The article is devoted to a topical issue around the world. Renewable energy sources, methods and features of protection of investors in green energy. As $ 10 billion has already been invested in Ukraine's green energy in 2019, and the state accumulates debt and does not provide guaranteed benefits to investors, so in this article we considered the main trends and ways to protect investors in green energy that currently exist in Ukraine. Most of the money invested was made by foreign investors, and not the return of the benefits promised to Ukraine, foreign investors may cause international strife. Also, Ukraine is experiencing economic stagnation due to the corona virus, so green energy is without a doubt the best way out of the situation to attract foreign investors. However, non-compliance with the international agreement may lead to a greater crisis than now, from which the Ukrainian economy will be very difficult to get out. Violation of an international agreement may lead to the reluctance of other countries to cooperate with Ukraine in any further field. The article noted and analyzed the changes that took place in the legislation during 2020 (innovations in the law on "green" tariff, the signing of the memorandum). Here is a list of conditions under which the "Guaranteed Buyer" was obliged to provide benefits to investors in renewable green energy. The reasons for which the "Guaranteed Buyer" does not fulfill its obligations and the statistics on the debt as of May 2021 of the state to investors are given. The issue of foreign investors in Ukraine's green energy was also considered. Their position is analyzed and possible problems with the investing countries are identified. Legislation in this area of energy cooperatives in Ukraine needs to be improved. In addition to economic legislation, municipal legislation needs to be improved, as local communities and local authorities play an important role in activating the creation of energy cooperatives. Energy cooperatives enable communities to meet their energy needs, use local fuels, become energy independent and be active members of the energy market. ; Статтю присвячено актуальній темі в усьому світі – відновлювальні джерела енергії, способи та особливості захисту інвесторів у зелену енергетику. Оскільки вже на 2019 рік у зелену енергетику України було вкладено $ 10 млрд, а держава накопичує борг та не надає гарантованих благ інвесторам, то у статті ми розглянули основні тенденції та способи захисту інвесторів в зелену енергетику, що є нині в Україні. Більшість інвестованих коштів було вкладено іноземними інвесторами, а не повернення обіцяних Україною благ іноземним інвесторам може спричинити міжнародні міжусобиці. Також Україна потерпає від економічної стагнації через коронавірус, тому зелена енергетика – це, без сумніву, найліпший вихід із ситуації для залучення іноземних інвесторів. Проте недотримання міжнародного договору може призвести до більшої кризи, аніж зараз, з якої українській економіці буде дуже важко виходити. Порушення міжнародної угоди може привести до небажання інших країн співпрацювати з Україною в будь-якій сфері надалі. У статті було зазначено та проаналізовано зміни, які відбувалися в законодавстві протягом 2020 року (нововведення у закон про «зелений» тариф, підписання меморандуму). Наведено перелік умов, за якими «Гарантований покупець» мав зобов'язання у наданні благ інвесторам відновлювальної зеленої енергетики. Наведено причини, за яких «Гарантований покупець» не виконує своїх зобов'язань, і зазначено статистичні дані щодо боргу держави перед інвесторами на момент травня 2021 року. Також було розглянуто питання, щодо іноземних інвесторів у зелену енергетику України. Проаналізовано їхню позицію та визначено можливі проблеми з країнами, що інвестували. Необхідне вдосконалення законодавства в цій галузі енергетичних кооперативів в Україні. Окрім економічного законодавства, мусить бути вдосконалено муніципальне законодавство, оскільки територіальні громади та місцеві органи влади відіграють важливу роль у активації створення енергетичних кооперативів. Енергетичні кооперативи дають можливість громадам задовольняти свої енергетичні потреби, використовувати місцеві види палива, ставати енергетично незалежними та бути активними членами енергетичного ринку.

Klopova I. H. Development stages of agricultural organic products' standardization and certificationin the European Union member-states. – Article.This article is devoted to the distinguishing and study of the stages of standardization and certificationof organic agricultural products in the EU member states. Within the study, based on the analysis ofexisting development trends, we have identified three stages:1) self-regulation of the market of organic goods;2) development and consolidation of national standards for organic products at the public and privatelevels;3) measures aimed at developing uniform standards within the EU with further harmonization ofnational legislation with the relevant standards.Also within each stage, we analyzed the relevant standards, traced their evolution and correlation.It is emphasized that the first stage is characterized by the presence of separate standards developed byfarmers or their associations. It is noted that at the first stage these standards were characterized by theirvoluntariness. Also, within the first stage, the gradual transition of farmers' associations into the form ofumbrella organizations was singled out. The second stage examines the sequence of consolidation of organicstandards in prospective EU member states and traces the impact of national and private regulation on theformation of legal regulation of standardization and certification of organic agricultural products at theEU level. It is noted that the third (modern) stage is characterized by the emergence of universal standardswithin the EU and the unification of law through the adoption of relevant regulations. The main acts atthe EU level, adopted within the third stage, are considered, their evolution is traced, and it is noted thatthe current stage of standardization and certification of organic agricultural products at the EU levelis not completed nowadays. The approved legal regulation of this area is constantly changing under theinfluence of external factors. The article notes that along with legal regulation at the EU level, organicstandards developed by private organizations remain in force, supplementing the standards enshrined inthe regulations without contradicting them. ; Кльопова І. Етапи становлення стандартизації та сертифікації сільськогосподарськоїорганічної продукції в державах – членах Європейського Союзу. – Стаття.Стаття присвячена виокремленню та дослідженню етапів становлення стандартизації та сертифі-кації органічної сільськогосподарської продукції в державах – членах ЄС. У межах дослідження наоснові аналізу існуючих тенденцій розвитку нами було виокремлено три етапи:1) саморегулювання ринку органічних товарів;2) розробка й закріплення національних стандартів щодо органічної продукції на державномуй приватному рівнях;3) заходи, спрямовані на вироблення єдиних стандартів у межах ЄС із подальшою гармонізацієюнаціональних законодавств із відповідними стандартами.У межах кожного етапу нами були проаналізовані відповідні стандарти, прослідковано їх еволю-цію та співвідношення. Наголошено, що перший етап характеризується наявністю окремих стандар-тів, розроблених фермерами та їх асоціаціями. Відзначено, що на першому етапі зазначені стандартихарактеризувалися своєю добровільністю. Також у межах першого етапу виокремлено поступовийперехід фермерських асоціацій у форму парасолькових організацій. У межах другого етапу розгля-нуто послідовність закріплення органічних стандартів у майбутніх державах – членах ЄС і прослід-ковано вплив налаштування на національному й приватному рівнях на формування правового регу-лювання стандартизації та сертифікації органічної сільськогосподарської продукції на рівні ЄС.Зазначено, що третій (сучасний) етап характеризується появою універсальних стандартів у межах ЄСта уніфікацією права шляхом прийняття відповідних регламентів. Розглянуто основні акти на рівніЄС, що були прийняті в межах третього етапу, прослідковано їх еволюцію та зазначено, що сучаснийетап становлення стандартизації та сертифікації органічної сільськогосподарської продукції на рівніЄС натепер не завершений. Ухвалене правове регулювання зазначеної сфери постійно змінюється підвпливом зовнішніх чинників. У статті відзначено, що поряд із правовим регулюванням на рівні ЄСчинними залишаються органічні стандарти, розроблені приватними організаціями, що доповнюютьстандарти, закріплені в регламентах, не суперечачи їм.Ключові слова: органічна сільськогосподарська продукція, регламент ЄС, стандартизація, серти-фікація, парасолькова організація.

