The introduction of artificial intelligence in all domains of life is the most transformative process in recent history. It is also a highly dynamic process, and due to the pace of technological development, a very limited legal framework is available to address issues of human rights, ethics, transparency, privacy, safety and accountability. During the last few years, artificial intelligence started to reshape employment processes. Positive aspects of the introduction of AI in the employment process are efficiency and quality in job matching, digitalisation and acceleration of the process, ability to process large data and match job seekers to available vacancy announcements, the alleviation of administrative burdens of employees of employment agencies and giving them strategic and innovative roles. All these are indispensable in present times when demographic challenges in European countries are leading to increased labour migrations and require changes in the recruitment process. The paper explores the current challenges of AI, i.e. how to achieve human-centred values and fairness of AI use during the employment process, preventing algorithmic bias and discriminatory application of AI tools. In order to harness the maximum benefits of AI, we need to develop a regulatory framework that would be enforceable, inclusive and adaptive (OECD), particularly knowing that most AI solutions are privately owned and developed for commercial purposes.

The technology associated with artificial intelligence is developing rapidly. As a consequence, artificial intelligence is being applied in many spheres of life and increasingly affects the functioning of society. Actions of artificial intelligence may cause harm (e.g. in the case of autonomous vehicles that cause traffic accidents). Rules of civil law, especially those relating to liability for damage resulting from somebody's fault or risk, came into being before artificial intelligence's invention and mostly before the latter's significant recent development. They include the Polish Code of civil procedure, which addresses the issues associated with liability, adopted in 1964 and still in force today, although with certain amendments. Therefore, no provisions that would directly refer to artificial intelligence and legal consequences of its actions have been introduced into the Polish civil law. The same applies to European law. Therefore, the issue of whether existing regulations may be applied in the case of artificial intelligence or, perhaps, whether they should be appropriately adjusted, needs to be analysed. The starting point for this analysis is the possibility of conferring upon artificial intelligence the status of an entity under the law, allowing it to independently bear the liability for the damage caused by it. This issue needs to be examined in the context of technology used today (e.g. autonomous vehicles), and also in the future. The analysis performed herein specifies who would bear liability for the actions of artificial intelligence. The deliberations in this area are based on the achievements of Polish and European legal science. Therefore, the conclusions formulated in the article regarding legislative changes apply to all national legal orders informed by European civil law principles.

Artificial intelligence (AI) is concerned with the symbol-manipulation processes that produce intelligent action; that is, acts that are arrived at by intelligible reasoning steps that are guided by knowledge of a particular domain. AI areas relevant to human factors and automation include expert systems, natural-language understanding, and intelligent robotics. These topics are reviewed and illustrated. Potential contributions of human factors research to AI are briefly described.

Artificial intelligence (AI) is developing rapidly. There are technologies available that fulfil several tasks better than humans can and even behave like humans to some extent. Thus, the situation prompts the question whether AI should be granted legal person- and/or agenthood? There have been similar situations in history where the legal status of slaves or indigenous peoples was discussed. Still, in those historical questions, the subjects under study were always natural persons, i.e., they were living beings belonging to the species Homo sapiens. We analyse the situation from moral-ethical and practical perspectives. The final conclusion is that the currently existing AIs are still so far removed from humans that there is simply no need to think seriously about legal person- or agenthood. Doing so would mean imposing obligations on the AI to follow. This, in turn, would mean that certain rights in relation to those obligations would have to be granted as well. By all evidence, this is something that humans are not ready to do yet and might never get that far.

Entity issues of artificial intelligence is no longer a purely theoretical question, as technological progress and its practical application is an increasingly common phenomenon, while the artificial intelligence system's ability to learn and to make decisions autonomously determines its subjective nature and increasingly limited ability to consider it as just a complex tool. So, the purpose of the research is to analyse the legal basis and issues related with acceptance of the artificial intelligence as a separate legal entity and peculiarities of civil liability for damages caused by artificial intelligence. The analysis was based on three issues: a concept of artificial intelligence, its possibility to be recognized as a separate legal entity and peculiarities of civil liability for damages caused by it. The research was carried out by employing the logical, the teleological, the systematic analysis, the linguistic, the synthesising methods and the analysis of legal documents. The analysis shows that there is no single concept of artificial intelligence, but the identified specific elements of its definition would simplify its legal regulation as well as only a fully autonomous artificial intelligence has a potential to be recognized as a separate legal entity, so in this case there is an objective need to review the framework for civil liability for damages caused by artificial intelligence in order to establish at least joint and several civil liability of it with the natural person responsible for it.
