Медицинские учреждения часто становятся объектами совершения противоправных действий из-за наличия наркотических, спиртосодержащих и дорогих медицинских препаратов, а также ценного диагностического оборудования и оргтехники. Ситуация осложняется тем, что медицинский и вспомогательный персонал, пациенты и посетители в случае нападения не могут в полной мере противостоять преступным элементам. Руководство учреждений здравоохранения в первую очередь должно обеспечить безопасность, то есть охрану учреждений, персонала, пациентов и посетителей, а потому должно выполнить необходимое планирование, тщательную разработку и внедрение охранных систем вместе с комплексом мероприятий административного характера. Целью работы является определение особенностей охранной деятельности в сфере защиты учреждений здравоохранения, проведение анализа законодательного и нормативно-правового обеспечения деятельности лицензированных охранных структур, а также их деятельности в сфере здравоохранения, определение потребности в организации таких служб и обоснование концептуальных основ построения интегрированных систем безопасности учреждений здравоохранения. Проведен общий и целенаправленный анализ и оценка законодательной и нормативно-правовой базы охранной деятельности в Украине с целью возможности ее использования для создания служб охраны и обеспечения предупреждения совершения преступлений в учреждениях здравоохранения. Проведено аналитическое исследование по обработке большого количества информационных источников (более 110) относительно создания и деятельности служб охраны в Украине и иностранных государствах с использованием методов Content analysis и Open Source Intelligence (OSINT). Исследована профессиональная отечественная и иностранная специальная литература, а также информация из Интернета об организации, деятельности, управлении и техническом оснащении служб охраны в различных учреждениях, в том числе и в учреждениях здравоохранения. В результате исследования, проведенного с привлечением профессиональных экспертов службы охраны труда, службы безопасности, пожарной охраны, Государственной службы охраны при Министерстве внутренних дел Украины, относительно организации и урегулирования оптимального функционирования служб охраны в учреждениях здравоохранения выявена насущная необходимость в их создании для обеспечения безопасности, защиты персонала и пациентов, что будет способствовать предупреждению совершения противоправных действий. Рассмотренная проблематика функционирования служб охраны в учреждениях здравоохранения актуальна, требует дальнейшей разработки и обсуждения на страницах журнала с привлечением руководителей отрасли и учреждений здравоохранения, специалистов охранных служб и правоохранительных органов. ; Медичні установи часто стають об'єктами вчинення протиправних дій через наявність наркотичних, спиртовмісних і дорогих медичних препаратів, а також цінного діагностичного обладнання й оргтехніки. Досліджена фахова вітчизняна й іноземна спеціальна література, а також інформація з Інтернету про організацію, діяльність, управління й технічне оснащення служб охорони в різних установах, у тому числі в закладах галузі охорони здоров'я. У результаті дослідження, проведеного із залученням фахових експертів служби охорони праці, служби безпеки, пожежної охорони, Державної служби охорони при Міністерстві внутрішніх справ України, щодо організації й налагодження оптимального функціонування служб охорони в закладах галузі охорони здоров'я виявлено нагальну необхідність їх створення для забезпечення безпеки, захисту персоналу й пацієнтів, що сприятиме запобіганню вчиненню протиправних дій. Розглянута проблематика функціонування служб охорони в закладах галузі охорони здоров'я є актуальною, вимагає подальшої розробки й обговорення на шпальтах журналу із залученням керівників галузі й закладів охорони здоров'я, фахівців охоронних служб і правоохоронних органів. ; Healthcare facilities often become objects of unlawful acts due to availability of narcotic, alcohol-containing and expensive medicines, as well as valuable diagnostic and office equipment. The situation is complicated by the fact that medical and support staff, patients and visitors are not able to fully resist the criminals in case of an attack. The management of healthcare facilities must first of all ensure safety, that is, protection of facilities, personnel, patients and visitors, and, therefore, carry out the necessary planning, careful development and implementation of security systems, along with a set of