Persons detained for reasons related to an armed conflict are in a vulnerable position. Deprived of their liberty, they are at the mercy of their captors. Certain groups of detainees are particularly vulnerable. Additionally, the way in which non-international armed conflicts are fought can make it difficult for some parties to the conflict to comply with the rules benefiting particularly vulnerable detainees. This Article identifies groups of particularly vulnerable detainees and analyzes the general and special protections that are afforded to them under the conventional and customary international law of armed conflict. It then considers the realities of detention in armed conflict and sets out different ways in which these realities can be balanced with the importance of the protections for vulnerable groups. Finally, drawing on the law of international armed conflict, the Article considers how possibilities including the release and repatriation of particularly vulnerable detainees and the accommodation of such detainees in a third State could be implemented in a non-international armed conflict.

By detention, in the pre-investigation procedure, one person is deprived of his liberty, which results in limited freedom of movement of that person, with the simultaneous establishment of other restrictions on the detained person. An arrested person, as well as a suspect, can be detained. These persons are detained on the basis of a decision on detention, which is announced, made and served by the public prosecutor, or upon his approval by the police. According to this decision, the detention of a person can last for a maximum of 48 hours. Bearing in mind that this formal act restricts the detained person's proclaimed right to freedom for the purpose of unhindered conduct of criminal proceedings, while freedom of movement is one of the basic human rights in a democratic society, this clearly shows the importance of the legal treatment of the authorities in the pre-investigation procedure towards the detained person, as and the legality of the detention decision itself. In order for the detention of a person to be justified, it must be legal in both material and procedural terms. Otherwise, there would be a legal basis for the detained person to claim damages, due to the arbitrary detention made against him by the authorities. This article points out the formal-legal determinations of the decision on detention, and the rights of adult persons who have been detained for a hearing, with the aim of pointing out some perceived shortcomings after conducting research and analyzing data from the decision on detention and proposing some legal improvements.
ANNOTATION: the article outlines the problematic issues of the institution of detention, clarifies its relationship with the constitutional human right to liberty and security of a person, reviews the practice of the European Court of Human Rights regarding detention, focuses on the violation of the principle of legal certainty in the current procedural legislation. It is fundamentally important in the study to determine the subjective composition of the persons who are detaining, in particular, the attention is focused on their procedural status, a position is considered regarding the limited terms of reference of authorized officials, in terms of the right to detention solely for committing a crime for which a penalty of imprisonment is provided, unlike persons holding legal detention who are authorized to detain a person in the commission of a criminal offense regardless of the severity. The article deals with the manipulation of procedural rules, which correlates with the so-called hidden purpose and occurs by substituting administrative detention in the understanding of criminal procedural legislation and is the basis for violation of human rights. The concept of immediate judicial control is considered and supported, which provides for an obligation on an authorized official to deliver a detained person directly to a court to resolve the issue of the legality of detention, bypassing the pre-trial investigation authorities, where the detained person is still long (60 hours, since this period should not be exceeded to deliver the detainee to the investigating judge, where a decision is made on the selection of a preventive measure against him), pressure may be applied. It is indicated that there is no clear and comprehensive definition of the category «authorized official» in the current Criminal Procedure Code, which leads to the problem of a which leads to the problem of a narrowed or broader interpretation of this concept. Proposals for its normative consolidation are presented. The work is fundamentally different in that specific problems became the basis for the study of domestic legislation, which were subsequently supported by the decisions