STRENGTHENING THE COMPENSATORY BASICS FOR VIOLATED SUBJECTIVE CIVIL RIGHTS PROTECTION IN THE EUROPEAN UNION MEMBER STATES AND THE RUSSIAN FEDERATION
The article tackles a problem of disputable issues coming alongside the implementation of public interests for the protection of violated private property rights in the European Union member states and the Russian Federation in regard of the possibility to collect additional (compensatory) or punitive amounts above the prescribed. The article provides an overview of various approaches to defi ne the notion "the right to judicial protection" and the "protection method" in European and Russian legal doctrines. The authors highlight controversial issues of imposing additional (compensatory) payments in Great Britain and Germany as a vivid example of various legal systems in action. The purpose of the article is to substantiate the global task - to develop a mechanism of additional compensation for violated rights in the legislation of the EU, EU member states and the Russian Federation with the focus on proprietary rights.

WE, THE PEOPLE OF THE FEDERATION! CONSTITUENT AUTHORITY IN CLASSIC AND MODERN FEDERATIONS ; MI, NAROD FEDERACIJE! USTAVOTVORNA VLAST U KLASIČNIM I SUVREMENIM FEDERACIJAMA
Regardless of the earlier assumptions about the obsolescence of the classic federal theory, the paper emphasizes the contemporary significance and relevance of federalism. Europe is the epicentre of modern federalization processes, not only when it comes to the European Union, but also a number of European countries such as Belgium, Spain and the United Kingdom. The paper points out the fundamental distinction between the classic and modern federalism, which has its origin in the fact that federal systems 'arise' differently as a result of opposite processes of federalization and that in this sense we can distinguish between classic "integrative" and modern "devolutive" federalism. The basic assumptions of the paper are that 1) these two federalism patterns originally differ in the character of the basic constitutive act of the federal union with regard to the subject of creating a federation, and 2) because contemporary federations are "federal states without a federal foundation" this difference is not noticeable today. On the contrary, it has largely disappeared, and in this way, the difference between classic and modern federalism is actually bridged. ; Bez obzira na ranije postavke o zastarjelosti klasične federalne teorije u radu se naglašava suvremeni značaj i aktualnost federalizma. Upravo je Europa epicentar suvremenih procesa federalizacije, ne samo kada je riječ o Europskoj uniji, već i nizu europskih država poput Belgije, Španjolske i Ujedinjene Kraljevine. U radu se ukazuje na temeljno razlikovanje klasičnog i suvremenog federalizma, koje ima ishodište upravo u činjenici da federalni sustavi različito "nastaju" kao rezultat suprotnih procesa federalizacije i da u tom smislu možemo razlikovati klasični "integrativni" i suvremeni "devolutivni" federalizam. Temeljne su postavke rada da 1) između ta dva obrasca federalizma izvorno postoji suštinska razlika u karakteru temeljnog konstitutivnog akta federalnog saveza s obzirom na subjekta stvaranja federacije, i 2) s obzirom na to da su suvremene federacije "savezne države bez federalnog temelja" ta razlika danas više nije zamjetna, već je ona, naprotiv, u velikoj mjeri nestala i na taj način zapravo se premošćuje razlika između klasičnog i suvremenog federalizma.

Europe, like America. The challenges of building a continental federation
The processes of building the United States of America since the late-eighteenth century and the European Union since mid-twentieth century are among the major claims for the possibility of a vast, continental-size polity based on democratic principles. While the European Union project is still full of uncertainties, the previous experience of building the United States of America offers the best reference for advancing towards a democratic federation. In this new volume from the Economic Studies Series of the Research Department of "la Caixa", Josep M. Colomer shows that the territorial limits of the European Union, like those of the American Union in the past, are not determined by geography or destiny but reflect the union's capacity to assimilate and institutionalize its components. The institutional and economic foundations of regional proto-federations
In the present paper we analyse for the first time as far as we know, the ancient Greek regional proto-federations, of free-democratic city-states. We examine their political institutions and policies, like common defense and external policy, military organization, representative federal bodies like popular assemblies, parliament, generals as military and political commanders, federal finance ministers etc., as well as their economic institutions and policies: Common currency, federal budget and federal revenues. We address in more detail as a case study the Aetolian Federation (Greek: Sympolitiae). Lastly, we compare this particular proto-federation with some of today?s federal states and the European Union (EU) and conclude that in some respects the proto-federation was more advanced than the EU, and thus can serve as a benchmark in addressing current European issues. Our main findings indicate that the Aetolian league, in accordance to its regional neighbor, the Achaean League had managed to establish a variety of institutions and mechanisms of governance that secured a satisfactory level of ?balanced? development to its city-state members under a Pareto efficiency perspective. The Aetolian League also achieved an ideal balance between direct and indirect (representative) democracy, an issue that is of major importance for the further EU integration. To achieve this, it established a system of a cumulative sum referendum process which we nominate, ?the Aetolian and Achaean cumulative model of governance?. We argue that this model could offer reliable and stable solutions even in modern EU decision-making processes, when complex issues are difficult to reach in common outcomes. It seems that the Aetolian Confederation had also managed to achieve a perfect combination of a strong institutionalized central government under a democratic profile and attitude. In addition, we argue that the system of monetary policy that comprised by the parallel usage of both local and federal coins that used by the city-state members of the Aetolian Confederation, might be a prodigal example of how to surpass the negative effects of today?s eurocrisis. Finally, we argue that the military organization of the League, could offer some ideas of how to create a would-be Federal Pan-European Armed Forces under the aegis of the EU.
