For lawyers in general, and international lawyers in particular, democracy is a neglected concept. Discourse is dominated by the ideas of human rights for individuals and minority or self-determination rights for groups. Those who seek greater protection for vulnerable members of a community argue for the recognition of new rights, or the more effective implementation of existing rights. They do not argue for more democracy. Indeed, given that claims for human and minority rights are not made only against authoritarian governments, but also democratic ones, there must exist an implied assumption that democracy is, by itself, not capable of protecting the interests of vulnerable minorities. Moreover, as the form of government which apparently venerates the will of the majority, democracy might be considered by some as being downright hostile to the interests of individuals and minorities.

Der vorliegende Beitrag untersucht Nichtdiskriminierung in den politischen Partizipationsrechten, die ein wesentliches Element für den Interessensschutz von Minderheiten darstellt. Ein besonderer Schwerpunkt liegt dabei auf notwendigen Maßnahmen, die eine wirkungsvolle Teilnahme der Minderheiten an beratenden Prozessen und Entscheidungen in einem demokratischen Staat gewährleisten. Für ethnisch-kulturelle Minderheiten bedeutet das Recht auf politische Partizipation auch die Notwendigkeit, spezielle Maßnahmen einzuleiten, einschließlich bestimmter Autonomierechte, falls dies zum Schutz und zur Förderung der Minderheitenkultur notwendig ist. Im zweiten Teil werden diese Maßnahmen und Bestimmungen untersucht, wobei der Autor besonders auf die 'Lund-Empfehlungen' über effektive Partizipation von nationalen Minderheiten im öffentlichen Leben eingeht. Non-discrimination in the right of political participation is essential for the protection of the interests of all minority groups - both minorities by force and minorities by will. This article considers some of the measures necessary to ensure effective participation by minorities in the deliberative and decision-making processes of the democratic state. For minorities by will, what the author calls ethno-cultural minorities, the right of political participation, within a deliberative understanding of democratic government, also implies the need to introduce special measures, including where necessary the introduction of autonomy regimes, to protect and promote the minority culture. The author then goes on to examine this proposition in the second half of the article, paying particular attention to the provisions set out in the 'Lund Recommendations' on Effective Participation of National Minorities in Public Life. Doctrinal controversies and the disputed international status of Kosovo and Palestine suggest that it is difficult for us international lawyers to know with any certainty when a new State has emerged in the international community. The contention here is that we should look to systems theory thinking—specifically complexity theory—to make sense of the law on statehood. Systems theory directs us to conceptualize the State in terms of patterns of communications adopted by law and politics actors and institutions and applied to subjects. Complexity tells us that these patterns develop without any central controller or guiding hand and that they exist only as a consequence of the framing of law and politics communications by a third party observer. The argument developed in this article is that these insights can provide the intellectual "scaffold" around which we can build our model of the international law on statehood.