Khort Iu. V. Regulation of cloud technologies in the financial sector of Ukraine. – Article.Currently, rapid development of cloud technologies usage in all areas, including the financial sector,can be noticed. However, in scholarly literature, the problems of legal regulation of cloud technologiesin the financial sector of Ukraine have not been reflected. This article examines the benefits and risksof using cloud technologies in the financial sector; conducts an analysis of the state and approaches totheir regulation both in Ukraine and abroad and gives a range of recommendations for building a model oflegislative regulation of cloud technologies in the financial sector of Ukraine. This article argues that thebenefits of using cloud technologies in the financial sector far outweigh the risks of using them. An analysisof Ukrainian legislation has shown that the lawmaker has declared the need to develop cloud technologies.However, the Draft of Law of Ukraine "On Cloud Services" has a number of shortcomings and requiresimprovement. The author suggests that the model of the legislative regulation of cloud services in Ukraineshould be based on an integrated approach, which involves the simultaneous development of both generallegislation defining the basic principles of cloud services regulation and special legislation defining thespecifics of these services in certain areas, in particular, in the financial sector. This study recommends forthe Ukrainian legislator to follow the practice of countries with developed financial markets and envisagethe possibility of outsourcing of functions to the cloud service providers for all types of financial (bothbanking and non-banking) institutions and application of the proportionate regulatory approach (mainlyaiming to outsource of critical or important functions). The author also suggests developing in Ukraine amodel contract for the provision of cloud services to the financial institutions and standards for auditingand effective supervisory practices exercised by competent authorities. Mitigation of country risk andespecially providing data confidentiality and information security in the financial sector of Ukraine bycloud service providers deserve particular attention. ; Хорт Ю. Регулювання хмарних технологій у фінансовому секторі України. – Стаття.Натепер у всьому світі відбувається стрімкий розвиток використання хмарних технологій у всіхсферах, включаючи фінансовий сектор. Однак у науковій літературі проблеми правового регулюванняхмарних технологій у фінансовому секторі України не отримали належного висвітлення. Стаття при-свячена аналізу переваг і ризиків щодо використання хмарних технологій у фінансовому секторі;дослідженню стану й підходів до їх регулювання як в Україні, так і за кордоном; наданню відповіднихрекомендацій щодо побудови моделі законодавчого регулювання хмарних технологій у фінансовомусекторі України. У статті доводиться, що вигоди від використання хмарних технологій у фінансовомусекторі значно більші в порівнянні з ризиками від їх використання. Аналіз українського законодав-ства показав, що законодавець задекларував необхідність розвитку хмарних технологій. Однак зако-нопроєкт України «Про хмарні послуги» містить низку недоліків і підлягає удосконаленню. Авторкапропонує застосовувати комплексний підхід моделі законодавчого регулювання хмарних послугв Україні, який передбачає одночасну розробку як загального законодавства, що визначає основнізасади регулювання хмарних послуг, так і спеціального законодавства, що визначає особливостінадання цих послуг у певних сферах, зокрема у фінансовому секторі. Рекомендується українськомузаконодавцеві слідувати практиці країн із розвиненими фінансовими ринками й законодавчо закрі-пити, що регулювання передачі функцій на аутсорсинг надавачам хмарних послуг має здійснюватисящодо всіх типів фінансових установ (як банківських, так і небанківських) і мати пропорційний харак-тер (має бути, головним чином, спрямоване на аутсорсинг критичних або важливих функцій). Пропо-нується розробити в Україні модельний договір про надання хмарних послуг фінансовим установамі стандарти проведення аудиту й здійснення ефективного нагляду компетентними органами. Увага маєприділятися врегулюванню ризику країни й особливо забезпеченню конфіденційності даних та інфор-маційної безпеки у фінансовому секторі України надавачами хмарних послуг.Ключові слова: надавач хмарних послуг, хмарна послуга, хмарні обчислення, фінансова установа,фінтех.

