This report summarizes the current state of water pollution and water pollution management strategies in the People's Republic of China (PRC). It also provides specific recommendations for implementing market-based policy instruments, such designed to mitigate water pollution and its negative effects. Market-based instruments such as water quality trading, fees and taxation, and public-private partnerships, have been tested internationally and in the PRC, and may be used as guide in implementing positive environmental policy reforms in the country. Success with such instruments provides a blueprint for developing more sophisticated water pollution control strategies using policy innovations to achieve greater benefits at lower costs. The Asian Development Bank is providing technical assistance to aid the government in its quest to identify the best possible options for ensuring clean water for its citizens. Experiences gained in the PRC can be relevant to practitioners in the other developing countries as well.

This bad practice prevailed in all rural regions until 16 July 2009 when these garbage dumps should be closed and rehabilitatedaccording to Government Decision number 345/2005 which comply the Landfill Directive 1999/31/EC. The paper aims a spatialanalysis of waste indicators concerning the rural dumpsites at administrative territorial units on national, regional and local scale.These data are correlated to geographical conditions reflecting spatial patterns in their distribution across and within Romanian counties.The role of geographical conditions is revealed at local scales in these spatial patterns due to a low coverage rate of rural communities towaste collection services. Such analysis supported by field observations is necessary for a proper understanding of illegal waste disposalissue. International audience ; The paper examines the per capita waste generation rates from from rural areas of Neamț County (Romania) using thematic cartography. Geographical approach of this issue is difficult because the lack of a geostatistic database at commune scale. Spatial analysis of waste indicators reveals several disparities between localities. Comparability of data between communes located in various geographical conditions must be carrefully made according to local waste management systems. Several dysfunctionalities are outlined in order to compare these results, on the one hand, between localities and on the one hand, between recent years. Geographical analysis of waste generation rates is imperative for a proper monitoring of this sector. Data from 2009, 2010 and 2012 shows that rural waste management is in a full process of change towards a more organized, stable and efficient system.

El objeto de esta investigación erige es la indagación sobre la severidad punitiva de las decisiones judiciales, tomando como referencia nuclear la violencia contra las mujeres en relaciones de la pareja y los discursos judiciales manifestados en las decisiones pronunciadas por los juzgados y tribunales. Al enjuiciador le cabe siempre optar entre el abanico de proposiciones jurídicas, desvelando si son, o no, aplicables a la factualidad y, en caso afirmativo, cuáles son las consecuencias que se derivan de ellas (Larenz, 1978). La violencia de la pareja es un problema históricamente recurrente y un problema de género, las mujeres son las principales víctimas, que no sólo en Portugal, sino en la generalidad de los países y culturas, que ha reclamado la atención particular de juristas, psicólogos, sociólogos, políticos y, naturalmente, de las comunidades. Sin embargo, no se trata de un fenómeno nuevo, sino antes bien de una compleja e intrincada cuestión social, que atraviesa todas las épocas, aunque presentemente ocupe tal vez un protagonismo mayor en los debates y en las preocupaciones humanas, una vez que el devenir social y la creciente consciencia colectiva sobre la dimensión y efectividad de los derechos humanos vienen suscitando la formulación de otros mecanismos de control, presumiblemente adecuados. Esta es la razón por la que, en las últimas décadas, se han traído a colación interrogaciones, derivadas de los choques y contradicciones que van surgiendo a nivel de las representaciones sociales, de las tradiciones y de la cultura, a muchos títulos aún dominantes en nuestra sociedad; no obstante, por todos lados ha ido sedimentando –por lo menos a nivel de las intenciones– la idea de la tolerancia cero en relación a este tipo de violencia. VII El espacio inaugural donde todas estas cuestiones asumen un papel determinante, de resultas del cual se procede a la construcción de una arquitectura normativa, de definiciones uniformizadas, es el proceso de criminalización. El Derecho es, por lo tanto, un regulador de relaciones interpersonales que, fijando patrones de comportamiento, procura encontrar formas de colmatar el desorden y promover el bienestar de una sociedad (Hart,1995). Para ello, opera en la regulación de las situaciones, que divergen de un país a otro, como sucede en las diversas etapas de la criminalización, en especial en sus fases primarias (producción legislativa) y secundaria (aplicación judicial), cada una de ellas organizada según una gramática específica, aunque interconectada, reflejando una lógica propia, emergente de sus tiempos histórico-culturales y político-sociales (Debuyst & Digneffe,1998). Dichas lógicas emanan de los titulares del Poder y de quienes dirigen el sistema, de sus intereses e ideologías, partiendo de estos para emitir juicios de valor; según Larenz (1978), estos juicios constituyen expresiones de una toma de posición personal del Legislador y, posteriormente, del Aplicador, realizadas en el respeto por valores que se reconocen como tales; para fundamentarlos, el juez no está limitado tan solo a la intuición axiológica, debiendo aplicar criterios que gestionan los valores (positivos y negativos) considerados vinculantes en la comunidad sociopolítica y jurídica, y por ella. Los dilemas de la justicia tienen origen en el funcionamiento actual y global de la sociedad; las representaciones individuales nacen de procesos más amplios y, en muchas ocasiones, ajenos al propio individuo, es decir, la relación entre la autonomía individual y social está en juego cuando las reglas de una comunidad precisan ser determinadas (Wagner, 2011; Dias, 2010). La violencia conyugal es un fenómeno bastante complejo y compuesto por diversos factores, de cariz social, cultural, psicológico, ideológico, económico, entre otros (Costa, 2003). Actualmente, el Código Penal portugués ya consagra expresamente (en su artículo 152) el delito de violencia doméstica. Más allá de este artículo específico, la ley también criminaliza, por ejemplo, las amenazas, la coacción, la difamación, las injurias, la sustracción de menor, el incumplimiento de la obligación de manutención, la violación, el abuso sexual y el homicidio o tentativa de homicidio (APAV, 2014). Las penas criminales, a nivel de marco central, van desde 1 a 5 años de prisión, lo que permite que el juez pueda suspender la pena, dado que su límite máximo no supera los 5 años. Éste es precisamente el eje del problema, pues el propio Legislador abrió la puerta al expediente de la suspensión. La tipificación de la violencia doméstica (malos tratos físicos o psíquicos, incluyendo privaciones de libertad y ofensas sexuales) comprende, como víctimas, a las siguientes personas: cónyuge o ex-cónyuge; uniones de hecho heterosexuales y homosexuales (incluso sin cohabitación); progenitor de descendiente común en 1er grado; persona particularmente indefensa en virtud de la edad, deficiencia, enfermedad, embarazo o los dependientes económicos que con él cohabiten (se exige la cohabitación). En el caso previsto, si el agente practica el acto contra menor, en presencia de menor, en el domicilio común o en el domicilio de la víctima, es castigado con pena de prisión de 2 a 5 años (artículo 152). En cuanto a las penas accesorias, la ley penal establece las siguientes: a) prohibición de contacto con la víctima, en particular el alejamiento de la residencia, el alejamiento del lugar de trabajo y supervisión por medios técnicos de control a distancia; b) prohibición de uso y porte de armas y, c) obligación de asistencia a programas de prevención de la violencia doméstica. En el presente trabajo nos ceñimos a la violencia conyugal, entre personas heterosexuales, que mantengan vida en común, en una relación análoga a la de los cónyuges. Diversos estudios han mostrado que, a pesar de que la violencia contra las mujeres no se circunscribe a los espacios domésticos, pudiendo también producirse en la calle o en el lugar de trabajo, lo cierto es que gran parte de este tipo de violencia tiene lugar sobre todo en casa. En Portugal, la vivienda es el espacio privilegiado donde ocurre esta violencia (43%), como quedó demostrado en el informe de la APAV (2014) recientemente publicado, siendo en ese espacio familiar donde los maridos actúan como los principales ofensores de las mujeres. En ese mismo estudio se comprobó que la violencia contra las mujeres es sobre todo física y psicológica, cuando ocurre en el espacio doméstico; discriminación sociocultural, cuando se produce en el lugar de trabajo, mientras que la violencia sexual tiene lugar sobre todo en la calle. ¿Tendremos que preguntarnos si en Portugal la violencia sexual cometida en el interior de las familias y, por lo tanto, la que sucede en los espacios domésticos, tiene una relevancia menor que la violencia sexual que se produce en la calle, o si las mujeres no la valoran de igual forma y, por eso mismo, no denuncian a los ofensores sexuales con los que viven, dejando que una vez más la tradición se sobreponga a lo que la ley ya contempla? ¿Será que la ideación de los antes denominados deberes conyugales, incluyendo el débito sexual, aún permanece en las creencias de los ciudadanos? La experiencia de la APAV, en sus diversos Gabinetes de Apoyo a la Víctima, que reciben y actúan con mujeres víctimas de violencia conyugal, tal como los múltiples estudios que han sido realizados, confirma que la violencia es practicada en el seno de la relación conyugal (entre personas que viven en situación conyugal, casadas o no). Se trata de un sistema circular, que surge, se desarrolla y termina, iniciándose nuevamente, de forma semejante, por lo que se lo denomina ciclo de la violencia conyugal o doméstica, dado que puede ser entendido, en este sentido, como un círculo, en el cual las dinámicas de la relación de la pareja se manifiestan sistemáticamente, pasando siempre por determinadas fases. Así, en este ciclo pueden identificarse las siguientes fases: a) la fase de construcción de la tensión; b) la fase de la violencia; y c) la fase del apaciguamiento o "luna de miel". El ciclo de la violencia conyugal dificulta mucho las tomas de decisión de la mujer víctima, pues experimenta fases muy dramáticas (la tensión y el ataque violento), pero que terminan en una fase considerada gratificante (el apaciguamiento), en la cual se reanima la esperanza de tener una relación conyugal sin violencia, que implica creer e intentar nuevamente el proyecto de vida soñado o evitar la compleja y en ocasiones dramática salida del hogar. Entre otros aspectos, la relación con el ofensor, la historia de vida anterior, los apoyos de los que dispone (o de los que carece), la violencia implicada y todos los actos que la constituyen, el impacto que tienen –y, sobre todo, el significado que ella atribuye a cada uno de esos actos– determinan la singularidad de su reacción (APAV, 2013). La revisión de varios estudios interculturales y antropológicos indica que la violencia conyugal es indisociable de la cuestión del género (Dias & Machado, 2008). La relación entre el género y la violencia conyugal ha generado, no obstante, bastante discusión y controversia (Miller & White, 2003), habiendo autores que defienden la neutralidad/simetría de género (Moffit, Robins & Caspi, 2001) y otros que afirman que el género y el poder suponen el proceso clave de la violencia conyugal, sin reducirse a ser un mero componente de ésta. A pesar de que la creciente superposición de los papeles en la relación conyugal lleve a la dilución de los papeles sexuales en la familia, las diferencias de género normalmente existen en todas las sociedades, como indica Giddens (2010). Dichas diferencias de género se expresan, aunque de forma diferente, a todos los niveles de la estratificación social, reflejándose en las diversas partes de la vida social, a nivel de las oportunidades y presunciones que desempeñan en ella, desde la familia al Estado. Según el mismo autor, a pesar de que en algunos países las mujeres hayan progresado de forma significativa, las diferencias de género aún son notables, y la violencia doméstica se ha ido perpetuando en silencio (Dias, 2004); las mujeres siguen asumiendo la responsabilidad de