This volume discusses the impact of human rights law on other fields of international law. Does international human rights law modify other fields of international law? Contributions focus on possible spillover effects of human rights on international economic or international criminal law. Does international human rights law have a streamlining effect on international law as a whole? This might be identified as a process of constitutionalisation. In this book, human rights can be understood as one of the core principles of international legal order and thus have an effect on the general law of treaties or on the settlement of disputes. Although human rights law is a relatively young field of international law, its content and core values today are of major importance for the interpretation of international law as a whole. As we witness a redefinition of sovereignty as a responsibility of states towards the people and a shift to greater relevance of the individual in international law in general, it is a logical consequence that human rights have an impact on other areas of international law

Die Diskrepanz zwischen Recht und Rechtswirklichkeit ist ein Merkmal nicht nur, aber insbesondere von Entwicklungsländern. Katrin Merhof analysiert diese Diskrepanz anhand des Beispiels des kolumbianischen Arbeitsrechts und dessen Umsetzung in der Blumenindustrie. Sie setzt sich mit der tatsächlichen Situation von Gewerkschaften und Leiharbeitern auseinander, betrachtet Lohnsituation, Arbeitszeiten und Gesundheitsschutz und behandelt insbesondere die Lage der Arbeitnehmerinnen. Bestehen Schutzlücken, stellt die Autorin dar, inwieweit diese auf die Rechtslage oder ein Umsetzungsdefizit zurückgeführt werden können. Dabei nimmt sie auch die Rolle relevanter völkerrechtlicher Verträge, verfassungsrechtlicher Vorgaben und der Rechtsprechung des Verfassungsgerichts im Bereich sozialer Rechte in den Blick. Außerdem zeichnet sie nach, welche nationalen und internationalen Akteure die Ausgestaltung des Rechts und damit auch die Situation der Arbeitnehmer in der Blumenindustrie beeinflusst haben.

The corporate governance structures of firms differ among countries for cultural, political or social reasons, among others, which may affect the environmental reporting policies of firms. In this regard, institutional contexts where firms are domiciled vary among regions, and consequently environmental reporting policies of firms will depend on the institutional factors where companies operate. The aim of this paper is to examine how institutional features such as investor protection, ownership dispersion and market‐oriented financial systems impact on environmental reporting policies of firms in different countries. The sample is composed of 5293 international companies, whose information was obtained from the Thomson Reuters Eikon database for the year 2015. The theoretical framework is based on institutional and stakeholder theories. Institutional theory argues that companies localized in the same institutional setting tend to behave in similar ways, and therefore the stakeholders' attitudes toward environmental reporting will be similar. The findings report that companies operating in countries with high ownership dispersion and where the most important capital providers are capital markets are most likely to disclose environmental issues, while firms domiciled in countries with strong investor protection are not associated with environmental disclosure policies.
