Liberal and Illiberal Immigration Policy: A Comparison of Early British (1905) and US (1924) Legislation

Examines the formation of early restrictive immigration legislation & the construction of liberalism in the US & GB. Analysis reveals two illiberal factors behind the passage of the US Johnson-Reed Act (1924): the advocacy of eugenicist arguments in the House Committee on Immigration & the political lobbying of restrictionists, who utilized discriminatory cultural assimilation assumptions from the Dillingham Commission's investigation of immigration. Immigration legislation in GB was based on the Royal Commission's investigation & recommendations, which did not discriminate against country of origin. The enactment of the complex British Aliens Act (1905) was controversial, & the discourse of opponents of restriction, claiming the basic right to asylum, played a key role in the propagation of liberal immigration ideologies in GB. The US law created an immigration policy regime based explicitly on discriminatory categories while the British law adopted the imperialistic rhetoric admonishing country-of-origin inequalities. The author feels that historically the US has been the more immigrant-friendly country, making this liberal paradox intriguing. 47 References. L. Collins