educar a los hijos y cuidar de la casa y los hombres la de sustentar a la familia, prevaleciendo la desigualdad de roles a nivel de «[…] poder, prestigio y riqueza» (Giddens, 2010, p. 114). Como dice provocadoramente Foucault (1980), en la obra Power/knowledge, donde hay poder hay resistencia y, no obstante, o tal vez por eso mismo, ésta nunca está en una posición de exterioridad en relación al poder. Así, si es verdad que la igualdad declarada e incluso promovida en la ley encuentra numerosos obstáculos en su aplicación práctica, el Derecho no controla definitiva o aisladamente la vida social y sus valores, pero no se limita, al contrario de los más escépticos, a plasmar en letra de ley las concepciones socialmente dominantes. El Derecho –las leyes, la jurisprudencia, las prácticas jurídicas y judiciarias– ha tenido un papel constitutivo importante en la segregación discursiva de grupos de personas, especialmente las mujeres. Se entroncará ahí, quizás, la función correctora del Derecho, pasando a contribuir en la búsqueda de formas de deshacer esa segregación, no sólo prohibiendo tratamientos discriminatorios, sino obligando a las oportunas instancias a tomar medidas que contraríen la real situación de inferioridad socio-familiar de algunas personas: transmitir, por ejemplo, a la sociedad que la violencia doméstica es realmente un delito que se produce en su seno a causa de las desigualdades de género e incluso de la apatía judicial que en ocasiones se revela. Como ya mencionamos anteriormente, el presente trabajo tiene como objetivos averiguar: (i) ¿cómo absorbe el Aplicador el mensaje dimanado del Legislador, entidad política? Es decir: ¿el Aplicador adopta el racional legislativo o se apropia de él, por ejemplo a través de la memorización de su dimensión legislativa, produciendo otros (o diferentes) enunciados aplicativos? Y, (ii) ¿de verificarse semejante distorsión aplicativa, al existir una severidad menor, el transgresor ya se ha percatado de ese hecho? Es decir: ¿el delincuente doméstico presenta una cierta impunidad? De donde se deduce la cuestión crucial: (iii) ¿podrán los tribunales convertirse en entes susceptibles de contribuir a desculpabilizar el delito de violencia de la pareja? Cual la credibilidad del testimonio de las víctimas? Teniendo en cuenta los objetivos y las características del estudio y los recursos disponibles para la investigación, optamos por un tipo de estudio exploratorio, descriptivo-correlacional. Lo clasificamos como exploratorio porque se desconoce la existencia de estudios de esta índole; asume también carácter descriptivo-correlacional una vez que pretendemos describir el universo de una determinada problemática o fenómeno (violencia conyugal) y establecer relación entre variables (entre otras variables, la dependencia económica de las víctimas en relación al acusado), "en el estudio descriptivo-correlacional, el investigador intenta explorar y determinar la existencia de relaciones entre variables, con miras a describir esas relaciones. El principal objetivo del estudio descriptivo-correlacional es el hallazgo de factores relacionados con un fenómeno." (Fortin, 2003, p.174) La parte práctica se apoya en una recogida de datos de procedimientos archivados referentes al delito de violencia conyugal y su análisis ius psicológico, utilizando, con ese fin, el instrumento Índice de Severidad Penalizadora y Psicologización (Criminalización Secundaria) – (ISPP-CS) (Poiares, 2009). Como el Índice fue construido para el análisis de procedimientos penales sin especificación del tipo legal, fue necesario, de acuerdo con la literatura, del estudio de procedimientos, por la propia especificidad del delito de violencia conyugal, teniendo como base el ISPP-CS, añadir más variables , que son las siguientes: relación con el acusado; dependencia económica de las víctimas en relación al acusado; dependencia económica de los acusados en relación a la víctima; posesión de arma; otros procedimientos relacionados con violencia conyugal; número de procedimientos de violencia conyugal; información de los procedimientos de violencia conyugal a nivel de los hijos y menores de edad (número de hijos de ambos, de la víctima y del agresor; si el caso fue presenciado por menores hasta los18 años; si se contactó la Comisión de Protección de Niños y Jóvenes en Peligro ; datos de los procedimientos sobre el historial de los episodios de violencia (tipos de violencia, consecuencias físicas para la víctima; víctima observada en el hospital, víctima en internamiento; el acusado suele exhibir armas o hacer alusión a ellas durante las amenazas o agresiones; casos anteriores por agresiones a la víctima y/o a otro familiar, practicadas por el mismo acusado); solicitud de informe social/evaluación psicológica; medida de coacción; género del magistrado que dirigió el juicio, así como tiempo transcurrido entre la queja y la sentencia. Estos datos tuvieron un tratamiento estadístico en Statistical Package for the Social Sciences (SPSS). El Índice de Severidad Penalizadora y Psicologización (Criminalización Secundaria) - ISPP-CS) tiene como objetivo general analizar la severidad penalizadora, así como permite verificar el grado de psicologización del procedimiento judicial, o sea, la utilización de información y conocimiento científico proporcionado por la Psicología Forense y su recepción a la hora de juzgar. En la vertiente severidad, el índice pretende evaluar cuál es el grado de penalización, oscilando entre un grado nulo y un grado elevado, pudiendo aplicarse a cualquier delito, una vez que el estudio se basa en los patrones de la dosimetría penal (= marco de la pena para cada tipo criminal), siendo el resultado expresado en porcentaje. Considera tres ejes: Acusado, Procedimiento Actual y Medida Final Adoptada. El primero proporciona diversa información sobre cada acusado en el procedimiento, en particular en las dimensiones socio-demográfica, cultural, clínica y forense. El segundo, tal como su propio nombre indica, remite al procedimiento actual del individuo: delitos en los que se encuentra pronunciado y medidas de coacción. Por último, la Medida Final Adoptada sugiere lo que fue determinado en tribunal y si se tuvieron en consideración la evaluación psicológica o la peritaje de personalidad, en el agravamiento o atenuación de la pena. El tipo de respuesta de los ítems varía entre las de respuesta múltiple o respuesta específica y directa. Se aplica a procedimientos ya archivados y el tiempo de duración de la aplicación del procedimiento es variable con la dimensión del procedimiento. El primer eje, el Acusado, está compuesto por las dimensiones socio-demográfica, cultural y por la anamnesis judicial, diferenciada por las sub-dimensiones clínica y forense. El segundo eje, el Procedimiento Actual, referencia el (1) delito(s) que se le imputa (respuesta especifica); en relación a los delitos imputados: (2) Tipo (respuesta específica); (3) Precepto Incriminador (respuesta específica); (4) Dosimetría penal (colocar el valor mínimo y el valor máximo). Por último, el tercer eje, "Medida Penal Adoptada", se refiere a: (1) Medida aplicada a cada delito (respuesta específica); (2) Acumulación jurídica (sí o no) (b) Medida aplicada en acumulación (respuesta específica); (3) La decisión refirió la realización de evaluación psicológica (sí o no); (4) La decisión refirió la realización de peritaje de personalidad (sí o no); (5) La evaluación psicológica fue utilizada para fundamentar la atenuación de la medida (sí o no); (6) El peritaje de personalidad sirvió de fundamento a la atenuación de la medida (sí o no); (7) La evaluación psicológica determinó el agravamiento de la medida (sí o no); (8). El peritaje determinó el agravamiento de la medida (sí o no); (9) En la decisión se invocaron razones para la atenuación de la medida (respuesta específica, cuáles); (10) Observaciones (respuesta específica). Este eje termina con una sinopsis general, que se aplicará a todos los delitos por los que haya sido condenado el sujeto. Referencia la dosimetría, diferenciando todos los delitos del individuo; (11) Medida aplicada (respuesta específica); (12) Medida aplicada en acumulación (respuesta específica); (13) Puntuación total (respuesta específica). La hoja de puntuación está constituida por ítems de cumplimentación referentes a los límites mínimo y máximo de la medida penal aplicable y a la pena concreta, en meses. Tal hoja de puntuación contiene asimismo una tabla formada por cinco columnas, cada una de ellas conteniendo cuatro puntos de escala referentes a la evolución del agravamiento de la pena; y una línea de cumplimentación, por acusado (Anexo II). En alternativa, se puede utilizar una plataforma informática construida por Branco (2013), destinada exclusivamente a facilitar el tratamiento de la información obtenida por este instrumento, transformando los resultados en una escala de 0-100%. En cuanto a los ítems relativos con el tipo de tribunal (singular o colectivo), número convencional, número de acusados, decisión (absolutoria o condenatoria), pena aplicada por acusado, fecha e identificación del asistente de investigación, debiendo éste indicar con una cruz cuál es el tipo de tribunal y de decisión; en lo que concierne al número convencional (número del procedimiento en la investigación), número de acusado y penas aplicadas, el asistente de investigación apunta objetivamente la información relativa a esos ítems, información recogida en el procedimiento analizado. La fecha y la identificación del asistente también deben ser indicadas. En lo tocante a la primera sección, correspondiente al Acusado, en su dimensión socio-demográfica, debe indicarse únicamente uno de los ítems relativos a la naturalidad (urbana/rural) y tan sólo uno de los ítems referentes al estado civil, así como a la situación profesional (empleado; desempleado; jubilado); deben ser indicadas, por escrito, las informaciones recogidas acerca del distrito municipal, municipio y edad; profesión; y la relativa al tiempo que hace que el sujeto está desempleado, si fuere el caso. En la dimensión cultural, el asistente debe indicar por escrito la etnia e indicar uno de los puntos referentes a la categoría formación académica, indicando si está completo o incompleto, siempre que sea el caso. Si, en el procedimiento analizado, otro fuere el ítem adecuado, especificarlo, indicando cuál, siempre que se haya facilitado dicha información. Con respecto a la categoría residencia urbana/rural, indicar tan sólo uno de los ítems e indicar por escrito el distrito municipal, municipio y tipo de alojamiento. Igualmente, indicar por escrito cuál es la relación afectiva o de parentesco entre los diversos acusados, siempre que exista. Con respecto a la Anamnesis Judicial, más específicamente a la dimensión clínica, en lo que concierne a la salud mental, indicar referencia de diagnóstico y cuál, así como indicar la existencia, o no, de acompañamiento; el mismo procedimiento en lo que se refiere a las adicciones; en este caso, el asistente debe indicar cuál es la sustancia e indicar debidamente si el sujeto es toxicómano o consumidor. En lo que atañe a las patologías físicas, indicar por escrito una referencia de diagnóstico, indicar la existencia o no de discapacidad, señalando cuál. En la dimensión forense, indicar si existió realización de evaluación psicológica o de peritaje de personalidad, indicando el tipo de institución responsable de su elaboración; indicar por escrito cuáles son las conclusiones, tanto de la evaluación como del peritaje; de la misma forma, indicar si existió, o no, decisión sobre inimputabilidad e indicar cuáles fueron las conclusiones. Aún en referencia a la decisión anterior, indicar si fue fundamentada por peritaje de personalidad o por evaluación psicológica forense. El asistente de investigación debe indicar la existencia, o no, de antecedentes criminales, registrando los delitos anteriormente cometidos y las medidas de coacción sufridas. Igualmente, debe indicarse con sí o no la existencia de prisión preventiva, mencionándose en su caso su duración; en lo que concierne a las medidas aplicadas, deben apuntarse las verificadas, tales como suspensión del procedimiento, multa, prisión, multa con pena suspendida, prisión con pena suspendida, prestación de trabajo a favor de la comunidad (PTFC), u otros; para todas las medidas verificadas, deberá ser indicado el delito. Deben ser anotadas cuáles son las medidas de coacción en el presente procedimiento y si se verificó o no prisión preventiva y cuál fue su tiempo de duración. Debe señalizarse la existencia de acompañamiento terapéutico durante el procedimiento (sí/no), indicando cuál y si tal fue o no cumplido. En relación a la revocación de la suspensión de la pena, debe ser registrado si tuvo lugar, y, en caso afirmativo, indicarse la razón. Obedeciendo al mismo criterio, debe indicarse el cumplimento o no de la pena