administrative measures. The aim of work is to determine the characteristics of security activities in the area of security of healthcare facilities, to analyze the legislative and regulatory support of licensed security structures, as well as their activities in the health sector and to determine the needs for organizing such services, justify the conceptual basis for building integrated security systems. The author has carried out general and targeted analysis and assessment of the legislative and regulatory framework of security activities in Ukraine in the view of possibility of its use to create security services and ensure the prevention of crime in healthcare facilities. Analytical study of a large number of sources (over 110) on the foundation and activities of security services in Ukraine and abroad has been conducted with Content analysis and Open Source Intelligence methods. The professional domestic and foreign special literature is studied, as well as information from the Internet about organization, activities, management and technical equipment of security services in various institutions, in particular healthcare facilities. As a result of a study conducted with the involvement of professional experts from the labor protection, security service, fire-fighting service, and State Security Service under the Ministry of Internal Affairs of Ukraine, it was proved that the organization of optimal functioning of security services in healthcare faci­lities is urgently needed to ensure safety and to protect personnel and patients from commitment of unlawful acts. The considered range of problems regarding the functioning of security services in healthcare facilities is topical and requires further development and discussion on the pages of the journal with the involvement of leaders of industry and healthcare facilities, security professionals and law enforcement agencies.

The scientific article is devoted to the dedicating of the novelty of the civil procedural legislation – the closing of proceedings in the case on the basis of the absence of the subject of dispute. By analyzing the general rules of civil procedural law and applying the analogy of law, the author explores the possibility of making scientifically sound proposals to improve civil procedural law.The necessity to distinguish between the concepts of the subject of the claim and the subject of the dispute and the inadmissibility of their identification is substantiated. The article analyzes various doctrinal approaches to defining the concept of the subject of the claim and the subject of the dispute. It is established that the subject of the claim is called the substantive legal claim of the plaintiff to the defendant, for which the court has to decide, and the subject of the claim is not identified with the real object of the claim. In turn, the subject of the dispute is the subjective rights, freedoms or interests in which the conflict arose, as well as the substantive object of the dispute.Particular attention is paid to the study of determining the point at which the subject of the dispute should be absent in order to serve as a basis for closing the proceedings. Case law has been analyzed and conflicts have been identified in the approaches of commercial courts and courts of general jurisdiction to stay proceedings due to lack of subject of the dispute. It has been established that in commercial litigation proceedings are to be closed if the subject of the dispute existed at the time of its occurrence and ceased to exist in the course of the case. In civil proceedings, by contrast, there is a position that, if the subject of the dispute was absent at the time of the claim, the court closes the proceedings. It has been found that both approaches are correct, which attributes the absence of the subject of the dispute to two groups of grounds for closing the proceedings: when the case was brought illegally and when the case was lawful, but it should not be considered further. It has been investigated that the court closes the proceedings in connection with the lack of the subject of the dispute at any stage after the opening of the proceedings, when the court finds that the subject of the dispute is absent or ceased to exist during consideration of the civil case ; Наукова стаття присвячена дослідженню новели цивільного процесуального законодавства – за-криттю провадження у справі на підставі відсутності предмета спору. Шляхом аналізу загальних норм цивільного процесуального права та застосування аналогії закону автор досліджує можливість виро-блення науково обґрунтованих пропозицій для удосконалення цивільного процесуального законодав-ства.