This article examines the issue of state cooperation with the International Criminal Court (icc), and why it is vitally needed to achieve the institution's mandate, including that of human rights protection. The article examines why state cooperation with the icc is so important and what issues undermine it, including disputes with the African Union, but many other issues as well. It surveys what the icc has done to promote cooperation and what steps ought to be taken to try and enhance state cooperation in the future. This is timely as the icc has set up a review process in 2020 to deal with a range of problems including state non-cooperation. The article therefore examines the practices and procedures of the Court, matters concerning its judges and staff, issues around the appointment of a new prosecutor, as well as and judicial appointments, as well as its jurisprudence. The article examines the issues that ought to be addressed, as well as how a variety of actors could better assist the Court, including the Security Council, the wider United Nations system, and the methodology for doing so. The article also reviews what defensive strategies can be taken up to defend the Court, including against aggressive anti-icc actors, such as the United States of America, who are ramping up their attacks on the Court and its personnel.

On July 17, 1998, the world community voted on the Rome Statute for the International Criminal Court (ICC,) which, if ratified by 60 countries, would establish for the first time in history, a permanent international criminal tribunal. The outcome was an overwhelmingly favorable vote, with 120 countries voting in favor, 21 abstentions, and 7 countries, including the United States, against. The idea of an international criminal court appeared to be in the making.

A entrada pelo Tribunal Penal Internacional (TPI) nas disputas pós-eleitorais de 2007-2008 causou preocupação entre os políticos do Quênia e influenciou os resultados das eleições de 2013? Este artigo argumenta que o indiciamento de quenianos proeminentes pelo TPI por atrocidades cometidas durante a violência pós-eleitoral foi a primeira tentativa de quebrar um ciclo vicioso de impunidade profundamente entrincheirado no corpo político do país. Entretanto, os indiciados exploraram os casos contra eles para exacerbar descontinuidades étnicas, polarizar o país e garantir uma controversa vitória por Uhuru Kenyatta e William Ruto durante as eleições de 2013, apesar de enfrentarem acusações abomináveis perante o TPI. Crucialmente, o Tribunal precipitou incerteza e trepidação entre os cleptocratas que estavam no poder no Quênia desde 1963, o ano da independência do país. A vitória presidencial controversa de Kenyatta em 2013 foi tanto pessoal quanto oligárquica, já que garantiu a continuidade do controle das esferas políticas e econômicas do Quênia por uma plutocracia autorreplicante. Com o controle do aparato estatal, Kenyatta e Ruto conseguiram com sucesso combater a ameaça representada pelo TPI. All nations are linked to each other by a mutual connection and their cultures make mutual heritage; nonetheless, this elegant combination will separate in a moment. Millions children women, and men are sacrificed for unimaginable disasters that human spirit has stunned suddenly during this century. In spite of obstacles facing with constituting international system based on justice, humans' fundamental rights were mentioned greatly during the World War I and II. Therefore, great determination was made to accomplish international security and peace in light of legal laws. Making United Nations, publishing human rights declaration, assigning convections such as preventing punishment of genocide and Geneva fourth conventions 1949 as complementation regulations and war rights indicate serious determination to shape international law system.