y el tiempo de reclusión cumplido; con respecto a la libertad condicional, debe ser apuntada su verificación, o no, así como la revocación, o no, debiendo ser indicado cuál fue el motivo. En lo que concierne al procedimiento actual, indicar con sí o no la verificación de acompañamiento terapéutico, especificando cuál. En la segunda sección, relativa al Procedimiento Actual, especificar los delitos por los cuales el acusado se encuentra pronunciado, indicando la medida de coacción: prisión preventiva (sí/no); si se aplica otra medida, indicar cuál. En el caso de que el acusado haya cumplido prisión preventiva, indicar sí o no, en función de si se produjo desde el inicio del procedimiento o especificar desde cuándo y hasta cuándo se mantuvo. Para los delitos imputados, especificar el tipo, el precepto incriminador (artículo del CP o de ley suelta) y la dosimetría penal (medida de la pena), indicando la presencia de pena de multa y su valor, en el caso de que haya sido aplicada. En lo tocante a la tercera sección, Medida Penal Adoptada, especificar la pena aplicada a cada delito, la existencia o inexistencia de acumulación jurídica y cuál es la pena correspondiente a dicha acumulación; indicar si hubo o no decisión de prisión efectiva, especificando cuál es la medida penal efectivamente decretada. En lo que se refiere a la evaluación psicológica forense y al peritaje de personalidad, indicar con sí o no la referencia a su realización, su utilización para proceder a atenuación o agravamiento de la pena; indicar si fueron invocadas razones para atenuación de pena y, en caso afirmativo, cuáles. Con respecto a la sinopsis general, tomar en cuenta todos los delitos por los cuales el acusado fue condenado e indicar la dosimetría de cada uno; indicar con sí o no la aplicación de la Ley de los Jóvenes Imputables; especificar cuál es la pena aplicada, referente a cada delito; y cuál es la pena aplicada en acumulación jurídica. En relación a la interpretación del Índice de Psicologización, este indica el grado de exigencia y el grado de importancia atribuida a las evaluaciones psicológicas forenses y a los peritajes de personalidad en la decisión que culmina con la atribución de una medida penal, eventual agravamiento o atenuación: tal importancia se basa en la puntuación de los ítems relativos a la decisión integrada en la sección Medida Penal Adoptada. En el presente caso, cuanto mayor sea el índice, mayor relieve tuvo la presencia del trabajo llevado a cabo por los técnicos de Psicología Forense en contexto judicial. La población comprende todos los elementos que comparten características comunes, definidas por los criterios establecidos para el estudio: procedimientos de violencia conyugal, con nacionalidad portuguesa. Se optó por una muestra del tipo no probabilístico por juicio. Es el tipo de muestra en que los elementos que componen el subgrupo son escogidos en razón de su presencia en un lugar en determinado momento. Este tipo de muestreo es ideal cuando el tamaño de la población es pequeño y en estudios exploratorios (Fortin, 2003). La recogida de datos se realizó en el Partido Judicial de Lisboa, Instancia Local Criminal - 1ª Sección Central de Instrucción Criminal. La muestra está formada por treinta y cinco procedimientos (n= 35), todos en el ámbito de la violencia doméstica (artículo 15), en lo que atañe al cónyuge o ex-cónyuge o personas en una relación análoga a la de los cónyuges. El análisis de resultados al que procedimos nos permite concluir que el déficit de la lucha contra la violencia conyugal se sitúa en dos fases del procedimiento criminalizador: en la primaria, porque las penas aplicadas tienen una dosimetría correspondiente en el requisito de duración para suspensión de la pena (artículo 50 del CP); y en la secundaria, dado que, como se deduce de la investigación empírica, los jueces usan de forma casi perdularia la suspensión de la pena, conjugándose ambos niveles para la transmisión de un mensaje de impunidad que es el principal amigo de la reproducción de los comportamientos violentos. En la vertiente de la violencia en contexto de relación conyugal, con y sin vínculos jurídicos, importa viabilizar medidas de castigo y de ayuda psicológica, que puedan reprogramar el sujeto delincuente - este es el espacio de la criminalización terciaria (donde se consagran la ejecución de la pena y la reinserción); y el tiempo de castigo debe, en este como en las otras expresiones de la criminalidad, coincidir con el tiempo resocializador, dejando bien clara la ilicitud del comportamiento y posibilitando la interiorización de las interdicciones. El análisis de los resultados demuestra la incoherencia entre el Derecho dicho y el Derecho hecho y, del mismo paso, la línea de incoherencia entre la psicologización que se impone, tanto en relación al agresor como en lo que toca a la víctima, y la psicologización efectivamente practicada. Uno de los objetivos del instrumento que aplicamos reside en la indagación de la contribución que la Psicología aporta al espacio judiciario: se detectó una incidencia mínima, incluso si consideramos los llamados informes sociales, cuya dimensión psicológica es con frecuencia exigua. Los resultados, aunque meramente indicativos, demuestran una baja severidad punitiva en el ámbito de la violencia conyugal, lo que parece indicar la necesidad de reestructurar el contexto punitivo en delitos de esta naturaleza, tanto en la criminalización primaria como en la secundaria, reclamando un enfoque ius psicológico de esta problemática.ABSTRACT The intention of this work lies in the question of punitive severity of judicial decisions, erecting domestic violence as crime. To do so, was adopted the use of an instrument - the Punitive and Psychologizing Severity Index (Secondary Criminalization - ISPP-CS) (Poiares, 2009) - whose purpose involves analyzing the severity of criminal measures and the extent to which psychology influences the choice of the type of sentence imposed. The sample consists of 35 case, gathered in the region of Lisbon: Local Criminal Court - 1st Section Central Criminal Procedure. The results, even if merely indicative, demonstrate a low punitive severity within the conjugal violence, which may indicate the need to restructure the punitive context in such crimes, whether in primary or in secondary criminalization, demanding a judicial psychological approach to the problem.

IN GENERAL, the difference between a s61emn vow and a simple vow is one which arises entirely from the will 6f the Church; ~for there is nothing intrinsic in the notion of a vow to warrant such a distinction. On March 19, 1857, by the encyclical, letter Ne~inem latet of the recently gstablisbed S. Congregation regarding the State of Regulars, Pius IX pr¢scribed that in all orders of men all novices should take simple vows for a period of at least three years, before being admitted ,tOsolemfi vows, A year-later the same" S. Congregation issued~ declaration regarding these simple vo~s. Though given~ origiffally to the Master General 6f the Order of Pr~acher~ in answerto a number of questions proposed, this declaration, dated June 12, 1858, was soon extended to other religious orders on request and becam~ the established policy of the Holy See 67 ADAM C. These Norrnae,.as they were called, did not have ~the force of law, since they~remained a private guide for the use of the S. It will'be useful for our present sttidy, therefore, to give those articles of-the Norrnae ,of 3une 28, 1901, which dealt with the matter of~ the. simple vow, of poverty. By the simple vow of poverty the Sisters~ renounce the right to dispose licitly of anything having a temporal value, except with the permission of~the legitimate superiorS. t.14. The Sisters are forbidden to retain the personal ad~ninis-tration of any of their personal goods. 1 15. Therefore, before the first profession of vows. they must dispose of the use °~nd '~sufruct of their income, or of the fruits ot~" their goods in the manner which pleases them, even infavo~ of their _ institute, if they~ freely choose to do so. They must also, before their first vows, transfer the administration of their goods to any person or persons the~y~°cho'ose; and, if they freely choose, even to their own institute, provided the.latter is informed and accepts the trust. °- 116. It was through 'humble obedience that all these arrived at this. haven of joy.- ~Mary and Joseph humbly made the trip to Jerusalem in obedienc~ tothe census-t, aking edict of AUgus~- tus Chesar, their civil ,superior. They might have consid-ered themselves excused under the circumstances, ,but they did not, arid their obedience led to the fulfillment of the prophecies and to the joy of the shepherds and of the Magi and of all Christians. The shepherds believed and acted upon the almost'unbelievable words of the angels that they .- should find God wrapped in swaddling '~lothes and laid in a manger. They belie,veal and followed' humbly and, found happiness. The Magi were obe~tient to an impulse of grace and to the light of a st~r, traveling great distances on what; no doubt, their friends called a wild,goose chase. They also found God and happiness~ All~ these were humble enough to see God in a helpless Babe and obedient enough to come in search of Him and adore Him. ,Thus they found joy,andpeace. The Presentationfifids Joseph and Mary offering Christ in tile ~emple in respons~ to the command of the Jewish law/"Every male~ opening the womb shall be called holy to the Lord" (Luke 2:23). Again Mary might have held herself exempt, for the virgin birth kept her from coming directly under the law. But Christ was her first-born,'anit so she complied even though her virginity wasuntouched. H:id she failed to comply, her neighbors, who did not kno~ of the miraculous nature of the birth, would have be~n 84 Marcb,'1947. ,~ THE ROSARY AND GOD'S WILL scandalized. Because she did comply, some people have doubted her virginity. Mary chose the second'~horn of this dilemma. Whatever Mary may have foreknown, God cer-tainly foresa.w that heretics would use this obedience of Mary's as an argument against her perpetual virginity'. God is most zealous.of Mary's honor; ye~ He inspired her to fulfill the law. For "obedience is better than sacrifice," because by obedience the whole man body, mind, and will is given entirely to God. On another occaslon, too, God taught.obedience at the risk of some people's misunder-s~ tanding Mary's glory. Christ, while speaking to a crowd. was told that His mother and brethren stood outside seeking t9 speak to Him; and'pointing to His-f011owers about Him He said, "Behold my mother and my brethren. Forwho~ soever shall do the will of my Father is my brother and sister and mother.'.' (Matthew 12:50.) And again .when the woman in. the drowd cried out blessing His~ mother, Christ answered, "Yea, rather~ blessed are~ they who hear the word of God ~ind keep it" (Luke 11:28). ,We know tha~,.the true understanding of these passages gives Mary praise; but nevertheless they urge us to praise her more. l~ecause her will is one With His than because she is mother. ' The Findin~ in the Temple orecalls these words of Christ,-"Did you not know that I must be about my Father's business?" (Luke.2:49.) Mary's question had u~ed the word "Father" in reference to Josdph;-Christ used it in reference to God the Fathers"from whom comes a11 paternity" and all authority. Doing His Father's business was, of course, submitting Himself to His Father's-will, was being obedient. These are the first words of Christ recorded in Scripture. His first lesson is a lesson of obedi-ence. His last lesson is the same, for "He,was obedient unto death, even unto the death Of the cross." 85 T. N. JORGEN~EN \ Revieu~ for Religious ~ In foretelling the characteristics of Christ, .the Psalmist says in His name, '~Sacrifice and oblation. ~ burnt offering and sin offering thou didst not require~ Then said I, 't3ehold t~c~me: In the h~ad of the book it is written of.me that I should do thy' will. O my God, I have desired it, and thy law is in the depth of my h~ar't.' " (Psalms 39:8ff.). A,fter ° the finding.in the Temple, "3esus went down into. Nazareth With Mary and 3oseph and.,was subject tothem." His thirty years of life in Nazareth give, in. point of time at least; ~a tenfold emphasis upon obedience over all the l~ssons which He crowded into'the three .years of public'miniStry! " The Sorrowful Mysteries carry on 'the lesson of humble obedience.- A.week before the Passion, Christ said to His - protesting apostles; "Shall I not drink the chalice which my Father has prepared for Me?" Looked upon as medicine which the perfect Doctor has carefully prepared,, sufferings become endurable, even most desirable. And they are jus.t that--the best of medicine. We' never have faced and never will face any suffering which God has not,prepared or per-- mitted for a very definite good in our spiritual life. ._ At the beginning of His Passion Christ spent hours in the agony in the garden praying over and over again~ "If it ¯ be possible let this chalice pass from me, howev~er,, not my ~ill but Thine be done.