Обґрунтовується необхідність розмежування понять предмета позову та предмета спору та недопу-стимість їх ототожнення. З'ясовано, що предметом позову називають матеріально-правову вимогу позивача до відповідача, щодо якої суд має ухвалити рішення, при цьому предмет позову з ре-човим об'єктом позову не ототожнюється. У свою чергу предметом спору є суб'єктивні права, свободи чи інтереси, щодо яких виник конфлікт, а також матеріальний об'єкт спору.Окрему увагу автором приділено дослідженню визначення моменту, на який має бути відсутній предмет спору, для того, щоб слугувати підставою для закриття провадження. У ци-вільному судочинстві існує позиція, згідно якої у випадку, якщо предмет спору був відсутній на час пред'явлення позову, суд закриває провадження у справі. З'ясовано, що обидва підходи є правильними, що відносить відсутність предмета спору одразу до двох груп підстав для закриття провадження: коли справа в суді виникла незаконно і коли справа виникла правомірно, але далі її розглядати недоцільно. International audience ; The case of Sorana Gurian (1913‑1956) allows to examine the situation of multiple exclusion in the 20th century European society: she is a Jewish woman, a stranger accused of espionage and collaboration and her body, disabled and affected by cancer, becomes the main culprit of this plural banishment. The author is a tragic figure: not only because of her life, but also due to the oblivion that her oeuvre fell into – yet original and contemporarily recognized – counting six volumes in French and Romanian and dozens of press publications. In the paper, I propose to read chosen literary chronicles commenting on two Gurian's editions published in Romania in 1945‑1946 – Zilele nu se întorc niciodată [Days that never return] and Întâmplări între amurg și noapte [Adventures between twilight and night]. These chronicles show the way in which the Other was perceived, in this case – a woman writer, a disabled woman or a Jewish woman in the 20th century. Such perspective aims to show the non‑ aesthetic conditions (gender, corporality, social class, political convictions, ethnic origin, etc.) which have determined Gurian's appearance and disappearance in the literary scene, and which still influence the way of perceiving her texts in Romania. At the end of this study, I reflect on the possibility of rehabilitating this figure in the history of European literature, that could renew the Romanian literary canon of the 20th century, in which women writers haven't still found their place. ; Le cas de Sorana Gurian (1913-1956) permet d'examiner la situation d'une multiple exclusion au sein de la société européenne du xxe siècle : elle est à la fois femme, juive et étrangère, accusée d'espionnage et de collaboration, et son corps, handicapé et touché par le cancer, devient le principal coupable de ce bannissement pluriel. L'auteure est une figure tragique : non seulement par sa vie, mais aussi par l'oubli dans lequel est tombée son œuvre – pourtant originale et reconnue à l'époque –, comptant six volumes en roumain et en français et des dizaines de publications dans la presse. Dans le présent article, je propose une lecture de quelques chroniques littéraires portant sur deux éditions de Gurian parues en Roumanie en 1945-1946 : Zilele nu se întorc niciodată [Les jours ne reviennent jamais] et Întâmplări între amurg și noapte [Aventures entre crépuscule et nuit], qui témoignent de la manière dont on percevait l'Autre, en l'occurrence une femme écrivain, une femme infirme ou bien une femme d'origine juive au xxe siècle. Cette perspective a pour but de montrer les conditionnements autres qu'esthétiques (genre, corporalité, classe sociale, convictions politiques, origine ethnique, etc.) qui ont déterminé l'apparition et la disparition de Gurian sur la scène littéraire, et qui influencent toujours la manière de percevoir ses textes en Roumanie. À la fin de cette étude, je réfléchis à la possibilité de réhabiliter cette figure dans l'histoire de la littérature européenne, ce qui pourrait permettre de rediscuter le canon littéraire roumain du xxe siècle, où les femmes écrivains ne trouvent toujours pas leur place. ; Przypadek Sorany Gurian (1913‑1956) pozwala zbadać sytuację wielokrotnego wykluczenia w xx‑wiecznym społeczeństwie europejskim: jest ona jednocześnie kobietą, Żydówką, obcą, oskarżoną o szpiegostwo i