Project Description Business at the Crossroads - Ogden City is a project to collect oral histories related to changes in the Ogden business district since World War II. From the 1870s to World War II, Ogden was a major railroad town, with nine rail systems. With both east-west and north-south rail lines, business and commercial houses flourished as Ogden became a shipping and commerce hub. After World War II, the railroad business declined. Some government agencies and businesses related to the defense industry continued to gravitate to Ogden after the war—including the Internal Revenue Regional Center, the Marquardt Corporation, Boeing Corporation, Volvo-White Truck Corporation, Morton-Thiokol, and several other smaller operations. However, the economy became more service oriented, with small businesses developing that appealed to changing demographics, including the growing Hispanic population. ____________________________________ Oral history is a method of collecting historical information through recorded interviews between a narrator with firsthand knowledge of historically significant events and a well-informed interviewer, with the goal of preserving substantive additions to the historical record. The interview was conducted on October 10, 2013, by Lorrie Rands. Jayeson discusses memories of Ogden and 25th Street. LR: Today is October 10, 2013 doing a phone interview with Mr. Jayeson Vance who is currently residing in San Francisco, about 25th street and Ogden. My name is Lorrie Rands and I will be conducting the interview. Jayeson, I, again, appreciate your time and your willingness to help us out with this. Let's begin with the simple basics of when and where were you born? JV: I was born at the old St. Benedict's hospital on 29th and Polk in Ogden, on June 26, 1947. LR: Where did you reside, where was your home in Ogden? JV: Our home was, when I was a boy, we were, first we lived in a post war housing, emergency housing for the GI's. My dad was at Hill Field as an Air Force Sergeant, an Army Air Corp Sergeant. That was at the old Bonneville Park, as they used to call it. It was an old cinder block, post war or emergency housing that, I don't know who paid for, probably the federal government. Then they, at some point around 1950 or 51, they destroyed those homes and we, my dad was able to get a home on 1362 Hudson, between 5th and 6th on, at just above Harrison, and we were just a quarter block below Polk. That's where I spent my early years and then we later moved to 108 Harrison, at first and Harrison. LR: So was Harrison at that time, was it paved all the way through? 1 JV: Yes, Harrison was paved, Hudson was primitive, it was unpaved, thank you for asking. We actually did not even have a phone in the house and my mother had to walk to Hudson and Polk, to a little phone booth as did all the neighbors in order to place a phone call. Actually, it seems funny now, and the street was dirt and it had a curb and gutter but it didn't have the sidewalks and it didn't have, you know, it was very primitive. It was like living out on the frontier in a way, and my grandfather used to say, "You can hear the coyotes at night up there where you live." He lived on 256 Harrisville Road which is still there, that structure is still standing. LR: You grew up then in that part of Ogden? JV: Yea, on that northeast bench, I went to Ben Lomond High and then my dad had gone to Weber and my mother, actually my mother was a USU graduate. I just said, "Well," I couldn't decide what to do after I graduated from Ben Lomond, so I decided on Weber, which was a great choice. I was pleased with, I always thought it had the best—a lot of people say about Weber that we had better professors than bigger schools because you didn't have teaching assistants teaching classes, you had Ph.D.'s teaching classes quite often and so I think in some ways we got a much better education at Weber than people maybe at the University of Utah had in some ways, so anyway, it was a good time to go to Weber. I briefly was the sophomore class president for a brief while, filled in for Mike Howe I believe was his name, cause he couldn't finish his term. My name at that time, I changed my name in 1982, and my born name was Clark Walker. So that's always strange, and I have to explain that, that I 2 changed my name. I was one of those kids that had kind of an identity crisis and so my legal name is Jayson P. Vance. I don't know how much you want to know about my personal life, but just to explain, if you look me up, you'll find me under Clark Walker. Weber State records, well, except I changed my diploma reads Jayeson Vance now, so I had that changed. LR: So, I'm just curious, why did you choose Jayeson Vance? JV: It was just one of those things that I had a friend who was a counselor, which said, "It's time for a change." I had just left a federal job and I wanted a new start in life and she said, "This would be a good time to change." She had done this to, she had changed her name and she said, "I don't know, it's great," and she was able to persuade me that I should do it. Then once you do that, and we'd had a house so we had to change the mortgage records so then and I had to go to court, to district court and officially change my name by law. I can't ever use the old name again and legally, so anyway, I have, for better or worse, that's my name. So I just have to accept that. In some ways I felt shouldn't be changing that because it's my family history, but then as I researched my family history, I found out that my father's father, who was an English immigrant during World War I, which is kind of odd, how do you get to where my father was born in California? It's a long story, but his father deserted the family, his name was reputedly, Sylvester Hodgson Walker. He deserted this mother and this infant boy, who was my father and said, "I'm a British subject, I don't want to have a kid." And he ran off to Canada, and he said, "You can't touch me, I'm a British subject." I don't even really know the man's name, I never saw a picture of him 3 and it's one of these great mysteries of life that I would love to see at least what he looked like and how did he end up in California during World War One. The British would have wanted any young man to be in the Army or something and so it's a—was his name really Walker, you know, all these mysteries like that. I didn't feel troubled about dropping the name Walker, so that's, anyway, we got off on a tangent. LR: No, that's great, I asked so, let's go ahead and go back then. You said that your dad worked at Hill Field as a sergeant in the Army Air Corps, what did your mom do? JV: My mother was a teacher in her later years, well, when they were first married she was a school teacher, then she dropped her job as a teacher to be a house wife and about 1959 she went back to Ogden public schools, worked at Edison school teaching second grade. Her name was Bonnie Ruth Murphy Walker and she passed away this month, just earlier this month, ten years ago the start of this month, she's been dead 10 years now. The family is all gone, my brother, my father and my mother are all gone and my wife and I live here. LR: You're kind of cutting out on me. JV: Oh, maybe if I hold the microphone up closer here. LR: I'm not sure if it's you or if it's me. That seems to be better, okay. I hate it when I get off on my flow. As you were growing up, what were some of the things you liked to do for fun? JV: I used to draw maps of the city actually. I loved history form early on. I read Land Mark Books, I was a boy scout. I got an Eagle Scout Award, I was an Eagle 4 Scout. I was very interested in police and crime, the FBI. I wanted to be an FBI agent at one time and I studied the history of, I was reading adult literature written for adults about the FBI, you know like the FBI story by Glen Whitehead I think it is, when I was twelve. I was trying to—it was not easy to read—but I was trying and I was just obsessed with that stuff and I saw the world very black and white, in a very black and white way. I remember giving—I had some really conservative, very, very conservative opinions about law and order and I wanted to—we had some milk stolen and I wanted my mother so badly to call the police department because I wanted to look at a real policeman in the face and we hardly had any crime in that area. I was so excited that was my amusement, anything to do with law and order or police, any TV show, Texas Rangers or Broderick Crawford, who starred in California Highway Patrol or anything like that. The Lone Ranger and all that stuff, I just loved all that. We played Army, it was post World War Two so we had, almost everybody I knew was the son or the daughter of a GI or a sailor from World War Two or a Marine. We had tons of Army Men and toys about World War Two and I had a whole Army and Navy set of toys that I just spent hours with. Then we would—the little kids in the neighborhood—we'd organize into tiny army, little army training things. Then I would build little model cities in the back yard with rocks and build a highway. I had a lot of fun doing that. I made a model of Ben Lomond peak at one time in my back yard out of clay and rocks and so I had a lot of fun as for Mount Ben Lomond and all that. I tried to make of Ogden out of rocks but it was a little over whelming. 5 LR: I'll bet. So did you ever have the chance to meet any Ogden Police officers when you were younger? JV: Yea, one of my friends, Gary Greenwood, became a police officer in Ogden and he and I were golfing buddies for quite a while, and I met him, just before I moved out of Ogden—I got married and moved away, I remember seeing him in his uniform with his shoes all polished. I was so proud of him and I so wished that I could be like him, be a policeman, but I never became a policeman, I became a park ranger. Not quite the same, but he was just kind of an inspiration when I saw him standing there with his highly polished shoes and his nice neat uniform and he was very proud of it, rightly so. I lost track of him, I would like to talk to him again but I tried to locate him on the internet and he was a probation officer for a while and I couldn't find any more about him. I haven't, if you know him or anybody knows him, I would love to talk to him. He was a great guy. I'm just joining the auxiliary law enforcement team here for the San Francisco police, I just applied to join that. It's a volunteer position, but my fantasy, my interest in crime and law and order has been lifelong. I guess it's no wonder I ended up on Alcatraz. LR: Did you ever hang out downtown? JV: Yea, we did, one of my stronger memories, my father would take me, well my father was a—after he left the Army Air Corps, he became a postman at the main post office and then later Gorder's station as they used to call the post office over there on the bench. He was, his route was the businesses along 25th and along Washington. He was the downtown postman, and he would drive all the 6 packages, they didn't have a UPS, and he would do all the package deliveries all over downtown. He was a gun lover, he loved guns and there was a gun shop on 25th that he loved to go to. He knew 25th very well, he knew the Porters and Waiters Club, he took me into the Depot Drug and there was some girly magazines one time. Oh, it was a little embarrassing, I was going through puberty. Oh we looked at those girly magazines a little bit, but that was among little things like that that I remember. Depot Drug was a hive of activity. It was scary, it was frightening, but it was exciting also. They had these barrels of toys. I loved anything with a plastic army man, or army soldiers like that, and they had just piles of that stuff. Even in the front window, or I think it could even have been on the sidewalk, I could remember my heart just pounding about it, and I only got to go in there a couple of times, but it was a just a hive of excitement. There was also a fear about 25th of course, the legend of all the possibility of heroin and prostitution and all those things that were going on around there. I could even I guess sense it in my father that he was a little bit on edge, but he never had anyone bother him or threaten him in any way while he was delivering mail. He had some rude business people that were pretty rude to him, you know, kind of abusive, but he didn't ever have any threats. He was very close with the black community in Ogden, he knew a lot of the black folks and he was very pro civil rights and he felt that they had gotten the bad end of the deal. The Porters and Waiters Club was famous, of course, for the railroad porters that worked on the Union Pacific that brought Jazz to Ogden. 7 It was also a street of sin certainly. Later in life, my best man at my wedding was Arnie Jacobson and his father was chief Jacobson of the Ogden police. Arnie told me some stories, but these are now second hand stories that he got from his father, so I don't have direct access to that information but it came through Arnie. His father put on black face because they didn't have any black police officers and went down onto 25th to purchase heroine, because the dealers on 25th were black. They did make some arrests and the Ogden police were known as the toughest police in Utah because of the street, because of patrolling 25th street they had to be tougher than the Salt Lake police, according to Arnie anyway. They would have this annual football, I believe football game between the Ogden Police and the Salt Lake police and the Ogden police would always win because they had to be tougher, even though it was a smaller department by far than the Salt Lake department. It really had quite a story there, I mean you could write a lot of, I could easily see someone writing a novel or a historical novel about it. Maybe that's what I should do, I don't know. Then my mother told me about working at the Union Laundry but she did all that Union Pacific linen as a young woman. She was a pretty young brunette and her father, Clarence Murphy, would warn her, he was a Union Pacific engineer. "Now Bonnie, you get down to Washington Boulevard and get on that street car and you run to Washington Boulevard," or somebody told her, or she told me that she was so scared on 25th that she ran all the way from Wall Avenue to Washington Boulevard as fast as she could run to get to Washington Boulevard to where she felt safe, and then get on the street car to go north to 8 Harrisville Road where they lived. She had a palpable fear of that street but she again never had anything happen to her so it just, there's a lot of stuff about that street. I've seen that, I don't know you've probably seen that DVD that that fellow put out about the history of Ogden I imagine. Are you aware of that one? LR: Yes, The one that was in 2007 or 11, not too long ago? Yes. JV: They explained that, I guess they alleged that Al Capone may have been on 25th, which I've never found any—I tried because I studied Al Capone quite a bit having been on Alcatraz where he was locked up for about five years, and I've never found any evidence, have you? To support that he was ever there. LR: I haven't, the only thing I have heard about are the rumors. JV: Yea, it's just legendary. When I worked on Alcatraz we'd have people from Canada and Saskatchewan Province was a place where he was reputed to have been. Oh, Al Capone, you hear this all the time, in Wisconsin he went to honey lodges and it is conceivable that he may have been in Ogden that he was really on, and it was called Little Chicago at one point. It was one of the nick names of Ogden, of that area of Ogden as you may know already. Of course, today, it's a very different street than it was and I'm looking at a picture of it right now, a modern picture. I guess there were some movies made there with that famous noddle parlor sign? LR: Yea, the Star Noodle, the one with the dragon? JV: There was a little China town there too of course, from the Chinese workers on the railroad. My grandfather, as a boy, his mother died when he was a youngster and his father was of course a railroad worker too, an engineer, and he was 9 basically raised himself on the streets. This would have been about 1900 or 1905 around in that era, used to run opium on a bicycle around China, the little Ogden, and helped these opium dealers. It was legal at that time to sell opium, and he would, as reprehensible as it sounds now, would sell opium to the Chinese, and make a little money that way, because they didn't have much money. He and his sister and his father, no mother, were kind of, you know, they had some kind of rough edges in his early years, and he remembered being pretty mean to some of the Chinese as a teenage boy, pulling there queue's. They used to wear their hair in queue's on the back of their head, doing some mean things like that and of course the Chinese were abused everywhere. Out here in San Francisco they were abused even more. The word Chink was frequently passed around. It was a racist time it was not fun to be black or Chinese in those days. It was rough for a lot of people. LR: So did you ever witness any of that discrimination in that part of Ogden? JV: No, that was way before my time. I think it went underground, I'm sure there was a feeling that Asians were odd or you know, they were kind of a curiosity. I don't remember. We used to eat at the Utah Noodle Parlor a lot and have the other—I forget the other noodle parlor name on Grant there. We used to, and we enjoyed all the food, the chop suey and all those things. So you'd hear little remarks like that, that were racists but it was, and of course it was. My grandfather had actually been a member of the Klan when he was a youngster. He had no education, he was brought up on the streets and he picked up whatever he picked up, and he picked up a lot of racists attitudes. I remember he, as a young 10 man—he wasn't that in his older years—but as a young man, there was a Klu Klux Klan Chapter there in Ogden. The Klan was all over the United States if you study the history of the Klan and it was very powerful in the early twenties and that's about the time he was starting his family. My grandfather was out there on Harrisville Road, but he I guess they had some Klan meetings up on the foothills in the early twenties where they burned crosses and stuff up on the foothills above. You can imagine how it must have felt to be a black person and see that going on, especially a tiny minority, there in that part of the world. A feeling, you must have been pretty much an emotional, a very unpleasant emotional experience anyway for a black or an Asian too. I think they were pretty mean to Asians, the Klan was, as well. He never said much about that, he did express racist attitudes which were part of that generation, occasionally. I had that wonderful contrast in my father who just really loved the black folks in Ogden. Marshall White, the police officer who was killed there, who was a hero of the police department. After they finally got a black officer, and then he got killed, but it was a rough town. There was somewhat open prostitution, if I remember, right along parts of Grant Avenue and Lincoln Avenue. Even in my early years, even as late as maybe 19, probably about 1970 even, there was still open prostitution going on, it was very limited, but it was there. As I've studied the street I know there was a back alley that ran heroin and a tunnel that ran heroin from the depot all along, I think on the north side of the street. Maybe that tunnel is still there, I've seen 11 some references that indicate that the tunnel went all the way to the Ben Lomond Hotel apparently. Are you aware of that? LR: I'm aware more of the rumors. JV: I saw something online about historic tunnel tours of Ogden and they, if I remember correctly were going into the basement of the Ben Lomond Hotel and somebody was leading a ghost tour or something like that. They were able to go under Washington Boulevard possibly and they said, "Well, who knows." Of course they want to enlarge everything and make it more exciting so they bring in Al Capone and all that. The danger of history is always that somebody tries to enlarge things or exaggerate things. I was never able to see that myself and I didn't even know, I'd heard rumors about it but I've never been in it. LR: Well I know that most of the businesses now have closed up there tunnels, so most of the people we have talked to, yea, it's possible, but now they're all closed up so. But yea, we've had a lot of references to them, a lot of people that remember being down in them, but none actually going form Ben Lomond to the depot. We can't actually verify that, so. It's fun to hear about though. JV: Well that was the big fancy hotel, I guess the Ben Lomond was built about 1927, and being a big, the highest building in town and anybody who wanted a prostitute probably would have wanted to bring them in underground into the hotel or something like that, or wanted maybe drugs and happened to be at the hotel. It does kind of make sense if you were in the, in the world of vice and you had money enough to stay in a nice room there and you wanted something, knowing the hotel business as I do, because I worked with it for a while here, 12 there are people in the hotels are bribable a lot of times, and if you want—they want some cash and if you have the cash, they'll find a way to get you what you want. Who knows, I wouldn't be surprised, I don't have any evidence of it, but I wouldn't be surprised if there was something like that going on. LR: I wouldn't be surprised either. Do you remember any of the people that used to live or work on 25th street? JV: Yes. Well, my mother worked at the Union Laundry I guess it was called as a— this would have been—she was born in 1919, so it would have been roughly around the time she graduated from Ogden High in 1938. So she was working at the Union Laundry, and that's where that tale about running down the street as fast as she could run, her heart pounding came from, that era. And then my grandfather, Clarence Patrick Murphy, a real Irish name, half Danish, but in fact his mother was Danish. He was working there from about age 16 and he was born about 1885 I believe, so he would have been there about 1901 and he was already working as a fireman as a teenage boy. He couldn't finish school, at Sacred Heart School on upper 25th where he went. He would bend over all the way to Wyoming shoveling coal. He told a tale later that even as a 16 year old boy of working with his back bent to shovel coal all the way from Ogden to Evanston and back just almost constantly shoveling coal to get up that grade to that high plateau in Wyoming. It was not the life that any of us would want to live I am sure, to spend back breaking hours to make a living. He was a devoted member of the Brotherhood of Locomotive Engineman and Firemen throughout his life and was a lifelong democrat of course, because of the 13 Democrats alliance with the labor unions. He was also one of the shop stewards of the Union Pacific in his later years. He also worked on the old Oregon Shortline Railroad, which was, he fondly would say, "Oregon Shortline," and his eyes would drift off as he thought about it. I guess the Oregon Shortline was, ran from Ogden to Pocatello, if I'm not mistaken, and didn't obviously it didn't go all the way to Oregon. He was the switching engineer which would be, he would build trains by bringing cars from one train and hauling them to join another train and then back and forth all day in the yards of Ogden. He'd go over those yards, and of course today, there's even I guess some activity there, but back in those days the yards were just a hive of energy and the sound of the rails and the squeaking of the iron against iron and you would hear all the noises associated with all that. The station where I went as, this would have been approximately 1955. My grandmother, my California grandmother, my father's mother, would come up from across the Lucin Cutoff across the Great Salt Lake on the Union Pacific from Promontory Point to West Weber and she would, we'd meet her at the Union Station whenever she'd come to visit us. That's where I got to see the Union Station quite a bit as a boy. There would be three or four taxi cabs, several cars coming and going and people were dressed—in those days the women wore gloves and hats and high heels all the time and the men wore business suits and big fedora hats. The railway express, REA railway express agency had a large outlet in the foyer of the station. 14 Just going in to the foyer of the Union Depot was to me, one of the most exciting things of my childhood because I would go in there and look around and seeing people coming and going, people making orders and carrying tickets, porters carrying baggage and porters with red caps on and white uniforms and white jackets. All black men, the only black people I had ever seen at that time in my life were down in the depot. Sorry, I get a little emotional sometimes when I'm talking about these things. I have to take a breath here for a moment. There was a very busy barbershop with an old fashioned striped aprons that, or whatever they called those things that they, smocks, that they would put around people being, having their hair cut. They had the talcum powder brushes and the barber clipping away furiously, and people in a hurry to get on, "I don't want to miss my train," and all those things. The station itself, getting inside was just, it seemed like the biggest building I had ever seen in my life at that time, probably was, and it, the big chandeliers and it was just, in its heyday was just packed with passengers and train schedules and the public address system announcing what was going on. I didn't even know what the people were doing as a boy, I had no concept of what riding a train was because we didn't actually get on the trains, so we never went out on the platforms and so all I saw was just the results of all that. What I observed was a little confusing because I didn't put it together that these people are coming from California or Chicago or wherever it may be. This really was the junction city of the Mountain West and it really was a big deal. It was so sad to see the old down town, as I'm sure you've heard from a 15 lot of people, to see what happened to that wonderful downtown on Washington Boulevard. Again, that's another subject for a book you could write about, Washington Boulevard in its heyday. Beuhler Bingham and B and B Clothiers, the Blue Door and all those fabulous clothing stores and Fred M. Nye that were able, because the economy was so powerful then with Hill Field and the Army Depot and the Naval Supply Depot and all those things, and then the railroad. Everybody was making money and it was sort of the golden age of Ogden. I guess from about the end of World War Two till roughly the time I graduated from Ben Lomond, about 1965, for about those twenty years that downtown district was just thriving. There was Watson and Tanner and 24th street was almost equal to Washington and its level of commercial activity and it was a really nice feeling to the town. There wasn't a lot of crime for the most part, you didn't hear about a lot of—we had, my mother had a friend, Officer Keith Burkdahl, who was a policeman. I remember she got—I guess one of the early beat nicks, there were a handful of beatniks I guess, in Ogden, that maybe were smoking marijuana and this guy hit her at 25th and Monroe. It was at night and he had dark glasses on, and he had sideburns and this would have been 1955 or 56 around the time Elvis was big. We just thought that was so bizarre that this fellow was dressed in this leather jacket and he had sideburns and he had dark glasses on and it's nighttime, you know, why are you wearing—it is kind of odd even now. Keith Burkdahl investigated this because my mother happen to. His wife was a good friend of my mothers and he was a patrolman and so he said, "Yea, we caught 16 this guy and arrested this guy." They finger printed him and everything. I was excited by that. It was, there were some rough characters in Ogden and who knows maybe he was using heroin or something too, or maybe he was associated with 25th street, but we never found out. Whenever I would encounter the Ogden police, I can remember in 1956, the Ogden Police had four brand new blue Fords that they got and they all, they had no markings, anywhere on the car. They were painted, I think, if I remember correctly they were a dark royal blue and they had just about the size of a coffee cup, maybe a large coffee cup, on top was a red, just a red light, and that's all, and a radio antenna, and not anywhere on the car did it say police, anywhere. It just is so funny to look back at that, we'd walk through City Hall Park and of course that was the police station back then. It was in the back of the city hall building, and you'd walk through city hall park and I'd see maybe eight or nine Fords with that bubble light on top, and maybe a couple of unmarked cars. That was the, such as it was, the Ogden police at that time. There's another story, you could do the history of the Ogden Police because they must have some tales to tell if you come across one of the retiree's from the Ogden police or somebody, the son of a police officer, I'd bet you'd get some great stories. Arnie Jacobson might be a good source because his dad. I don't know what became of him, I haven't been in touch with him in years, but his dad, I know was the chief about 1970, they had the police radio in their house because his dad was the chief, so he would hear all the radio calls in Ogden as a 17 boy. You get into some personal information sometimes, but he got run out of the house. LR: Well speaking of growing up, did you ever attend any of the theaters downtown? JV: Yes, the movies? LR: Yes. JV: Yea, we loved the Orpheum, thank you for reminding me. The Orpheum and the Egyptian, but the Orpheum even more so, it was sadly destroyed. The most exciting, fun thing we ever did I think was about 1959 and Ogden was just in its glory days at that time. We, there was a girl next door, Susanne Sylvester, who I had a crush on, and I forget who else. Anyway, we were all about 12 or 13 years old and our parents escorted us, and we got all dressed up and went to, I put on a tie and a sports coat and the girls were dressed up and we just, we just thought that was the most fun we had ever had. We went to the Orpheum and saw a movie, I can't remember what the movie was now. It was just going to the theater down, either the Egyptian or the Orpheum was just one of the special things about that time in life when you are coming of age. I think for almost anyone who was there at that time would remember it well. LR: So is that the theater that had the Popeye Club? JV: I don't know. You know, I don't know about the Popeye Club. Actually when you said that it was the first time I've heard that term. LR: Oh really, okay. JV: I must have missed out. LR: It might have been Paramount. I get my theaters mixed up, I apologize. 