~" Not my will but Thine be donee-how perfectly these words of the first sorrowful mystery echo Mary's words of the first joyful mystery, "'Be it done unto me-according to thy word."-With this prayer to strengtl~en Him, Christ overcame His fear' and went forth bravely with unwavering poise to endure the worst that man and devil could devise. All that He endured, He looked upon a~ providential, the fulfilling of the prophecies;., the sanctifying, of the human race, the chalice prepared by His loving Father. Like P~ter He was subj~ct to human authority "for God's sake." Like Paul He taught that "there is no power butofrom God and. those that are ordained by God: therefore he that resists lawful superiors, resists God" (.Ro-mans 13 : 1 ). -The Glorious Mysteries take, up where the sorrowful ones leave off, fob they picture the reward which Christ gained by His Passion. "He humbled himself becoming obedient unto death, .even to the death of the cross. For which cause. God has exalted'Him and has given Him a name" which is above all other names, that in the name 6f 3esus-every knee should bow of those that are in Heaven, on earthl and under the.earth, and that eyery_tongue should confess that the Lord ,Jesus Christ.is in the glory of,Ggd the Father."- (Ph!lippians 2:8ft.) The reward which ,we meditate upon in the glorious mysteries, Christ's and Ma~y's and the saints', is the pledge and protot~rpe, the promise and the pattern, of.the glory that c6hae~ to all who through. humble obedience gain gl0ridus triumph. Virtue means being like.the blessed in heaven; their'ob~dience is c~mplete and therefore their freedom and.happiness are perfect. This/ prayer.at the beginning of each decade keeps reminding us,. in .our subconscious mind at least if not in ou~ conscious thoughts, that the road to peace and joy and triumph is identical with the road to the fulJ surrender of ou,r will to Gbd. At times it may. not seem so to us, of course, because oub ignorance and emotion may blind us to a great degree. We are like men walking a straight and well-marked road in a fo~ or darkness which gives, it a strange and d~u.btf, ul appearance, It is just b~cause of this deception that we, x - T. N. All of the foregoing shows us how the vital lesson of_ humble obedience is taught, and taught with the great insistence it deserves, in the Rosary. _It would be an inter-esting and a highly profitable exercise to see how other import,ant lessons and virtues ruin through the fiifteen mys-teries. They a, re there.~ All that we need is there, for ~the Rosary is the story of the Incarnation, and the Incarnation is God's answer to original sin, God's o;,vn wonderful'plan for our perfection and salvation. THE effects of Holy Communion are wrought primarily in the soul. By a most intimate union through~char-ity, Christ taken as food sustgins and nourishes the soul, causes it to grow in grace, builds up the ravages wrought by sin, .and brings delight. But it would be strange indeed if Holy Communion "had no effect on-the body. We consider holy .the altar on which the body and blood of Christ is Offered; afad the tabernacle in which He rests, a sacred place. Ought not our bo'dies, into whic~ He has entered so often,-be sacred too? During His lifetiine here on earth, great healing power. wentout from the mortal body.of Christ.~. "And all the multitude sought to touch him, for virtue went out from him, and healed a11" (Luke 6:19). These wonders were worked by a mere paS~ing contact. Now that the body of Christ is glorified, what wonders ought we not to expect from His coming into ofir very bodies? "For no man hateth his own flesh: but--nourisheth and-cheris'he'th it, a.~' algo Christ doth the church: because we are members of his body, of his flesh, and of ~is bones~' (Ephes.ians 5:29, 30). Man is composed of two elements, a body and a soul. These twoare most ihtimately joined and greatly influence each other. This is well illustrated by the transmission of original sin. ~ " If the. flesh of the first man made poisonous and° mortal com-municates death to the soul, shall not the Flesh of Christ. wbich is l~ealthful 'and life-giving, bestow upon it life and safetg? St. Clement of A1exandkia says: And the mixture 6f b6th--of the drink and of the Word.---is Call~d Eucharist, renowned.and glorious grace: and they who by faith p~rtake of-It are sanctified both in body and in soul. For the divine mixture, man, the Father's will has rhystically compounde~d bY the, Spirit and. the Word. For, in. truth, the Spirit is joined to.the soul, which is inspired by It: and the flesh, by reason of whichthe Word. became flesh, to the-Word. (Paedogog., 1.2, c.2.) B~r reason of the uriion of the body of Christ with our bodies in,Holy Communion, a sort of relationship arises between our bodies and His. There is a certain affinity, of c0~ncorpo~ration everi,, between our bodies and His. The Fathers of the Chu, rch speak of_this not merely as of a passing state existing only--as 10ng as the sacred- species remain with us, but as of a permanent effect in-our bodies, setting up something of a blood relationship with Christ. He considers our bodies as somethihg of His own and sur-rounds 'them with a special" protection. According to the promise of Christ and the declaration~ of the Fathers it seems that we must say that Christ the Lord considers the very flesh,of tho~'e who_worthily receive the sacrament as I~is own flesh b~t special a~nitg, as though consecrated by contact with His. most sacred flesh . This mystical 9O 2 EFFECTS OF HOLY COMMUNION union of our flesh with the flesh of Christ receives its fuller consum-mation and as it were sacramental consecration through, conjunction of His glorified body and blood with our own b6dies. In thi~, union ire celebrated th~ nuptials of the Lamb with His Spouse the Church still pilgrimaging in the single members; which will be celebrated more happily and in more complete union only in our heavenly l~ome. (Franzelin, De 85. Each., c. 19.) Holy Communion" restores to .us something of our 6riginal integrity. St. Gregory o'f Nyssa says: Since we have tasted (of the forbidden tree) which has wounded our nhture, we must have something that will "heal what has been wounded . ~Now what is this? Nothing other than. that body that has showed itself stronger than death and was_the source of our life. For'as a little leaven, as the Apostle says, fermenteth the-whole mass, so the body give~ over by God to death thoroughly changes us into itself when itis within us. (Patrologia Graeca, 45, 94.) Thii does not mean, of course, that. concupiscer~ce is .completely extinguished by receiving the Holy Eucharist. But by means of the Sl~eciaI abundance of grace the sacra-ment ,brings to the soul, it is much easier to overcome the temptations o'f the flesh and the devil. (~oi~cupiscence is gre~itly restrained arid we are able to dominate ~it more easily. Such chanriels of grace are opened in the soul that they overflow, so to speak, to the Body whidh is so inti- ~atelyJconnected with it. But there is an even more immediate effect upon ~he body:Z Sometimes the presence df Christ in us weakens our propehsity~to be aroused by carnal excitations. By a cer-tain preternatural tempering of the bodily dispositions, it restrains,our natural incliiiation t0ward-things.6f the flesh. Although this is not certain, it dods seem that at times Christ has almost fettered concupiscence in the bodies of His saints, This would seem more .proBable since the sacrament of extreme unction affects the body when God sees fit. We ,must also take into consideration the fact that God can exercise His special providence in this regard by 91 C. A. HERBST Review for Religious removing external occasions that are the cause of sinf~l movements in man and by exciting in him thoughts and affectibns that lead to t.emlSerance. De Lugo explains that the Eucharist affects the body di/ectly and immediately "b~ro diminishing the intensity of the fire of_ concupiscence,' partly by putting the demons to flight so that they will not present images of sinful objects, partly by quieting and'sup-pressing the activi.ty of the humors, lessening their inten-sit, y, and so" forth" (De Sac. Each., 12, 5). The effect of Holy Communion on the body most dwelt upon in Christian tradition is that indicated by Christ in John 6, 55: "He that eateth my flesh, _and drinketh' my blood, hatheverlasting life: and I will raise him up in the last ~tay." Although it is decreed for every man once to die and for his body to return to the earth from whence it was taken, there results from the reception of this sacrament some beginning of incorruptibility and immortality already in this life. St. Ignatius speaks of "breaking one and_the same bread, which is the medicine of immortality, and the antidote to prevent us from dying, but (which causes) that we .should live forever in Jesus Christ" (Eph., 20). St. Irenaeus says: "Thus also our bodies, receiving the Eucharist, are no longer corrut~tible, having the hope of-tl~e ~esurrection"; and "How do they deny the flesh to be "capable of the gift of'God, which is eternal life, Which is nurtured by the body and blood of Christ, and is a member of rus. (Patroloqia Graeca, 7, 1029; 1126.) St. Cyril of Alexandria comments thus on John 6, 55: I, He says, being in him that is, by My flesh will raise him who eats up again, even on the last day. For, of course, it cannot be that He who accordihg to nature is life shoul'd not prevail over cor-ruption and vanquish de~th. So although death, which has taken hold of us by the Fall, has reduced the human body to the necessity of corruption, still, because Christ by His flesh is in us, ~e shall cer-tainly rise a~gain. For it is unthinkable, quite impossible even, that March, 1947 EFFECTS 0~- HOLY COMMUNION the Life should not restore life to those in whom He dwelt. For as we put a spark in a heap of straw that the seed.of the fire may~be preserved, sb also Our Lord Jesus Christ through His flesh enkindles life in us and, as it were, sows in us the seed of immortality which removes.all the corruptio.n that is in us. (Patrologia Graeca, 73,582.) In the dogmatic teaching of ~he ChurCh, one finds little about the effects of Holy Communion on the body; but .tra.dition-is heavy with it. Perhaps no better indication of its burden can be given than is contained in these words Of St.~ Irenaeus: ~ ~ 'Wherefore,also the Blessed Paul says in the Epistle to the Ephe: sians: "For we are members of his body, of his flesh and of his bones" (Epl~esians 5:30): not of some spiritual orinvisible ~an s~ying this :. "for a spirit has neither bones' nor-flesh" (Luke 24: 39) ~ but Of that disposition which is of a true man, which consists of flesh and nerves and bones. (Patrologia Graeca, 7, 1126~.) As indicated, modeln theologians have als0 made~m~fch of it. About ali that can be~said on the_whole matte~ has been summarized masterfully by qne of.the greatest of them. ~ W.hen Christ' is worthily received.,He is .r~eally joined ,witia the recipient, because He is truly and properly within him~ and as it were ~aken in a. bodily embrace. From this it follows that, as 10rig as Christ is present, in so far as it is from His sacramental power, He excites the recipient, to love, and in affection also embraces him cor-porally, who has Him corpora.11y within himself. Then again, from the same bodily reception and.as it were commingling, as the s~ints say, there remains,'~ven after the real presence of Christ is gone, a. certain relationship between Christ and the recipient. For by reason of that cont.act, by special title this one is considered something of Christ. Christ has special care not only~of his soul, but even of his bod~. He sanctifies it. He makes it partaker of His glory." Positive cultivation of interest is by all means the great means-to .