Introduction. The article examines the problems of institutional provision for innovative development of the infocommunications as a component of the sphere of digitalization of Ukraine. The subjects have been singled out and the shortcomings in relation to the institutional provision of the innovative development of the country's infocommunication sphere have been identified. Determining the leading role of the infocommunication sphere in the process of formation and development of innovation infrastructure of the national economy, and on the basis of research of organizational, economic, innovative and legal bases of regulatory activity of the system of state and non-state institutions proposals are made to improve institutional development of infocommunication sphere. Aim and tasks. The purpose of the article is to study the features and problems of institutional provision for innovative development of the infocommunications as a component of the sphere of digitalization of Ukraine and provide suggestions on ways to improve it. Result. An analysis of basic legal acts aimed at regulating scientific, technical and innovative activities of Ukraine is provided. The characteristic features of economic activity in the infocommunication sphere are highlighted and the factors that hinder the innovative development of the digitalization of Ukraine are formed. It is shown that the institutional provision of innovation in Ukraine is represented by an extensive structure, as government regulation should provide solutions to existing problems in the economy and concentrate available resources for the effective implementation of research and innovation. Conceptual bases of creation of innovation and investment hubs in the country are formed, principles of their formation are allocated, among which basic are - concentration, common interests and interaction, and models of their financial and infectious maintenance. Conclusions. Based on the study, the authors proposed in the process of regulating the innovative development of the infocommunication sphere to apply a systematic approach with the definition of methods and mechanisms of state regulation, which should be formed and enshrined in law. The consequence of consistent state provision of the innovation and institutional environment will be the creation of favorable conditions for doing business in the country and the development of creative human potential. ; Вступ. У статті досліджено проблеми інституціонального забезпечення інноваційного розвитку інфокомунікацій як складової сфери діджиталізації України. Виокремлено суб'єкти та визначено недоліки щодо інституціонального забезпечення інноваційного розвитку інфокомунікаційної сфери країни. Визначаючи провідну роль інфокомунікаційної сфери у процесі становлення та ровитку інноваційної інфраструктури національної економіки, та на основі дослідження організаційних, економічних, інноваційних та правових засад регуляторної діяльності системи державних та недержавних інституцій сформовано пропозиції щодо удосконалення інституціонального забезпечення інноваційного розвитку інфокомунікаційної сфери. Мета і завдання. Метою статті є дослідження особливостей і проблем інституціонального забезпечення інноваційного розвитку інфокомунікацій як складової сфери діджиталізації України та надання пропозицій про способи його вдосконалення. Результати. Надано аналіз базових нормативно-правових актів, які спрямовані на регулювання науково-технічної та інноваційної діяльності Україні. Виділено характерні риси економічної діяльності в інфокомунікаційній сфері та сформовано чинники, які заважають інноваціному розвитку діджиталізації в України. Показано, що інституціональне забезпечення інноваційної діяльності в Україні представлено розгалуженою структурою, оскільки державне регулювання повинно забезпечувати вирішення існуючих проблем в економіці та концентрувати наявні ресурси задля ефективної реалізації робіт з наукових досліджень та інноваційних розробок. Сформовано концептуальні основи створення в країні інноваційно-інвестиційних хабів, виділено принципи їх формування, серед яких базовими є - концентрація, спільні інтереси та взаємодія, та моделі їх фінансово-інфестиційного забезпечення. Висновки. На основі проведеного дослідження авторами запропоновано у процесі регулювання нноваційного розвитку інфокомунікаційної сфери застосовувати системний підхід з визначенням методів та механізмів державного регулювання, які мають бути сформовані та законодавчо закріплені. Наслідком послідовної державної підтримки інноваційно-інституційного середовища стане створення сприятливих умов для ведення бізнес у країні та розвитку креативного людського потенціалу.

The media upholds democracy and rights of mass people in the contemporary globe, and it is regarded as the fourth estate of a state. It is known to all that freedom of press is a fundamental right of citizens in a democracy. This fundamental right is being questioned by world governments bearing manifold interpretation in the related laws and systems along with different kinds of insecurity issues like killing, force disappearance, attacking or being threatened. Mass-media systems of the world vary from one another according to the economy, polity, religion, and culture of different societies. Journalism and freedom of speech has been an important part of a democratic society from the very beginning of modern history. Violence, threats, and insecurity against journalists all over the world have been increasing steadily. Additionally, fear of losing jobs, political pressure and harassment by the state-authority or political leaders, providing anti-public law and self-censorship are suffocating media freedoms every now and then. A good number of researches have been done; and published literature on the subject matter is also ample. But there are very few on the issue of media-control and journalist insecurity in Bangladesh. This research is an attempt to explore the journalists' insecurity issues and overt/covered control mechanisms by the state that has been practiced over the mainstream news media in Bangladesh in different times. The study mostly focused on the socio-political environment of journalists' insecurity and state-sponsored media-control mechanisms in Bangladesh. There were possibilities to work with other countries, but the area has been chosen based on Bangladeshi Media to add something new to that gap. ; Os meios de comunicação social defendem a democracia e os direitos das pessoas de massas no mundo contemporâneo, e é considerado como o quarto estado. Todos sabem que a liberdade de imprensa é um direito fundamental dos cidadãos numa democracia. Este direito fundamental está a ser questionado por governos mundiais com múltiplas interpretações nas leis e sistemas relacionados, juntamente com diferentes tipos de questões de insegurança como matar, forçar o desaparecimento, atacar ou ser ameaçado. Os sistemas de mass-media do mundo variam uns dos outros de acordo com a economia, política, religião e cultura de diferentes sociedades. O jornalismo e a liberdade de expressão têm sido uma parte importante de uma sociedade democrática desde o início da história moderna. A violência, as ameaças e a insegurança contra os jornalistas em todo o mundo têm vindo a aumentar constantemente. Além disso, o medo de perder empregos, a pressão política e o assédio por parte da autoridade do Estado ou dos líderes políticos, proporcionando leis anti-públicas e auto-censura, sufocam de vez em quando as liberdades dos meios de comunicação social. Um bom número de pesquisas tem sido feito; e a literatura publicada sobre o assunto também é ampla. Mas há muito poucos sobre a questão do controlo dos media e da insegurança dos jornalistas no Bangladesh. Esta investigação é uma tentativa de explorar as questões de insegurança dos jornalistas e os mecanismos de controlo aberto/coberto pelo Estado que tem sido praticado sobre os principais meios de comunicação social no Bangladesh em diferentes épocas. O estudo centrou-se principalmente no ambiente sócio-político da insegurança dos jornalistas e nos mecanismos de controlo dos meios de comunicação social patrocinados pelo Estado no Bangladesh. Havia possibilidades de trabalhar com outros países, mas a área foi escolhida com base nos meios de comunicação social do Bangladesh para acrescentar algo de novo a essa lacuna.

