Court Judgments on Ukraine, particularlyin damages. Our work is in grater extent devoted to understanding of the concept of«family life» within the meaning of Art. 8 of the Convention and its relationship withthe concept of «private life».Current understanding of the concept of «family life» by the Conventionpassed a certain evolutionary way. Not accidentally Art. 8 of the Convention apliesthe term «family» using a multifaceted construction «family life», and of coursr,considering understanding of «family» in face legal orders. Understanding of theconcept of «family life» constantly goes through expansion due to the influence ofdifferent social processes, from migration to advanced medical technologyies, thatillustrates the application of the principle of effective and dynamic interpretation oflaw the Strasbourg court. This principle stipulates the evolutionary interpretation ofConvention norms, transforming Convention into a living instrument that responds tothe changing of present situation and allows to constantly expand guaranteesprovided by this document.In the examples considered in the paper, we note that the interpretation of theterm «family life» primarily carried out by the Court from giving preference toprotecting the interests of children, even if not their rights are violated in fact. ; В статье проанализированы основные тенденциионные подходы к пониманию «семейной жизни», право на уважение которой гарантировано ст. 8 Конвенции о защите прав человека и основных свобод. Unfortunately, the annual practice of the StrasbourgCourt demonstrates the discrepancy of the legislation of Ukraine with the provisionson protection of rights guaranteed by the Convention itself and the Protocols thereto.Ukraine is consistently among the top five on amount of applications on theprotection of violated rights to the European Court of Human Rights, taking into theaccountand the fact that object to the appeal against Ukraine could be violationscommitted since 11 September 1997. On the contrary, there is consistently lowpercentage of enforcement of the European Court Judgments on Ukraine, particularlyin damages. Our work is in grater extent devoted to understanding of the concept of«family life» within the meaning of Art. 8 of the Convention and its relationship withthe concept of «private life».Current understanding of the concept of «family life» by the Conventionpassed a certain evolutionary way. Not accidentally Art. 8 of the Convention apliesthe term «family» using a multifaceted construction «family life», and of coursr,considering understanding of «family» in face legal orders. Understanding of theconcept of «family life» constantly goes through expansion due to the influence ofdifferent social processes, from migration to advanced medical technologyies, thatillustrates the application of the principle of effective and dynamic interpretation oflaw the Strasbourg court. This principle stipulates the evolutionary interpretation ofConvention norms, transforming Convention into a living instrument that responds tothe changing of present situation and allows to constantly expand guaranteesprovided by this document.In the examples considered in the paper, we note that the interpretation of theterm «family life» primarily carried out by the Court from giving preference toprotecting the interests of children, even if not their rights are violated in fact. ; В статье проанализированы основные тенденциионные подходы к пониманию «семейной жизни», право на уважение которой гарантировано ст. 8 Конвенции о защите прав человека и основных свобод. Since the extension of jurisdiction of the European Court of Human Rights toUkraine, when European Convention on Human Rights and Fundamental Freedomscame into force (11 September 1997; ratified on July 17 of the same year), there areexamples of estimation of norms of Ukrainian legislation in General, and Art. 8,which is the subject of our consideration, from the point of compliance with theprovisions of the Convention. Modern international human rights treaties may envisage the rights of states, which participate in these treaties, to derogate from contractual obligations under emergency circumstances. The existence of the right to derogate (based on the provisions of the law of the state right to withdraw from the fulfillment of certain contractual obligations) has a significant impact on the state behavior in the field of ensuring and protecting human rights.On May 21st,2015,Ukraine used this right as a member of the Convention for the Protection of Human Rights and Fundamental Freedoms (hereinafter referred to as the Convention), Art. 15 of which establishes the right to derogate from obligations in emergency situations, which led to a closer study by scientists of the question of the derogation right.The normative consolidation of the right to a derogation, in particular in Art. 15 of the Convention treats the possibility of the existence of an objective necessity to reduce the level of protection of human rights and freedoms. Contemporaneously with consolidating the right of the state to the derogation, these provisions of the law contain conditions designed to prevent the unjustifiably wide application of this very right.According to the basic requirements, which are contained in Art. 15, first of all, it is enshrined that the right to withdraw from the state's obligations can arise only due to the war or another public danger threatening the life of the nation.The next key requirement is that measures taken by the state in derogation from their obligations should strictly correspond to the severity of the situation.The third requirement is the inadmissibility of the extension of the right to derogate to the rights, the protection of which is guaranteed by the polls, the list of which is given in Art. 15 of the Convention.Also these measures should not contradict other obligations of the state in accordance with the International Law.And, indisputable is the condition of compliance with the procedural requirements, enshrined in Sect. 3 of Art. 15 concerning the official public announcement of the derogation, which contains some information about the measures taken by the state and the reasons for taking them.Compliance with the requirements, mentioned above, will be served, in particular, by the activities of the Temporary Consultative Body of The Cabinet of Ministers of Ukraine Multiagency Commission on the questions of Ukraine derogation from the duties regarding the Covenant on Civil and Political Rights and the Convention for the Protection of Human Rights and Fundamental Freedoms, which was established on April 19th, in accordance with the Resolution of the Cabinet of Ministers of Ukraine.The activities of the Commission will help to prevent the abuse of the right of the State to derogate from certain obligations defined by the Covenant and the Convention and unreasonable reduction of the level of human rights protection and freedoms as the matter of fact that Ukraine may use this right. Gender equality is part of a broad cultural transformation that changes the functioning of traditional societies and contributes to the development of democratic institutions. Validation of gender equality provides a transition to post-materialistic values of self-realization, which contribute to the economic development of countries.In 2014, an Association Agreement was signed between Ukraine, on the one hand, and the European Union, the European Atomic Energy Community and their member states, on the other hand, which defines a qualitatively new format of relations with the EU on the principles of "political association and integration "is a strategic reference point for systemic reforms in Ukraine. From association with the EU, it follows that each country seeking to gain membership in the European Union must comply with the standards in force in the EU and respect those rights and obligations granted to its member countries. In particular, the Agreement provides for the need to strengthen the dialogue and cooperation of the parties to ensure, in particular, gender equality and non-discrimination.Nowadays Ukraine has a constitutional reform. This reform is aimed at developing a democratic legal state and European integration. Equal rights and opportunities for both sexes is one of the main pillars of this reform and at the same time a sensitive indicator that shows how developed and democratic the state is.The international (European) standards of protection against gender discrimination, their significance for Ukraine in the context of constitutional reform are analyzed in the article. International standards for gender equality and the main documents are considered; the activities of international organizations, specialized bodies and other institutions whose goal is to ensure gender equality is studied. ; Анализируются международные (европейские) стандарты защиты от гендерной дискриминации, их значение для Украины в условиях конституционной реформы.