- progress in prayer. Now it is proposed to add some other III. A third way to vitalize meditation i,s clearly to conceive the end or purpose of it and. then to feel quite free to choose any means that are suitable. Different persons -~ would express the aim of meditation differently, but/,11 such ¯ formulations should eventually .come to ~omething like- .these: namely, to ady_ance in the knowledge/, love, and work of God; or, to achieve wholehearted love of God, both affective and effective; or, intelligently and "earnestly to- - accomplish the divine plan for one. More particularly and more proximately mental prayer should give one a keener kno~-wled~e and a more. nearly adequate appreciaf!.on Of divine realities and ~v, alues, and thus greater good will," indeliberate and deliberate. To this end, clea.rly and s.teadily held before the mind, all contributive means are legitimate. Herein lies one of the great differences ~etween vocal and mental prayer. In. reciting the Office, for example, one has rio freedom; all that one can do is pre-cisely that which has been prescribed. In mdntal prayer one c~n follow any good-idea or"affecti0n or discuss any- -thing with God. God's own infinite_ magn.itude is an 98 DIFFICULTIES IN MEDITATION~II unlimited field to be explored and talked over with,Him. His whole universe, so far-reaching in space and time and scope, all conducive in some way or other to our supernat-ural d.estiny, is also appropriate matter for consideration with Him. Naturally an~ laudably in any particular.hour of prayer a person would have a specific purpose; but if ,he finds it too difficult to pursue that, he can always fall back upon. the general end of prayer. This is always available, and alway~s al~o great and inspiring. ¯ If one should find that he has nothing tO think about or nothing to say to God, he cofild prayerfully consider jhst this problem with God. He .might find exci~l.lent material °for humiliation and shame; and an advance in humility is one of the best .things possible in the spiritual life. ".In fact it would seem that in whatever situation or predicament a man can find hiinself, he could have a little conference about it with his heavenly Father a'nd turn it to 'good account. He could help verify the principle that to those who love God and-see their opportunities everythifig Works out for the best. IV. It has just been pointed out that in mental prayer one is free to do anything that promotes one's purpose. The intelligent ,6se of method enables one to make the most this freedom. Method may be necessary, in the beginning esp~ecially, and it may be most useful, but it is' not to be fol-lowed for its own sake. Like other means, to .which it assigns order and measure, it should be used when it con-tributes to the result sought: otherwise one should, feel at perfect'liberty,to abandi~n it. If.prayer comes naturally and spontaneously; so mudh the better. To help different people or the same person at different times, there are at least eleven methods of meditation that are more or less ~ell. known. Such schemes could be of great assistance in moments of temptation as well. as during the hour~ of meditation. To illustrate what is meant, an example or t,wo may be given. When in the course of one's mental prayer it is appropriate that one should feel moved and still one is ~o torpid that no emotion arises.spohtaneously, one could ask : ','Which of these affections should I feel ?- Love, hatred; desire, aversion; joy,~ sorrow; hope, despair:~cour-age,', fear; anger?" If a man has been thinking of some good person, or thing, perhaps he should feel moved to compla-cence, admiration, awe, a sense of sublimity,, reverence, desire, hope, confidence, courage; love, joy, gratitude, zeal, loyalty, emulation. , An evil object might call forth displeasure, hatred, aversion, horror, disgust, pity, fear;- grief, shame, humiliation, confusion, contrition, and so forth. To move or stren.gthen the will, one might consider such motives as these schemes propose: ~ ~x 1. Holy happy they~are who carry ou~ the divine plan; nega,- tively, positively.--Hqw lovely, God is! 2. The consequences, good or bad7 of.possible courses of action; for self, for God, for others; in time, in eternity.---Their intrinsic.~ - values; the pleasant or unpleasant features about them: their proprie-ties or improprieties. " ¯ ~ 3. Necessity, (possibility), facility,uPleasure, utility, .nobility. 4. Truth, goodness, beauty.--Accomplishment, joy, peace: b~atitude, imperfect in time, perfect in eternity. " V. There are. not many .minds that can do much origir~al thinking. Then to"evoke and guide thought, have some "anticipating scheme," such as the familiar questions, "Who?'~ What? When?. Why?" and so fbrth. Try to develop imagery that-is- rich and realistic. Do. not expect the process of repro-ducing ideas to b~come much easier by repetition. When One is contemplating something that. is or was visible, for example, an incident in the life Of Christ, it is advisable to visualize it, that is, to reconstruct it as fully as possible before the e~es of the.imagination. Then, also one should .cultivate empathy/, that is, feel oneself, as it were, into the situation of those who a~tu~lly' took part in the historical occurrence; how, for instance, should I '.have felt if I had been one of the spectators at the-resurrection of Lazarus? Finally, in all mental prayer one. should keep in mind and be guided in the first place by the though~ of one's ~rocation, its purpose, its requirements, values, and so ¯forth. .VI. Amgng other aids to meditation the-following deserve mention or further consideration: 1. Pra~lerful and reflective reading is perhaps the' most obvious help and one that hardly any.literate person could normally 'excuse himself fr6m. It is not at all equal in commendability to m'ental prayer, but is a very excellent means of prayer and sanctification, andincomparably better than, say, sleeping. Nor is .it so lowly and mean as may at first appear. For many years no less a mystic tfaan the great St.Theresa needed a book to pray over. From rime'to time one sl~ould pause;, reflect, apply the ideas-to oneself; and confer with God. Medi-tative reading would,seem to be the absolute minimum to, be exPecte~ from an intelligent and earnest-person. 2. Thoughtful vocal prayer can also be.a great.~help,. In prayers of one'sown choice it is not the ~aumber of words that counts, but the disposition of mind, of .feeling, and of --will with which they, are said. Hence the de~ir~ibility of imp[oving these qualities. To recite one's prayers slowly, deliberately, emphasizing appropriate phrases or repeating them, and to throw as much heart and spirit ,,as possible into them, are so many ways~0f augmenting the efficacy of. therri. One of St. Teresa's nuns could not pray except vocally : .but in this case it was discovered that the recitation was accompanigd by a high form of mystical contempla-tion (The Way of ,Perfection, chap., ,41). Very -probably the best way to recite the Divine Office--I do not _say tile easiest or the fastest-~--would be to try to accompany it with a ~entle sort of diffuse contemplation. This way-,would .als0 be felt as .less burdensome-than some others. For St. Ignatius in-his last years, the breviary was so potent a stimulus to contemplation that he could not get on with-saying it andhad to be dispensed from the obligation. 3. All°~uthorities on prayer are agreed that for success in it'a minimum measure of morti~cation is ,required. It would not be possible except for a short time since'rely and earnestly to strive during° meditation to prefer the better things and ask God to help one unless at other times one tried, and to some extent successfully, to forego the worse ~hings. Bodily mortification is one of the first means to spiritual iidvankement and a person could not neglect it altogether, and then decently and wholeheartedly beseech God for His graces. Interior mortification, or self-coxitrol, rn'astery of~one's emotions, is even more ~learly and closely 103 G. AUGUSTINE ELLARD Review for. Religiot2s connected with prayer and imperatively demanded by it. Mental prayer is" almost synonymous with cultivating a good moral disposition, and this in .turn is almost synony-mous with holding one's inferior ificlinations in check. -Nobody who complains of too much difficulty or of failure in meditation need fe~l discouraged until he has given mor-tification, one of the standard means, a fair trial. Pro-ficiency in mental prayer is not one of thOse good things. that one can get for nothing. 4. Distractiot~S are a teasing and perennial prbblem-. We can hardly hope for a complete victory over them. But even when involuntary and inculpable they involve a real loss of precious,graces, and. to reduce this it is all the more necessary to make our conquest of them as nearly complete as possible.1 How close to perfect victory it c~in come is shown b'y the records of ~ome of the saints, notably of St. Aloysius. There is no simple remed~ for distractions. ~Tbe saints seem to have combated thein with a multiplicity _ o~:weapons. Each one must find out for himself what com-bination of means is most effective foi him. A little knowledge of t~he psychology of a~ttention will make one's effort more ,intelligent. We may distinguish three stages in the development of attention. In the first it is instinctive or exploratory and depends upon native or acquired interests. With this, for instance, a teacher of small children mus~.begin. Then for a time attention.may be forced; tb~at is, it m, ay need to be supported'by extraneous motives. The. old-fashioned teacher's hickory, stick may exemplify thi~ phase, or a college student toiling for credits. 1The statement in the text to the effect that even involuntary distractions involve a loss of precious graces may sound startling to some. However, it should be kept in mind that strictly mental prayer is incompatible with distractions, whether volun-tary or involuntary. A distraction really brings mental prayer to a dead stop; and thus the fruits that belqng precisely to the mental prdyer itself are lost. It is true, 0f course, that the effort made to avoid distractions is highly pleasing to God: and it may well be that God rewards this effort with graces that equal or even sutpass the fruits that would be obtained from a prayer made without distractions. ED. 104 March, 1947 DIFFICULTIES IN MEDITATION--II Finally, wheri the matter is fit to excite and' hol._d interest and one has,got sufficiehtly far into-it to see and feel that fact, attention becomes spontaneous. This of-cot~rse is the Kind that is desirable .and to be aimed at. Determinants .o~ attention, as enumerated by psy-chologis, ts, may be either external (objective) or internal (subjective). In the case of meditation the.external factors are likely to be sources of, trouble. Change attracts notice; witness lights that flicker on and off. Loud noises and bright colors are more apt to get attention. The larger,a ~hingis, the more probably, other.things being equal,, it will be remarked. .R_epetition makes for attention in many cases; thinl~ of certain advertisements or slogans. Nov~etty of any kind or unusualness is one of the .very best stimu-- Iantsof attention. Position may give an object a b~tter chance for notice, for instance, if it is nearer the observer or in the center, say, of a picture or display. Lastly, and mostly, significance br meaningfulness is a. potent .cause of attention; for a soldiel on guard in the combat zone the slightest noise or movement may be mo~t important and get his ,rapt consideration. These external stlmull,-are in general .just what one who is trying to pray without dis-tractions must as far as possible avoid. ., Tl~e internal, subjective factors are much more rele-vant to our l~urpose. It is easy and natural for us to aitend to whatever is in accord with our fundamental instinctive inclinations; an example would be anything that touches our pride or inherent tendency to pleasure. The same is true of the leading emotional "tendencies that we have admit'ted into our lives or deliberately built up therein. A strong and long fostered zeal for the foreignmissions would make one attentive~to anything that concerns th, em. Our moods have a similar effect. When we are glad we are inclined to notice what makes us more glad and w.hen we !05 G. "A kindly ~lispo~ed per--. son will attend to. th~ better-things in others, a'rfd a con-firmed fault-finder will rather see~ their weaknesses. Edu-cation and training prepare us to attend to special fields.: Think of the differences in this respect between, say. teaching nuns, hospital workers, and'_cloistered contempl.a-tires. Of all these interior conditions pertinent to atten-. tion.and it~ opposite, distraction, perhaps ~he most i.mp~)r-. rant for those who are cultivating mental prayer is one's °purpgse, whether it. be passing' or permanent. Ifi for e~ample, a man's aim be to make a particular sale or to amass millions of. dollars before he dies, it will .be natural for him to .give his attention tO Whatever seems to conduc~ to that.purpose or to interfere with iL One wh~ is seeking fame and. honor is~ sensitive to_. all that pertains to if'and indiffereni: to other~ things. A saint is alert and resporisive to whatever'makes for progress in the love. and service of God,', an~ apostle_to anything that appears to promise help ifi sanctifying souls. Henc~ the, supreme importance and necessity of knowing, with the, ~utmost clarity, w15at ,we should want, of appreciating its value ~.fully, and then of really ~and earnestly. ~anting it. ~Naturally enough we attend to what we really want. ~ In r.addition to ,knowing and respecting the psycho-logical law~ that govern attention and: diversibn of it, one's. effort to ~ivoid distractions might well include o'the~ "fol-lowing: to acknowledge, with the proper, sense of humili-ation, that the force of distractions is greater for one,than the .attrac,tion~of God or of union with Him; to feel and appreciate as realistically as possible wha~ great.priv~ation~a in the spiritual order distractions cause for us, foroGod, and for souls: to understand that abi!ity to concentrate is One 106 March, 1947 DIFFICULTIES IN MEDI~FATION--II" 6f the most elementary desirable t?aits ii'n a p,ersonality, and that~ it is moie or less necessary for any kind of success. (nobody would expect much from a scatterbrained crea, tute.); and, ~finally, when distrac'tions do Occur and are noti.ced, to turn them to good account by a-vigorous recall of attention~ by hu,mbling oneself, by deploring the losses suffered, by talking the matter over with Gqd from differ, ent~ points of view, andby begging grace to profit even f, ro~ bne's weakneises. 