This research articles studies with a qualitative methodology the ecological constitucionalism in Latin America. The land is not silent and the Constitutions must give it a voice: this is the great challenge of Andean ecological constitutionalism, characterized by an original process of innovation and experimentation, found particularly in Ecuador and Bolivia, which marks the genesis of a paradigm of environmental protection alternative to the Western one, and which emblematically outlines the passage from an anthropocentric legal vision to a seductive biocentric approach. The constitutional recognition of legal personality to nature shifts the centre of gravity from environmental fears to the issue of rights themselves, and contributes to the construction of a renewed legal order that can, and must, contemplate the hypothesis of returning the soul taken from the non-human. Now, recognizing rights to entities hitherto excluded from juridical thought, allows for a radical and stimulating revision of the idea of nature and also suggests new ways of relating to Mother Earth which, far from mortifying her vital cycles, structure, functions and evolutionary dynamics, exalt the opportunity to sediment Buen Vivir's ethical practices, which, moreover, are stimulating to promote equity, social justice and pluralism. A vision that, dismantling the obsolete assumptions of progress and the one-dimensional understanding of development and economic growth, draws possible scenarios of coexistence in which diversity is the rule, and not the exception. Latin America opens new doors, providing new keys, and assuming the creation of a global ecological rule of law, capable of shifting the objectives of sustainable development towards a more holistic dimension, capable of facing challenges, and why not, future risks as well. ; El presente artículo de investigación analiza mediante una metodología cualitativa el constitucionalismo ecológico latinoamericano. La tierra no calla y las constituciones deben permitirle hablar: este es el gran desafío del constitucionalismo ecológico andino, caracterizado por un original proceso de innovación y experimentación, típico sobre todo de Ecuador y Bolivia, y que marca el surgimiento de un paradigma de protección ambiental alternativo a aquel occidental que traza emblemáticamente el pasaje de una visión jurídica antropocéntrica a una cautivadora aproximación biocéntrica. El reconocimiento constitucional de la personalidad jurídica de la naturaleza desplaza el interés de las preocupaciones ambientales al tema de los mismos derechos, y contribuye a la construcción de un renovado orden jurídico que puede —y debe— preveer la posibilidad de devolver el alma quitada a lo no humano. Ahora bien, reconocer derechos a entidades hasta ahora excluidas del pensamiento jurídico permite modificar de forma radical y estimulante la idea de naturaleza, y sugerir inéditasmodalidades de relación con la Madre Tierra, las cuales, lejos de variar sus ciclos vitales, estructura, funciones y dinámicas evolutivas, exaltan la oportunidad de sedimentar prácticas éticas de "Buen Vivir", y también promocionan equidad, justicia social, pluralismo y democratización. Además de desarmar las obsoletas premisas del progreso y de la comprensión unidimensional del desarrollo y del crecimiento ecónomico, esta visión traza posibles escenarios de convivencia en los que la diversidad ya no es la excepción, sino la regla. América Latina abre nuevas puertas, proporciona nuevas claves y supone la creación de un Estado de derecho ecológico global capaz de desplazar los objetivos del desarrollo sostenible hacia una dimensión más holística, que sabe afrontar los desafíos, así como eventuales riesgos futuros.

Stephanie and Laura are two girls who find themselves in the uniquenessof a mode of existence that does not always have space in everyday life and schools. Tinho is sensitive enough to perceiving Stephanie's needs as intrinsic to any child's. Thus, a silent and complicit friendship is born between them. Laura recognizes―in her family and at the heart of the politics of the country in which she was born―that all lives matter. Every effort is therefore valid to run a school that caters for a single child.Based on the methodology for analyzing the creation of images from the Brazilian short Carreto and the Cuban short Una niña, una escuela, the article highlights the respectful way in which the directors build the relationship of children with special educational needs and their surroundings. The result of this analysis made it possible to share, inthe context of Law 13.006/2014, creative exercises based on these two films. The exercises proposed by the article, inspired by the methodology of creation pedagogy, can be developed with children, and aim to highlight Brazilian and Latin American childhoods, as well as to enhance the inventive relationship with the audiovisual material. ; Stephanie y Laura son dos chicas que se encuentran en la singularidad de una forma de existencia que no siempre tiene un lugar en la vida cotidiana y en las escuelas. Tinho es sensible a percibir las necesidades de Stephanie como intrínsecas a las de cualquier niño. Así, una amistad silenciosa y cómplice nace entre ellos. Laura tiene en su familia y en el corazón de las políticas del país donde nació el reconocimiento de que todas las vidas importan. Por lo tanto, todo esfuerzo es válido para operar una escuela que atiende a un solo niño. A partir de la metodología de análisis de la creación de imágenes de los cortos Carreto (brasileño) y Una niña una escuela (cubano), el artículo destaca la forma respetuosaen que los directores construyen la relación de los niños con necesidades educativas especiales y su entorno. El resultado de este análisis permitió compartir, en el contexto de la Ley 13.006 / 2014, ejercicios creativos, basados en estas dos películas. Los ejercicios que propone el artículo, inspirados en la metodología de la pedagogía de la creación, puedenser desarrollados con niños, y tienen como objetivo resaltar la infancia brasileña y latinoamericana y potenciar la relación inventiva con el audiovisual. ; Stephanie e Laura são duas meninas que se encontram na singularidade de um modo de existência que nem sempre tem espaço no cotidiano da vida e das escolas. Tinho é sensível em perceber as necessidades de Stephanie como intrínsecas à de qualquer criança. Assim, nasce entre eles uma silenciosa e cúmplice amizade. Laura tem em sua família e no coração das políticas do país onde nasceu o reconhecimento de que todas as vidas importam. Todo esforço é válido, portanto, para fazer funcionar uma escola que atenda a uma única criança. A partir da metodologia de análise da criação das imagens dos curtas brasileiro, Carreto, e cubano, Una niña una escuela, o artigo destaca o modo respeitoso com que os diretores constroem a relação das crianças com necessidades educacionais especiais e seu entorno. O resultado dessa análise permitiu compartilhar, no contexto da Lei 13.006/2014, exercícios de criação, a partir desses dois filmes. Os exercícios que o artigo propõe, inspirados na metodologia da pedagogia da criação, podem ser desenvolvidos com crianças, e tem o objetivo de destacar as infâncias brasileiras e latino-americanas e potencializar a relação inventiva com o audiovisual.