18 JV: The Popeye Club, maybe the Paramount was, Popeye Copper Club, Ogden, or Popeye—it says here, I am doing a little web search. I remember the Paramount was where the Paramount Bowl was, is that right? LR: I'm not sure. JV: Where the river, by the river bridge? Where the Ogden sign, is that right? LR: I'm honestly not sure, I thought it was downtown myself. I know the Orpheum and the Egyptian were. I thought the Paramount was too, so. JV: Let's see here, we had a friend who lived right by the Ogden bridge, the Ogden sign, where the Ogden sign in on the east side of Washington. There was this very interesting neighborhood there that reminds, as I got older and look back at it, I thought, "Oh my gosh, that's a lot like big city's back east." It reminded me of, in some ways. I remember the Paramount Bowling alley. When you said Paramount I thought more of a bowling alley then I did of a theater. Then there was a drive in too, and there may have been called the Paramount, there was the Riverdale Drive-in, and there was a drive-in on the south end of town was the Riverdale and going up towards North Ogden was, that Harrisville area there was a drive-in out that way, the North Point Drive- In. The drive-ins, of course, when you're a teenager in those days, it was where all the necking and all that went on. Exciting dates or all the wishful thinking for boys mostly was going on. I know there was a Paramount theater, maybe if I put movie theater, Ogden Utah, my search engine isn't generating a lot right now on that. Let's see, as it opened on the, oh, here it says, "The Paramount theater opened as the 19 Alhambra theater, March 17, 1915 with a concert by the Ogden Tabernacle Choir." There's one reference there, its Cinema treasure. Oh, here we go, 2429 Keisel Avenue. LR: Ah, that's right. JV: Oh, the Alhambra. So here is a, I vaguely remember this photo, I mean this store front. It's located on Keisel, just off of, I think just off 24th, because that looks like the Fred J. Keisel building. LR: Yes, it would have been on the opposite, it would have been closer to 25th. It's actually not there anymore, they tore it down. JV: Yea, I bet it's gone. That's my granddad's era for sure, those old street lights and globe street lights and the old early automobiles. LR: What are some of your favorite memories of downtown Ogden then? JV: Well, to be honest, it was the pretty girls you would see. You would see very, very pretty girls, you'd see dozens of girls that would just you know, traffic stop kind of thing where you'd go, "wow." It was also just the feeling that it was exciting, it was a pleasant city. There was a lunch counter near 25th and Washington, Keeley's Café. You'd go in, it was a bustling café, downtown café—going in and having lunch there. There was also a toy shop near there, and my grandfather doted on me, I was his favorite, out of the five grandchildren I was the oldest one and he liked, I don't know, he and I just bonded and he would take me in as a boy and bought me a pistol set, a cowboy pistol set from this store and I don't know the name. It was a toy store near the Broom hotel and it had just all kinds of cowboy toys all 20 over the walls, and this was a pretty big, pretty large, you know, reasonably large toy store and he bought me this holster and toy gun and toy bullets and I think it was probably one of my happiest moments in childhood. Then going on that date to the Orpheum was another one. The Utah Noodle Parlor was always fun to go to and having the big butterfly shrimp that they still make I think, I think they're still there somewhere. LR: No, they actually closed down. JV: Oh, they closed down? LR: Yea, it hasn't been that long, but Utah Noodle is no more. JV: Oh, that's too bad. That was a great tradition, but I guess Jimmies Flower shop is still there probably. That was a great flower shop. I didn't know the Glassman's, I guess you've come across A L Glassman, the name A L Glassman, but he was the operator of the Orpheum it says. Have you come across the Name Ira Huggins? He was the great attorney, probably the most famous attorney in Ogden. LR: I'm not sure. JV: Ira Huggins was—my mother would speak of him very fondly. I found a URL here, its Cinema Treasures, and it has a lot about the Paramount Theater, 2429 Keisel. This might be a page you want to look at it. It's Cinematreasures.org/theaters/26282, [some of the information that follows come directly from this website.] This is a lot of information I wasn't aware of here about the publisher . Glassman, of course, owned the Standard Examiner and apparently owned this theater also at some point and one of its premier 21 attractions was Cecil B. De Mill, The Ten Commandments. In 1925 it was leased by Public Theaters and renamed Paramount Theater so it started as the Alhambra, I guess. Glassman also owned the Orpheum but he bought the Alhambra in 1923 and then, according to this web site, during the summer months, Orpheum Vaudeville moved to the Alhambra, so they had Vaudeville, wow, now that's very interesting. In 1925 the Alhambra was leased by the Publix Theaters and renamed Paramount Theater, so that's where they got the Paramount. It underwent a complete renovation and seating was reduced to 1900 one of its premier attractions was Ten Commandments. Not the one in the 1950s but the original. By 1927 the theater was under the direction of Brooklyn-born Louis Marcus, who also owned major theaters in Salt Lake, including the Capital and other theaters in Idaho. Fanchon & Marco "Ideas" supplemented the screen attractions at the Paramount. With the demise of the American Theatre in Salt Lake in 1929, the Paramount boasted being Utah's largest theatre. Wow, I didn't know any of this. In 1929 Marcus said he was selling his interest to Publix Theaters and retiring. He was elected mayor of Salt Lake from 32 and served four years and died in 1939. 1934 it came under the ownership of Paramor Theatres who also operated the Orpheum Theatre, Lyceum Theatre and Colonial Theatre. The local Ogden Theatre was an independent. So there is quite a story there of just the theater industry in Ogden. In July of 1954, Paramor Theatres completed renovations which gave it all new seating and a 42' by 21' screen. In time for Christmas 1954, a new marquee and Paramount vertical sign in addition to the Formica snack bar 22 was added to the interior. And that's when "White Christmas" came out with Bing Crosby. So, you'll probably want to look at that website for sure. LR: Yea, I wrote it down so I'll be able to. JV: It's not that much information but it has this one wonderful old photo of the Alhambra. LR: Hmm, that's cool. JV: Yea, also, I would recommend to you to see UCR.edu. LR: Right, I wrote that down too. JV: Yea, and if you can't—that website is a little obtuse—it's something like digital newspaper survey and it's California papers, but remarkably, like I say, especially the San Francisco papers, have lots and lots of Ogden's lore and stories, especially around the time of 1890 to 1930, which would be of great value to anyone doing research at the university there. Then you can form a partnership with the UC Riverside, maybe the two schools could maybe get together on helping each other, because I know that educators always need support and they have to help each other and there is always the threats of budget cuts and things like that. I know he was, that fellow at UC Riverside was saying, "Oh we've got to prove to the regents of the university that we are doing something of value to the community so that they won't shut us down." I wrote, personally when I was a park ranger, wrote a couple of paragraphs saying how much value I've gotten out of it. You're able to, or course with your printer on your computer, you're able to print stories up if you want, or photos. They also have photos too, because you're looking at the actual paper and you can see the old historic ads. 23 LR: Right, that's fun. JV: Yea, it's really fun. You sound like you're a history lover too, so you'd have a field day with that probably. LR: I have two more questions if that's alright JV: It's been a lifelong love for me. ___________ being a park ranger, it was one of the great joys of being a park ranger was being able to give history tours, you know how it's just limited to Alcatraz history, which has quite a colorful history of course. LR: I know it's kind of getting, this has kind of gone long, but I have two more questions if that is ok. JV: Yeah, sure. LR: My first one is, you talked about your grandfather being involved in the Klan in Ogden, do you know much about that? JV: No, he was, I think he was a little ashamed of it. He, I know, it's really unfortunate I can't ask any of these folks any questions or maybe my aunt, who is still alive might know something about it. She lives in Portland, Oregon. I could ask her but she would have been embarrassed about it too. I know that he talked in racial terms about when he would watch the prize fights, Gillette Prize fights on television and he would, there was definitely a palpable racism present when he would—see a black man fighting a white man or something in a Prize fight. The only reason I know about the Klan was that my mother told me that, he didn't tell me himself he was a member of the Klan. I think he was embarrassed. He was certainly not proud of it. 24 I heard, now, I'm trying to place where I heard the recollection by some, probably from my mother, that they had put some burning crosses up on, I think the north east bench, up around, somewhere around where Ben Lomond High stands today. Up on 7th or 7th street, upper 7th street probably or somewhere where it would be seen for miles around or hoped anyway. Just to terrorize the poor black folks a little more, and probably it would have been, I'm sure they didn't like Asians either, or Jews of course. There were a handful of Jewish people too in Ogden so those groups would have been not too thrilled, I'm sure, to see that. I could try and ask Aunt Patty, she's Jennings Olsen's sister by the way, my aunt. He was the professor there at Weber for many years. She may know something about it also, and if you want, I could call you back if I'm able to find out more. The KKK was organized in all 48 states in the 1920s per public television documentary. LR: It's just a curiosity. I will leave that entirely up to you. It was just a—really, someone who was involved, so I wouldn't complain but I don't want you to feel like you have to do that or anything. JV: Well, I'm always willing to help, it's fascinating. What I have found with history and the more you dig, the more interesting it is. LR: Well this is true, I agree. JV: You reminded me of that little neighborhood around the Ogden sign there on the east side of Washington that, I wish I could relive that. Also there was something— I went to visit a friend who lived right there. There was a little alley that shot off of Washington and I think it said Paramount Bowl and it was across 25 from Bigler's Desert Inn, which was an old structure that is no longer there either. We fished in the Ogden river briefly, just once, it only happened once, I went to see him and we fished in the river. It was kind of odd, it seemed like, because here it is almost like in downtown but also almost like out in the country at the same time. It was a really nice little district there that I haven't seen any photos of, but I can picture it in my head as I close my eyes I can see it. There were store fronts right the river and I think a concrete fence or something against the river bank itself, but I'm sure it's all gone now. All that's left is the historic sign there now, but it's fun to reminisce anyway. LR: Well, my last question is this, how has Ogden changed since you were growing up here, do you think? JC: It had that timing, you know, 24th and Washington was the heart of the city and it was the heart of Ogden, it really was like the heart. It was just like a human body has a heart, it was the heart of the city and it was a thriving heartbeat. I remember a young boy yelling, "Standard," and he used to actually hold up the newspaper in his arm and wave it and people would run up and buy a newspaper. It was from the Bon Marché store which was at 22nd to about 26th or 27th along Washington, was just bustling with traffic, excitement. The ladies were dressed in their finest clothes and men were dressed in business suits, and not everyone dressed that way, but it was certainly a thriving place and then along 24th, almost the same scene. It's just sad to see that, well it's happened to many cities; it's not just Ogden, that the core of the city got gutted and changed irreparably. It's too bad 26 that it couldn't have been like what was done with Trolley Square in Salt Lake where they at least maybe changed the buildings, but don't gut every, just don't tear everything completely. The W. T. Grant store was a big deal on 24th and Washington and there was the Kiesel building and the Eccles building and the First Security Bank building and it had this little sky line and it was just, I don't know, it just seemed like a really, really positive. Overall, 25th kind of gave you the vice and a little excitement and drama, which was also kind of fun, and it just kind of was a really nice place to grow up. It sort of represented America, to me. I wrote a little article when I was a boy about it and I took a world book and I followed the outline they used to write about Chicago or New York and I just took every element, and Ogden had it all, in miniscule amounts. It had a little Asian neighborhood, it had a black neighborhood, it had everything in America and it was a, in a microcosm, it was the country. It's sad to a, I'm sorry, LR: It's okay. JV: Makes me feel bad to see that all that is lost. I know there is some of it there still. The Egyptian Theater is still there, but, LR: You're right, most of it is gone. JV: We would get, to go down to Washington Boulevard was a big deal and we would put on our best clothes and we would, yea, it was just a big deal. Even when I started working at the highway department on 17th and Wall or near, just off Wall, at the Utah Highway, Utah Road Commission, we looked forward to driving along Washington Boulevard just for the fun of seeing people on the street and seeing 27 all the excitement that it used to represent. I don't know, it's just, thank you for letting me share all that, and if I can come up with some more goodies I'll certainly call you. On December 27, 2019, the General Assembly of the United Nations passed Russia-led resolution A/74/401, entitled "Countering the use of information and communications technologies for criminal purposes (United Nations, 2019, Countering the use)." Vehemently opposed by Western states such as the United States, the resolution approved the establishment of a committee of experts to evaluate the potential for an international cybercrime treaty (United Nations). While international cooperation of this kind is commendable, Western states and human rights groups have professed concerns that the vague language of the resolution has the potential to erode the human rights protections afforded to citizens under international law (Hakmeh & Peters, 2020). International Cyber Law Background The cyber domain is often presented as another realm, a world that exists outside of the mostly tidy borders the international community has used to separate themselves. Aligning with Running head: INTERNATIONAL LAW & THE CYBER DOMAIN 3 this view is the notion that cyberspace cannot be regulated because it expands beyond the traditional idea of territorial sovereignty (Kanuck, 2010, p. 1573). These ideas raise two concerns over the identification and prosecution of cybercrime. The first concern is the conflict between "cybercrime, which is global in scale, and police activities that are confined to national borders (Cangemi, 2004, p. 166)." The conflict arises in the very structure of the Internet, which "can be characterized as a multitude of individual, but interconnected, electronic communications networks (Zekos, 2008, p. 30)." This interconnectedness has created a grey area within the legal system, where no one entity has regulatory control over what happens in that area. The second concern is far more technical and highlights the transient nature of information and data (Cangemi, 2004, p. 166). The source of information can be easily masked to hide its actual location, and data "may be amended, moved, or altered in a few seconds (p. 166)." The speed in which data travels presents a significant hurdle to the legal and law enforcement mechanisms typically used to investigate crimes. As Cangemi notes, this creates "an appreciable risk that the evidence of cyber-offences will disappear" long before implementing the required resources (p. 166). Nevertheless, despite these concerns, "nation-states do strive to exercise their sovereignty over cyberspace (Kanuck, 2010, p. 1573)." The physical elements of cybercrime, such as the location of the people perpetrating the crimes or the location of the hardware used to execute the crimes, are used as a connecting link to allow governments "to address cyber conflicts involving both state and nonstate actors as matters to be resolved by sovereign powers under their respective legal systems (p. 1573)." When evidence moves beyond territorial borders, states seek to invoke bilateral or international action to further pursue the crime. This model follows the same formula that society developed over time, whether it be in stopping crimes such as international drug trafficking or heinous acts of terrorism. The international community is well-Running head: INTERNATIONAL LAW & THE CYBER DOMAIN 4 versed in this cycle, and the "nature of the international legal system affords this sovereign-centric approach primacy under the United Nations (U.N.) Charter regime (p. 1573)." If the international community is content in continuing to use this cycle, then "international legislation and action are essential to combat the phenomenon" of cybercrime (Pocar, 2004, 27). The essential requirement of international involvement and negotiation has rung true in the late 20th and early 21st centuries, as the international community takes steps to evolve international law to include cyber issues, specifically cybercrime. The 1980s introduced international consultation on cybercrime by multiple organizations. In 1983, the Organization for Economic Cooperation and Development (OECD) commissioned a two-year study focusing "on the possibility of harmonizing and internationalizing national cybercrime laws (Brenner, 2012, p. 133)." OECD later published a report in 1986 summarizing the results of the study and recommending countries criminalize certain cybercrimes. In 1985, the Council of Europe convened its own study, which involved a four-year focus on "the legal issues raised by cybercrime (p. 133)." In 1997, the Council of Europe convened another study tasked with "the drafting of a cybercrime treaty that would harmonize national laws dealing with cybercrime offenses and investigations (p. 133). In 2001, the study's efforts came to fruition in the creation of the Convention of Cybercrime. Also referred to as the Budapest Convention, the international treaty entered into law in July 2004 with the principle objective of "pursuing a common criminal policy aimed at the protection of society against cybercrime, especially by adopting appropriate legislation and fostering international co-operation (Council of Europe, 2001, Preamble)." As of 2018, 29 states have ratified the treaty, but the rapid development of technology has resulted in the convention becoming outdated, leaving governments and organizations calling for a new treaty (Murphy, 2018, p. 549) (Shackelford, 2014, p. 312). Russia's 2019 United Nations resolution is the latest attempt to modernize international cyber Running head: INTERNATIONAL LAW & THE CYBER DOMAIN 5 law and has received much adulation despite its vague, concerning language and human rights implications. The next section of this paper addresses human rights and provides an overview of states' obligations to this arena as members of the international community. Human Rights & the International Community Modern international human rights law begins with the first article of the Charter of the United Nations (UN), which dictates that one of the purposes of the UN is to "achieve international cooperation…in promoting and encouraging "respect for human rights and for fundamental freedoms for all without distinction as to race, sex, language, or religion (Buergenthal, 2006, p. 785)." While the Charter provided minimal specificity as to what "respect for human rights" entailed, this provision and others within the Charter catalyzed a new international perspective on human rights. In joining the United Nations, members inherently accepted "the proposition that the Charter had internationalized the concept of human rights (p. 787)." Furthermore, the Charter insinuated that "states were deemed to have assumed some international obligations relating to human rights (p. 787)." Articles 55 and 56 of the Charter cemented the beginnings of these obligations, requiring member states to "take joint and separate action in co-operation with the Organization for the achievement of purposes" such as promoting "universal respect for, and observance of, human rights and fundamental freedoms for all (United Nations, 1945, Article 55, 56)." The specificity of human rights became more overt when the United Nations devoted the UN Commission on Human Rights to the task of drafting non-legally-binding human rights instrument. In December 1948, the UN General Assembly unanimously adopted the Universal Declaration on Human Rights (Murphy, 2018, p. 402). Composed of thirty articles, the declaration instituted vital human rights and eventually "served as a template for numerous subsequent treaties on human rights (p. 404)." As a result, the Running head: INTERNATIONAL LAW & THE CYBER DOMAIN 6 Universal Declaration on Human Rights "has come to be accepted as a normative instrument in its own right (Buergenthal, 2006, p. 787)." Both documents uphold two pedestals of traditional international law as it pertains to human rights. The first pedestal retains responsibility for "the treatment by one state of another's nationals, an area known as state responsibility for injury to aliens (p. 389)." Although addressed at the state level, this notion asserts that individuals are afforded certain protections when in another state. The second pedestal, advanced by scholars such as Hugo Grotius, focuses on "the protection of persons against the acts of their own governments (p. 389)." It is this pedestal that introduces what is now known as humanitarian intervention, or the "idea of state intervening to protect the other state's nationals (p. 389)." Together, both the Charter of the United Nations and the Universal Declaration are "considered to spell out the general human rights obligations of all UN member states," of which there are now 193 (Buergenthal, 2006, p. 787) (Murphy, 2018, p. 59). Each international legal instrument has lent itself to the creation of international institutions dedicated to monitoring "compliance by the states parties with the obligations imposed by these instruments (Buergenthal, 2006, p. 788)." Such institutions include entities like the UN Human Rights Council and the Office of the United Nations High Commissioner for Human Rights (p. 788). Together, the instruments and institutions "laid the normative foundation of the contemporary international human rights revolution" and "influenced, in part at least, the contents of the legal norms under which international criminal tribunals operate today (p. 791)." The criticality of these elements to the international system, particularly as it pertains to international law, is justification for using each as measuring tools with which to judge the new UN cyber-focused resolution objectively. The third section of this paper will assess the purpose of the resolution and explain the supporting argument for its contents. Supporting Arguments & Analysis of A/74/401 Running head: INTERNATIONAL LAW & THE CYBER DOMAIN 7 In order to truly understand the intent of international laws, it is crucial to develop an understanding of the stances actors take concerning the specific issues at hand. This understanding is of particular importance when discussing Resolution A/74/401 and the underlying views of cyberspace. Two opposing perspectives lie at the heart of debates surrounding the cyber domain and Internet governance and center around the notion of sovereignty. The first perspective is that "many governments are attempting to exert sovereignty in cyberspace in the same way as they do in physical domains (Nocetti, 2015, p. 111)." For these governments, the dominance of private sector institutions within cyberspace and "the unfettered internet access of their fellow citizens" are causes of concerns (p. 111). This sentiment is particularly true within the Russian government. Under its traditional views of governance, Russia "conceives of cyberspace as a territory with virtual borders corresponding to