5. An aid:to progress-in meditation that is especia11~ in place for American religious and priests of the twentieth century is rnoderatibnin external activities. For some~there always was the danger of.neglecting one's own interior 'life and giving oneself e~cessively to works of zeal for others, Various r~asons now seem to make this danger greater than ever before, In any man, thought.should, hold h certain primacy overaction, and above all in one who profes, ses to specialize, in the spiritual life. Overabsorption in wprk, even if it be the best possible kind of work, leaves one too tired physically for mental prayer, unbalances one's intdr- f._ :. ests and preoc~cupations, and, perhaps worst bf all, involves a certain necessity of being more or less distracted while attempting to deal with God and one's own soul. ~ 6. One of the. best means to progress iri Virtue and in prayer-is what ~e may call the general discipline of one's imagination., and emotions. It is about .the same as interior mortification or, what is more pertinent now, recollection. It is both an effect of prayer and a condition of success in subsequent prayer. If a man leave his imagination and emotions free to drift fo_r'themselves, at the very leasth~ will squander much of his energy and time, accomplish l~ss for himself and for souls, give God so much less glory, and be less happy in heaven for eternity. But it is hardly pos-sible that such a man's losses should he"merely negative. :107 G. A~GUSTINE ELLARD ~ Re~iew for Religiot~s Sooner or later he will also com~it more s~in andothus incur positive penalties. So much for the effect upon his moral ,status in general. As for prayer, he will come to it less well prepared, with less taste for it, ,with greater tendencies to all that is contrary to it, and naturally therefore with less facility in it. ~ Provin~ ~he good will protested to God in this morning's meditation will keep one better recollected during the day, better disposed in every way to avoid, evil and do good,~and betterfitted to deepen that good will in tomorrow morning's prayer. 7. Bodily posture ,is a factor of success or failt~re in prayer. Those who are free should find out by experiment what position helps them most at the time of meditation. It could.hardly be the one whichis also the most conducive to sleep. In any case it must be reverent. 'At °different times or in different states of mind or of nerves, various positions may be best. During an hour both kneeling and standing might be used., Gentle walking back and forth in some suitabl~ place is a distinct aid to some people. "One possible advantage about it is that it helps to keep away drowsiness. 8. If the aim be prayer, rather than something else, there dhould-be intelligent choice or: subject matter. The needs, capacities, graces, and so on, of all the individual members in a community are not just the same; still less are t,hey the same on, say, the fifteenth of March every year for a lifetime. Therefore, from the pqint of view of prayer it is not desirable, generally speaking, that points be read to a whole community, especially from the same book, year after year. Here again th~ guiding principle should be, "Know your objectiye and select the most suitable means!" Often-times, for instance, subjects taken for meditati6nshould be such as will reinforce one's efforts in the particular examen. Finally, it would.be a distinct aid to proficiency, in mental prayer to read, say. every fe.w years, one after another of the great classical works on prayer. What can Ido to become interested? ~ ° ~ Reverend Fathers5 ¢ In my opinion, much of the prevailing difficulty that exists for religious in the exercise .of mental prayer is owing to the fact that so -little is known by religious of a'nything beyond the discursive method of prayer (cofisiderations, affections, resolutions). Introduction Such symptoms as hard, complex, bodily or mental feelings, that turn our everyday life into a hell, at first, lead us to a doctor, and then - to a psychotherapist. A sick man is keen to get rid of a symptom. A doctor prescribes medication, that is ought to eliminate a symptom. A psychotherapist searches for a reason of the problem that needs to be removed. There is such an idea that a neurotic symptom, in particular, an anxiety - is a pathological (spare or extra) response of a body. It is generally believed that such anxiety doesn't have some real, objective reasons and that it is the result of a nervous system disorder, or some disruption of a cognitive sphere etc. Meanwhile, it is known that in the majority of cases, medical examinations of anxious people show that they don't have any organic damages, including nervous system. It often happens that patients even wish doctors have found at least any pathology and have begun its treatment. And yet - there is no pathology. All examinations indicate a high level of functionality of a body and great performance of the brain's work. Doctors throw their hands up, as they can't cure healthy people. One of my clients told me her story of such medical examinations (which I'll tell you with her permission). She said that it was more than 10 years ago. So, when she told her doctor all of her symptoms - he seemed very interested in it. He placed a helmet with electrodes on her head and wore some special glasses, when, according to her words, he created some kind of stressful situation for her brain, as she was seeing some flashings of bright pictures in her eyes. She said that he had been bothered with her for quite a long time, and at the end of it he had told her that her brain had been performing the best results in all respects. He noted that he'd rarely got patients with such great health indicators. My client asked the doctor how rare that was. And he answered: "one client in two or three months." At that moment my client didn't know whether to be relieved, flattered or sad. But since then, when someone told her that anxiety was a certain sign of mental problems, or problems with the nervous system, or with a body in general, she answered that people who had anxiety usually had already got all the required medical examinations sufficiently, and gave them the advice to go through medical screening by themselves before saying something like that. Therefore, we see a paradoxical situation, when some experts point to a neurotic anxiety as if it is a kind of pathology, in other words - some result of a nervous system disorder. Other specialists in the same situation talk about cognitive impairments. And some, after all the examinations, are ready to send such patients into space Main text I don't agree with the statement that any neurotic anxiety that happens is excessive and unfounded. It often happens that there is objective, specific and real causes for appearance of anxiety conditions. And these causes require solutions. And it's not about some organic damages of the brain or nervous system. The precondition that may give a rise to anxiety disorder is the development of such a life story that at some stage becomes too toxic - when, on the one hand, a person interacts with the outside world in a way that destroys his or her personality, and, on the other hand, this person uses repression and accepts such situation as common and normal. Repression - is an essential condition for the development of a neurotic symptom. Sigmund Freud was the first who pointed this out. Repression is such a defense mechanism that helps people separate themselves from some unpleasant feelings of discomfort (pain) while having (external or internal) irritations. It is the situation when, despite the presence of irritations and painful feelings, a person, however, doesn't feel any of it and is not aware of them in his or her conscious mind. Repression creates the situation of so-called emotional anesthesia. As a result, a displacement takes place, so a body starts to signal about the existing toxic life situation via a symptom. Anxiety disorder is usually an appropriate response (symptom) of a healthy body to an unhealthy life situation, which is seen by a person as normal. And it's common when such a person is surrounded by others (close people), who tend to benefit from such situation, and so they actively maintain this state of affairs, whether it is conscious for them or not. At the beginning of a psychotherapy almost all clients insist that everything is good in their lives, even great, as it is like in everyone else's life. They say that they have only one problem, which is that goddamn symptom. So they focus all of their attention on that symptom. They are not interested in all the other aspects of their life, and they show their irritation when it comes to talking about it. People want to get rid of it, whatever it takes, but they often tend to keep their lives the way that it was. In such cases a psychotherapist is dealing with the resistance of clients, trying to turn their attention from a symptom to their everyday situation that includes their way of thinking, interactions with themselves and with others and with the external world in order to have the opportunity to see the real problem, to live it through, to rethink and to change the story of their lives. For better understanding about how it works I want to tell you three allegorical tales. The name of the first tale is "A frog in boiling water". There is one scientific anecdote and an assumption (however, it is noted that such experiments were held in 19 century), that if we put a frog in a pot with warm water and start to slowly heat the water, then this frog get used to the temperature rise and stays in a hot water, the frog doesn't fight the situation, slowly begins to lose its energy and at the last moment it couldn't find enough strength and energy to get out of that pot. But if we throw a frog abruptly in hot water - it jumps out very quickly. It is likely that a frog, that is seating in boiling water, will have some responses of the body (symptoms). For example, the temperature of its body will rise, the same as the color of it, etc., that is an absolutely normal body response to the existing situation. But let us keep fantasizing further. Imagine a cartoon where such a frog is the magical cartoon hero, that comes to some magical cartoon doctor, shows its skin, that has changed the color, to the doctor, and asks to change the situation by removing this unpleasant symptom. So the doctor prescribes some medication to return the natural green color of the frog's skin back. The frog gets back in its hot water. For some period of time this medication helps. But then, after a while, the frog's body gets over the situation, and the redness of the frog's skin gets back. And the magical cartoon doctor states that the resistance of the body to this medication has increased, and each time prescribes some more and more strong drugs. In this example with the frog it is perfectly clear that the true solution of the problem requires the reduction of the water temperature in that pot. We could propose that magical cartoon frog to think and try to realize that: 1) the water in that pot is hot, and that is the reason why the skin is red; 2) the frog got used to this situation and that is why it is so unnoticeably for this frog; 3) if the temperature of the water in the pot still stay so hot, without any temperature drop, then all the medication works only temporarily; 4) if we lower the temperature in that pot - the redness disappears on its own, automatically and without any medication. Also this cartoon frog, that will go after the doctor to some cartoon physiotherapist, will face the necessity to give itself some answers for such questions as: 1) What is going on? Who has put this frog in that pot? Who is raising the temperature progressively? Who needs it? And what is the purpose or benefit for this person in that? Who benefits? 