ABSTRAKPasal 19 ayat (2) huruf c UUPA menguraikan bahwa pendaftaran tanah diakhiri dengan pemberian surat-surat tanda bukti hak, yang berlaku sebagai alat pembuktian yang kuat. Pada UUPA menekankan bahwa pembuktian kepemilikan tanah haruslah dibuktikan dengan mencantumkan sertipikat sebagai dasar hukum tertinggi atas kepemilikan sebidang tanah tersebut. Tetapi, di dalam kehidupan sehari-hari dalam prakteknya masih sering ditemukan tanah yang menurut legalitas hukum belum memadai/belum kuat secara hukum yang menurut UUPA tanah yang sah adalah tanah sudah bersertipikat tetapi dalam penerapannya masih banyak bukti pemilikan berbentuk Surat Kepemilikan Tanah yang selanjutnya disebut SKT. Tujuan penelitian ini adalah untuk menganalisis dan menjelaskan kekuatan hukum SKT sebagai bukti kepemilikan sebidang tanah serta menguraikan permasalahan hukum sewa-menyewa tanah yang hanya menggunakan SKT hingga dari sewa-menyewa tanah yang dilakukan tersebut diterbitkannya sertipikat, serta mengetahui bagaimana upaya penyelesaian baik dari segi yang menyewakan maupun penyewa tanah tersebut yang dilakukan di Desa Tanjung Jaya Kecamatan Sungkai Barat Kabupaten Lampung Utara sudah sesuai dengan hukum yang ada. Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif analitis, berupa perundang-undangan maupun hasil wawancara dengan pihak-pihak terkait. Kekuatan SKT berdasarkan UUPA dan PP No. 24 Tahun 1997 Tentang Pendaftaran Tanah merupakan salah satu alat bukti tertulis yang dapat dijadikan bukti alas hak untuk penerbitan sertipikat. Walaupun terdapat perbedaan penyebutan di masing-masing daerah terkait dengan SKT ini, hal ini bukanlah menjadi permasalahan. Karena yang ditekankan adalah alas bukti hak itu sendiri sebagai bukti salah satu alas hak yang nantinya akan dijadikan sebagai dasar pembuatan sertipikat.Kata kunci: kekuatan surat kepemilikan tanah; pendaftaran tanah; perjanjian sewa-menyewa tanah. ABSTRACTArticle Number 19 Paragraph (2) Letter c in Law Number 5 Year 1960 concerning about Basic Regulations on Agrarian Principles explains that land registration is ended by granting of proof of rights, which act as strong proofs. It is regulated further in PP Number 24 Year 1997 About Land Registration Article Number 4 paragraph (1) juncto Article Number 3 Letter which determines that to provide legal certainty and protection to holders of a unit of land, flat, and other registered rights so that they can easily prove themselves as the holders of the relevant rights, they are given the rights of the land. The purposes of this research are to analyze and explain the legal power of Land Ownership Letter (SKT) as a proof of land ownership and describe the legal issues of land leases which use Land Ownership Letter (SKT) only until the certificate issuance, and to know the legal protection for both renters and rentees of land which are carried out in Tanjung Jaya Village, Sungkai District, North Lampung Regency, in accordance to the existing laws. Research method used in this research is normative juridical approach with research specifications in the form of descriptive analysis using data of legislation and interview results with related parties. The position of SKT based on UUPA and PP Number 24 Year 1997 About Land Registration is as one of the written evidences which can be used as basic evidence for the certificate issuance. The effort to resolve cases of double-stranded SKTs can be pursued by several court-filing mechanisms. AbstractInternational Law, specifically UNCLOS 1982, MARPOL 73/78, and SOLAS 1974 give mandates to every State to carry out protection and prevention of marine pollution. As one form of protection and prevention pollution is establishing a Particularly Sensitive Sea Area (PSSA). Since 2016, the Indonesian Government has submitted a proposal to designate the Lombok Strait as one of the PSSA. This study aims to analyze and provide an understanding of the prospects for the establishment of PSSA in the Lombok Strait including the Gili Islands and Nusa Penida Island after the approval of the Traffic Separation Scheme (TSS) in 2019 based on International Law.This study uses a juridical-normative approach with descriptive analytical research to describe and analyze the international legal instruments used. The research data were obtained from the results of library research and interviews with related institutions such as the Ministry of Foreign Affairs and the Ministry of Transportation of the Republic of Indonesia. Data processing conducted by qualitative analysis methods. This study concludes that the specific PSSA arrangements are governed by the IMO Resolution A.982 (24) related to the PSSA Guidelines as PSSA is not explicitly regulated in UNCLOS 1982. The Lombok Strait is highly prospective to be established as a PSSA as the Lombok Strait has fulfilled the criteria of the IMO accompanied by the mandate of protection and prevention of the marine environment from UNCLOS 1982, MARPOL 73/78 and SOLAS 1974.In 2019, the designation of TSS in Lombok Strait was approved so that discussions related to PSSA can continue. However, The PSSA discussed at the IMO session requires the