physical state borders, and wishes to see the remit of international laws extended to the internet space (p. 112)." Furthermore, Russia's domestic fears of an open Internet fuel its international concerns. Russia sees the Internet as "politically disruptive because it enables citizens to circumvent government-controlled 'traditional media (p. 113).'" It aligns this perspective "with the inherently authoritarian nature of the Russian regime (p. 114)." Russia's negative perception of the Internet as it is today ultimately lends itself to Russia's ideal mechanism of perpetuating its belief that "global internet governance is envisioned as an issue of high politics in which states - and the interstate balance of power-play – play an essential role (p. 116, 117)." Under this mechanism, it is little wonder that Russia has led international legal initiatives to refine control over the Internet since the Council of Europe's enactment of its Convention on Cybercrime. In a Ministry of Foreign Affairs press release following the General Assembly's adoption of Resolution A/74/401, Russia proclaimed that the "resolution shows that the world community urgently needs to develop a universal, comprehensive, and open-ended convention Running head: INTERNATIONAL LAW & THE CYBER DOMAIN 8 on countering cybercrime (Ministry of Foreign Affairs, 2019)." The adopted resolution's language appears to align with this projected intent from Russia. The resolution stresses "the need to enhance coordination and cooperation among States in combating the use of information and communications technologies for criminal purposes" and notes "the importance of the international and regional instruments in the fight against cybercrime (United Nations, 2019, Countering the Use)." In order to fulfill these objectives, the resolution establishes an "intergovernmental committee of experts, representative of all regions" that will "elaborate a comprehensive international convention on countering the use of information and communications technologies for criminal purposes (United Nations, 2019)." Remarks of supporting nations support this appearance of cohesion. The representative from Nicaragua indicated the resolution would address cybercrime "in a more representative, democratic and transparent manner, taking into account the individual circumstances of developing and developed countries (Third Committee, 2019, Meetings Coverage)." China echoed this support, stating the resolution "is conducive to filling legal gaps in international cooperation (Third Committee)." At the same time, Belarus declared that "international cooperation is vital in investigating and combating cybercrime (Third Committee)." At face value, the resolution is a gesture of goodwill, a written contract to pursue options to disrupt cybercrime that will benefit all states. However, Russia's press release takes these notions a step further, realigning its message to its traditional view of international politics. It notes, "the resolution proposed by Russia essentially enhances states' digital sovereignty over their information space and ushers in a new page in the history of global efforts to counter cybercrime (Ministry of Foreign Affairs, 2019)." Furthermore, the press release dictates that the "convention must be based on the principles of respecting state sovereignty and non-interference in internal affairs (2019)." There are two Running head: INTERNATIONAL LAW & THE CYBER DOMAIN 9 essential points within this statement that require further analysis. The first is the reassertion of the authoritarian construct with which Russia chooses to view cyberspace. In a press release initially dedicated to lauding the necessity of international cooperation, Russia simultaneously defaults to its traditional views of the international community and advocates for a "digital Westphalia (Nocetti, 2015, p. 117)." In recognizing sovereignty, Russia insinuates that the international community will successfully legislate mechanisms that will reduce cybercrime. A quick review of the supporting states in favor of the resolution upholds Russia's authoritarian views (United Nations, 2019, Countering the Use). In addition to China, Nicaragua, and Belarus, countries like Iran, Syria, Venezuela, Cuba, and the Democratic People's Republic of Korea are only some of the 88 Member States of the General Assembly who voted to adopt the resolution. Unsurprisingly, these states also abide by similar authoritarian perspectives on international law and sovereignty. China, for example, maintains a "comprehensive, multidimensional system that governs Internet infrastructure, commercial and social use as well as legal domains (Liang & Lu, 2010, p. 105)." This system supports "Internet censorship" and "China's single-party political system and its heavy intervention in Internet development (p. 105)." Given the nature and history of these states' political systems and methods of governance, the sudden focus on international cooperation generates questions of the underlying goals that may hide behind the official demands of the resolution. The second point requiring acknowledgment is the additional re-emphasis of sovereignty while also emphasizing non-interventionist beliefs in discussing non-interference in internal affairs. The resolution itself makes no mention of sovereignty or internal affairs beyond assisting countries with improving "national legislation and frameworks and build the capacity of national authorities" to deal with cybercrime (United Nations, 2019, Countering the Use). Despite the lack of language on this topic, the leading state on this initiative, Russia, felt the need Running head: INTERNATIONAL LAW & THE CYBER DOMAIN 10 to emphasize its sovereignty in a press release about the resolution (Ministry of Foreign Affairs, 2019). Once again, Russia gives the impression that there may be a hidden desire layered within the words of the resolution. Additionally, the concept of non-interference within the international system is not without exceptions. The most critical exception being suspicion of human rights violations. As previously stated, humanitarian intervention and protecting citizens from their own government is a staple of international human rights law (Murphy, 2018, p. 389). Therefore, while non-interference in domestic matters is undoubtedly an essential tenet of international law, the resolution cannot call for international cooperation to combat cybercrime and simultaneously ignore the international cooperation required to maintain peace and security (United Nations, 1945, Charter of the United Nations). The next section of this paper will address these obligations to cooperation as it pertains to human rights while also highlighting the opposing arguments against Resolution A/74/401. Opposing Arguments for A/74/401 & Analysis of Human Rights Concerns The first perspective at the heart of the cyber domain debates, as described previously, is modeled after authoritarian beliefs and government control. The second perspective, modeled after a more Western approach to governance, is the belief of a free and open Internet that should remain decentralized and that "the best regulatory system is one that develops organically (Shackelford, 2013, p. 53)." A free Internet is more firmly the belief of the United States. This idea introduces the initial context necessary to understand the United States' opposition to the Russian-led cybercrime resolution. Even before the rapid development of the Internet, American foreign policy internalized the notion of "free flow of information internationally as an important element of national security (McCarthy, 2011, p. 92)." Former Secretary of State George Schultz argued that the free flow of information "undermined the Soviet Union and authoritarianism (p. 92, 93)." At its earliest beginnings, the Internet was a product of American ingenuity and, as a Running head: INTERNATIONAL LAW & THE CYBER DOMAIN 11 result, built with a bias for "American libertarianism (p. 93)." In the present, the West has developed this concept in the "context of freedom expression, protection of intellectual property rights, and national security (Powers & Jablonski, 2015, p. 3)." As former Secretary of State Clinton asserted, the United States and other Western nations support the "freedom to connect" in opposition to efforts by states such as China, Iran, and Russia to create state-level information infrastructures designed for censorship (p. 3). The historical rivalry and disagreement between the two states on information, particularly as it pertains to cyberspace, only further roots the United States' opposition to the new United Nations cybercrime resolution. In its statement to the United Nations during the 49th & 50th meetings of the Third Committee, the United States expressed disappointment "with the decisions of the sponsors of this resolution to bring it to the Third Committee (United States Mission to the United Nations, 2019)." Contrary to the resolution's focus on cooperation, the United States' proclaimed the resolution would "drive a wedge between Member States and undermine international cooperation to combat cybercrime at a time when enhanced coordination is essential (United States Mission to the United Nations)." Furthermore, the United States asserted Russia's actions in introducing the resolution essentially bypass the "expert-driven, consensus-based process and therefore is not in line with their precedent (United States Mission to the United Nations)." Other Western states appear to agree with the United States assertions, as states such as the United Kingdom, Australia, France, Republic of Korea, and Germany composed part of the 58 Member States who opposed the adoption of the resolution (United Nations, 2019, Countering the Use). In a manner similar to the states in favor of the adoption, some opposed states made remarks in agreement with those of the United States during the Third Committee. Finland, on behalf of the European Union, remarked that "there is no consensus on the need for a new international instrument to fight cybercrime" and that the draft "represents a duplication of resources (Third Running head: INTERNATIONAL LAW & THE CYBER DOMAIN 12 Committee, 2019, Meetings Coverage). Canada and Australia presented similar sentiments, remarking that "the Budapest Convention on Cybercrime is an important baseline for international cooperation" and that the new resolution "seeks to undercut consensus and will diminish existing global efforts that are already delivering results (Third Committee, 2019)." There is one remaining argument against the new cybercrime resolution: the potential that the document's vague language will create an environment where human rights will be more easily violated if left unchecked (Hakmeh & Peters, 2020). In a letter to the United Nations General Assembly, 37 organizations and six individuals expressed their concern for human rights protections as they pertain to the cybercrime resolution (Association for Progressive Communications (APC), 2019, Open Letter, p. 4). The first concern is a lack of clarity surrounding the scope of the "use of information and communications technologies for criminal purposes (APC, p. 1)." If left undefined, the language in the resolution arguably "opens the door to criminalising ordinary online behaviour that is protected under international human rights law (APC, p. 1)." If steps to do so were taken as a result of the new resolution, they would be in direct violation of the United Nations High Commission for Human Rights; who stated in 2011 that "human rights are equally valid online as offline (Shackelford, 2019, p. 168)." The second concern offered by non-government entities is the increasing trend in "criminalising ordinary online activities of individuals and organisations through the application of cybercrime laws (APC, 2019, Open Letter, p. 1, 2)." The letter even goes so far as to quote the UN Special Rapporteur over these concerns, that the "surge in legislation and policies aimed at combating cybercrime has also opened the door to punishing and surveilling activists and protestors in many countries around the world (APC, p. 2)." If used in such a manner, these initiatives, in addition to the UN cybercrime resolution, are in direct violation of the Charter of United Nations and the Universal Declaration on Human Rights. Within the Charter of the United Nations, efforts to Running head: INTERNATIONAL LAW & THE CYBER DOMAIN 13 restrict or punish opposition elements such as activists or protestors violates Articles 55 and 56, which requires states to cooperate with the UN in achieving the organizations' purposes such as promoting human rights (United Nations, 1945, Article 55, 56). The Universal Declaration on Human Rights provides more specific language with which to attribute potential violations. The open letter notes that legislation of this kind is used to "criminalise legitimate forms of online expression, association and assembly through vague and ill-defined terms that allow for arbitrary or discretionary application (APC, 2019, Open Letter, p. 2)." Immediately, legislation that allows for criminalization of these elements is in direct violation of Articles 18, 19, and 20, which declare "all persons have a right to freedom of thought, conscience, religion, and assembly (Murphy, 2018, p. 402)." Furthermore, violations such as these also violate article two, which guarantees people "the right to life, liberty, and security" and dictates that "these rights are to be held without discrimination of any kind (Murphy, p. 402, 403)." Upholding these rights within cyberspace continues to fall in line with the Western perspective on the Internet. As McCarthy quotes, "the Internet is arguably the greatest facilitator for freedom of expression and innovation in the world today (McCarthy, 2011, p. 94)." The status of the Universal Declaration on Human Rights as "legitimate norms within the international system" permits this interpretation and application of international law to future resolutions (p. 94). If states are signatories to the declaration, any future adoption of any resolution must adhere to the principles and freedoms guaranteed by it. Resolution A/74/401 does refer to human rights protections, "reaffirming the importance of respect for human rights and fundamental freedoms in the use of information and communication technologies (United Nations, 2019, Countering the Use)." However, the resolution's open language is in direct contradiction to this promise, if not clarified. As the open letter indicates, "simply reaffirming the importance of respect for human rights" is "insufficient to safeguard human rights while Running head: INTERNATIONAL LAW & THE CYBER DOMAIN 14 countering cybercrime (APC, 2019, Open Letter, p. 2)." The final section of this paper recommends additional actions that may further unify opposing entities on this resolution while simultaneously addressing all human rights concerns. Recommendations The Russian-led supporters of the resolution and the United States-led opposition are unified in one common element, at least in writing. The element is that consensus and international cooperation are vital in addressing cybercrime (Ministry of Foreign Affairs, 2019) (United States Mission to the United Nations, 2019). This notion is in concert with the Council of Europe, who remains the only entity to successfully orchestrate an international cybercrime treaty (Council of Europe, 2004, Convention on Cybercrime). In 2001, the Council of Europe postulated that "solutions to the problems posed must be addressed by international law, necessitating the adoption of adequate international legal instruments" that can "ensure the necessary efficiency" required to combat cybercrime (Pocar, 2004, p. 28). If the international community determines that another cybercrime treaty is required within the intergovernmental committee of experts authorized by Resolution A/74/401, then the new treaty should consider the aims of the Council of Europe Convention on Cybercrime (United Nations, 2019, Countering the Use). In doing so, the United Nations should strive to create a "basic framework for the establishment by contracting states of domestic substantive and procedural laws" in a manner that allows states to "cooperate expeditiously with one another (Pocar, 2004, p. 30)." If successful, the United Nations will be able to "establish procedures for relevant international relations" and provide "forms of cooperation between national judicial authorities as many interact with each other both swiftly and efficiently (p. 31)." Furthermore, the necessity of these requirements is supported by the very nature of the "the world-wide dimension of the Internet," Running head: INTERNATIONAL LAW & THE CYBER DOMAIN 15 which "implies that its illegal use and related offenses must prompt responses and concerted efforts from all relevant domestic and international authorities (p. 34)." The non-governmental organizations' open letter to the United Nations supports the need for cooperation but takes it one step further than the states themselves. In its current structure, the Internet is a public-private endeavor, with private entities dominating cyberspace (Nocetti, 2015, p. 111). The present language of the United Nations cybercrime resolution allows for an intergovernmental committee of experts. However, it does not expand on the actual composition of the committee (United Nations, 2019, Countering the Use). Noting that Russia and other authoritarian regimes prefer non-government entities to use the government as a proxy for communication, it can be inferred that a Russia-led resolution intends the committee to be comprised of only government entities (p. 117). The open letter rightly points out that collaboration on cyber issues must expand beyond state cooperation. Addressing cybercrime is "necessarily a multi-stakeholder endeavour" that "requires government officials and experts, members of the technical community, civil society, the private sector, and scientific and research institutions (APC, 2019, Open Letter, p. 4)." An assessment of this viewpoint reveals that a committee dedicated to combatting cybercrime cannot rely on government expertise alone. In order to accurately reflect the composition and requirements of a private-public Internet, all discussions surrounding this resolution should involve both private and public entities. Therefore, the committee should be reformed to more accurately reflect the Internet's users. In doing so, the United Nations breaches the divide between authoritarian and more democratic governments, further increasing cooperation on this resolution. However, increased cooperation through a broader, inclusive committee and implementation of lessons learned from the Council of Europe Convention on Cybercrime will not ensure that the future convention successfully resolves the resolution's weaknesses. In Running head: INTERNATIONAL LAW & THE CYBER DOMAIN 16 modern-day, the international system emphasizes international human rights more than ever before, as "this branch of international law has experienced phenomenal growth over the past one hundred years (Buergenthal, 2006, p. 807)." This growth has contributed to the "growing political impact of human rights on the conduct of international relations and the behavior of governments (p. 807)." If real success is desired within international governance, then the committee established under the "Countering the use of information and communications technologies for criminal purposes" resolution must account for human rights protections when determining the requirements of the "comprehensive international convention (United Nations, 2019, Countering the Use)." As the representative from Costa Rica during the 49th and 50th meetings of the Third Committee, "the international community must protect and observe fundamental freedoms, including the right to privacy (Third Committee, 2019, Meeting Coverage)." Until there is consensus on "sensitive topics such as…State responsibility to prioritize and protect human rights," the future proposed convention will fall short of its goal of achieving complete international ratification (Third Committee). Conclusion As cyberspace expands in conjunction with the rapid advancement of technology, the fear of the unknown drives further division between already opposing states in the international system. Resolution A/74/401 is the latest testament to the evolution of politicization within Internet governance. In addressing a topic that impacts every Internet-accessible region of the world, the resolution simultaneously magnifies the opposing perspectives of states as it pertains to sovereignty within the cyber domain. Furthermore, it reignites the protracted debate over whether or not human rights obligations addressed in such documents as the Charter of the United Nations or Universal Declaration on Human Rights are legally binding. Preventing further polarization requires both an acknowledgment of a fracturing international system of Running head: INTERNATIONAL LAW & THE CYBER DOMAIN 17 governance and a proposed solution to address the issue. While state-centric governance provides legitimacy and the potential for a higher allocation of resources dedicated to protecting the Internet, increased sovereignty also "risks sacrificing innovation, complicates the regulatory environment of cyberspace, and may threaten a positive vision of cyber peace (Shackelford, 2013, p. 50)." These risks are why an alternative method to an intergovernmental committee must develop in response to the resolution. This method should integrate a multi-stakeholder construct to more fully recognize the competing impacts of cybercrime and fairly address the allegations of human rights infringement. One such method is polycentric governance, a system composed of "diverse organizations and governments working at multiple levels" in order to "increase levels of voluntary cooperation or increase compliance with rules established by governmental authorities (p. 330)." Individually, each organization or type of government faces its own unique hurdles. Together, they "contribute to a governance regime that is multi-level, multi-purpose, multi-type, and multi-sectoral in scope that could complement the top-down governance model increasingly favored" by states such as Russia or China (p. 331). Implementing polycentric governance to more equitably debate the appropriate response to international cybercrime will create an international community willing to consider the developing convention. In doing so, the environment will be better suited to determining whether or not the international system can leverage international law to investigate and prosecute cybercrime. And he finally became superintendent of the manufacturing company but had to leave because he was getting 2 wood sawdust in the lung and the doctor told him either he had to leave or he would die within a year, which he did leave. IRENE BEAUDOIN: Well he had to take a year's absence [unintelligible - 0:01:46] and went back to his home in New Brunswick and stayed there for six months until he felt better and came back here. And then he started a grocery business, and then from that, he went into the insurance company. SPEAKER 1: Where was his grocery business? IRENE BEAUDOIN: On 6th Street going down the hill. SPEAKER 1: On 6th Street? IRENE BEAUDOIN: Mechanic. BILL BEAUDOIN: [Unintelligible - 0:02:13]. IRENE BEAUDOIN: Yeah, [unintelligible - 0:02:16]. SPEAKER 1: Oh is that right? IRENE BEAUDOIN: Mm-hmm. SPEAKER 1: Yeah. Oh, they had a store there. How long was he in business there? IRENE BEAUDOIN: That I don't know. I couldn't tell you how long he was in the grocery. I really have no idea. He was in a few years, but how long, I don't know. SPEAKER 1: Right. About when was that, what year approximately? IRENE BEAUDOIN: Perhaps '96,'97. SPEAKER 1: I see. So, your father was a very [unintelligible - 0:02:50] businessman in the French community. IRENE BEAUDOIN: Mm-hmm. You see for a while he worked for a Mr. [Wingman] who owned a grocery store, and from there, this is how he got started in the grocery business. SPEAKER 1: So, did he cater mostly to the Franco-Americans? IRENE BEAUDOIN: Oh yes. He – I remember him telling me. So, he used to deliver, you know, the [unintelligible - 0:03:17] and he used to do this at 3 night many times and he used to carry these heavy bags of flour and sugar. SPEAKER 1: The location is right on the edge of what's called French Hill and then when you get down below there are many Italians. IRENE BEAUDOIN: Yes. SPEAKER 1: Do you know if… IRENE BEAUDOIN: There were Italians at the time, yes. SPEAKER 1: There were Italians there at the time. IRENE BEAUDOIN: Yes. SPEAKER 1: And do you know if they bought from the store also? IRENE BEAUDOIN: Oh, yes. There were, you know, neighbors around that area that would come to the store to buy that were Italian. SPEAKER 1: In that case, did he have a language difficulty or did he have enough knowledge of English to carry him through or…? IRENE BEAUDOIN: I think my mother helped him a lot in that area because I do believe he spoke French. I don't believe he knew too much English at the time but… SPEAKER 1: Well, you mentioned that your mother spoke English then. IRENE BEAUDOIN: That's right. SPEAKER 1: Where did she learn the English? IRENE BEAUDOIN: Well, she had to go to public school. There were no parochial schools where she came from. SPEAKER 1: Was your mother born in the United States? IRENE BEAUDOIN: Yeah, she was born in West Boylston. SPEAKER 1: She was born in West Boylston, and what was her name? IRENE BEAUDOIN: Gonville. SPEAKER 1: Gonville. IRENE BEAUDOIN: Yeah. SPEAKER 1: Was that related to the Gonvilles that lived on 7th Street when they were here? IRENE BEAUDOIN: Sure.4 SPEAKER 1: Oh, it was. IRENE BEAUDOIN: The father was my mother's brother. SPEAKER 2: [Unintelligible - 0:04:55]. IRENE BEAUDOIN: Of course. They lived right near you. SPEAKER 1: Yes, now I remember. I remember my folks mentioning it, yeah. Well, you mentioned they were born here? IRENE BEAUDOIN: Now who are you talking about, my mother? SPEAKER 1: Your mother, I'm sorry, your mother. IRENE BEAUDOIN: In West Boylston. SPEAKER 1: In West Boylston, I see. So, what brought her here? IRENE BEAUDOIN: Because they took the town over to make a reservoir and that's the reason why she came up here. SPEAKER 1: I see. Well, have your grandparents on your mother's side lived in the United States for a while? Did they come from Canada? IRENE BEAUDOIN: Oh, they've been here for a long time, yes. SPEAKER 1: They had been here for a while? IRENE BEAUDOIN: Yeah. SPEAKER 1: I see. You don't recall anyone mentioning when… IRENE BEAUDOIN: No, no. Evidently they've been here for a long time because my grandfather owned the grocery store and the fish market in West Boylston. SPEAKER 1: In the area as a reservoir? IRENE BEAUDOIN: Yes, yeah. SPEAKER 1: I see. IRENE BEAUDOIN: In fact, it was their home, and the store evidently was very close to the church that still remains there but just collapsed. SPEAKER 1: Oh, is that right? IRENE BEAUDOIN: Yeah. SPEAKER 1: Oh, I see. So, your mother went to the public schools of West Boylston, picked up her English, and somewhere she met your father. Was that Leominster or in West Boylston?5 IRENE BEAUDOIN: Well, when she came out here to look for work after the –you know, preparing to make the reservoir. SPEAKER 1: Oh I see. She came here to look for work. And where did she go for work? IRENE BEAUDOIN: Clewett's. SPEAKER 1: At Clewett. IRENE BEAUDOIN: And then she did work in a dry goods store downtown. SPEAKER 1: Do you recall the dry goods store? IRENE BEAUDOIN: No, but it would be in the vicinity of the Metropolitan Theater, in that area. SPEAKER 1: Do you ever recall your mother talking about wages and working conditions at Clewett's at the time? IRENE BEAUDOIN: Yeah, I remember them saying how, you know, the wages were like perhaps $7 a week is what they earned. SPEAKER 1: Did they consider that good or was she satisfied or…? IRENE BEAUDOIN: Well, evidently that