2) Why did the frog get into the pot? What are the benefits in it for the frog? Or why did the frog agree to that? 3) What does the frog lose when it gets out of this pot? What are the consequences of it for the frog? What does the frog have to face? What are the possible difficulties on the way? Who would be against the changes? With whom the frog may confront? 4) Is the frog ready to take control over its own pot in its own hands and start to regulate the temperature of the water by itself, so to make this temperature comfortable for itself? Is this frog ready to influence by itself on its own living space, to take the responsibility for it to itself? The example "A frog in boiling water" is often used as a metaphorical portrayal of the inability of people to respond (or fight back) to significant changes that slowly happen in their lives. Also this tale shows that a body, while trying to adjust to unfavorable living conditions, will react with a symptom. And it is very important to understand this symptom. Symptom - is the response of a body, it's a way a body adjusts to some unfriendly environment. Symptom, on the one hand, informs about the existence of a problem, and from the other hand - tries to regulate this problem, at least in some way (like, to remove or reduce), at the level on which it can do it. The process is similar to those when, for example, in a body, while it suffers from some infectious disease, the temperature rises. Thus, on the one hand, the temperature informs about the existence of some infection. On the other hand, the temperature increase creates in a body the situation that is damaging for the infection. So, it would be good to think about in what way does an anxiety symptom help a body that is surrounded by some toxic life situation. And this is a good topic for another article. Here I want to emphasize that all the attempts to remove a symptom without a removal of a problem, without changing the everyday life story, may lead to strengthening of the symptom in the body. Even though the removal of a symptom without elimination of its cause has shown success, it only means that the situation was changed into the condition of asymptomatic existence of a problem. And it is, in its essence, a worse situation. For example, it can cause an occurrence of cancer. The tale "A frog in boiling water" is about the tendency of people to treat a symptom, instead of seeing their real problems, as its cause, and trying to solve it. People don't want to see their problems, but it doesn't mean that the problem doesn't exist. The problem does exist and it continues to destroy a person, unnoticeably for him or her. A person with panic disorder could show us anxiety that is out of control (fear, panic), which, by its essence, seems to exist without any logical reason. Meanwhile the body of such a person could be in such processes that are similar to those that occur in the conditions of some real dangers, when the instinct for self-preservation is triggered and an automatic response of a body to fight or flight implements for its full potential. We can see or feel signs of this response, for example, in cases when some person tries to avoid some real or imaginary danger via attempts to escape (the feeling of fear), or tries to handle the situation by some attempts to fight (the feeling of anger). As I mentioned before, many doctors believe that such fear is pathological, as there is no real reason for such intense anxiety. They may see the cause of the problem in worrisome temper, so they try to remove specifically anxiety rather than help such patients to understand specific reason of their anxiety, they use special psychotherapeutic methods that are designed to help clients to develop logical thinking, so it must help them to realize the groundlessness of their anxiety. In my point of view, such anxiety often has specific, real reasons, when this response of a body, fight or flight, is absolutely appropriate, but not excessive or pathological. Inadequacy, in fact, is in the unconsciousness, but not in the reactions of a body. For a better understanding of the role of anxiety in some toxic environment, that isn't realized, I want to tell you another allegorical tale called "The wolf and the hare". Let us imagine that two cages were brought together in one room. The wolf was inside one cage and the hare was in another. The cages were divided by some kind of curtain that makes it impossible for them to see each other. At this point a question arises whether the animals react to each other in some way in such a situation, or not? I think that yes, they will. Since there are a lot of other receptors that participate in the receiving and processing of the sensory information. As well as sight and hearing, we have of course a range of other senses. For example, animals have a strong sense of smell. It is well known that people, along with verbal methods of communicating information, like language and speaking, also have other means of transmitting information - non-verbal, such as tone of voice, intonation, look, gestures, body language, facial expressions etc., that gives us the opportunity to receive additional information from each other. The lie detector works by using this principle: due to detecting non-verbal signals, it distinguishes the level of the accuracy of information that is transmitted. It is assumed, that about 30% of information, that we receive from the environment, comes through words, vision, hearing, touches etc. This is the information that we are aware of in our consciousness, so we could consciously (logically) use it to be guided by. And approximately 70% of everyday information about the reality around us we receive non-verbally, and this information in the majority of cases could remain in us without any recognition. It is the situation when we've already known something, and we even have already started to respond to it via our body, but we still don't know logically and consciously that we know it. We can observe the responses of our own body without understanding what are the reasons for such responses. We can recognize this unconscious information through certain pictures, associations, dreams, or with the help of psychoanalysis. Psychoanalysis is a great tool that can help to recognize the information from the unconscious mind, so that it can be logically processed further on, in other words, a person then receives the opportunity to indicate the real problems and to make right decisions. But let us return to the tale where the hare and the wolf stay in one room and don't see each other, and, maybe, don't hear, though - feel. These feelings (in other words - non-verbal information that the hare receives) activate a certain response in the hare's body. And it reacts properly and adequately to the situation, for instance, the body starts to produce adrenaline and runs the response "fight or flight". So the hare starts to behave accordingly and we could see the following symptoms: the hare is running around his cage, fussing, having some tremor and an increased heart rate, etc. And now let us imagine this tale in some cartoon. The hare stays in its house, and the wolf wanders about this house. But the hare doesn't see the wolf. Though the body of the hare gives some appropriate responses. And then that cartoon hare goes to a cartoon doctor and asks that doctor to give it some pill from its tremor and the increased heart rate. And in general asks to treat in some way this incomprehensible, confusing, totally unreasonable severe anxiety. If we try to replace the situation from this fairy-tale to a life story, we could see that it fits well to the script of interdependent relationships, where there are a couple "a victim and an aggressor", and where such common for our traditional families' occurrences as a domestic family violence, psychological and physical abuse take place. Only in 2019 a law was passed that follows the European norms and gives a legislative definition of such concepts as psychological domestic abuse, sexual abuse, physical abuse, bullying, that criminalizes all of these occurrences, establishes the punishment and directly points to people that could be a potential abuser. Among them are: a husband towards his wife, parents towards their children, a wife towards her husband, a superior towards a subordinate, a teacher towards his or her students, children towards each other etc. When it comes to recognition of something as unacceptable, it seems more easy to put to that category such occurrences as physical and sexual abuse, as we could see here some obvious events. For example, beating or sexual harassment. Our society is ready to respond to these incidents in more or less adequate way, and to recognize them as a crime. But it is harder to deal with the recognition of psychological abuse as an offence. Psychological abuse in our families is common. Psychological abuse occurs through such situations, when one person, while using different psychological manipulations, such as violation of psychological borders, imposition of feeling of guilty or shame, etc., force another person to give up his or her needs and desires, and so in such a way make this person live another's life. Such actions have an extremely negative effect on the mental health of these people, just as much as physical abuse. It can destroy a person from the inside, ruin self-esteem and a feeling of self-worth, create the situation of absolute dependence such victim from an abuser, including financial dependence etc. It often happens that psychological abuse takes place against the backdrop of demonstrations of care and love. So you've got this story about the wolf and the hare, that are right next to each other, and the shield between two of them is a repression - a psychological defense mechanism, when a person turns a blind eye to such offences, that take place in his or her own life and towards him or her. And this person considers this as normal, doesn't realize, doesn't have a resource to realize, that it is a crime. Most importantly - doesn't feel anything, as a repression takes place. But a body responds in a right way - from a certain point of the existence of such a toxic situation the response "fight or flight" is launched in a body at full, in other words - the fear and anxiety with the associated symptoms. The third allegorical tale I called "Defective suit", which I read in the book of Clarissa Pinkola Estés with the name "Running With the Wolves". "Once one man came to a tailor and started to try on a suit. When he was standing in front of a mirror, he saw that the costume had uneven edges. - Don't worry, - said the tailor. - If you hold the short edge of the suit by your left hand - nobody notices it. But then the man saw that a lapel of a jacket folded up a little bit. - It's nothing. You only need to turn your head and to nail it by your chin. The customer obeyed, but when he put on trousers, he saw that they were pulling. - All right, so just hold your trousers like this by your right hand - and everything will be fine, - the tailor comforts him. The client agreed with him and took the suit. The next day he put on his new suit and went for a walk, while doing everything exactly in the way that the tailor told him to. He waddled in a park, while holding the lapel by his chin, and holding the short edge of the suit by his left hand, and holding his trousers by his right hand. Two old men, who were playing checkers, left the game and started to watch him. - Oh, God! - said one of them. - Look at that poor cripple. - Oh, yes - the limp - is a disaster. But I'm wondering, where did he get such a nice suit?" Clarissa wrote: "The commentary of the second old man reflects the common response of the society to a woman, who built a great reputation for herself, but turned into a cripple, while trying to save it. "Yes, she is a cripple, but look how great her life is and how lovely she looks." When the "skin" that we put on ourselves towards society is small, we become cripples, but try to hide it. While fading away, we try to waddle perky, so everyone could see that we are doing really well, everything is great, everything is fine". As for me, this tale is also about the process of forming a symptom in a situation when one person tries very hard to match to another one, whether it is a husband, a wife or parents. It's about a situation when such a person always tries to support the other one, while giving up his or her own needs and causing oneself harm in such a way by feeling a tension every day, that becomes an inner normality. And so this person doesn't give oneself a possibility to relax, to be herself (or himself), to be spontaneous, free. As a result, in this situation the person, who was supported, looks perfect from the outside, but