approval of other countries that enjoy the rights of passage through the Lombok Strait. Penelitian ini bertujuan untuk menganalisa dan memberi pemahaman terkait prospek penetapan Kawasan Perairan Sensitif (PSSA) di Selat Lombok termasuk Pulau Gili dan Pulau Nusa Penida pasca ditetapkannya Skema Pemisah Lalu Lintas (TSS) pada tahun 2019 berdasarkan Hukum Internasional. Penelitian ini menggunakan pendekatan yuridis-normatif dengan jenis riset deskriptif analitis untuk menggambarkan dan menganalisis instrumen-instrumen hukum internasional yang digunakan. Data penelitian diperoleh dari hasil penelitian kepustakaan dan wawancara dengan lembaga terkait seperti Kementerian Luar Negeri dan Kementerian Perhubungan Republik Indonesia. Pengolahan data dilakukan dengan metode analisis kualitatif. Penelitian ini menyimpulkan bahwa pengaturan PSSA secara spesifik dimuat di dalam Resolusi IMO A.982 (24) terkait Pedoman Identifikasi dan Penetapan PSSA. Hal ini merupakan aturan lanjutan dikarenakan PSSA tidak diatur secara eksplisit di dalam UNCLOS 1982. Tahun 2019 penetapan Skema Pemisah Lalu Lintas TSS sebagai salah satu syarat pembentukan PSSA di Selat Lombok telah disetujui sehingga pembahasan terkait PSSA dapat terus dilanjutkan. Namun masih diperlukan persetujuan negara-negara lain yang memiliki hak melewati Selat Lombok. Oleh karenanya, perlu penguatan proposal khususnya terkait bagian atribusi untuk lebih meyakinkan urgensi penetapan Selat Lombok sebagai PSSA. Las áreas naturales protegidas son importantes para la preservación del patrimonio natural y de los ecosistemas en peligro. Por ello, existe una legislación específica, la asignación de recursos económicos y personal especializado. En el caso del bosque de caldén, estas políticas ambientales, sustentadas por la Ley Provincial Nº2624 son efectivas para contrarrestar las deforestaciones y los incendios, pero no tienen el mismo alcance para riesgos y problemas ambientales asociados al avance de los agroecosistemas en la provincia de La Pampa, proceso visibilizado en la última década. Es así como el área protegida de la Reserva Provincial Parque Luro, presenta una situación de inminente riesgo en relación al contexto. El objetivo del trabajo es analizar los cambios ambientales provocados por los usos del suelo rural. Se utiliza una metodología que consiste en examinar las legislaciones vigentes y el plan de manejo ambiental. Se realiza a partir de la construcción de un diagnóstico confeccionado con reportes de estudiantes, entrevistas elaboradas por la cátedra de Biogeografía, aportes de la Subsecretaría de Ambiente y estadísticas de producción del área contigua a la reserva. Este análisis integral, plasmado en un árbol de problemas, posibilita determinar la necesidad de crear una zona de amortiguamiento vinculante. ; Natural reserves are important to maintain natural heritage and endangered ecosystems. Therefore, there are specific environmental legislation, economic resource allocation and qualified personnel. In the case of Calden Forest these policies, based on Provincial Law N°2624, are efficient to counteract deforestation and fires but are not efficient enough to reduce the risk and environmental problems associated to the advance of agroecosystems, a process which has increased during the last decade. This is the reason why the area of Parque Luro Natural Reserve represents a situation of imminent risk in relation to the context. The aim of this research is to analyze the environmental changes caused by use of rural soil. The methodology applied consists in analyzing current legislation and the environmental management. It is carried out from a diagnosis based on students' reports, interviews prepared by the faculty of Biogeography, contributions by the Environment Undersecretariat and production statistics for the reserve adjacent area. This comprehensive analysis, reflected in a problems tree, makes it possible to determine the need for creating a binding buffer zone. ; As áreas naturais protegidas são importantes para a preservação do patrimônio natural e dos ecossistemas em perigo. No caso do bosque de Caldén, estas políticas ambientais, baseadas na Lei Provincial N° 2624 são efetivas para neutralizar as deflorestações e os incêndios; mas não tem o mesmo alcance para os riscos e problemas ambientais associados ao avanço dos agrossistemas, na província de La Pampa, cujo processo é visibilizado na última década. Como consequência, a área protegida da Reserva Provincial Parque Luro apresenta uma situação de iminente risco em relação a esse contexto. O objetivo do trabalho é analisar as mudanças ambientais provocadas pelo uso do solo rural. Utiliza-se uma metodologia que trata de examinar as legislações vigentes e o plano de direcionamento ambiental. Realiza-se a partir da construção de um diagnóstico elaborado com relatórios de estudantes, entrevistas elaboradas pela cátedra de Biogeografia, contribuições da Subsecretaria de Ambiente e estatísticas de produção da área adjacente à reserva. Esta análise integral, expressadas em uma quantidade de problemas, possibilita determinar a necessidade de criar uma zona de redução vinculante.

