"Comparative law and the history of law are traditionally devoted to expanding the context of legal rules and legal institutions. Comparison involves history, as the well-known motto proclaims, but history also involves comparison. Both disciplines are in fact interested in deepening the space-time coordinates of law as a social phenomenon, which means that they take up a critical approach to their object of study.
In recent years, this trait is increasingly coming into conflict with the tendency to present law as a mere technocratic instrument for organizing societies. As a result of the »end of history« discourse, the Western economic and political order has become a definitive point of reference worldwide, with law scholars charged with identifying best practices to enhance their efficiency.
A group of comparative lawyers and legal historians critically discuss this assumption from a theoretical point of view as well as from the perspective of their respective fields of research. The result is a multifaceted range of ideas on the significance and possible future of two disciplines that share, in addition to their traditional approach, a crisis of identity."

Le politiche monetarie non possono supplire alla mancanza di politiche fiscali, impedite dall'impostazione monetarista decisa dal livello europeo. La Banca centrale europea non ha grandi margini di manovra. Il suo statuto le affida il compito di tenere i prezzi sotto controllo e dunque di occuparsi di inflazione e di deflazione, mentre nulla dice a proposito di lavoro: diversamente dalla Federal Reserve, la Banca centrale statunitense, non deve, o meglio non può, perseguire l'obbiettivo della piena occupazione. Il Governatore Draghi ama ripeterlo ai governi nazionali e alle istituzioni europee, a cui ricorda spesso e volentieri che la BCE non si può sottrarre dallo svolgere il suo ruolo in ambito monetario, ma chiedendo al contempo a chi ha il controllo della politica fiscale di svolgere il suo.

L'Europa è oggi in una gabbia perché intrappolata dall'Euro per la cui sostenibilità si impongono cure a base di fanatismo ordoliberale. Il rifiuto di negoziare superando le politiche di austerità può essere interpretata come la prova che esiste un connubio quasi inscindibile tra la moneta unica e l'austerità fiscale; questo è ciò che peraltro è stato dichiarato dai sostenitori delle politiche tedesche più oltranziste. Qualora alle presenti condizioni si passasse da una unione monetaria ad una unione fiscale come viene auspicato da coloro che domandano oggi "più Europa" come soluzione della crisi dell'Eurozona, il rischio è che tutto ciò venga istituzionalizzato, con ulteriori cessioni di sovranità alle attuali istituzioni europee che risulteranno rafforzate senza peraltro un effettivo controllo democratico.

"It is a matter of grave concern that the explanation of the 2007-8 financial markets crash which continues to exert the largest political influence upon the attempts being made to reform the financial system is based on the concept of deregulation. The crash was a disaster the groundwork for which was laid by the highly aggressive and utterly incompetent government restructuring of the financial sector called in the UK the 'Big Bang'.
