Increasing economic competition combined with the powerful threat of transnational activism are pushing firms to develop new political strategies. Over the past decade a growing number of corporations have adopted policies of industry self-regulation-corporate codes of conduct, social and environmental standards, and auditing and monitoring systems. A Public Role for the Private Sector explores the phenomenon of industry self-regulation through three different cases-environment, labor, and information privacy-where corporate leaders appear to be converging on industry self-regulation as the appropriate response to competing pressures. Political and economic risks, reputational effects, and learning within the business community all influence the adoption of a self-regulatory strategy, but there are wide variations in the strength and character of it across industries and issue areas. Industry self-regulation raises significant questions about the place of the private sector in regulation and governance, and the accountability, legitimacy and power of industry at a time of rapid globalization

The primary objective of this article is to describe recent Australian moves to greater industry self‐regulation and, within that context, to examine the development of AS3806, a voluntary standard developed by Standards Australia, which firms may use as a model or template for the design and management of their regulatory compliance systems. The article is divided into four sections. The first provides an outline of recent Australian developments regarding industry self‐regulation and compliance. The second describes the growing interest in industry codes of conduct and the role of the Australian Competition and Consumer Commission (ACCC). The third describes the main features of AS 3806. The fourth examines the question of compliance standards in relation to the legal process, focusing on two recent cases and is followed by a conclusion.

AbstractThis article focuses on the origins and the development of American hospital industry self‐regulation. Drawing on extensive archival research, this article suggests that the American College of Surgeon's Hospital Standardization Program was closely linked to the American pragmatist tradition. So understood, the Program represents a major milestone in the history of American regulation, perhaps the first self‐regulatory system steeped in pragmatist principles of social ordering, a Progressive‐era model of governance that long ago foreshadowed some of today's most significant regulatory innovations.

AbstractIn recent years, there has been increasing managerial and academic attention given to a variety of mechanisms for companies to respond to stakeholder concerns about global business ethics. One area that merits further analysis is the role of industry‐level cooperation regarding issues in global business ethics such as labor practices. There are two main issues that we will address in this article: institutional pressures that predict when an industry will create a code of conduct and institutional complements for an industry‐level code of conduct to be "successful" with regard to responding to stakeholder concerns about international business operations. We offer a number of propositions—bringing together work from both the corporate social responsibility and (neo)institutional theory literatures—with regard to both predictors and complements of industry self‐regulation in reference to labor practices.

Self-regulation of the Internet industry has been a popular policy approach adopted by many countries. However, unlike self-regulation of more traditional industries, self-regulation of the Internet industry has been a challenging process due to the sheer volume of cyberspace and involvement of stakeholders located beyond any single country's jurisdiction. The industry has achieved limited success in self-regulation, specifically in the area of child protection in cyberspace. China has actively adopted a policy of Internet industry self-regulation and public supervision of the Internet industry, in order to remove online material that is not suitable for children. This article critically reviews China's pre-emptive government regulation and stern actions to regulate the Internet industry to monitor the material that the Internet industry allows through its network. Despite criticism of the Chinese government for its attempts to control freedom of expression through the Internet, this article argues that China has in its own unique ways managed to monitor the contents in cyberspace. There are many valuable lessons to be learnt from the Chinese experience. Studying the unique working relationship that has evolved between the Chinese government and the Internet industry may be beneficial in understanding the ways in which vulnerable population groups like children can be protected in cyberspace.

In many cases, these efforts have produced results well beyond what could be required under public regulations. Although the U.S. Environmental Protection Agency began a process of regulatory reinvention in the 1990s as a means of promoting such innovations, the results have been somewhat disappointing. This article examines the recent trends in corporate environmental management and regulatory reform. It concludes with a discussion of changes in regulatory design that could promote ongoing gains in corporate environmental performance through the creation of a hybrid system combining elements of public regulation, government‐supervised corporate self‐regulation, mandatory information disclosure, and green procurement.
