We develop an empirically based conception of international legalization to show how law & politics are intertwined across a wide range of institutional forms & to frame the analytic & empirical articles that follow in this volume. International legalization is a form of institutionalization characterized by three dimensions: obligation, precision, & delegation. These dimensions are conceptually independent, & each is a matter of degree & gradation. Their various combinations produce a remarkable variety of international legalization. We illustrate a continuum ranging from "hard" legalization (characteristically associated with domestic legal systems) through various forms of "soft" legalization, to situations where law is largely absent. Most international legalization lies between the extremes, where actors combine & invoke varying degrees of obligation, precision, & delegation to create subtle blends of politics & law. 4 Tables, 1 Figure. Wie die beiden Politikfelder Energie und Gesundheit zusammenhängen, erschließt sich nicht auf den ersten Blick. Klar benannt sind zumindest die negativen Externalitäten, die sich aus dem Energieverbrauch aus fossilen Brennstoffen ergeben. Im Januar 2019 bezeichnete die Weltgesundheitsorganisation (WHO) Klimawandel und Luftverschmutzung als die zwei größten Herausforderungen für die Gesundheit aller. Ein differenzierter Blick auf Infrastruktur, Verfügbarkeit und Qualität der Energie- wie der Gesundheitsversorgung und den Zugang zu ihnen zeigt, wie eng verwoben diese Politikfelder sind. Kein moderner Krankenhausbetrieb funktioniert ohne sichere Stromversorgung, für die Lagerung von Impfstoffen sind leistungsfähige Kühlketten unerlässlich. Im Sinne der "Ziele nachhaltiger Entwicklung" der Vereinten Nationen müssen die beiden Politikfelder so ausgestaltet und verschränkt werden, dass sie über nationale Grenzen hinweg zur menschlichen Sicherheit beitragen und planetare Grenzen berücksichtigen. Es kommt darauf an, Gesundheit und Energie zusammenzudenken und Synergien zwischen ihnen zu schaffen. Dies wäre ein wichtiger Beitrag, um die Nachhaltigkeitsziele rascher umzusetzen. (Autorenreferat)
Based on the social principles of the United Nations International Convention on the Rights of Persons with Disabilities (2006), we study the social model of disability that inspired it to evaluate the models of justice that can be adjusted to this transformation in the understanding of disability. Next, we analyze the most relevant theories of justice designed in recent decades based on the criteria of how they approach the problem of justice for people with disabilities. Finally, we expose a balance of the theories. We proposed a position related to the demand for political participation expressed in the Convention and the report on its implementation in Colombia in 2016. ; Partiendo de los principios sociales de la Convención Internacional de Naciones Unidas sobre los derechos de las personas con discapacidad (2006), se estudia el modelo social de la discapacidad que la inspiró, con el propósito de evaluar los modelos de justicia que pueden llegar a ajustarse a esta transformación en la comprensión de la discapacidad. Paso seguido se analizan las teorías de la justicia más relevantes que se han diseñado en las últimas décadas a partir del criterio de la manera en que abordan el problema de la justicia para las personas con discapacidad. Finalmente, se propone un balance de las teorías expuestas y se toma una posición relacionada con la demanda de participación política que se expresa en la Convención y en el informe sobre su implementación en Colombia en el año 2016.
