International audience ; The judiciary is called upon to ensure justice, ensuring human rights and freedoms, and balancing private and public interests. In this aspect, a significant role is played by the correct choice of the court that is authorized to consider a case. This problem is acute in the separation of jurisdiction of commercial, civil and administrative proceedings. In view of this, it is vital to study theoretical approaches to delimiting the jurisdiction of commercial, civil and administrative courts. The aim of the work is to analyze theoretical approaches and problematic issues regarding the delimitation of jurisdiction of commercial, civil and administrative courts. The methodology of the study included such methods as comparison, analogy, generalization, systemic, structural-functional method, method of analysis and synthesis. The study of theoretical approaches to the delimitation of jurisdiction of commercial, civil and administrative courts allowed to analyze the characteristics of each of the jurisdictions. It is also remarked that determining the jurisdiction of the dispute remains a rather difficult problem for the practice of law enforcement, due not only to imperfect legislation, but also to existing dogmas in science and practice.

This article briefly examines the lack of application of the principle of double compliance in Ecuadorian legislation, for which we questioned: What are the consequences and legal effects of non-application of this principle? To answer this question and to understand the seriousness of the lack of application of this principle, we review the guarantees that individuals have at present to assert their rights before the State, as well as the virtues and defects that each procedure has. We address what would happen in a hypothetical scenario where an appeal on this matter was raised. Finally, we will conclude that the lack of application of the double compliance is unconstitutional. ; El presente artículo analiza brevemente la falta de aplicación del principio de doble conforme en la legislación ecuatoriana, para lo cual se cuestiona: ¿cuáles son las consecuencias y efectos jurídicos de la falta de aplicación del mencionado principio? Para responder esta pregunta y comprender la gravedad de dicha falta, se revisan las garantías que actualmente tienen los particulares para hacer valer sus derechos frente al Estado, así como las virtudes y defectos que tiene cada vía; con lo cual se estudia lo que podría ocurrir en un escenario hipotético de plantearse un recurso de apelación en esta materia. Finalmente, se concluirá que la falta de aplicación del doble conforme es inconstitucional.

This article begins with an analysis of the development of administrative justice in Poland over the last centuries. In particular, the author examines administrative jurisdiction before 1918, when Poland regained its independence, the period of the Duchy of Warsaw, the Kingdom of Poland, and the practice on Polish territory under Austrian and Prussian control. The author then moves to modern law by presenting the judicial system in Poland in general, especially the differences between the separate systems of general courts and administrative courts, and analyses the jurisdiction of voivodship (regional) administrative courts, and the basic principles of judicial and administrative proceedings. The focus of study is mainly devoted to judicial and administrative procedure, rather than an administrative process of citizens before administrative authorities regulated in a separate Code of Administrative Procedure. The article describes the role of the judge (pointing out the differences between the active role of first instance judges and the limited capabilities of the judges of the appeal) and the powers of the Supreme Court, in particular its power to adopt resolutions, which has agreat importance for the unification of the jurisprudence. A brief analysis is given to class actions, which in the Polish legal system are inadmissible in court and administrative proceedings. The articles provides a statistical cross-section illustrating the role of administrative jurisdiction. The author concludes with observations pointing up the progress of administrative jurisdiction in Poland, not only in the legal sense, but also in the cultural sense.

International audience ; Congolese administrative justice is in the process of reform although there is reason to regret that it is taking place very slowly. Indeed, the Constitution of February 18, 2006 consecrated the institution of an administrative jurisdictional order, thus breaking with several decades of organization of an administrative justice essentially grafted to the order of the judicial jurisdictions. But, it is ten years after that the legislator deigns to adopt the law relating to the organization, competences and functioning of the jurisdictions of the administrative order! This article offers a critical reading of the law with the aim of appreciating the architecture and strengths of administrative jurisdiction and discussing the question marks that remain. ; La justice administrative congolaise est en pleine réforme quoiqu'il y ait lieu de regretter qu'elle s'opère à pas de tortue. En effet, la Constitution du 18 février 2006 a consacré l'institution d'un ordre juridictionnel administratif, rompant ainsi avec plusieurs décennies d'organisation d'une justice administrative essentiellement greffée à l'ordre des juridictions judiciaires. Mais, c'est dix ans après que le législateur daigne adopter la loi portant organisation, compétences et fonctionnement des juridictions de l'ordre administratif ! Le présent article propose une lecture critique de la loi dans l'objectif d'apprécier l'architecture et les atouts de la juridiction administrative et de discuter les points d'interrogation qui subsistent.