was about what everyone earned in shops at that time. SPEAKER 1: Do you remember if your mother ever mentioned the people that worked at Clewett's, whether or not they were Franco-Americans largely or a great number of them or…? IRENE BEAUDOIN: Well, there were several French people working there, but I think the majority were American and Irish, I think, more than French. SPEAKER 1: I see. And that would be approximately what year or what time? IRENE BEAUDOIN: Probably around, you know, 18… SPEAKER 1: '96? IRENE BEAUDOIN: '96, '97, '98, around. SPEAKER 1: Right around there. IRENE BEAUDOIN: Yeah, around that, yeah. SPEAKER 1: All right. So then your parents met in Leominster. IRENE BEAUDOIN: Mm-hmm, and were married here in Leominster.6 SPEAKER 1: And were married here in Leominster. Where were they married? IRENE BEAUDOIN: At Saint Cecilia's. SPEAKER 1: At Saint Cecilia's. So by the time they met, the Saint Cecilia's had been established as a parish? IRENE BEAUDOIN: That's right. It was a very small church but it was already established, but they helped the parish grow. I believe they were married by Father Balthasard. SPEAKER 1: -Which was the first pastor. IRENE BEAUDOIN: Mm-hmm. Yeah, they were married by Farther Balthasard. SPEAKER 1: Your parents were married, your mother worked at Clewett's, and your father had his grocery store. Now, you say he remained in business three or four years, what did you say? IRENE BEAUDOIN: Well, possibly longer because he started in the insurance business in 1919. SPEAKER 1: Oh I see, so from just prior to 1900 until 1919, he was in the grocery business. IRENE BEAUDOIN: Right. SPEAKER 1: Where did he start his insurance business and how? IRENE BEAUDOIN: He started from this own home. SPEAKER 1: Up on 6th Street? IRENE BEAUDOIN: No, on Mechanic Street. SPEAKER 1: On Mechanic at this point. IRENE BEAUDOIN: Mm-hmm, and from there he had his office across the street from the church. I believe there's a hairdressing parlor there. [Unintelligible - 0:09:50] was on one side and my father's office was on the opposite side. I don't know who's in there now, but then he moved from there to the present location, which is at the corner of Walker and Mechanic. SPEAKER 1: I see. What kind of businesses? You mentioned insurance business. What did he do, sell insurance or…?7 IRENE BEAUDOIN: Yeah. He started with life insurance and then into all types of insurance: general insurance, car, fire insurance and automobile insurance. SPEAKER 1: So, he became an agent for various insurances. IRENE BEAUDOIN: Right. SPEAKER 1: How long was he in that insurance business? IRENE BEAUDOIN: Well, when he left, it was 50 years. He retired two years after they saw the 50th anniversary. SPEAKER 1: He left the business. IRENE BEAUDOIN: Yeah. SPEAKER 1: He sold that business. IRENE BEAUDOIN: He sold it, right. SPEAKER 1: When he first started, did he make it a habit or did he try to cater specifically to Franco-Americans or did he…? IRENE BEAUDOIN: Yes, he did. SPEAKER 1: He did. IRENE BEAUDOIN: He did but he had all types, all nationalities that came to the office for insurance. He was liked, very well-liked by all, yeah, and he helped a lot of people. Grandma said that he did help a lot of people, but no one else knew about it. SPEAKER 1: Yeah. Was he associated in any way with a Mr. Gordon who was also in the insurance business? IRENE BEAUDOIN: No. He was always alone in business. No one that I – I know he worked in the insurance [unintelligible - 0:11:52]. SPEAKER 1: So, he was a very early parishioner at Saint Cecilia's, one of the founders of the parish. I presume that he became an active member of the parish? IRENE BEAUDOIN: They both were very active, raising funds to someday build the church that we now have. SPEAKER 1: Were they involved in preparing for the original school? IRENE BEAUDOIN: Oh, yes, they worked very hard for that.8 SPEAKER 1: Did you go to that school? IRENE BEAUDOIN: Yes, I sure did. I graduated from there. BILL BEAUDOIN: We were going to school there when the fire… IRENE BEAUDOIN: The fire broke out. BILL BEAUDOIN: When the school burned down and we went to class in various houses around. IRENE BEAUDOIN: I went in [Lamont's]. BILL BEAUDOIN: I went to [Holme's] house which was where the school yard is now. SPEAKER 1: Oh yeah. IRENE BEAUDOIN: Yeah. BILL BEAUDOIN: There was an old house there. That's where I went to school. IRENE BEAUDOIN: Yeah, and I went in Lamont's Hall which is… SPEAKER 1: It's across the street. IRENE BEAUDOIN: Yeah. BILL BEAUDOIN: It was in the old town square. That's where I went to school. She went to… IRENE BEAUDOIN: Yeah, something's now. SPEAKER 1: There was approximately a thousand students in the school at the time. Where did they all go? IRENE BEAUDOIN: In homes. BILL BEAUDOIN: All over third… IRENE BEAUDOIN: Third and fourth. Different people offered their homes and converted a room or two into classrooms. And then there were several classes in Lamont's Hall. They divided that up into, you know, several classes. I don't remember how many. BILL BEAUDOIN: Then we got the old church, the old church, the old white church which is where the [back lot], where the present school is – or the present church. SPEAKER 1: When they built the school, the first brick school, did they have the church in there?9 IRENE BEAUDOIN: No. They still had the… SPEAKER 1: They still had the white… IRENE BEAUDOIN: White church across the street. And they had a school house there, next to the church. BILL BEAUDOIN: They had the eighth and ninth grades there. IRENE BEAUDOIN: Right, right. SPEAKER 1: Yes, I think I remember the same pictures – IRENE BEAUDOIN: I remember it, but we didn't go to school there ourselves; in fact, my cousin, Sister [Elinya] who was a convent girl taught there. And I remember, you know, having to go there with my mother to visit her, but I never attended school in that building. SPEAKER 1: Where is your cousin now, the nun? IRENE BEAUDOIN: Oh, she passed away quite a few years ago. SPEAKER 1: Quite a few years ago. IRENE BEAUDOIN: Yeah. SPEAKER 1: All right. Now, the first time I asked this question, I've heard stories told about the fire at the school. Does anyone know to this day what actually happened, how the fire got started? IRENE BEAUDOIN: No, I've always heard it had been set, but whether that was so or not, I don't know. SPEAKER 1: Wasn't there rumors that the Ku Klux Klan was involved or…? IRENE BEAUDOIN: Yeah. SPEAKER 1: I heard that, I don't know. BILL BEAUDOIN: The Ku Klux Klan was very active in those days, because I remember, you know, we would see from where I lived, we always see the crosses burning on Prospect Hill. SPEAKER 1: And where was that where you lived? BILL BEAUDOIN: On 6th Street, right where the fire was. We could see right across Whitney Field and up into Prospect Hill, and one of the police officers saw it. He was an officer in the police department, Mr. [Karl] lived next door to us. We would always see him go into 10 the room, and if the crosses were burning they would be out chasing these guys around. I'll never forget that. IRENE BEAUDOIN: Well, it must have been around town, you know, around the hill, because I remember my folks talking. I wasn't supposed to be hearing this, I guess, but I would overhear different things. And I'm sure they used to go up Mechanic Street. BILL BEAUDOIN: They attacked his home one time on Sixth Street, Mr. Karl. They tried to burn that. IRENE BEAUDOIN: Of course, I remember them talking about the white sheets that they put over their clothing and, you know, crosses. SPEAKER 1: So they actually did this in Leominster? BILL BEAUDOIN: Oh, yes, we testified – IRENE BEAUDOIN: I was petrified of them that whenever they spoke of them, I was very petrified. SPEAKER 1: But it was never – the fire was never actually shown to… IRENE BEAUDOIN: No, it was never proven that it was set by anyone. That was a rumor, I suppose. SPEAKER 1: I always heard another rumor that one of the local parishioners had done it, someone's family had trouble with. I don't remember. IRENE BEAUDOIN: I never heard that one. SPEAKER 1: I heard that one a few times. BILL BEAUDOIN: I don't remember how it happened. I just remember very vividly the day it happened and [unintelligible - 0:16:58] was running over, wanting to see the fire. SPEAKER 1: Oh, it was a terrible night. It was all ice. And, of course, living not too far away from the convent, we really could see it well because my father went, but my mother and I naturally didn't go because it was such a bad night out. But, it really hit, you know, the parishioners because they really had worked to have the 11 school and then to have somebody let that happen, it meant starting all over again. SPEAKER 1: Who was the pastor at the time? IRENE BEAUDOIN: Oh Father [Shiquin]. SPEAKER 1: Father Shiquin. IRENE BEAUDOIN: Yes. SPEAKER 1: How many years was Father Shiquin in Leominster? Was it forty? SPEAKER 1: I don't know. I know he celebrated his 50th anniversary as a priest here but… IRENE BEAUDOIN: Well, he came from Worcester here, which would have been – what, Bill? BILL BEAUDOIN: Oh, when Father came here, he'd been … IRENE BEAUDOIN: It was 1919? BILL BEAUDOIN: Yeah. He's been here, I think, five or six years then. SPEAKER 1: And so then the parishioners had to begin all over again? IRENE BEAUDOIN: Mm-hmm. They used to have fairs and minstrels. SPEAKER 1: Minstrels? IRENE BEAUDOIN: They had one or two a year. And then recitals from the different students that took piano. In the music department, they used to have recitals and I guess they sold tickets for that because we used to hold it at the Realtor. I know I used to perform as a piano student, and then, of course, the minstrels was a variety affair. I remember as a little kid, I perhaps was seven or eight years old, dancing on the stage for different little skits they had. SPEAKER 1: Do you recall if the parish received any outside help to rebuild the school or…? IRENE BEAUDOIN: Well, I don't know about that, but I'm – perhaps from the Diocese of Worcester or… BILL BEAUDOIN: No. The only thing I ever heard about it as I recall is a gift from Mr. [Doyle].12 IRENE BEAUDOIN: Because we were in the Boston diocese at the time, weren't we? BILL BEAUDOIN: Springfield. IRENE BEAUDOIN: Springfield, that's right. Whether they got help from the bishop at the time, I don't know. SPEAKER 1: All right. So, you, Irene, graduated from Saint Cecilia's, and from there, where did you go? IRENE BEAUDOIN: Leominster High. SPEAKER 1: You went to Leominster High. And did you graduate from Leominster High also? IRENE BEAUDOIN: Yeah. SPEAKER 1: What did you do after graduation? IRENE BEAUDOIN: I went to Becker College and then I went into hairdressing. SPEAKER 1: You went to Becker's and then you went to hairdressing. What did you take up in Becker's, what course? IRENE BEAUDOIN: Business course. SPEAKER 1: Business – one or two years? IRENE BEAUDOIN: One year. SPEAKER 1: One year, and then off to hairdressing. That's a switch, isn't it? IRENE BEAUDOIN: Mm-hmm. BILL BEAUDOIN: She went to hairdressing school in Worcester. IRENE BEAUDOIN: I went to hairdressing school in Worcester also, yeah. SPEAKER 1: Was that at girls' trade? IRENE BEAUDOIN: No, no, no. It was beauty school. SPEAKER 1: And did you go into business for yourself or did you work for someone? IRENE BEAUDOIN: No. I worked as a beautician in two different beauty shops, and then I got married and that was the end of my working days. SPEAKER 1: [Laughs] These beauty shops were they located on French Hill or were they in town? IRENE BEAUDOIN: I worked for Olivia who was on Washington Street. SPEAKER 1: On Washington.13 IRENE BEAUDOIN: She has passed away, and I also worked in Fitchburg and she has passed away also. SPEAKER 1: So that… IRENE BEAUDOIN: Oh, I worked at [Selligs] also. I must say that. I worked at [Selligs] as a biller. SPEAKER 1: Is this right after Becker's then? IRENE BEAUDOIN: No, after hairdressing. I went back to the business world. SPEAKER 1: [Laughs] So Sellig's must have been new at the time. IRENE BEAUDOIN: They had just come in. BILL BEAUDOIN: Her father was instrumental at bringing Sellig's] here. In fact, he did bring Sellig's here. IRENE BEAUDOIN: That's right. SPEAKER 1: Oh, is that right? BILL BEAUDOIN: Her father had that building. SPEAKER 1: Which building is that, the one on Green Street? IRENE BEAUDOIN: On Green Street, right. SPEAKER 1: And when you say your father had that… BILL BEAUDOIN: Well, he was a realtor. SPEAKER 1: Oh. As time went by with his insurance business, he had realty as part of the business. IRENE BEAUDOIN: Oh, he had realty, right. He went into realty and… SPEAKER 1: And he had the place on Green Street. Do you recall how he managed to get Sellig's in here, where they came from or…? IRENE BEAUDOIN: There's a lot of concessions [unintelligible - 0:22:38]. SPEAKER 1: Well, it was through – he was also, you see, director of the bank. SPEAKER 1: Which bank was that? IRENE BEAUDOIN: Well, it's Monument Federal now. It was Leominster Home Federal at the time. SPEAKER 1: Oh, I see. BILL BEAUDOIN: Leominster Home loan. IRENE BEAUDOIN: Home loan.14 SPEAKER 1: Home Loan, which is now Monument, I see, and he was a…? IRENE BEAUDOIN: Director. He was a director since, I believe, 1919 or 1920. Right after he got into the insurance business, I think he became a director. He was for many, many years. SPEAKER 1: I see. And it's through that, his position as director and in the real estate business that he was able to bring Sellig's into Leominster. IRENE BEAUDOIN: That's right, that's right. SPEAKER 1: Where were they from? IRENE BEAUDOIN: Gardner. SPEAKER 1: Oh they were in Gardner. IRENE BEAUDOIN: Yeah. SPEAKER 1: That was their home base then? IRENE BEAUDOIN: That's right. And he formed a committee with different businessmen in Leominster, and Mr. Buckley was one of the other gentlemen that [unintelligible - 0:23:55]. SPEAKER 1: Which Mr. Buckley? IRENE BEAUDOIN: Cornelius. SPEAKER 1: Cornelius? IRENE BEAUDOIN: Yeah. SPEAKER 1: The father of the present Cornelius Buckley? IRENE BEAUDOIN: Right, right. SPEAKER 1: I see. IRENE BEAUDOIN: And the two of them, I remember, worked very hard to get this like concern into Leominster. SPEAKER 1: Now who owned the building at the time, do you recall? IRENE BEAUDOIN: Well, I don't know… BILL BEAUDOIN: There was a trust [unintelligible - 0:24:21] formed and it was purchased by the group. IRENE BEAUDOIN: Yeah, right. BILL BEAUDOIN: Anybody could be a shareholder if they wanted to.15 SPEAKER 1: This was in what years, in what year did this occur, the Depression years? IRENE BEAUDOIN: No, no. It was 1937. I would say '38, '37, '38. SPEAKER 1: So, we're still a little in the Depression. IRENE BEAUDOIN: Yeah, just about at the end of it, yeah. SPEAKER 1: This was a rather brave attempt then… IRENE BEAUDOIN: And it helped; it did help, yeah. SPEAKER 1: I gather then they must have had to deal with the city officials at the time? IRENE BEAUDOIN: Oh, yes. That's right. SPEAKER 1: The city officials were receptive of bringing them in, I take it? BILL BEAUDOIN: Yes. IRENE BEAUDOIN: It was – Pete Lapierre, I think, was mayor at the time, wasn't he? I think he was. SPEAKER 1: Mayor Lapierre. How did the Depression affect your father's business, or did it affect it at all? IRENE BEAUDOIN: Oh, it did affect it, as far as people being able to pay for the insurance. It was quite head-on at the time, but he managed to hold on to all his customers by paying a lot of premiums himself. And he also was appointed to appraise property at that time, which was a big help. SPEAKER 1: Did he ever hold any position in city government? IRENE BEAUDOIN: Yeah. During World War II, he was appointed to be on the Selective Board and was chairman… SPEAKER 1: Selective Service Board? IRENE BEAUDOIN: Service Board, yeah. He was chairman of that board for a number of years. SPEAKER 1: Do you recall any other people that were on the board at the time? IRENE BEAUDOIN: Yes. Mr. Harris was one of them. BILL BEAUDOIN: Paul Holman.16 IRENE BEAUDOIN: Paul Holman. BILL BEAUDOIN: Are we talking about the carriage company that Paul Holman owned – was one of the owners of… IRENE BEAUDOIN: Of the Whitney Carriage. BILL BEAUDOIN: Mr. [Hart]. IRENE BEAUDOIN: Oh Mr. Hart, right. BILL BEAUDOIN: Who was the president of [unintelligible - 0:27:04]. Those were the Selective Service Board. IRENE BEAUDOIN: Now another thing, I don't know if I mentioned this, though, where my father was on the board of directors for a bank. SPEAKER 1: Yes, you did. IRENE BEAUDOIN: I mentioned this before, didn't I? He did a lot of appraisals for the bank also on property. SPEAKER 1: Apparently your father was the only Franco-American on the Selective Service Board for quite some time. IRENE BEAUDOIN: That's right, that's right. Then later on in years, of course, Mr. [Golden] was on the board also. SPEAKER 1: Henry Golden later on joined the… IRENE BEAUDOIN: Yes, Henry Golden was on. SPEAKER 1: Did your father ever work for the state of Massachusetts? IRENE BEAUDOIN: Well, just – no, I don't really think he ever had been. No, no, he didn't. SPEAKER 1: When he was an appraiser, was he an appraiser for the banks or was he an appraiser for the city of… IRENE BEAUDOIN: No, that was for the state. That was for the state. SPEAKER 1: For the state, I see. IRENE BEAUDOIN: He was appointed by the governor. SPEAKER 1: He was appointed. Who was the governor then? IRENE BEAUDOIN: Dever, Governor Dever. SPEAKER 1: I see. Now, as far as the city is concerned, besides the Selective Service, did he ever serve on any other, any commissions? Or 17 did he ever run for – was he ever elected to office or anything of that kind? IRENE BEAUDOIN: No, no. SPEAKER 1: Was he interested in politics or…? IRENE BEAUDOIN: Oh, he enjoyed politics but he never really cared to run for an office. SPEAKER 1: Did he ever work to help Franco-Americans become citizens? Was he ever involved in that? IRENE BEAUDOIN: He certainly was. In fact, he sponsored many people that came from Canada here. SPEAKER 1: In that sense, did he belong to – was it Club [Nordier]? It seems to me that they were active, politically active in the city. BILL BEAUDOIN: [Unintelligible - 0:29:33]. SPEAKER 1: He belonged to [unintelligible - 0:29:36]? IRENE BEAUDOIN: Oh, yeah, he belonged to that. SPEAKER 1: And was he ever a member of the Saint-Jean-Baptiste? IRENE BEAUDOIN: Oh, yeah, yes. SPEAKER 1: Any other organizations that you remember that he might have been in? BILL BEAUDOIN: [Unintelligible - 0:29:47]. IRENE BEAUDOIN: Yeah, [Jasons], the Elks. BILL BEAUDOIN: [Unintelligible - 0:29:53]. SPEAKER 1: In that case, Irene, your father must have become acquainted with Bill's father? IRENE BEAUDOIN: Oh, he knew Bill's dad and mother for – well ever since his father and mother came here from Worcester. SPEAKER 1: Was that through your… IRENE BEAUDOIN: They were friends for many, many years. SPEAKER 1: I see. Do you think that – how many children did you and Bill have? IRENE BEAUDOIN: We have three boys.18 SPEAKER 1: You have three boys. And were they all educated locally or…? IRENE BEAUDOIN: Well, they all went to high school here. BILL BEAUDOIN: Saint Cecilia's. IRENE BEAUDOIN: They went to Saint Cecilia's first naturally, and then two of them went to Notre Dame and one went to Leominster High. SPEAKER 1: And what are they doing now? IRENE BEAUDOIN: Well, the oldest boy is in Connecticut and he's a doctor. The second boy is in Connecticut and is working with addicts. He… SPEAKER 1: Drug addicts? IRENE BEAUDOIN: He took up psychology. BILL BEAUDOIN: He's an assistant to a psychologist there, a doctor. IRENE BEAUDOIN: And works with drug addicts. SPEAKER 1: Is he working out of the university or…? IRENE BEAUDOIN: No, right in a hospital. SPEAKER 1: In a hospital, I see. IRENE BEAUDOIN: And the youngest is in business with his father. SPEAKER 1: Oh I see. That's the solder business? IRENE BEAUDOIN: Right. SPEAKER 1: You said, when I asked you where they went to school, you said Saint Cecilia's naturally. Why did you say 'naturally'? IRENE BEAUDOIN: Because that's the school we went to as youngsters and it seems to be the school that you sent your children to. SPEAKER 1: So, they teach as much French when your children went through as when you went through. IRENE BEAUDOIN: No, no. SPEAKER 1: How much French did they teach when your children went through? IRENE BEAUDOIN: I believe they only had like 15 minutes or a half hour and, it's all they have; very, very little French. SPEAKER 1: And those were lessons in the language then?19 IRENE BEAUDOIN: That's right, that's right. And you could – they could choose catechism, either having a French catechism or an English catechism. SPEAKER 1: I see. And what year did they go through? IRENE BEAUDOIN: Let's see. It would be 1954. BILL BEAUDOIN: What – at Saint Cecilia's? IRENE BEAUDOIN: He went in '54. BILL BEAUDOIN: I don't remember the date that well. SPEAKER 1: They were in school at Saint Cecilia's in the 50s then, the three of them. IRENE BEAUDOIN: Yes. SPEAKER 1: So that by the 1950s… IRENE BEAUDOIN: Not the three of them. SPEAKER 1: So, that by the mid-50s and into the 60s, the French had just about disappeared from the school except for… IRENE BEAUDOIN: I would say so, yes. SPEAKER 1: Except for that 20 minutes a day of lessons in language. IRENE BEAUDOIN: Exactly. SPEAKER 1: Quite a change from the time that you were there. IRENE BEAUDOIN: We were there, right, because our afternoon was complete French from catechism to Bible to your French language and so on, which took all your afternoon in French. SPEAKER 1: So, coming back to your father now, it seemed to me from having asked you a number of questions that from relatively early in his insurance and real estate business, he was run outside of the French community quite early. Would that be correct? IRENE BEAUDOIN: Mm-hmm. SPEAKER 1: In other words, he did a lot of business with many other people in the community, other than French Canadians from almost the beginning?20 IRENE BEAUDOIN: That's right, that's right, but the majority of his business was done with the French Canadian but he had many other people, you know, different nationalities: Italian, American, Irish… SPEAKER 1: Yeah. What kind of an education did your father receive? He went to… IRENE BEAUDOIN: He had no education whatsoever. He was a self-made man really. SPEAKER 1: He didn't get through the eighth grade or anything like that? IRENE BEAUDOIN: No, no. He had to go work on the farm. I… SPEAKER 1: While in Canada, he worked on the farm? IRENE BEAUDOIN: While in Canada, they lived on a farm and he worked on the farm, and if I remember correctly now… BILL BEAUDOIN: He worked in a coal mine. IRENE BEAUDOIN: Yeah, he worked in a coal mine also. SPEAKER 1: In New Brunswick? IRENE BEAUDOIN: New Brunswick. Springhill, was it? BILL BEAUDOIN: Springhill, the one they had all the very serious collapses there [unintelligible - 0:35:13]. SPEAKER 1: Yeah, yeah, Springhill mine, in New Brunswick. BILL BEAUDOIN: Yeah. And this happened – oh, God, I remember there was that shack and, you know, he can remember the track to the shack. He remembered that shack because he worked there. SPEAKER 1: And he came to the United States at 16; then he was rather young when he was working in the mine. IRENE BEAUDOIN: That's right, because in those days you went to work at any age. BILL BEAUDOIN: If you could do any kind of work in the pit. IRENE BEAUDOIN: If you could carry a shovel and a pick. But I think he went as far as the fourth grade and I don't believe he went any further than that. BILL BEAUDOIN: And that was in New Brunswick.21 IRENE BEAUDOIN: In New Brunswick. And, of course, they lived so many miles away from a school or a church. It was very… SPEAKER 1: Then when he came to the United States, his intention was to go to Rhode Island, was that it? IRENE BEAUDOIN: Yeah. SPEAKER 1: And this was for work. IRENE BEAUDOIN: That's right. SPEAKER 1: Where did they plan on working when he went to Rhode Island and do you recall…? IRENE BEAUDOIN: They had nothing in mind. They were just looking for work. SPEAKER 1: Do you recall where they went in Rhode Island? Was it Woonsocket or…? IRENE BEAUDOIN: Woonsocket. SPEAKER 1: It was Woonsocket. IRENE BEAUDOIN: Yeah, Woonsocket, Rhode Island. SPEAKER 1: And he came back here to Leominster. IRENE BEAUDOIN: That's right. SPEAKER 1: Why did he stop in Leominster? This puzzles me. IRENE BEAUDOIN: Well, evidently they had to change trains or something. I don't know just what it was, but he was downtown. I remember him saying he was down town, waiting for another train, and all he had was 50 cents in his pockets. SPEAKER 1: Did he meet relatives when he went to Rhode Island? IRENE BEAUDOIN: He had no relatives out here whatsoever. He came on Canada with another friend of his, and they were both 16. SPEAKER 1: And both of them had intentions of going to work in Rhode Island? IRENE BEAUDOIN: Yeah. SPEAKER 1: Did his friend stay in Rhode Island? IRENE BEAUDOIN: Yeah. The friend stayed in Rhode Island; he came back here alone.22 SPEAKER 1: And now your great grandparents on your – well, your grandparents on your father's side remained in Canada? IRENE BEAUDOIN: His mother came. His father died, then he went back to get his mother and his sister and they lived in Fitchburg in Cleghorn. He found them an apartment in Cleghorn. Why Cleghorn, I don't know now. I couldn't tell you why they lived there. Why not Leominster, I don't know. SPEAKER 1: There were many French Canadians in Cleghorn probably. IRENE BEAUDOIN: And my grandmother died in Cleghorn, and my aunt died in Worcester, and his sister, his only sister who was in a home there in Worcester… I'm trying to think of the name of that place. SPEAKER 1: You mentioned that your father delivered groceries by horse and buggy. When did he eventually get a car? IRENE BEAUDOIN: I believe it was around – in the 20s, early 20s. It was a turn car; he called it a turn car, which he just loved. And I can remember so many times, well, I guess, I was five or six years old when there was a rainstorm or thunderstorm that came up in the summertime, how he would stop the car and put up the side pieces and then the windshield wipers were on the inside. They had to this by hand. SPEAKER 1: They had to work the manual windshield. IRENE BEAUDOIN: Yeah, or the windshield wipers were on the outside but I guess you had to work it from the inside. SPEAKER 1: Exactly, a little handle. IRENE BEAUDOIN: That's right, yeah. SPEAKER 1: And so he got his first car after he went into the insurance business? IRENE BEAUDOIN: Well, I'm sure it must have been at that time, yes. SPEAKER 1: And how long did he drive? IRENE BEAUDOIN: He was almost 91 when he retired from driving. We mentioned several times, you know, "How I wish – why don't you give 23 up?" I didn't ask him to give up. I would say, "If you want to give up, I can take you wherever you want to go." And he'd just reply, "What's the matter with you? I can drive as well as you can." So, that was that. SPEAKER 1: Though your father was not active in politics, holding office or anything like that, was he involved in politics in any other way or no? IRENE BEAUDOIN: No. SPEAKER 1: I found that many of the Franco-Americans voted or tended to vote Republican until about the 1930s. Was your father a Republican or was he a Democrat? IRENE BEAUDOIN: He was a Republican and changed when Bill's father ran. BILL BEAUDOIN: And always went back to Republican. IRENE BEAUDOIN: Went back to Republican but to give his father that vote, he had to change – BILL BEAUDOIN: Her father did run for the city council once. IRENE BEAUDOIN: Yeah, that's right. BILL BEAUDOIN: But he was defeated and only because he was a Republican, no other reason. SPEAKER 1: Oh your father did run for…? IRENE BEAUDOIN: He did run. That's correct. These words relate to the building of the tabernacle in the wilderness. It was to sub-serve such great purposes in the camp of the chosen people that God himself had revealed the pattern of it to Moses on Mount Sinai, in-dicating and fixing both its general plan and its minutest details, and saying to him : "See that thou make all things according- to the pattern showed to thee.'' Moses was, first, to grasp clearly the plan, the ideal. He was to go to his work, not aimlessly, but knowing what he was to do and how he was to do it. Definiteness of plan, distinctness of ideal, and fidelity to it were to him the esseutialconditions of success. The lessons thus taught are easily discerned. They are applicable now and here. You, my young friends, are about to go down from a veritable mount of privilege and preparatory training to engagements and a mission that have been fixed for you in the divine plan. Your intended work is to be constructive. You are to be builders in a very high and real sense—builders of character, organizers and constructors of a lifework as solemn in its im-port as destiny and as enduring as the endless cycles of eternity. Nor are you left to guess what you are to do and how you are to do it. God, who has built the universe and formed its myriad and minutest parts together in a comprehensive and harmonious plan, whose purpose shines in every star, blooms in every flower, is enfolded in every seed and finds ex-pression in every voice of nature, has his plan, also, for your life and work. He has embod-ied it for your guidance in the precepts and principles of His word. He has revealed it 67 THE COLLEGE MERCURY. most clearly and impressively in the spotless example of His Son. He has brought you up to that other mount of latest and sweetest reve-lation, the mount of the cross, that you might with open-face behold and with grateful hearts love the heavenly pattern of living and work-ing. Fidelity to this divine ideal is central and all inclusive in your preparation for life. To ignore it is the madness of turning from light to darkness. To practically neglect it will be to repeat the fatal mistake of the foolish builder who "built his house upon the sand," and whose plans and efforts and hopes came to naught in the ruin wrought by the tempest's and torrent's fury. Speaking to you, therefore, in the name of your instructors and delivering to you the final and affectionate charge of the institution, whose training you have received, permit me to set before you the pattern of a true life, to urge you to embody it in the ideal, and plans you form for your work, and to re-peat to you the solemn injunction : "See that you make all things according to it.'' He then presented and discussed the ideal of a true life as ist. The subordination of the material to the spiritual. 