Globally, the past two years have been successful years in oil and gas exploration with discoveries almost doubling those made in 2017.1 Notwithstanding Africa's endowment in vast natural resources, including substantial oil and gas reserves, one of the most dramatic finds in Africa has been Mozambique's natural gas developments. Mozambique is set to become one of the largest and most dominant natural gas finds in the world. These developments have attracted the attention from countries around the world, the UAE, in particular, taking the lead. Engineering, procurement, construction and installation ("EPCI") contracts, are a common form of contract in the oil and gas sector, which is used to undertake large scale oil and gas projects. The nature of these contracts consists of significant local (in-country work) and foreign (out-of-country work) elements. Due to the complex nature of EPCI contracts, one of the major areas of dispute in the taxation environment are the uncertainties around the taxation of profits arising to contractors under these contracts. The taxpayer and the Revenue Authorities have different views as to where the income arising from EPCI contracts is to be taxed. The taxpayer takes the stand that only such income from the project as is relatable to activities in the host state, should be taxed in the host state. The Revenue Authorities contend that EPCI contracts are to be considered as one and indivisible, and hence the entire income from the contract is liable to be taxed in the host state. Based on an examination of recent judgments passed by the Authority of Advanced Rulings ("AAR") and various Tax Courts, currently, there seems to be no certainty regarding the taxation of income arising to contractors under an EPCI contract and this has in turn resulted in a number of contractors having to pay excessive taxes. This dissertation seeks to analyse the tax treatment of income arising to contractors, from supplies and services under an EPCI contract in the context of the oil and gas sector entered into between Mozambique and the United Arab Emirates ("UAE"), in Mozambique. The purpose of this analysis is to determine how these profits should be taxed, in light of the Mozambique-UAE Treaty2 and Mozambican domestic legislation. In other words, the question that this dissertation seeks to answer is, whether profits arising from an EPCI contract in the oil and gas sector, should be taxed as a whole in Mozambique, or per the various components of the EPCI contract. 1 Fuel for thought, Africa oil and gas review, 2019, Current developments and a look into the future, www.pwc.co.za/oil-gas review [November 2019]. 2 Convention between the Republic of Mozambique and the Government of the United Arab Emirates for the Avoidance of Double Taxation with respect to Taxes on Income and Capital (2003). The key finding arising from the research presented in this dissertation is that although an EPCI contract is entered into in Mozambique (consisting of both offshore and onshore elements), this would not make the entire income from that contract to be taxable in Mozambique. Importantly, only such part of the income as is attributable to the operations carried out in Mozambique can be taxed in Mozambique. Following the analysis, as described above, this dissertation finally endeavors to provide recommendations on how contractors should approach and structure EPCI arrangements in order to create the best possible situation for themselves within the limits of what the law allows, and to reduce potential tax litigation. This can serve to inform other developing countries who have oil and gas operations.

A request for a preliminary ruling regarding the interpretation of article 1 letter i) of Regulation 883/2004 (EC) of the European Parliament and of the Council of 29 April 2004 on the coordination of social security systems, in relation to the provisions of Luxembourg national legislation and the right of free movement, recognized in article 45, Treaty on the Functioning of the European Union (TFEU), in connection with the article 7.2 of Regulation (EU) No 492/2011 of the European Parliament and of the Council of 5 April 2011 on freedom of movement for workers within the Union Text with EEA relevance, regarding the free movement of workers within the Union and with article 2.2 of Directive 2004/38/EC of the European Parliament and of the Council of 29 April 2004 on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States. Does the right to free movement of workers violate the precept of the Luxembourg Social Security Code that only grants the frontier worker a family benefit, linked to the exercise of his activity as an employee in that State, by the son with whom he is connected by filial bond, denying it by the son of his wife integrated in the family unit and with respect to the one who assumes this support, being that all the minors resident in Luxembourg do have the right to receive benefit? El Tribunal de Justicia de la Unión Europea (TJUE) concluye declarando la obligación de todo Estado miembro de respetar el Derecho de la Unión y, en concreto, las disposiciones relativas a la libre circulación de trabajadores, cuya aplicación al caso determina que a las mismas se oponga una disposición nacional como la referida.

El establecimiento de espacios de participación es un desafío abierto para gran parte de los Estados latinoamericanos. Su óptimo funcionamiento dependería de factores adicionales a la gestión institucional. Este artículo indaga cómo los Consejos Comunales de Organizaciones de la Sociedad Civil (COSOC) responden a requerimientos de gobernanza y deliberación democrática, que articulados con elementos de capital social y cultural, son componentes fundamentales del ejercicio de participación ciudadana. Para explorar este planteamiento, se tomó el caso del Consejo de la Sociedad Civil (COSOC), Chile. Los datos surgen del proyecto para la instalación del cosoc (Ley 20 500), ejecutado en la región del Biobío, Chile, en 2017. La metodología es mixta, predominantemente cualitativa, basada en el análisis de talleres participativos con apoyo de datos descriptivos tomados de las encuestas. Los principales resultados apuntan a la operatividad y eficacia de la participación y al valor que esta adquiere a partir de las condiciones del contexto y demanda social, es decir, cuestiones como la información disponible, el nivel de asociatividad, la formación cívica, las asimetrías de poder, entre otras. Las anteriores, variables vinculadas a la estructura y condiciones de los espacios promovidos y a la calidad de los procesos democráticos en la región. ; Citizen participation is an open challenge for a large part of the Latin American states. Its optimal functioning would depend on various factors in addition to institutional management. This article seeks to investigate how the Communal Councils of Civil Society Organizations (cosoc) respond to the requirements of democratic governance and deliberation, proposed as fundamental components for the proper exercise of citizen participation articulated with elements of social and cultural capital. To investigate this approach, we took the case of Chile and the local experience of cosoc (Law 20 500), using data from the project "Installation of Civil Society Councils and Proposal of Construction of two mechanisms of Citizen Participation according to reality territorial", executed in the Biobío Region, Chile, in 2017. The methodology is mixed, predominantly qualitative, based on the analysis of participatory workshops and the support of descriptive data from surveys. The main results point to the operation and effectiveness of the participation and the value that it acquires based on the conditions of the context and social demand. That is to say, issues such as the information available, the level of associativity, civic training, power asymmetries, etc. All of them are variables linked to the structure and conditions of the promoted