This article places in historical perspective the enactment and administration by the federal courts of Section 2255 of the Judicial Code and concludes a prisoner's basic right to attack, collaterally, a conviction is largely unimpaired by this legislation. Section 2255 was enacted not with the idea of enlarging the class of remedies already available to attack a conviction, but rather to provide that a proper attack upon an original conviction be made in the sentencing court and not in some other court through use of the writ of habeas corpus. Resort to habeas corpus is thus allowed only when the remedy by motion is inadequate and ineffective.

"This book provides a multidisciplinary and comparative look at the contemporary phenomenon of conscientious objection or contestation in the name of religion and examines the key issues that emerge in terms of citizenship and democracy. These are analysed by looking at the different ways of challenging or contesting a legal obligation on the grounds of religious beliefs and convictions. The authors focus on the meaning of conscientious objection which asserts the legitimacy of convictions - in particular religious convictions - in determining the personal or collective relevance of the law and of public action. The book begins by examining the main theoretical issues underlying conscientious objection, exploring the implications of the protection of freedom of conscience, the place of religion in the secular public sphere, and the recognition and respect of ethical pluralism in society. El Perú cuenta con un nuevo tratamiento de la capacidad en el Código Civil de 1984, logrando un acercamiento a las directrices de las Naciones Unidas en pro de la autonomía y la plena capacidad jurídica de las personas con discapacidad. Mediante las últimas modificaciones, realizadas por el Decreto Legislativo Nº 1384, se unen varios aspectos inconclusos en torno a los derechos de las personas con discapacidad, sobre la base del respeto a los derechos humanos de todos los ciudadanos, especialmente en cuanto a su dignidad, autonomía e igualdad ante la ley. El modelo social vigente remplaza el régimen de sustitución de la voluntad de las personas incapaces, por uno de asistencia a través de los denominados apoyos y salvaguardias. Toda persona, independientemente de su capacidad, es un sujeto de derecho libre de tomar y responder de sus decisiones personales. ; Peru has a new capacity treatment in the Civil Code of 1984, achieving an approach to the guidelines of the United Nations in favor of the autonomy and full legal capacity of persons with disabilities. Through the latest modifications made by Legislative Decree N. 1384, several unfinished aspects are linked to the rights of persons with disabilities based on respect for the human rights of all citizens, especially in terms of their dignity, autonomy and equality before the law. The current social model replaces the regime of substitution of the will of the incapable by one of assistance through the so-called supports and safeguards. Every person, regardless of their capacity, is a subject of free right to take and respond to their personal decisions. ; O Peru conta com um novo tratamento da capacidade no Código Cicil de 1984, alcançando acercar-se das diretrizes das Nações Unidas em prol da autonomia e da plena capacidade jurídica das pessoas com incapacidade. The debate over the compatibility of EU competition enforcement with Article 6 ECHR is far from over. Whilst there has been a great - some would say excessive - deal of papers on due process issues, less, if none attention has been paid to the rules and remedies that govern conflicts of interests amongst lawyers, civil servants, legal secretaries and Members of the Court. This short paper seeks to open the discussion on this issue. ; Le débat sur la compatibilité du système institutionnel et processuel d'application du droit européen de la concurrence avec la CEDH n'est pas clos. Assurément, les articles sur le sujet ont proliféré en doctrine contemporaine, spécialement sur la question du procès équitable. En revanche, la doctrine s'est peu intéressée à la question du régime juridique entourant les conflits d'intérêts entre avocats, fonctionnaires de la Commission, Référendaires et Membres de la Cour.