2nd. The embodiment of beneficence. 3rd. Having as its radiant centre—its Holy of Holies, God, his will, grace and glory. After discussing these points he addressed the class as follows : "My young friends of the class of'96: In sending you forth now, the Institution is concerned, not only for what you will do, but also for the spirit in which you will do it. It would have you adopt as the stand-ard by which you will measure your achieve-ments a high and worthy ideal and aim. What you will do, the spheres you will fill, will be determined largely by your endowments and opportunities, by circumstances not always within your control. You may not be per-mitted to choose what you will do, but you can determine the spirit in which you will do it. This, more than anything else, will settle the question of your worthiness and real suc-cess. Ideals and aims, whether right or wrong, true or false, lofty or low, though but neutral facts, mere abstractions, become a vitalized force to those who make them their own—a power to be measured only by the comprehen-siveness and reach of the principles involved. Whether in the form of proverbs, mottoes or doctrine, they have masterful force. Men bow before them as the ripened corn before the au-tumn winds. How the recent re-statement of the Monroe doctrine, our nation's ideal for this continent, and its interposition against the ag-gression of England roused the people with readiness to subordinate to it all other interests and to defend it at any cost : "Freedom for the American slave," too, was once only an abstraction, and those who cherished it were decried as wild enthusiasts, but it asserted its sway and, through the proclamation of Presi-dent Lincoln and the victories of the Union arms, became a sublime reality in the disen-thrallment of swarthy millions. Of the Puri-tans, whose unswerving devotion to truth and the principles of liberty once made them seem so visionary, whose name has become familiar as any household word in the homes of free-dom, and whose imperishable memorial is the civil and religious liberty of England and America. Macaulay, tracing the power that swayed them to its source, has well said: "They derived their character from the daily contemplation of superior beings and eternal interests." All history attests the fact that all men who have done the best and largest work first wrought out in thought the pattern of their work. They anticipated the end from the beginning and set their aims toward it as the pilot holds the prow of his ship towards the harbor beyond the sea. Greatness and steadiness of aim impelled Paul and Luther to heroic deeds and made them a world-wide force. The loftiness of their ideals drew them up with increasing strength into spheres of sub-limest achievement. Nor can you come into excellence of char-acter and work in any other way. "Purpose," it has been wisely said, "is what gives life a meaning." It rouses and directs the energies, THE COLLEGE MERCURY. 68 and prevents drifting. Bind your life to that which is great and good, and greatness and goodness will be your enduring portion. A worthy ideal will give its ennobling impress to vour character and work, in any sphere, even as the beauty of the blossom is determined by the colors laid at the root of the tree. In the very sense of incompleteness, of "having not yet attained" which it begets and perpetuates vou will find a prime condition of progress, and an urgency to such sustained effort as in-sures increasing effectiveness and power. "Mrs. Sarah Larman Smith," it is said, "learned to talk of Christ to the Arab women in a few months, and Schwartz to the Hindoos in three weeks." Why? A great purpose— to preach the gospel to the benighted and per-ishing, quickened their faculties and enabled them to do in a few weeks or months what to minds, lacking such inspiration, would have been the work of years. So let it be with you. While you dwell among things which seem temporal and have to do with them, look above and beyond them at the things which are un-seen and eternal. Let your ideal of living and working be a pattern showed to you in the Mount of God, a celestial power and iuspira: tion in the doing of earthly things. Grasp its full significance "in the perfect man" in whom the ideal became the real, and pattern was changed with person. Let His love constrain you ; His arms control you ; His example in-spire and mould you ; let it be Christ for you to live, and the end will be, must be, eternal gain. "See that you make all things accord-ing to the pattern showed to you in the Mount.'' THE PLACE OF THE Y. M. C. A. IN THE SOCIOLOGY OF THE COLLEGE. BY DR. ENOCH PERRINE. A change international in extent has revo-lutionized the college world. Barriers between the different classes and between professors and students have been broken down. An-tagonism between different professors and bit-ter contention between colleges has largely disappeared. Colleges are bound even in an international fellowship. All departments contribute to this movement, the Y. M. C. A. most of all, suggesting a sociology of the col-lege. The young man coming to college thinks first of his social status, the attitude of other students, and whether he shall make war or peace. Formerly he had to conquer a place and having established his reputation as a dangerous man, he visited the newer comer with the same horrors to which he had been subjected. Now the Y. M. C. A. meets him at the beginning and does numberless acts of kindness, exhibiting the characteristics of Christ, "the first true gentleman that ever breathed." It thus binds the college world fast by social ties. This must be done in the college before we can expect, it to obtain out-side, since in the college are peculiar incen-tives for the work. The young man next adjusts himself to his intellectual environment. He begins to be shut in by the material success about him and may be tempted to leave behind his "trailing clouds of glory." Then the Y. M. C. A. can direct aright his thought, insisting that God ought to be traced everywhere, thus binding all his intellectual efforts around the cross of Christ, "by whom all things consist." The importance and office of the intellect in the pursuit of truth will be plain to him. Darwin suffered an atrophy ou his poetic and spiritual side and the Y. M. C. A. may prevent such a fate from overtaking their fellows, thus pre-venting the head from freezing the heart and working a great benefit in the Intellectual life of the college. As he proceeds in the acquisition of knowl-edge, the young student will begin to think that in ideas alone there is a defense against moral degredation and a nepenthe for all dis-appointments. Culture will keep corruption from his hands—will be a shelter in the time of storm. Orators and poets shall be his all in all. Then the Y. M. C. A. may give him 69 THK COLLEGE MERCURY. right conceptions as to the Moral life, assert-ing that it is pitiful when the soul mounts higher but comes not closer to God and prov-ing that he only is truly moral who bases his life upon God. All parts of the social life are to be harmonized under one supreme principle. This is to be found at the foot of the cross and any other proposal is but a scheme of decep-tion leaving the mighty turmoil to seethe and boil underneath in undiminished horror. As the Y. M. C. A. insists upon this no man of culture will wail with Mathew Arnold that "most men die unfreed, having seen nothing, still unblest." But all these results may be successfully ac-complished and yet the student may miss the crowning glory. He may play the gentleman in the highest outward sense, may go willingly to the point where his logical faculties assure him that'there is a God, may develop his aesthetic sense so that the moral thing shall seem to be a beautiful thing, and yet blending by all this glory he may not know that he is really in Chimerian darkness. Then the Y. M. C. A. can declare that only he truly loves who loves a personality, that no one ever got beyond a cold respect for an abstraction, though that abstraction be a s.ream of tend-ency that makes for righteousness, and that one must see the king in his beauty before he will get that larger outlook without which life is flat, stale and unprofitable. The Y. M. C. A. can bring about this very desirable change of view better than any other agency about the college since the ordinary student out of Christ, now that he is no longer in the acad-emy, will resent the efforts of his professors to a greater degree than he will those of his fel-lows. Hence in the Social, Intellectual, Moral and Spiritual life of the college, the Y. M. C. A. can make its influence felt at every point, con-tributing that great and final binding force which will make the students in colleges in all lauds a more nearly compact body, and hence furnishing the material for an enduring sociol-ogy inside the college that shall spread out-ward in power and bring the world into a fed-erated parliament that-shall be the longest known to history'. FINE ART'S LIFE. BY L. P. EISENHART. Delightfully care-free seems the Fine Art's career to most of us. Light-hearted and blith-some, it is like the Arcadian life of poetic lore. But beneath its ruddy surface are the marks of many a suffering, the traces of many a heartache. The working of these hidden cares gives to genius its wonted lustre. Sons of art whatever be its realm are all of one brotherhood. The story of the one is the re-told tale of the other. The history of Italy is one great romance. It is the story of sailors, painters and poets. But its fulcrum chapter is the tale of that life-tossed son of Florence. Dante. Born into the throes of civil war, banished from office, de-serted by his friends, he was turned out of his beloved Florence, a heart-broken exile. Sor-row- stricken, death-doomed, he became a wan-derer with no home on earth. An American poet told his life-story in the epithet "world-worn." But his thoughts kept tending toward the eternal world. There his tender pitying soul found a calm repose. This hidden pain of a wrecked and thwarted usefulness showed itself seared and smarting in the Divine Comedy. Had he been spared these suffer-ings, the world would have lost its greatest epic, "the voice often silent centuries" would have been unheard. Insanity made an exile of another Italian bard. Vexed in spirit and failing in body, it was during the same moments of his prison lite that he poured forth his sweetest strains. In another clime those ballads which inspired a nation's people with the love of country are the life thoughts of a poverty-cursed poet. England's master poet in the trouble time of life wrote his best tragedies. A German poet touched the key-note of Fine Art's life when he said of a fellow-craftsman, "The Muse of THE COEEEGE MERCURY. 70 Comedy kissed him on the lips, but the Muse of Tragedy on the heart." Many a versed line lightly passed by has in it the throb and heart-break of tragic every day. The picture of Scott's departure from life-bought Abbottsford is painted in cold, gray colors. We who read his tales of Scotland life scarce realize the pathos and romance of their writer's ill-fated career. Of it his own words were: "But death would have them from me, if misfortunes had spared them." Pride-stricken, broken in body and crushed in spirit he toiled until his fingers could no longer grasp that noted pen. Scott, the minstrel of Highlandlays, the story-teller of border life appeared in the tragic fifth act of his life as Scott the great-hearted man. The life of Robert Louis Stevenson was one long struggle for health. It was this that led him into the pleasant scenes of Scotland, brought him to America, and finally carried him to the island of Samoa. Yet in these blighted years came his creative mood, came too his working day. *'I count life just a stuff To try the soul's strength on, educe the man." Delightful Jean Paul Richter gave this word-ing to our theme—thought. "Fate does with poets, as'we-do with birds—it darkens the warbler's cage until he has caught the oft-played air that he is to sing." Workers at canvas and easel have painted with real meaning in dark, sombre hues. Michel Angelo working for years on those Florentine frescoes, a victim of civil strife and hated by his fellow-painters is a picture not to be forgotten. Many a time did faithless patrons and flights for liberty stay his brush. The sweet-faced Madonnas of an earlier art age are their master's souls in color. Had they life, theirs would be a touching tale of dingy garrets, sleepless nights, days of untold hunger. Pressing poverty and a father's violence made intense the storm and stress period of Beethoven's life. Few were the moments not embittered by trouble at home, ingratitude of friends and the sting of unjust criticism. But life itself seemed lost when the dearest of all senses to him was gradually passing away. His own sonatas could no longer make sound-harmony. It was at this time that he poured forth his great symphonies, those tales of human woe. That was poetic music, the music of the soul. Not one of Schubert's greater operas was placed upon the stage ; nor was he ever to hear his own symphonies ; to him starvation was an uncanny darkness, ever near by. The Fine Art's life of our master musicians is a song in minors. The saddening notes of their soul-touching sonatas are the echoes of many sufferings. Behind the richly-colored scenes of the glit-tering theatre have been acted life's sternest realities. Queens of the stage and kings among actors have not only acted tragedies but have also lived them. While yet a mere boy, Edwin Booth, snow-bound amid the' wastes of Nevada, heard the news of his father's death, the loss of his only hope. The woman of his first love, the companion in his art, died in his absence. Then came the rash act of a lunatic brother, which cast a shadow over the whole world and for a moment his reputation and honored name seemed lost. But a nation's sympathy and the sense of duty to his great art called him back from his gloomy retire-ment. Returning, "he saw his fortune of more than a million dollars, together with the toil of some of the best years of his life frittered away." "A crowning hurt was the gradual passing away of his style of dramatic art. Booth was a dreamer, made sublime by suffer-ing. It was his cares and sorrows that made him dreamy and mysterious in Hamlet, tender and majestic in Richelieu, frenzied and at the same time affectionate in King Eear. May we not say, then, that often has it been the storm and stress of things that has cried to the Fine Art's soul, "Awake !" Here love's first and finest feelings find expression and the wholesome restraints of government begin their peaceful sway. The Father of us all set the solitary in families and bound them together with ties of mutual sympathy, mutual depend-ence and mutual helpfulness. Among the chosen people it developed into the patriarchal gov-ernment ; among the Greeks and Romans, in their highest civilization, the home was a sacred spot and the family the cradle of social and political power and the school of patriotism and religion. With the neglect of the home and a disregard for the family, came the decay of morals, the loss of power and the fall of the empire. The home must ever be the founda-tion of government, and if the foundations be destroyed, how can the individual, social and political building stand ? If the home be pro-tected and the graces of virtue, education, in-dustry and religion be carefully fostered and cultivated, the nation must live and fulfil her high destiny. The coming campaign will doubtless again fill the air with eloquent argu-ment in protection of the national sheep and the American hen and skillfully fail to mention the imperiled boy in the citadel of the Ameri-can home. Whether our great leaders recog-nize the home in their ambition for position or not, the fact remains the same, that here lies the secret of national power or weakness. There are several insidious tendencies which threaten the national life by destroying the home. There is the mad rush to the large cities early in life to secure financial advant-age. Leaving the pure mountain air, the ten-der ministries of home and nature, the asso-ciations of religion in the country or village church, the simple demands of society, the modern young man is tossed like a toy upon the jostling mass of humanity to "break every tender tie" of home, to live in the city board-ing house or hotel and to measure his untried strength with the powers of the world, the flesh and the devil. His future success in building character that will ornament society, strengthen the church, and protect the nation from potitical peril will depend largely upon the principles brought from the obscure home among the hills and valleys of his youth. The permanence of his financial and social standing must depend finally, not so much upon the tricks of trade, nor the chance of fortune, but upon the fidelity to truth, the per-sistent industry and the self-sacrificing econ-omy, laid stone upon stone, in the tedious for-mation of character about the humble home of childhood. Even wealth or position without these would be a calamity. The mountain stream, bursting from the rock, leaping with youthful glee over many a sunlit cascade, goes hurrying to the broad plain below, to turn the weels of industry, to quench the thirst ol a multitude, to join hands with kindred streams and bear upon her jew-eled decked bosom the commerce of a world. But there are a few simple laws laid down by Mother Nature, from which she must never depart. vSo, from the home must go the forces that will drive the machinery of a nation, strike hands with their kindred beyond the seas, and lift an exiled world back to God. Our success will depend upon a few simple laws which God and our Christian mothers will teach us. One of these principles is that gold must not become the individual's nor the nation's god. There are things finer than gold, more pre-cious than much fine gold. Those invisible hands that bind the gold-thirsty young man to his mother, those imperishable chords that in-crease their tension with distant separation and will not relax through the pleadings of time. Those divine threads that are woven into the web of our lives, in such a variety of color, through so many years of tender ministries, which neither the sunshine nor the rain will cause to fade. That mysterious attraction that tears the busy merchant from his surroundings to hasten to the old home, to feast the eyes upon scenes that will not perish, to quicken the affections that cannot die, to grasp the parental hand that warms with age, and to look upon the face of the only one whose feat-ures beautify with years. What strange calculations are these ! By some irresistible logic, as he stands by the grave of the departed mother, he reasons thus: 73 THE COU-EGE MERCURY. Take these stocks and bonds, these railroad and real estate interests, seize these large man-ufacturing and commercial. enterprises, take this palace of marble and bury them all, rather than let the cruel clay hide from me the treas-ured influence that crowned that life, finer than gold. Wealth must not become our ideal nor our idol. Only as it builds more homes and builds them more beautiful, adorns them with culture and religion, sweetens them as fountains of purity for the healing of the nation, strength-ens them as fortresses for her protection, will it bless our civilization. Another tendency that threatens the home is the social condition which seeks to separate the family. There is a kind of centrifugal force which tends to scatter the members of the household and destroy that bond which should bind them together with a kind of social grav-itation, which afterwards becomes the power of the community and of the state. There is danger of the boys and girls being thrown from the home nest before the fledgelings can use their wings or have wisdom to select their food. There are many temptations to lure them from the tender influences and sympa-thies of those who reared them. Even the recognized helps may prove hindrances ;. the schools that place these young lives in the hands of strangers over half their time from six years of age, the social, innocent pleasures that rob the parents of over half the remainder of their heaven-given opportunities, to say nothing of those attractions which cause many to spend the remainder of their time not spent in eating and sleeping outside of the home. How narrow the margin becomes for the home to do its work. To pi ess the plastic ma-terial into shape, to lay the artful chisel to the stone and hew with loving stroke the perfect form. How jealous the parent should be of these first and best opportunities! How guarded the sensitive plate of the mind and heart, that the first light to shine upon its deli-cate surface should reflect a perfect image ! Is the father anxious to spend the leisure hours in the home rather than in the lodge or club house, or is he too busy with his profes-sion, too closely confined to his business to im-press true character upon his own boy, who shall succeed him in business and become heir of his hard-earned estate ? Has the wife and mother been more anxious to keep flies out of the house than to keep her boy in ; has she be-stowed more thought upon velvet or brussels than upon the delicately woven character of an immortal ; has she studied to make an impres-sion upon fashionable society rather than to impress a future citizen of the State ? The law of nature will not be reversed to make amends for parental indifference or careless-ness. The colors we mix will appear on the canvas, the materials we use in the mortar will show themselves in the building. Is the home the centre of attraction and interest? Then it has its rightful place and becomes the sun of the system around which all things re-volve, from which they get their light and heat and are held in their proper orbits. De-stroy this relation, and confusion and anarchy follow. The home is a miniature government, in which the parents rule. Here begins re-spect for authority and obedience to law, the two great essentials in the security of the State; and if not learned here, may be learned too late to avert crime. Here are developed those finer affections toward brothers and sisters which, when en-larged, produce true patriotism and make "the whole world kin." Here under the form of possessions acquired and protected, the true right of ownership becomes early established, that true love of country may become the en-larged law of self-protection ; thus combining the law of chivalry to defend the innocent and the heroism of the soldier to protect the nation. The social and national life are found in min-iature in the empire of the home which, when properly controlled, becomes the ideal of the national government. The King rules his subjects with a father's tenderness. The sub-jects obey the laws, prompted by filial grati-tude for the general good. An injustice against THE COLLEGE MERCURY. 74 one member is an offense against the whole body politic. Suffering in part enlists the sympathy of the whole. A cry of distress startles the nation and all the nerves of sensa-tion carry the news and the alarm brings re-pair and relief trains over every highway of approach. The homes of the nation must ever be the fountains for the public school, the supply for the church, the protection of our liberties against internal and external foes. These must be the watch towers, and the sons and daughters the real standing army to protect our civil and religious liberties. The thousands of men who live on wheels, without a sure place to set their feet, must have a starting-point and a returning point for their souls, a tension to hold them in place more binding than the rules of the business firm, a restraint to stay their feet on the verge of temptation mightier than law, an unseen angel to stand between them and sin, to guard them from its blighting touch This starting-point is the Christian home, this tension, the mystic chord that binds them to the altar, this angel, the messenger that sits in the temple of the memory and holds the wife, the mother, the innocent children before the soul. The home is a type of Heaven, the perfec-tion of future blessedness. God, the Father of us all, Christ, the Brother of us all, we, the children. From the imperfect to the perfect, from the trial to the triumph. We are but children away from home. Earth is but the play-ground. We stretch onr tiny hands toward the stars glimmering in the dark-ness that surrounds us. We tire of these earthly toys. We cry, in our distress, to grasp the eternal. zarządzaniu. As pointed out by the Author,
the book is a case of a work rare on the Polish
publishing market, written by an outstanding
scientist, who successfully runs a business
activity. The combination of practical experience
with theoretical knowledge gave a result
that may be satisfying both for practitioners
as well as theorists, and also those who want
to get to know the ins and outs of an effective
and efficient business management. The Author
of the review believes that it is an important
voice for shaping an inclusive socio-economic
system, which constitutes a value in itself. Although
the book is mainly concerned with
business management, its message has a much
wider dimension and is concerned with real
measures of wealth, money and people's lives.
The book was awarded The SGH Collegium of
Business Administration Award "For the best
scientific work in the field of business administration
in the years 2014-2015".

