In Alderwood Associates v. Washington Environmental Council, the Washington Supreme Court reversed a temporary restraining order forbidding the defendant's solicitation or demonstration on plaintiff's privately owned shopping mall. Although there was no majority opinion because the court split four-one-four, the result of the several opinions is that the Washington constitution now bars private as well as state action that interferes with the gathering of initiative signatures on certain private property. However, four justices also concluded that the free speech sections of the Washington constitution restricts private as well as state action. The Alderwood result is desirable, but could have been reached without an abandonment of the state action requirement. Such an abandonment, although subscribed to by less than a majority, strays from principled constitutional analysis and inhibits further reasoned development of the state constitution.

In 1981 the Washington state legislature enacted the Sentencing Reform Act (SRA) with the intent of reducing disparity in sentencing through the implementation of presumptive sentencing ranges. The SRA authorizes judges to depart from the presumptive range by imposing an exceptional sentence if appropriate mitigating or aggravating factors exist. Since 1981, virtually all courts have determined a factor's appropriateness by considering its relation to the factual nature of the crime itself. In State v. Freitag, however, the Washington Court of Appeals recently held that a trial court may rely on factors which do not directly relate to the nature of the crime as the basis for an exceptional sentence below the standard range. By holding that the trial court may consider a defendant's personal qualities, the stated purposes of the SRA, and the defendant's criminal history, the court has contradicted the intent of the legislature in passing the SRA, ignored Washington case law, and created a dangerous precedent for other courts to follow.

Parental investment theory postulates that where physical condition varies significantly then birth sex ratio will be correlated with social status. Application of this theory to man remains contentious. This study examines physique, wealth, and social status in relation to the sex of live births. It reports a female-biased sex ratio in high social and economic status Nepalese. Close consanguineous marriage, intended to conserve landed wealth within related lineages, and increased female work burdens accompanying larger farm size, are proximate factors which may underlie this finding. A differential payback hypothesis is one way of explaining this pattern.