of the ECHR, but today they remain in the current legislation anyway. This is a comprehensive approach to the issue of legislative imperfections, and it focuses the legislator's attention on them. ; АННОТАЦИЯ: в статье обозначены проблемные вопросы института задержания, выяснено его соотношение с конституционными правами человека на свободу и личную неприкосновенность, осуществлен обзор практики Европейского суда по правам человека относительно задержания, акцентировано на нарушении принципа правовой определенности в действующем процессуальном законодательстве. Принципиально важным в исследовании является определение субъектного состава лиц, осуществляющих задержание, в частности, сосредоточено внимание на их процессуальном статусе, озвучена позиция относительно ограниченного круга полномочий уполномоченных должностных лиц, в части права на задержание исключительно за совершение преступления, за которое предусмотрено наказание в виде лишения свободы, в отличие от лиц, осуществляющих законное задержание, которые уполномоченные задерживать человека при совершении уголовного правонарушения независимо от тяжести. Освещено манипулирование процессуальными нормами, которое коррелирует с так называемой скрытой целью и происходит путем подмены задержания в понимании уголовного процессуального законодательства административным задержанием и является основой для нарушения прав человека. Рассмотрена и поддержана концепция немедленного судебного контроля, что предусматривает возложение на уполномоченное должностное лицо обязанности доставить задержанное лицо непосредственно в суд для решения вопроса законности задержания, минуя органы досудебного расследования, где на задержанное лицо еще долго (60 часов, поскольку именно этот срок не должен быть превышен для доставки задержанного к следственному судье, где принимается решение об избрании в отношении него меры пресечения), может оказываться давление. Указано, на отсутствие в действующем уголовном процессуальном Кодексе четкого и исчерпывающего определения категории «уполномоченное должностное лицо», что приводит к проблеме суженного или расширительного толкования этого понятия. Представлены предложения по его нормативному закреплению. Работа принципиально отличается тем, что основой для исследования отечественного законодательства, среди прочего, стали конкретные проблемы, которые впоследствии были подкреплены решениями ЕСПЧ, однако на сегодня еще остаются в действующем законодательстве. Такой подход позволяет комплексно подойти к вопросу законодательных несовершенств и сосредоточить на них внимание законодателя. ; АНОТАЦІЯ: у статті окреслено проблемні питання інституту затримання, з'ясовано його співвідношення із конституційним правом людини на свободу та особисту недоторканість, здійснено огляд практики Європейського суду з прав людини стосовно затримання, акцентовано на порушенні принципу правової визначеності у чинному процесуальному законодавстві. Принципово важливим у дослідженні є визначення суб'єктного складу осіб, які здійснюють затримання, зокрема, зосереджено увагу на їхньому процесуальному статусі, озвучено позицію стосовно обмеженого кола повноважень уповноважених службових осіб, у частині права на затримання виключно за вчинення злочину, за який передбачено покарання у вигляді позбавлення волі, на відміну від осіб, що здійснюють законне затримання, які уповноваженні затримувати особу при вчинені кримінального правопорушення незалежно від тяжкості. Висвітлено маніпулювання процесуальними нормами, що корелює із так званою прихованою метою та відбувається шляхом підміни затримання в розумінні кримінального процесуального законодавства адміністративним затриманням – що і є підґрунтям для порушення прав людини. Розглянуто й підтримано концепцію негайного судового контролю, що передбачає покладення на уповноважену службову особу обов'язку доставити затриману особу безпосередньо до суду для вирішення питання законності затримання, минаючи органи досудового розслідування, де на затриману особу ще протягом тривалого часу (60 годин, оскільки саме цей строк не повинен бути перевищений для доставлення затриманої особи до слідчого судді, де приймається рішення про обрання стосовно неї запобіжного заходу), може чинитись тиск. Указано, на відсутність у чинному кримінальному процесуальному Кодексі чіткого та вичерпного визначення категорії «уповноважена службова особа», що призводить до проблеми звуженого або розширювального тлумачення зазначеного поняття. Надані пропозиції щодо його нормативного закріплення. Робота принципово відрізняється тим, що основою для дослідження вітчизняного законодавства, з-поміж іншого, стали конкретні проблеми, що згодом були підкріплені рішеннями ЄСПЛ, проте на сьогодні ще лишаються у поточному законодавстві. Такий підхід дозволяє комплексно підійти до питання законодавчих недосконалостей та зосередити на них увагу законодавця.