Introduction

One of the distinctive features of the contemporary economy and contemporary world is a kind of obsession of quantity which is related to thoughtless consumerism, unfavourable to the care for the quality of the work and the quality of the produced and consumed goods and services. It is accompanied by culture (or rather non-culture) of singleness. Therefore, the book The Doctrine of Quality by Andrzej Blikle is like a breath of fresh air.

It is a different perspective on the economy and the model of operation of enterprises, on the model of work and life of people. A. Blikle proves that it can be done otherwise. He proves it on the basis of careful studies of the source literature – as expected from a professor of mathematics and an economist, but also on the basis of his own experience gained during the scientific and educational work, and most of all through the economic practice. In the world governed by the obsession of quantity, characterised by fragility, shortness of human relationships, including the relationship of the entrepreneur – employee, A. Blikle chooses durability of these relations, creativity, responsibility, quality of work and production, and ethics. The Doctrine of Quality is a rare example of the work on the Polish publishing market, whose author is a prominent scientist, successfully conducting a business activity for more than two decades, which has contributed to the development of the family company – a known confectionery brand "A. Blikle". The combination of practical experience with theoretical knowledge gave a result that may be satisfying both for practitioners as well as theorists, and also those who want to get to know the ins and outs of an effective and efficient business management, or develop the knowledge on this topic. In an attractive, clear narrative form, the author comprehensively presents the complexities of business management, indicating the sources of success, but also the reasons and the foundations of failures.

At the same time, he presents these issues with an interdisciplinary approach, which contributes to thoroughness of the arguments and deeper reflections.

Holism, typical to this book, is also expressed in the focus of A. Blikle not only on the economic, but also on social and ecological issues. Here, the author points to the possibility and need of reconciliation of the economic interests with social interests, and the care for the public good. Analyses of this subject are presented using the achievements of many areas of studies, in addition to economic sciences, including mathematics, sociology, psychology, medicine, and others. This gives a comprehensive picture of the complexity of business management – taking into account its close and distant environment.

There are no longueurs in the book, although extensive (over 500 pages), or lengthy, or even unnecessary reasoning overwhelming the reader, as the text is illustrated with a number of examples from practice, and coloured with anecdotes. At the same time, the author does not avoid using expressions popular in the world of (not only) business. He proves that a motivational system which is not based on the approach of "carrot and stick" and without a devastating competition of a "rat race" is possible. The author supports his arguments with references not only to the interdisciplinary scientific achievements, but also to the economic historical experiences and to a variety of older and newer business models.

There is a clear fascination with the reserves of creativity and productivity in the humanization of work. In fact, the author strongly exposes the potential of productivity and creativity in creating the conditions and atmosphere of work fostering elimination of fear of the future. He shows that such fear destroys creativity. It is not a coincidence that A. Blikle refers to the Fordist principles, including the warning that manufacturing and business do not consist of cheap buying and expensive selling. He reminds that Henry Ford, a legendary creator of the development of the automotive industry in the United States, put serving the public before the profit. The Doctrine of Quality is at the same time a book – proof that one of the most dangerous misconceptions or errors in the contemporary understanding of economics is finding that it is a science of making money, chremastics. Edmund Phelps and others warned against this in the year of the outbreak of the financial crisis in the USA in 2008, reminding that economics is not a science of making money but a science of relations between the economy and social life [Phelps, 2008]. Economics is a science of people in the process of management. Therefore, by definition, it applies to social values and ethos. Ethos is a general set of values, standards and models of proceedings adopted by a particular group of people. In this sense, ethos and economics as a science of people in the process of management are inseparable. Detaching economics from morality is in contradiction to the classical Smithian concept of economics, as Adam Smith combined the idea of the free market with morality. He treated his first work, The Theory of Moral Sentiments, as an inseparable basis for deliberations on the nature and causes of the wealth of nations, which was the subject of the subsequent work of this thinker [Smith, 1989; Smith, 2012]. Identifying economics with chremastics would then mean that all actions are acceptable and desired, if their outcome is earnings, profit, money. The book of A. Blikle denies it. It contains a number of case studies, which also stimulate broader reflections. Therefore, and also due to the features indicated above, it can be a very useful teaching aid in teaching entrepreneurship and management.

The appearance of a book promoting the doctrine of quality and exposing the meaning of ethos of work is especially important because today the phenomenon of product adulteration becomes increasingly widespread, which is ironically referred to in literature as the "gold-plating" of products [Sennett, 2010, pp. 115-118], and the trend as "antifeatures", that is intentionally limiting the efficiency and durability of products of daily use to create demand for new products. A model example of antifeature is a sim-lock installed in some telephones which makes it impossible to use SIM cards of foreign operators [Rohwetter, 2011, p. 48; Miszewski, 2013]. These types of negative phenomena are also promoted by the development of systemic solutions aiming at the diffusion of responsibility [Sennett, 2010]. This issue is presented among others by Nassim N.N. Taleb, in the book with a meaningful title Antifragile: How to Live in a World We Don't Understand? The author proves that the economy and society lose their natural durability as a result of the introduction of numerous tools and methods of insurance against risks, but mostly by shifting the burden of risks on other entities [Taleb, 2012]. N.N. Taleb illustrates his arguments with numerous convincing examples and references to history, recalling, inter alia, that in ancient times there was no building control, but the constructors, e.g. of bridges had to sleep under them for some time after their construction, and the ancient aqueducts are still working well until today. So, he shows that a contemporary world, focused on quantitative effects, does not create a sound base for ethical behaviours and the care for the quality of work and manufacturing.

Andrzej Blikle points to the need and possibility of opposing this, and opposing to what the Noble Price Winner for Economics, Joseph Stiglitz described as avarice triumphs over prudence [Stiglitz, 2015, p. 277]. The phrase emphasised in the book "Live and work with a purpose" is the opposition to the dangerous phenomena listed above, such as for example antifeatures.

convincing that although the business activity is essentially focused on profits, making money, limited to this, it would be led to the syndrome of King Midas, who wanted to turn everything he touched into gold, but he soon realised that he was at risk of dying of starvation, as even the food turned into gold. What distinguishes this book is that almost every part of it forces in-depth reflections on the social and economic relations and brings to mind the works of other authors, but at the same time, creates a new context for them.

So, A. Blikle clearly proves that both the economy and businesses need social rooting. This corresponds to the theses of the Hungarian intellectual Karl Polanyi, who in his renowned work The Great Transformation, already in 1944 argued that the economy is not rooted in the social relations [Polanyi, 2010, p. 70]. He pointed to the risk resulting from commodification of everything, and warned that allowing the market mechanism and competition to control the human life and environment would result in disintegration of society. Although K. Polanyi's warnings were concerned with the industrial civilization, they are still valid, even now – when the digital revolution brings fundamental changes, among others, on the labour market – they strengthen it. The dynamics of these changes is so high that it seems that the thesis of Jeremy Rifkin on the end of work [Rifkin, 2003] becomes more plausible. It is also confirmed by recent analyses included in the book of this author, concerning the society of zero marginal cost and sharing economy [Rifkin, 2016], and the analyses concerning uberisation [Uberworld, 2016].

The book of Andrzej Blikle also evokes one of the basic asymmetries of the contemporary world, which is the inadequacy of the dynamics and sizes of the supply of products and services to the dynamics and sizes of the demand for them. Insufficient demand collides with the rapidly increasing, as a result of technological changes, possibilities of growth of production and services. This leads to overproduction and related therewith large negative implications, with features of wasteful economy of excess [Kornai, 2014]. It is accompanied by phenomena with features of some kind of market bulimia, sick consumerism, detrimental both to people and the environment [Rist, 2015]. One of the more compromising signs of the economy of excess and wasting of resources is wasting of food by rich countries, when simultaneously, there are areas of hunger in some parts of the world [Stuart, 2009].