spaces and the quality of their democratic processes. ; A participação é um desafio aberto para grande parte dos Estados Latino-Americanos. Seu ótimo funcionamento dependeria de fatores adicionais à gestão institucional. Este artigo indaga como os Conselhos Comunais de Organizações da Sociedade Civil (cosoc), respondem a requerimentos de governança e deliberação democrática, que articulados com elementos de capital social e cultural, são componentes fundamentais do exercício de participação cidadã. Para explorar esta abordagem, tomou-se o caso do Conselho da Sociedade Civil (cosoc), Chile. Shape memory alloys (SMA) undergo a solid-solid phase transformation called martensitic transformation, involving a "high temperature" phase, austenite, and a "low temperature" phase, martensite. The crystalline microstructure of the alloy alters mechanisms of transformations, and its pseudo-elastic behavior. The reduction of the grains to nanometric size shows new and unknown thermal and mechanical characteristics. Knowledge of thermomechanical behavior is however essential for the validation of multiaxial models to democratize the use of these materials. This work presents the development of innovative biaxial dynamic tests for the study of the pseudo-elastic mechanical behavior of a nickel titanium under biaxial dynamic compression. A single projectile, launched on a complex system of 45 ^ { circ} triangles, bars and transmitters, creates a biaxial solicitation of the sample. This mechanism ensures that the loads are synchronized along the two axes. Thanks to its architecture, the system makes possible many cases of multiaxial dynamic stress, unexplored until now. The forces and displacements across the sample are calculated independently, along both axes, from strain gauges glued on bars. The use of a thermal and optical camera allows strain and heating sources fields to be identified. The stress field is estimated by combining the information from the strain gauges placed on the bars and a finite element analysis of the specimen. The deformation appears homogeneous in the biaxial loading region of interest where a significant rise in temperature due to the phase change latent heat is observed. On the other hand the dynamic testing allows an equivalent dynamic stress/strain curve under biaxial and quasi-adiabatic conditions to be plotted. Experiments are finally compared to the results of finite difference axisymmetric model where the constitutive law is given by a fully coupled stochastic multiscale model. ; La microstructure cristalline de l'alliage joue un rôle vis-à-vis des mécanismes de transformations, et de son comportement pseudo-élastique. La réduction des grains vers une taille nanométrique offre notamment des caractéristiques thermiques et mécaniques bien différentes et peu connues. La démocratisation de l'utilisation de ces matériaux passe par la validation de modèles complets et donc par la connaissance du comportement thermomécanique multiaxial dynamique. Ce travail propose la mise en place d'essais dynamiques biaxiaux innovants pour l'étude du comportement mécanique pseudo-élastique d'un nickel titane sous compression dynamique biaxiale. Un seul et unique projectile, lancé sur un système complexe de triangles à 45^{circ}, barres et renvois d'angles, permet de solliciter l'échantillon de manière biaxiale. Le mécanisme permet notamment d'assurer la synchronisation des chargements selon les deux axes. Grâce à son architecture, le banc d'essais rend possibles des cas de sollicitations dynamiques multiaxiales inexplorés jusqu'à présent. Le grand nombre de points de mesure par jauges de déformations collées sur les barres permet de calculer les efforts et déplacements aux limites de l'échantillon et ce indépendamment suivant les deux axes de sollicitation. L'utilisation d'une caméra thermique et d'une caméra optique permet d'identifier les champs de déformations et de sources de chaleur. Le champ de contrainte est estimé en combinant les informations des jauges de déformations et une analyse par éléments finis de l'échantillon. La déformation apparaît homogène dans la région de chargement biaxiale, où une augmentation significative de la température due à la chaleur latente de changement de phase est observée. Les essais dynamiques permettent d'autre part d'établir une courbe contrainte / déformation dynamique équivalente dans des conditions biaxiales et quasi-adiabatiques. Les expériences sont finalement comparées aux résultats du modèle axisymétrique en différences finies où la loi de comportement est donnée par un modèle multi-échelle stochastique entièrement couplé.

In the years 1918 through 1940, the public opinion of the society was formed not only by the local press, but also by the publications in foreign languages, which reached Lithuania. Therefore, in order to ensure the se­curity of the state and society, the publications – not only local, but also those published abroad, and also imported in Lithuania – were censored in Lithuania in the interwar period. During the discussed period, the censorship of foreign publications was aimed to protect the country from publications that propagated anti-state ideas and instigated national discord. Institutions for the supervision and control of the press watched that content disagreeing with the moral values of the time and various publications by religious sects would not get into Lithuania. Already in the year 1919, the Law on Press established that the Minister of the Interior had the right to prohibit the import and distribution of publications in Lithuania, contrary to the establishment of the inde­pendent state of Lithuania. The censorship of foreign publications was performed by the Units of the Citizen Protection Department of the Ministry of the Interior, the names of which changed. After the year 1923, the censorship of foreign publications was related to the stages of development of the security service in the Ministry of the Interior. The books published and printed abroad were inspected at the customs posts near the state border of Lithuania. The customs officers inspected the publications in the presence of the railway police. When performing the censorship of foreign publications, an important position was taken by the border police, especially that which protected the wall with Germany, through which many smuggled goods were carried. The censorship of foreign publications intensified in the year 1933, after the establishment of the State Security Department. The activities of this institution are illustrated by the records about the detention of books in post offices, made by the officers of the Press Unit of this Department, the private persons' requests to issue the permits for taking the publications from the post office, the permits to subscribe to the books or to import them by applying preventive censorship, and the other documents in the Office of the Chief Archivist of Lithuania. Lists of prohibited books also illustrate the foreign censorship activities. One of the earliest lists is a list of pu­blications prohibited for import and distribution in Lithuania, compiled since 1926. Sixteen lists of still nowhere announced foreign publications and books prohibited by censorship to be distributed are provided in the Appendix to the Article. ; Pastaruoju metu viešojoje erdvėje vis daugiau kalbama apie informaci­nius karus ir propagandą. Straipsnyje analizuojama užsienio spaudinių cenzūros sistema Nepriklausomoje Lietuvoje. Įvežamos spaudos į Lietuvą priežiūros teisinį pagrindą sudarė spaudos įstatymai. Pirmaisiais Nepriklausomos Lietuvos gyvavimo metais užsienio spaudinių cenzūrą vykdė Vidaus reikalų ministerijos Piliečių apsaugos departamento skyriai. Vėliau šią veiklą perėmė Valstybės saugumo departamentas. Cenzūros įstaigos di­džiausią dėmesį sutelkė į antivalstybinio turinio leidinius, kurie į Lietuvą nelegaliai arba bandant pasinaudoti legaliomis pašto paslaugomis buvo įgabenami iš kaimyninių šalių.
