Die Tragweite des Verfassungsgerichtsurteils vom 12. Juli 1994, das die "Out-of-area"-Einsätze der Bundeswehr regelt, wird zunächst aus der historischen Perspektive deutlich: Von 1973 bis 1992 vertrat die Bundesregierung die Position, daß das Grundgesetz nur indirekte Beiträge zu UN-Friedenssicherungseinsätzen erlaube. Einsätze der Bundeswehr könnten nur im Verteidigungsfall (Art. 87a/§2 GG) und zudem nur auf dem Territorium der NATO-Mitgliedstaaten erfolgen. Verfassungsrechtlich umstritten war jedoch das Verhältnis zwischen Art. 87a/§2 und Art. 24/§2 GG, des weiteren die Frage, welches Organ Einsätze der Bundeswehr zu beschließen habe, sowie das Problem, ob neuere politische Zielsetzungen von NATO und WEU mit den jeweiligen Vertragswerken noch übereinstimmen. In seiner Entscheidung erklärte das Bundesverfassungsgericht unter Berufung auf Art. 24/§2 GG "Out-of-area"-Einsätze der Bundeswehr im Rahmen von kollektiven Maßnahmen auf Grund der UN-Charta für verfassungskonform. Jeder solche Einsatz bedürfe allerdings der vorherigen Zustimmung des Bundestages mit einfacher Mehrheit. Durch das Urteil nicht geklärt ist die Frage der Teilnahme der Bundeswehr an von den UN erlaubten, aber nicht kontrollierten Einsätzen sowie an NATO- oder WEU-Einsätzen, die entweder ohne UN-Legitimierung erfolgen oder über NATO- oder WEU-Vertrag hinausgehen. This book investigates the selective nature of UN sanctions regimes with a specific focus on the post-Cold War era. Legally binding on all members, UN sanctions are the most effective and legitimate non-violent multilateral tools to respond to international security threats. They are also symbolically more powerful than unilateral or multilateral sanctions because they enjoy global support. However, while dozens of threats to international peace were met with UN sanctions since 1990, many others were not. How can we explain this incoherent approach? With a focus on the selectiveness, rather than effectiveness of UN sanctions the author reflects on the shifting geopolitical tensions between Security Council members and uses a variety of widely used academic datasets to provide a unique overview of what determines sanctions and sanctionable events.

The law on the use of force in relation to the maintenance of international peace remains one of the most important areas of international law and international relations to date. Rather than simply provide another factual account of the law in this area, this detailed and analytical book seeks to explore its normative aspects. Rooted in public international law, the book provides insight into the historical evolution and sociological environment of this particular branch of law. The competences and practice of the UN and of regional organizations in maintaining peace are examined before the focus is shifted to the inter-State level, the main non-use of force rule and its claimed or recognized exceptions.