At the same time, the economy of excess does not translate to the comfort of the buyers of goods – as in theory attributed to the consumer market. It is indicated in the publication of Janos Kornai concerning a comparative analysis of the features of socio-economic systems. While exposing his deep critical evaluation of socialist non-market systems, as economies of constant deficiency, he does not spare critical opinions on the capitalist economy of excess, with its quest for the growth of the gross domestic product (GDP) and profits. As an example of the economy of excess, he indicates the pharmaceutical industry, with strong monopolistic competition, dynamic innovativeness, wide selection for the buyers, flood of advertisements, manipulation of customers, and often bribing the doctors prescribing products [Kornai 2014, p. 202]. This type of abnormalities is not alien to other industries. Although J. Konrai appreciates that in the economy of excess, including the excess of production capacities, the excess is "grease" calming down and soothing clashes that occur in the mechanisms of adaptation, he also sees that those who claim that in the economy of excess (or more generally in the market economy), sovereignty of consumers dominates, exaggerate [Kornai, 2014, pp. 171-172], as the manufacturers, creating the supply, manipulate the consumers. Thus, there is an excess of supply – both of values as well as junk [Kornai, 2014, p. 176]. Analysing the economy of excess, J. Kornai brings this issue to the question of domination and subordination. It corresponds with the opinion of Jerzy Wilkin, according to whom, the free market can also enslave, so take away individual freedom; on the other hand, the lack of the free market can lead to enslavement as well. Economists willingly talk about the free market, and less about the free man [Wilkin, 2014, p. 4].

The economy of excess is one of the consequences of making a fetish of the economic growth and its measure, which is the gross domestic product (GDP) and treating it as the basis of social and economic activity. In such a system, the pressure of growth is created, so you must grow to avoid death! The system is thus comparable to a cyclist, who has to move forwards to keep his balance [Rist, 2015, p. 181]. It corresponds with the known, unflattering to economists, saying of Kenneth E. Boulding [1956], criticising the focus of economics on the economic growth, while ignoring social implications and consequences to the environment: Anyone who believes in indefinite growth in anything physical, on a physically finite planet, is either mad or an economist. [from: Rist, 2015, p. 268].

GDP is a very much needed or even indispensable measure for evaluation of the material level of the economies of individual countries and for comparing their economic health. However, it is insufficient for evaluation of the real level of welfare and quality of life. It requires supplementation with other measures, as it takes into account only the values created by the market purchase and sale transactions. It reflects only the market results of the activity of enterprises and households. Additionally, the GDP account threats the socially desirable and not desirable activities equally. Thus, the market activity related to social pathologies (e.g. functioning of prisons, prostitution, and drug dealing) also increase the GDP. It was accurately expressed already in 1968 by Robert Kennedy, who concluded the discussion on this issue saying that: the gross national product does not allow for the health of our children, the quality of their education or the joy of their play. It does not include the beauty of our poetry or the strength of our marriages, the intelligence of our public debate or the integrity of our public officials. It measures neither our wit nor our courage, neither our wisdom nor our learning, neither our compassion nor our devotion to our country, it measures everything in short, except that which makes life worthwhile [The Guardian, 2012].

While Grzegorz W. Kołodko even states that it should be surprising how it is possible that despite a number of alternative measures of social and economic progress, we are still in the corset of narrow measure of the gross product, which completely omits many significant aspects of the social process of reproduction [Kołodko, 2013, p. 44]. In this context he points to the necessity of triple sustainable growth – economic, social, and ecological [Kołodko, 2013, p. 377]. Transition from the industrial civilisation model to the new model of economy, to the age of information, causes a kind of cultural regression, a phenomenon of cultural anchoring in the old system. This type of lock-in effect - described in the source literature, that is the effect of locking in the existing frames and systemic solutions, is a barrier to development. The practice more and more often and clearer demonstrates that in the conditions of the new economy, the tools and traditional solutions turn out to be not only ineffective, but they even increase the risk of wrong social and economic decisions, made at different institutional levels.

All this proves that new development models must be searched for and implemented, to allow counteraction to dysfunctions of the contemporary economy and wasting the development potential, resulting from a variety of maladjustments generated by the crisis of civilisation. Polish authors who devote much of their work to these issues include G.W. Kołodko, Jerzy Kleer, or Maciej Bałtowski. Studies confirm that there is a need for a new pragmatism, new, proinclusive model of shaping the social and economic reality, a model which is more socially rooted, aiming at reconciling social, economic and ecological objectives, with simultaneous optimisation of the use of the social and economic potential [Kołodko, 2013; Bałtowski, 2016; Kleer, 2015]. There is more and more evidence that the barriers to economic development growing in the global economy are closely related with the rooting of the economy in social relations. The book of A. Blikle becomes a part of this trend in a new and original manner. Although the author concentrates on the analyses of social relations mainly at the level of an enterprise, at the same time, he comments them at a macroeconomic, sociological and ethical level, and interdisciplinary contexts constitute an original value of the book.

Conclusion

I treat the book of Andrzej Blike as an important voice in favour of shaping an inclusive social and economic system, in favour of shaping inclusive enterprises, that is oriented on an optimal absorption of knowledge, innovation and effective reconciliation of the interests of entrepreneurs with the interests of employees and the interests of society. Inclusiveness is indeed a value in itself. It is understood as a mechanism/system limiting wasting of material resources and human capital, and counteracting environmental degradation. An inclusive social and economic system is a system oriented on optimisation of the production resources and reducing the span between the actual and potential level of economic growth and social development [Reforma, 2015]. And this is the system addressed by Andrzej Blikle in his book. At least this is how I see it. Although the book is mainly concerned with business management, its message has a much wider dimension and is concerned with real measures of wealth, money and people's lives.

The UK participants demonstrated a self‐enhancement bias by expressing that they would fair far better than the average prisoner. 'Can Employers Play a More Positive Role in Prisoner Reentry? Urban Institute's Reentry Roundtable'.The authors report that in the early 21st century over 600 000 prisoners were released each year from prison and three million or more ex‐prisoners were in the general population. Holzer et al. indicate that one of the greatest hurdles for a newly released prisoner is finding employment because, as applicants, they are faced with an aversion on the employers part to hiring ex‐offenders. Holzer et al. explore the extent and nature of this aversion. Journal of Contemporary Criminal Justice21(4): 314–35.In this article, La Vigne, Naser, Brooks and Castro look at the role of the family in recidivism rates. Specifically, they examine the role of in‐prison contact with family members on released prisoner success. This article first defines family and then looks at the quality of familial bonds at imprisonment and during incarceration. Next, they examine the inter‐personal bonds in relationships, i.e., parent–child vs. husband‐wife of these post‐released prisoners. The authors' findings were inconsistent. For example, in some situations in‐prison contact was detrimental on family relationships and ties, wherein other cases the same contact served to strengthen the family and create a tighter network of family support for the newly released prisoner. The American Journal of Sociology108(5): 937–75.Pager examined the relationship between prior incarceration and race on employment on two teams of subjects. One team consisted of two 23‐year‐old, white men and the other team was two 23‐year‐old, African‐American men. The two teams were nearly identical in personality, appearance, skills and employment history. The variables were race and criminal record. The findings suggest that race and employment history are important factors on post‐released employment. Thirty‐four percent of white applicants without criminal backgrounds received a call back while only 14 percent of black applicants without criminal backgrounds got called back. Seventeen percent of white applicants with criminal records received call backs while only 5 percent of black applicants with criminal records received call backs. Students must briefly site articles from this course to support their methodologies and indicate the problems they suspect they will face as they try to determine the success or failure of their program. Budgets and money are a non‐issue. In the 'real' world budgets are always an issue but for the purpose of this assignment they are not. However, when designing your program you should consider whether your design is financially feasible.. The goal of such an assignment is for students to recognize the barriers prisoners face to successful reentry, the evidence and research that goes into creating prisoner policies, and that a program must be multi‐faceted and comprehensive in order to provide a platform for former inmate success.

Irwin watched as incarceration rates doubled between 1980 and 2000 despite crime levels staying relatively stable. Irwin notes that most of the prisoners in his study were incarcerated for 'unserious' crimes and were often treated in unethical ways. Irwin begins by examining incarceration rates, the demographics of the prison population, problems prisoners faced while incarcerated, post‐release difficulties and hurdles, and the societal costs of the prison super‐structure. Irwin offers a thorough examination of why prisoners are incarcerated, what they face while inside prison walls, what challenges they face once released, and the financial implications of imprisoning people.

The research activity carried out during the three years of the PhD course attended, at the Engineering Department of the University of Palermo, was aimed at the identification of an alternative predictive model able to solve the traditional building thermal balance in a simple but reliable way, speeding up any first phase of energy planning. Nowadays, worldwide directives aimed at reducing energy consumptions and environmental impacts have focused the attention of the scientific community on improving energy efficiency in the building sector. The reduction of energy consumption and CO2 emissions for heating and cooling needs of buildings is an important challenge for the European Union, because the buildings sector contributes up to 36% of the global CO2 emissions [1] and up to 40% of total primary energy consumptions [2]. Despite the ambitious goals set by the Energy Performance of Buildings Directive (EPBD) at the European level [1], which states that, by 2020, all new buildings and existing buildings undergoing major refurbishments will have to be Nearly Zero Energy Buildings (NZEB) [3,4], the critical challenge remains the improvement of the efficiency when upgrading the existing building stock to standards of the NZEB level [5]. The improvement of the energy efficiency of buildings and their operational energy usage should be estimated early in the design phase to guarantee a reduction in energy consumption, so buildings can be as sustainable as possible [6]. While a newly constructed NZEB can employ the "state of the art" of available efficient technologies and design practices, the optimization of existing buildings requires better efforts [7]. One way or the other, the identification of the best energy retrofit actions or the choice of a better technological solution to plan a building is not so simple. It has become one of the main objectives of several research studies, which require deep knowledge in the field of the building energy balance. The building thermal balance includes all sources and sinks of energy, as well as all energy that flows through its envelope. More in detail, the energy demand in buildings depends on the combination of several parameters, such as climate, envelope features, occupant behaviour and intended use. Indeed, the assessment of building energy performance requires substantial input data describing structures, environmental conditions [8], thermo-physical properties of the envelope, geometry, control strategies, and several other parameters. From the first design phases designers and researchers, which are trying to respect the prescriptions of the EPBD directive and to simultaneously ensure the thermal comfort of the occupants, must optimize all possible aspects that represent the key points in the building energy balance. As will be shown in Chapter A, the literature offers highly numerous complex and simplified resolution approaches [9]. Some are based on knowledge of the building thermal balance and on the resolution of physical equations; others are based on cumulated building data and on implementations of forecast models developed by machine-learning techniques [10]. Several numerical approaches are most widespread; these have undergone testing and implementing in specialised software tools such as DOE-2 [11], Energy Plus [12], TRNSYS [13] and ESP-r [14]. Such building modelling software can be employed in several ways on different scales; they can be simplified [15,16] or detailed comprehensively by different methods and numerical approaches [17]. Nevertheless, they are often characterised by a lack of a common language, which constitutes an obstacle for making a suitable choice. It is often more convenient to accelerate the building thermal needs evaluation and use the simplified methods and models. For example, a steady state approach for the evaluation of thermal loads is characterised by a good level of accuracy and low computational costs. However, its main limitation is that some phenomenon, such as the thermal inertia of the building envelope/structure, may be completely neglected. On the other hand, the choice of a more complex solution, such as the dynamic approach, uses very elaborate physical functions to evaluate the energy consumption of buildings. Although these dynamic simulation tools are effective and accurate, they have some practical difficulties such as collecting detailed building data and/or evaluating the proper boundary conditions. The use of these tools normally requires an expert user and a careful calibration of the model and do not provide a generalised response for a group of buildings with the same simulation, because they support a specific answer to a specific problem. Meanwhile the lack of precise input can lead to low-accuracy simulation. Anyway, in all cases it is necessary to be an expert user to implement, solve and evaluate the results, and these phases are not fast and not always immediately provide the correct evaluation, conducting the user to restart the entire procedure. In the field of energy planning, in order to identify energy efficiency actions aimed at a particular context, could be more convenient to speed up the preliminary assessment phase resorting to a simplified model that allows the evaluation of thermal energy demand with a good level of accuracy and without excessive computational cost or user expertise. The aim of this research, conducted during the three years of the PhD studies, is based on the idea of overcoming the limits previously indicated developing a reliable and a simple building energy tool or an evaluation model capable of helping an unskilled user at least in the first evaluation phase. To achieve this purpose, the first part of the research was characterised of an in-depth study of the sector bibliography with the analysis of the most widespread and used methods aimed at solving the thermal balance of buildings. After a brief distinction of the analysed methods in White, Black and Grey Box category, it was possible to highlight the strengths and weaknesses of each one [9]. Based on the analysis of this study, some alternative methods have been investigated. In detail, the idea was to investigate several Black-Box approaches; mainly used to deduce prediction models from a relevant database. This category does not require any information about physical phenomena but are based on a function deduced only by means of sample data connected to each other and which describes the behaviour of a specific system. Therefore, it is fundamental the presence of a suitable and well-set database that characterise the problem, so that the output data are strongly related to one or more input data. The completely absence of this information and the great difficulty in finding data, has led to the creation of a basic energy database which, under certain hypotheses, is representative of a specific building stock. For this reason, in the first step of this research was developed a generic building energy database that in a reliable way, and underlining the main features of the thermal balance, issues information about the energy performances. In detail, two energy building databases representative of a non-residential building-stock located in the European and Italian territory have been created. Starting from a well-known and calibrated Base-Case dynamic model, which simulates the actual behaviour of a non-residential building located in Palermo, it was created an Ideal Building representative of a new non-residential building designed with high energy performances in accordance whit the highest standard requirements of the European Community. Taking into consideration the differences existing in the regulations and technical standards about the building energy performance of various European countries, several detailed dynamic simulation models were developed. Moreover, to consider different climatic characteristics, different locations were evaluated for each country or thermal zone which represent the hottest, the coolest and the mildest climate. The shape factor of buildings, which represents the ratio between the total of the loss surfaces to the gross heated volume of a building, was varied from 0.24 to 0.90. To develop a representative database where the data that identify the building conditions are the inputs of the model linked to an output that describes the energy performances it was decided to develop a parametric simulation. In detail different transmittance values, boundary conditions, construction materials, and energy carriers were chosen and employed to model representative building stocks of European and Italian cities for different climatic zones, weather conditions, and shape factor; all details and the main features are described in Chapter B. These two databases were used to investigated three alternative methods to solve the building thermal balance; these are: • Multi Linear Regression (MLR): identification of some simple correlations that uses well known parameters in every energy diagnosis [18–20]; • Buckingham Method (BM): definition of dimensionless numbers that synthetically describe the relationships between the main characteristic parameters of the thermal balance [21]; and • Artificial Neural Network (ANN): Application of a specific Artificial Intelligence (AI) to determine the thermal needs of a [22] building. These methods, belonging to the Black-Box category, permit solving a complex problem easier with respect to the White-Box methods because they do not require any information about physical phenomena and expert user skills. Only a small amount of data on well-known parameters that represent the thermal balance of a building is required. The first analysed alternative method was the MLR, described in Chapter C. This approach allowed to develop a simple model that guarantees a quick evaluation of building energy needs [19] and is often used as a predictive tool. It is reliable and, at the same time, easy to use even for a non-expert user since an in-depth knowledge in the use phase is not needed, and computational costs are low. Moreover, the presence of an accurate input analysis guarantees greater speed and simplicity in the data collection phase [23]. The basis for this model is the linear regression among the variables to forecast and two or more explanatory variables. The feasibility and reliability of MLR models is demonstrated by the publication of the main achieved results in international journals. At first, the MLR method was applied on a dataset that considered heating energy consumptions for three configurations of non-residential buildings located in seven European countries. In this way, it was developed a specific equation for each country and three equations that describe each climatic region identified by a cluster analysis; these results were published in [19]. In a second work [18], it was applied the same methodology to a set of data referring to buildings located in the Italian peninsula. In this case, three building analysed configurations, in accordance to Italian legislative requirements regarding the construction of high energy performance buildings, have been employed. The achievement of the generalised results along with a high level of reliability it was achieved by diversifying each individual model according to its climate zone. It was provided an equation for each climate zone along with a unique equation applicable to the entire peninsula, obviously with different degrees of reliability. An improved version of the latest work concerning the Italian case study appeared in the paper published in [20]. The revised model provided an ability to predict the energy needs for both heating and cooling. Furthermore, to simplify the data retrieval phase that is required for the use of the developed MLR tool, an input selection analysis based on the Pearson coefficient has been performed. In this way the explanatory variables, needful for an optimal identification of thermal loads, have been identified. Finally, a comprehensive statistical analysis of errors ensured high reliability. The second analysed alternative method represents an innovative approach in developing a flexible and efficient tool in the building energy forecast framework. This tool predicts the energy performance of a building based some dimensionless parameters implemented through the application of the Buckingham theorem. A detailed description of the methodology and results is discussed in the Chapter D and is also published in [21]. The Buckingham theorem represents a key theorem of the dimensional analysis since it is able to define the dimensionless parameters representing the building balance [24]. These parameters define the relationships between the descriptive variables and the fundamental dimensions. Such a dimensional analysis guarantees that the relationship between physical quantities remains valid, even if there is a variation of the magnitudes of the base units of measurement [25]. The dimensional analysis represents a good model to simplify a problem by means of the dimensional homogeneity and, therefore, the consequent reduction in the number of variables. Therefore, this model works well with different applications such as forecasting, planning, control, diagnostics and monitoring in different sectors. The application of the BM for predicting the energy performance of buildings determined nine ad hoc dimensionless numbers. The identification of a set of criteria and a critical analysis of the results allowed to immediately determine thought the dimensionless numbers and without using any software tool, the heating energy demand with a reliability of over 90%. Furthermore, the validation of the proposed methodology was carried out by comparing the heating energy demand that was calculated by a detailed and accurate dynamic simulation. The last Black-Box examined model was the application of Artificial Neural Networks. The ANNs are the most widely used data mining models, characterised by one of the highest levels of accuracy with respect to other methods but generally have higher computational costs in the developing phase [26]. The design of a neural network, inspired by the behaviour of the human brain, involves the large number of suitably connected nodes (neurons) that, upon applications of simple mathematical operations, influence the learning ability of the network itself [27]. Also in this case, as described in Chapter E, this methodology was applied at the two different energy databases. In [22], the ANN was used to predict the demand for thermal energy linked to the winter climatization of non-residential buildings located in European context, while in another work under review, the ANN was used to determine the heating and cooling energy demand of a representative Italian building stock. The validation of the ANNs was carried out by using a set of data corresponding to 15% of the initial set which were not used to train the ANNs. The obtained good results (determination coefficient values higher than 0.95 and Mean Absolute Percentage Error lower than 10%) show the suitability of the calculation model based on the use of adaptive systems for the evaluation of energy performance of buildings. Simultaneously, a deep analysis of the investigated problem, underlines how to determine the thermal behaviour of a building trough Black-Box models, particular attention must be paid to the choice of an accurate climate database that along with thermophysical characteristics, strongly influence the thermal behaviour of a building [9]. In detail, to develop a predictive model of thermal needs, it is also necessary to pay close attention to the climate aspects. In the literature, many studies use the degree day (DD) to predict building energy demand, but this assessment, through the use of a climatic index, is correct only if its determination is a function of the same weather data used for the model implementation. Otherwise, the predictive model is generally affected by a greater evaluation error; all these aspects are deeply discussed analysing a specific Italian case study in Chapter F, and the main results are published in [8]. The results achieved during the three years of PhD research, make it possible to affirm that each model can be used to solve thermal building balance by knowing merely a few parameters representative of the analysed problem. Nonetheless, some questions may be asked: Which of these models can be identified as the most efficient solution? Is it possible to compare the performances of these models? Is it possible to choose the most efficient model based on some specific phase in the evaluation? To attempt to answer these questions, during the research period it was decided to compare the three selected alternative models by applying a Multi Criteria Analysis (MCA), that explicitly evaluates multiple criteria in decision-making. It is a useful decision support tool to apply to many complex decisions by choosing among several alternatives. The idea rising thanks to the scientific collaboration with the VGTU University of Vilnius, Lithuanian, in the person of Prof. A. Kaklauskas and Prof. L. Tupènaitè, experts in the field of multi-criteria analysis. At the first time a multi-criteria procedure was applied to determine the most efficient alternative model among some resolution procedures of a building's energy balance. This application required extra effort in defining the criteria and identifying a team of experts. To apply the MCA, it was necessary to identify the salient phases of the evaluation procedure to explain the most sensitive criteria for acquiring conscious, truthful answers that only a pool of experts in the field can provide. Details of this work were carried out during the period of one-month research in Vilnius, from April to May 2019, where it was possible to improve the application of the Multiple Criteria Complex Proportional Evaluation (COPRAS) method for identifying the most efficient predictive tool to evaluate building thermal needs. These results are collected in Chapter G and the main results are explained in a paper under review in the Journal "Energy" from September. The identification of the most efficient alternative model to solve the building energy balance through the application of a specific MCA, allowed to deepen the identified methodology and improve research. In particular, the most efficient alternative resolution model was the subject of the research that took place during the research period at the RWTH in Aachen University, Germany with Prof. M. Traverso, Head of the INaB Department, from September 2018 to March 2019. The experience in the field of LCA and the possibility of identifying the environmental impacts linked to the building system, has led the research to investigate neural networks for a dual and simultaneous environmental-energy analysis. The results confirm that the application of ANNs is a good alternative model for solving the energy and environmental balance of a building and for ensuring the development of reliable decision support tools that can be used by non-expert users. ANNs can be improved by upgrading the training database and choosing the network structure and learning algorithm. The results of this research are collected in Chapter H and published in [28].