those who tried to match, arises some visible defect, like a limp - a symptom. And so this person lives like a cripple, under everyday stress and tension, trying to handle it, while sacrificing herself (or himself) and trying to maintain this situation, so not to lose the general picture of a beautiful family and to avoid shame. The tailor, who made this defective suit and tells how to wear the suit properly, in order to keep things going as they are going, often is a mother who raised a problematic child and then tells another person how to deal with her child in the right way. It is the situation when a mother-in-law tells her daughter-in-law how to treat her son properly. In other words, how to support him, when to keep silent, to handle, how to fit in, so that her problematic son and this relationship in general looks perfect. Or vice versa, when a mother-in-law tells her son-in-law how to support her problematic daughter, how to fit in etc. When, for example, a woman acts like this in her marriage and with her husband, with these excessive efforts to fit in - then after a while everybody will talk like: "Look at this lovely man: he lives with his sick wife, and their family seems perfect!". But when such a woman becomes brave enough to relax and to just let the whole thing go, everybody will see that the relationship in her marriage isn't perfect, and it is the other one who has problems. Each time when someone tries excessively to match up to another one, while turning oneself in some kind of a cripple, - he or she, on the one hand, supports the comfort of that person, to whom he or she tries to match up, and on the other hand - such a situation always arises in that person such conditions as a continuous tension, anxiety, fear to act spontaneously. A symptom - is like a visible defect, that shows itself through the body (and may look like some kind of injury). It is the result of a hidden inner prison. As a result of evolution, a pain tells us about a problem that is needed to be solved. When we repress our pain we can't see our needs and our problems at full. And then a body starts to talk to us via a symptom. Psychotherapy aims for providing a movement from a symptom to a resumption of sensitivity to feelings, a resumption of the ability to feel your psychological pain, so you can realize your own toxic story. In this perspective another fairy-tale looks interesting to analyze - it is Andersen's fairytale "Princess and the Pea". In the tale a prince wanted to find a princess to marry. There was one requirement for women candidates, so the prince could select her among commoner - high level of sensitivity, as the real princess would feel a pea through the mountain of mattresses, and so she could have the ability to feel discomfort, to be in a good contact with her body, to tell about her discomfort without such feeling as shame and guilt, and to refuse that discomfort, so to have the readiness to solve her problems and to demand from others the respect for her needs. It is common for our culture that the expression "a princess on a pea" very often uses for a negative meaning. So people who are in good contact with their body and who can demand comfort for themselves are often called capricious. At the same time the heroes who are ready to suffer and to tolerate their pain, who are able to repress (stop to feel) their pain represents a good example to be followed in our society. So, we may see the next algorithm in cases of various anxiety disorders: the existence of some toxic situation that brings some danger to a person. And we need not to be confused: a danger exists not for a body, but for a personality. A toxic live situation as well as having a panic attack is not a threat for the health of a body (that is what medical examinations show), and vice versa - it's like every day intensive sport training, that could be good for your health only to some degree. A toxic situation destroys a person as a personality, who longs for one self's expression; the existence of such a defense mechanism as repression - it's a life with closed eyes, in pink glasses, when there is inability (or the absence of the desire) to see its own toxic story; 3.the presence of a symptom - a healthy response of a body "fight or flight" to some toxic situation; displacement - it's replacement of the attention from the situation to a symptom, when a person starts to see and search for the problem in some other place, not where it really is. A symptom takes as some spare, pathological reaction that we need to get rid of. The readiness to fight the symptom arises, and that is the goal of such methods of therapy as pharmacological therapy, CBT and many others; the absence of adequate actions that are directed towards the change of a toxic situation itself. The absence of the readiness to show aggression when it comes to protect its space. All of it is a mechanism of formation of primary anxiety and preparation for launch of secondary anxiety. A complete anxiety disorder is the interaction between a primary and a secondary anxiety.

Sin embargo, los conflictos no han cesado.En 1997, el Secretario General de la ONU, Kofi Annan, afirmaba que vivimos en una era de reestructuración, y "como en todos los periodos de transición,en la actualidad coexisten, en una tensión inquietante, expresiones muy diferentes de la situación humana: la mundialización se difunde pero aumenta la fragmentación y la afirmación de las diferencias; se amplían las zonas de paz a la vez que se intensifican diversas explosiones de terrible violencia; se está creando una riqueza sin precedentes pero sigue habiendo grandes bolsones de pobreza endémica; la voluntad de los pueblos y sus derechos integrales se celebran y violan al mismo tiempo; la ciencia y la tecnología mejoran la vida humana en tanto que sus efectos secundarios amenazan a los sistemas que sustentan la vida en el planeta". 1 Veintiún años después, podríamos afirmar que el orden internacional actual aún se presenta "disfuncional" en cuanto al logro de sus objetivos e "inestable",en términos de seguridad global.Los elementos económicos, geopolíticos y geoestratégicos, ideológicos, étnico-culturales, territoriales y religiosos continúan siendo las principales causas de los conflictos que hoy presenciamos. Muchos de esos conflictos son, en realidad, la prolongación de disputas que tuvieron lugar hace décadas.Otras, en cambio, han surgido tras el orden mundial que se impuso desde 1948. A pesar de que actualmente no existe ninguna guerra activa declarada de forma oficial entre Estados, al menos 13 países sufren en la actualidad conflictos armados. Otros muchos padecen, desde hace años e incluso décadas, situaciones de grave violencia o realidades bélicas no resueltas aún y calificadas, según el momento, como conflictos de "alta" o"baja" intensidad.En relación a la disputa de un territorio o territorios, existen en la actualidad más de 35 casos. Los territorios disputados hacen referencia a aquellos territorios, terrestres o marítimos, sobre los que dos o más países disputan su soberanía o no han establecido 1 una demarcación clara de sus fronteras. Por regla general están bajo la administración de un Estado que no ha reconocido la reclamación territorial del otro Estado, o en otros casos son áreas terrestres o marítimas sobre las que ninguna parte posee un control efectivo sobre el territorio, o lo controla sólo parcialmente. También existen disputas en aquellos territorios que habiendo sido divididos, las partes no se reconocen mutuamente y también aquellos que perteneciendo a un Estado, quieren convertirse en Estados independientes o ya se han constituido. Además existen territorios que se encuentran bajo ocupación militar de otro Estado y disputas territoriales que están latentes o "congeladas"temporalmente. En 2017 y según la información expuesta por el Programa de Recopilación de Datos sobre Conûictos de la Universidad de Uppsala (UCDP), podemos afirmar que los conflictos armados de base estatal han disminuido. Sin embargo,los conflictos armados liderados por actores violentos no estatales han aumentado, especialmente durante la última década. Dichos conflictos no son producto de intereses incompatibles e irreconciliables entre Estados,ni de confrontaciones entre facciones nacionales claramente definidas que se disputan el poder al interior del Estado. El conflicto que domina el escenario actual es la manifestación de un proceso de fragmentación política y social, usualmente acompañada por procesos de desintegración estatal. En términos generales, presentan identidades nacionales, etnias y/o concepciones religiosas enfrentadas al interior de un mismo territorio, persecuciones de minorías, genocidios y migraciones masivas. El número, letalidad y complejidad de estos se han incrementado y prolongado violentamente en Medio Oriente, África y Asia Meridional hasta constituirse en fuentes de inestabilidad regional e internacional. El año pasado se registró un nuevo máximo de conflictos de base no estatal activos, con el consiguiente aumento de víctimas fatales.En contraste con los patrones históricos, los conflictos contemporáneos tienden a desarrollarse y concentrarse en las zonas urbanas. Como resultado de ello, la población civil es la más afectada por esta violencia física,psíquica, estructural y cultural de carácter organizado, así como por diversas modalidades criminales engendradas en su seno y que también atentan contra la supervivencia de aquella. Según el Alto Comisionado de Naciones Unidas para los Refugiados (ACNUR, 2017), al finalizar el año 2016 había más de 65 millones de personas desplazadas forzosamente en todo el mundo a consecuencia de la persecución, los conflictos, la violencia o las violaciones de Derechos Humanos.Sin embargo, las migraciones internacionales no se producen únicamente como consecuencia de conflictos. También existen migrantes voluntarios que se movilizan más allá de sus fronteras nacionales en busca de mejores oportunidades y condiciones de vida, en un mundo en el que las desigualdad ese injusticias crecen cada día. Acordamos que la pobreza y las desigualdades no son causa de la violencia, pero tal como afirma Kaldor (La sociedad civil global, 2001), su persistencia global es un argumento e incentivo para ella.Este volumen de la revista Studia Politicae, Grupos en conflicto y territorio,procura ofrecer al lector una serie de artículos que ayudarán a esclarecer algunos conflictos y desafíos presentes en el orden internacional contemporáneo,así como constituirse en una oportunidad para avanzar en la reflexión teórica y política al respecto. Autores especializados tanto de universidades europeas como latinoamericanas presentan unas contribuciones de gran calidad y originalidad.El primer artículo, Nexos entre migraciones forzadas y desarrollo en el marco de la gobernabilidad migratoria: aproximaciones a la categoría de refugiado en el contexto sudamericano, de la Doctora Janneth Clavijo y la Doctoranda Clara Dalmasso del Centro de Investigaciones y Estudios sobre Cultura y Sociedad – CONICET y UNC, tiene como objetivo analizar el modo en que el enfoque de la gobernabilidad migratoria, y en particular la discusión sobre el desarrollo, ha permeado la (re)configuración de las políticas de refugio en el escenario sudamericano, haciendo hincapié en el análisis del carácter construido de la categoría de refugiado y su diferenciación de las migraciones económicas.En el segundo artículo, Maximiliano Zuccarino, Licenciado en Relaciones Internacionales, Facultad de Ciencias Humanas (FCH) – Universidad Nacional del Centro de la Provincia de Buenos Aires (UNCPBA) y Doctor en Historia (FCH-UNICEN), aborda la política exterior como política pública y analiza la incidencia de las variables internas en la formulación de la primera,a partir de un estudio de caso: la posición adoptada por la Argentina ante un conflicto interestatal de carácter territorial entre Paraguay y Bolivia,por la región del Chaco Boreal.Desde Europa, la profesora agregada de Relaciones Internacionales en la Universidad Nebrija, Gracia Abad, nos habla en el tercer artículo sobre Xinjiang o la gestión china de un conflicto étnico-territorial, relativo a la lucha por la independencia política de la comunidad uigur en el seno de una potencia emergente como la actual República Popular China. Paraello, la autora nos plantea un recorrido por las causas subyacentes en los conflictos territoriales y las particularidades étnico-religiosas presentes en la región, así como en las demandas uigures y la postura china asumida al respecto. Para terminar, Heike Pintor Pirzkall, profesora de Cooperación Internacional y Desarrollo en la Universidad Pontifica Comillas, hablará en el último artículo de este número sobre el proceso de integración de la minoría su de teen Alemania después de 1945 y cómo este pueblo ha mantenido su identidad desde entonces.