This research aims to know the potential effect of Intellectual Capital Performance (ICP) to the intensity of Intellectual Capital Disclosure (ICD). The independent variables used in this research are the components of ICP that consists of Value Added Human Capital (VAHU), Value Added Capital Employed (VACA), and Structural Capital Value Added (SCVA) that is measured by using the Value Added Intellectual Coefficient (VAIC™). While, the dependent variable used in this research is ICD that measured by a disclosure index and relevant scoring system. Company size and leverage are also used in the regression model as moderating variables. One year annual reports (2017) of banking sector companies registered on the Indonesia Stock Exchange (IDX) are analyzed in quantitative research type. The samples that listed on the IDX in 2017 are selected by using purposive sampling method with certain criteria and 33 banking sector companies are obtained. The analysis is made by multiple regression analysis and the data testing is conducted by using SPSS 22 and Eviews 9 which previously has been carried out the classic assumption test first. Results of this study indicate that: (1) Simultaneously, ICP component significantly affect ICD. However, each component of VAHU and SCVA does not significantly affect the ICD, only VACA significantly affects the ICD; (2) Simultaneously, with the moderation of company size, ICP does not significantly affect the ICD. Similarly, each component of VAHU, VACA and SCVA does not significantly affect ICD; and (3) Simultaneously, with the moderation of company leverage, ICP significantly affects ICD. Máster Universitario en Ingeniería Industrial ; El sector de la automoción engloba un mercado muy exigente, donde los clientes poseen expectativas de calidad muy altas y donde las empresas proveedoras de vehículos están sometidas a grandes presiones y regulaciones. En los años ochenta, las empresas conocidas como "The Big Three", Ford, Chrysler y General Motors (en aquel momento entre las tres se repartían la gran mayoría de la cuota del mercado de la automoción), unieron sus fuerzas en busca de un objetivo común, y nominaron a una comisión de expertos para hacer frente a la amenaza que suponía la creciente expansión de la industria automovilística japonesa. Además, estas tres empresas crearon el AIAG ('Automotive Industry Action Group'), una asociación sin ánimo de lucro que se compone de un diverso grupo de profesionales y actores interesados de este sector, que incluye, por ejemplo, proveedores de todos los tamaños de piezas y material, fabricantes, proveedores de servicios, e incluso el mismo gobierno, además de las propias empresas automovilísticas. Esta asociación vela por la existencia de un trabajo colaborativo entre todos los miembros, buscando sinergias y apoyos mutuos para que todas las partes salgan beneficiadas. En el contexto actual, las empresas proveedoras del sector de la automoción deben cumplir con los estándares definidos por el AIAG con relación al APQP. El APQP ('Advanced Product Quality Planning'), es, como su propio nombre indica, una planificación avanzada de la calidad del producto. Se trata de un proceso que sigue una metodología totalmente estructurada, orientada hacia el cumplimiento de los requisitos del cliente sobre el producto final, involucrando para ello en el proceso a proveedores y al cliente final. La estructura del proceso se basa en cinco grandes etapas, que incluyen entradas y salidas en cada una de ellas. Las salidas se generan a partir de una combinación de las entradas, y en ocasiones directamente a partir de otras salidas. La clave reside en que se trata de un ciclo sin fin de mejora continua, donde se busca en todo momento mantener la calidad del producto fabricado por encima de unos mínimos, que corresponden siempre a los requisitos especificados por el cliente. Al ser un ciclo, las salidas de una etapa, son las entradas de la siguiente, y cuando se llega a la última etapa se vuelve a comenzar (de ahí el término de mejora continua). De esta manera, se consigue establecer un proceso estándar y reproducible, mediante el cual se asegura cierto rigor en cuanto a la calidad del producto, que es aplicable a cualquier proceso de producción de cualquier producto (en este caso vehículos), donde lo único que cambia de uno a otro es la particularización de las entradas para cada caso en concreto, siendo los factores los mismos. El APQP se basa en el 'ciclo de Deming', también conocido como 'círculo PDCA' (de sus siglas en inglés, 'plan, do, check, act'). O lo que es lo mismo, "planear, hacer, verificar y actuar". En el caso del APQP, este ciclo se divide en cinco etapas, ya que la fase de "do" se parte en dos. Las etapas son las siguientes: 1) Planificación y definición del programa: se produce la traducción de las necesidades y expectativas del cliente en especificaciones y objetivos de calidad del producto. 2) Diseño y Desarrollo del Producto: se produce una revisión crítica de los requisitos de diseño y de la información técnica del producto. Tiene lugar el desarrollo y verificación del diseño, evaluando los problemas potenciales de éste en relación a la posterior fabricación y su factibilidad. 3) Diseño y Desarrollo del Proceso: se asegura que el proceso será efectivo de cara a cumplir con las necesidades y expectativas del cliente. 4) Validación del Producto y del Proceso: el proceso de fabricación es validado mediante la evaluación de una tirada de producción piloto de prueba. 5) Retroalimentación, Evaluación y Acciones Correctivas: etapa final, en la cual se recoge todo lo analizado y aprendido en las etapas anteriores, y se hace uso de ese conocimiento adquirido para corregir las partes que han dado un resultado negativo y han hecho que el rendimiento del producto no sea el óptimo y el requerido, así como para añadir los detalles y partes que faltan para conseguir un mejor resultado final. Es la etapa más importante y en la que reside el sentido del APQP. El problema es que la implementación y aplicación del APQP es una tarea ardua y muy complejo, que conlleva numerosos retos que deben ser superados y donde las herramientas tradicionales no sirven, ya que su uso para la gestión del APQP provocaría retrasos y bloqueos en el proceso de producción y en el suministro. Sin el uso de una herramienta tradicional que dé soporte al APQP, las empresas proveedoras son incapaces de hacer un buen seguimiento del proceso para así reutilizar y aprovechar datos del producto en el paso de un programa al siguiente. La consecuencia es que los beneficios del APQP se ven reducidos o incluso eliminados. Es en este contexto precisamente donde nace la aplicabilidad, utilidad y practicidad del sistema PLM. PLM ('Product Lifecycle Management') es un enfoque estratégico de negocio para la gestión eficaz y el uso del capital intelectual corporativo (CIC). El CIC es la suma de todo el conocimiento que una organización acumula a lo largo de sus actividades para alcanzar sus objetivos. Esto incluye: la definición del producto, el historial del producto y la experiencia adquirida por la organización respecto al producto. el PLM es una solución informática a nivel empresarial que busca implementar una estrategia de gestión de toda la información que se genera a lo largo de la vida de un producto, también denominada CIC. No obstante, es importante destacar que, en esencia, PLM no es un sistema informático o una tecnología, sino más bien la estrategia que hay detrás, que se apoya en esa tecnología para poder ser aplicada. De manera muy sintetizada, se puede decir que existen dos funciones que son implícitas al PLM: 1) Gestión eficaz del CIC: Garantizar la precisión, integridad y seguridad de toda la información. 2) Uso eficaz del CIC: Hacer que la información esté disponible de forma inmediata en el lugar y formato adecuados, para los usuarios adecuados (ya sean personas o programas), y para las tareas adecuadas. Un sistema PLM se basa en un flujo de información global y común a todos los actores que intervienen en el proceso, de forma que todos puedan interactuar entre ellos en tiempo real y de manera segura y práctica. El pilar de la estructura que hace esto posible es una base de datos en la que cada persona que interviene en el desarrollo del producto puede volcar la información que considere que debe quedar registrada para que otros puedan hacer uso de ella. Esta idea es una de las bases de todo sistema PLM: la reutilización del conocimiento. En esencia, lo que se está consiguiendo a través del uso de un sistema PLM es optimizar el proceso. Esta es la meta que se persigue en todo momento y el objetivo final que subyace en cada acción de PLM: que con menos esfuerzo y menos tiempo invertido se alcancen mejores resultados. En este documento se ha estudiado la aplicabilidad y utilidad de emplear un sistema PLM para la gestión del proceso APQP. Estos son los beneficios principales que se han observado:  Se proporciona un excelente cimiento para cualquier empresa automovilística a través de flujos de trabajo integrados, una base de datos común, accesible y de gran capacidad, la gestión eficaz de proyectos, la creación de informes y de la capacidad de integración con otras herramientas.  Es una solución "todo en uno", que sustituye la necesidad de la coexistencia de varias herramientas.  Se llega a mejores tomas de decisión, al tener visibilidad de las tareas en proceso y de los ítems asociados, por ejemplo, el conocimiento de los múltiples proyectos donde es empleada una misma pieza.  Se puede gestionar el desarrollo de productos complejos para vehículos y de todos los requisitos de documentación asociados a ellos.  Reducir los costes de los cambios de diseño, gracias a detectar antes los cambios necesarios e implementarlos con un efecto más positivo y generando menos coste. También poder comunicar esos cambios a los distintos departamentos y equipos, mejorando así la calidad del producto y, consecuentemente, la satisfacción del cliente.  Aumentar o posibilitar la reutilización del conocimiento a través del acceso rápido y sencillo a proyectos previos APQP.  Se consigue la introducción de nuevos productos en el mercado en el tiempo programado y respetando el presupuesto disponible. Por tanto, se puede concluir que una solución PLM que dé apoyo al proceso APQP y a todos sus requisitos, es una poderosa herramienta de negocio que conlleva numerosos e importantes beneficios, los cuales ya han sido probados en el sector de la automoción. Sin embargo, se debe puntualizar que el PLM no debería de ser el fin en sí. El uso de un sistema PLM suele actuar de catalizador para un cambio en el negocio de manera conceptual y profunda. Para poder aprovechar todo el potencial del PLM y su máximo beneficio, deben revisarse todos los procesos y estructuras de la organización, y aplicar cambios que impulsen la tecnología PLM allí donde se necesiten. Esto hará que se optimicen a nivel global los procesos internos del negocio, así como la forma en la que las empresas automovilísticas se relacionan con sus socios, proveedores y clientes. En el mundo actual y el sector de la automoción, donde el entorno empresarial es cada vez más global, exigente y hostil, la tecnología PLM es el vehículo necesario para crear y mantener un negocio innovador que pueda competir eficazmente en todos sus mercados. ; The automotive industry involves a very demanding market, where the clients possess very high expectations regarding quality and where the supplying companies of vehicles are under big pressures and have to follow strict regulations. During the 1980s, the companies known as "The Big Three", Ford, Chrysler and General Motors (at that moment they shared between them most part of the automotive market share), joined their strengths in the search for a common target, and they nominated an expert committee to face the threat that the increasing expansion of the Japanese industry represented. Moreover, there three companies created the AIAG ('Automotive Industry Action Group'), a nonprofit association made up of a diverse group of professionals and stakeholders of this sector, which includes, for example, suppliers of materials and parts of all sizes, manufacturers, service providers, and sometimes, even the government itself, as well as the automotive companies. This association supports the existence of a collaborative environment within all members, searching for synergies and mutual support so that every party can benefit from this alliance. In the actual context, the supplying companies of the automotive sector must comply with the standards defined by the AIAG with respect to APQP. APQP is, as its names states for itself, a way of anticipating a plan for the product's quality. It consists of a process which follows a highly structured methodology, focused on the compliance of the client's requirements over the final product, involving the suppliers and the final client in this process. The structure of the process is based on five big phases, which include inputs and outputs in each one of them. The outputs are generated by a combination of the inputs, and occasionally directly from other outputs. The key resides on the fact that it is never-ending cycle of continuous improvement, where the target is always to maintain the product's quality over certain minimum level, which always corresponds to the requirements specified by the client. As it is a cycle, the outputs of a phase are the inputs of the next one, and once you fulfill the last phase, you start over again from the beginning (that is why it is said to be a continuous improvement). This way, standard and repeatable procedure is successfully established, through which certain level of rigor is assured in terms of the product's quality, which is applicable to any kind of production process of any kind of product (vehicles in this case), where the only thing that changes from one to another is the group of inputs for that case in particular (the factors remain constant). APQP is based on the Deming cycle, also known as the PDCA circle (Plan, Do, Check, Act). In the case of APQP, this cycle is divided into five phases, since the second phase ("do") is split into two. These are the APQP phases: 1) Program planning and definition: translation of the client's expectations and needs into the product's specifications and objectives. 2) Product design and development: there is a critical revision of the designing requirements and the technical information of the product. The design's verification takes place, evaluating its potential issues towards the future manufacturing and its viability. 3) Process design and development: it is assured that the process will be effective regarding the compliance of the client's needs. 4) Product and process validation: the manufacturing process is validated through the evaluation of a test production run. 5) Feedback, evaluation and corrective action: final phase in which everything that has been analyzed and learnt from the previous phases, and that acquired knowledge is used in order to correct the parts which have performed negatively and which have avoided the performance form being the optimal and expected, as well as to add the details which are missing, so as to achieve a better result. This is the most important phase and on which the purpose of APQP lies. The problem is that APQP's implementation and application are very arduous and complex tasks, which involves multiple challenges which must be overcome and where traditional tools are not enough, since their use for APQP would cause serious delays and even blockades in the production and supplying process. Without the use of a tool which supports APQP, the supplying companies are incapable of satisfactorily monitoring the process, in order to reuse the product's information from one program to the next. The consequence is that the benefits of APQP are seriously reduced or even eliminated. It is in this context precisely in which the PLM system becomes applicable, practical and very useful. PLM ('Product Lifecycle Management') is a strategic approach of the business for the effective management and use of the corporative intellectual capital (CIC). The CIC is the sum of all the knowledge that an organization accumulates throughout its activities in order to reach its targets. This includes: the product's definition, the product's history and best practices. PLM is a technological solution at a business level that tries to implement a management strategy for all the information which is generated throughout the whole product's lifecycle, also called CIC. However, it is important to point out that, essentially, PLM is not a computing system or a technological tool, but the strategy which lies beyond, which finds in that technology the path in order to be applied. In a very summarized way, it can be said that two main functions are implicit to PLM:1) Effective management of CIC: guaranteeing the precision, integrity and safeness of all the information. 2) Effective use of CIC: making the information be readily available, at the right place and format, for the right users, and for the right tasks. A PLM system is based on a global information flow, common to all actors who take part in the process, so that all of them can interact among themselves in real time and in a practical and safe manner. The structure's pillar which makes this possible is a data base into which each person who intervenes in the product's development can enter the information which they consider should be registered so that other can make use of it. This idea is one of the basis of every PLM system: the recycling of knowledge. Essentially, what is being achieved through the use of a PLM system is the optimization the process. This is the goal that is pursued at all time and the final target which lies under every action of PLM: achieving better results with less effort and less time waste. In this document, the applicability and usefulness of implementing a PLM system for the management of the APQP process have been studied. These are the main benefits which have been observed:  An excellent basis is provided towards any automotive company throughout the use of integrated workflows, a common data base, accessible and of great capacity, the effective management of projects, reports creation and the capacity of integration with other tools.  It is an "all in one" solution, which substitutes the need for the coexistence of several tools.  There is better decision making, having better visibility of the tasks in process and the associated items, for instance, the knowledge of the multiple projects in which a same component is being used.  It is possible to manage the development of complex products for vehicles and all of its associated documentation requirements.  Minimizing the costs caused by changes in the design, by detecting earlier the necessary changes and implementing them with a more positive effect. Also being able to communicate those changes to the different departments and teams, improving thus the product's quality and, consequently, the client's satisfaction.  Increasing or making it possible to reuse the knowledge through quick and simple access to previous APQP projects.  The introduction of new products into the market respecting the planned schedule and the available budget. Henceforth, it can be concluded that a PLM solution which supports the APQP process and all its requirements, is a powerful business tool which involves multiple and significant benefits, which have already been proved in the automotive industry. However, it must be remarked that PLM should not be the end itself. The use of a PLM system usually acts as a catalyzer for a change in the business in a conceptual and transcendent way. To be able to make the best use of PLM's potential and its maximum benefit, all of the processes and the organization's structures must be revised, so that the necessary changes to boost PLM technology can be applied. This will optimize the internal business processes, as well as the way in which the automotive companies interact with their partners, their suppliers and their clients. Over the last 20 years, the international community has significantly stepped up its efforts to prevent, detect, and deter money flows related to criminal activities and terrorism financing. Since the early 2000s, this drive has extended to developing countries, with most of them introducing anti-money laundering (AML) policies. The primary driver behind this is law enforcement; these policies are aimed at detecting and tracing flows of ill-gotten money, which would enable authorities to fight and prevent crime and recover assets of crime, corruption, and tax evasion. The core objective of this study is to introduce economics into the international debate about anti-money laundering, and to introduce the idea of the usefulness and effectiveness of such policies. The study focuses on two developing countries: Malawi, a low-income country, and Namibia, a middle-income country. The findings presented in this study are based on an extensive literature research; World Bank discussions with numerous public- and private-sector officials and representatives of the Governments of Malawi and Namibia during a Bank mission in November 2010; and workshops conducted in both countries in February 2011 to obtain feedback on the preliminary findings. In conducting this study, the team adopted an interactive approach. This was critical because mobilization of local expertise is essential not only in establishing a complete picture of current and future AML challenges, but also in designing policy considerations that subsequently are widely supported.

A low-income country, Ethiopia has made impressive progress in improving health outcomes. The Inter-agency Group for Child Mortality Estimation reported that Ethiopia has achieved Millennium Development Goal (MDG) 4, three years ahead of target, with under-5 mortality at 68 per 1,000 live births in 2012. Significant challenges remain, however, with the maternal mortality ratio at 420 out of 100,000 live births. The government has introduced a three-tier public health care delivery system to deliver essential health services and ensure referral linkages, with level three as specialized hospitals (one per 3.5 million 5 million population), level two as general hospitals (one per 1 million 1.5 million), level one as primary hospitals (one per 60,000 100,000) with satellite health centers (one per 15,000 25,000) and health posts (one per 3,000 5,000). One initiative contributing greatly toward universal health coverage (UHC) is the Health Extension Program (HEP) that provides free primary care services at health posts and communities. The country is at its early stage initiating insurance schemes to provide financial protection for its citizens: Social Health Insurance (SHI) for formal sector employees and Community-Based Health Insurance (CBHI) for rural residents and informal sector employees. Public facilities are expected to provide exempted services for free, and there is a fee-waiver system for the poor.

Honduras has experienced moderate economic growth in the past decade, in line with the rest of the region. Despite this growth track record, limited opportunities for decent jobs for the majority of workers have resulted in stagnant poverty and inequality rates that are still the highest in Central America (CA). In parallel, progress in human development indicators has also been mixed in the last decade. In education, while primary enrollment has significantly increased, low coverage at all other levels of education, inequalities in access and low quality persist. In health, Honduras is close to achieving the 2015 child mortality Millennium Development Goals (MDGs), but maternal mortality, non-communicable diseases (NCDs), and violence pose additional challenges. And despite advances in setting up a social protection system, fiscal sustainability and lack of coordination among interventions prevail, undermining poverty reduction efforts. The ability of the Honduras government to expand safety nets, to increase the access and quality of public education and health services, to engage in active labor market policies, and to improve human development indicators in general, remains limited for a number of reasons. First, overall real social public spending has been on the decline in the last few years. Second, low revenues and fiscal deterioration pose challenges to adequately financing needed social sector improvements. Third, challenges in budget formulation and execution (mainly due to institutional factors) also diminish the impact of social spending. But more importantly, Honduras needs to significantly improve the effectiveness and efficiency of its social spending. This note argues that moving forward Honduras should prioritize three main aspects: a) to rationalize and increase the effectiveness of social public spending by enhancing the pro-poor features of targeting mechanisms; b) to significantly redress the imbalance between recurrent spending, especially the wage bill, and capital expenditure; and c) to continue strengthening information systems tools, legislation, and institutions in an effort to consolidate programs into fewer and higher impact interventions.