kolaborację, zaś jej ciało, niepełnosprawne i chore na raka, staje się głównym winowajcą tego mnogiego wygnania. Autorka jest postacią tragiczną nie tylko ze względu na jej życie, lecz również ze względu na zapomnienie, w jakie popadła jej oryginalna i uznana przez współczesnych twórczość, na którą składają się sześć wydań w językach francuskim i rumuńskim oraz dziesiątki publikacji w prasie. W niniejszym artykule odczytuję wybrane kroniki literackie komentujące dwa teksty opublikowane przez Gurian w Rumunii w latach 1945‑1946 – Zilele nu se întorc niciodată [Dni nigdy nie powracają] oraz Întâmplări între amurg și noapte [Zdarzenia między zmierzchem a nocą]. Kroniki te pokazują bowiem, w jaki sposób postrzegano Innego, w tym przypadku – pisarkę, niepełnosprawną kobietę czy Żydówkę w xx wieku. Ta perspektywa ma na celu wskazać uwarunkowania nie‑ estetyczne (płeć, cielesność, klasa społeczna, poglądy polityczne, pochodzenie etniczne itd.), które zdecydowały o pojawieniu i zniknięciu Gurian na scenie literackiej, a które ciągle określają postrzeganie jej tekstów w Rumunii. Na końcu tego studium zastanawiam się nad możliwością rehabilitacji tej postaci w historii literatury europejskiej, co mogłoby z kolei przyczynić się do odnowienia rumuńskiego kanonu literackiego xx wieku, w którym nadal nie ma miejsca dla pisarek. ; Cazul Soranei Gurian (1913‑1956) ilustrează situația unei excluderi din considerențe multiple în societatea europeană din secolul xx‑lea. Fiind femeie, evreică și străină, acuzată de spionaj și de colaborare, trupul său, cu handicap și atins de cancer, devine principalul vinovat al acestei exilări plurale. Autorea este un personaj tragic: nu numai din cauza vieții sale, ci și din cauza uitării în care a căzut opera sa, totuși originală și recunoscută de către contemporanii ei, compusă din șase volume în limba franceză și în română, precum și de zeci de publicații în presă. În acest articol, propun o lectură a unor cronici literare privind cele două ediții ale Soranei Gurian publicate în România în anii 1945‑1946 – Zilele nu se întorc niciodată și Aventuri între amurg și noapte. Aceste cronici reflectă modul în care se percepe Celălalt, în acest caz – o scriitoare, o femeie cu handicap, o evreică în contextul secolului xx. Această perspectivă are să identifice diferite condiționări (gen, corporalitate, clasă socială, convingeri politice, etnie șamd), care au determinat atît apariția, cît și dispariția lui Gurian de pe scenă literară și care încă înfluențează modul de percepere al textelor sale în România. La sfîrșitul acestui studiu, propun o reflecție asupra posibilității de reabilitare a acestei figuri în istoria literaturii europene, ceea ce ar putea conduce la rediscutarea canonului literar românesc al secolului xx, unde scriitoarele încă nu‑și găsesc locul.

В статье рассмотрен феномен «информация» через призму определений, которые даются различными науками. Посредством диаграммы сродства выделяются основные категории-смыслы этого термина. Так, в ходе анализа были получены следующие категории: процесс, переход, алгоритм, отображение, код, выбор, знания (сведения). Обобщение этих категорий дает возможность дефинировать понятие «информация» как феномена «системной связности». Такой подход позволяет анализировать современное общество, которое подвержено постоянным кризисам (экономическим, политическим, экологическим, энергетическим, экзистенциальным и пр.), как общество непрекращающегося информационного кризиса. Информационный кризис позволяет продуцирование ложной связности в обществе, что затрудняет как общее управление, так и индивидуальную ориентацию человека в окружающем мире. Ложная связность повышает уровень общей запутанности в различных сферах жизнедеятельности общества. В статье показано, что воспринятая ложная связность порождает ошибочные решения, а в долгосрочной перспективе – и кризисные явления в обществе. Указывается, что индивидуальная способность к пониманию окружающего мира имеет очень большое значение с точки зрения развития человеческого общества. Чем меньше человек способен к прогнозированию своих действий, тем больше ошибочных результатов следует ожидать от него и его деятельности. В статье предлагается формула смысла информации, которая показывает вариативную природу этого явления. А также она позволяет понять, каким образом можно снижать вариативность смысловой нагрузки информации. Сама работа с информацией представляется как сложный процесс, направленный на выявление связности объектов посредством детализации информации об объекте. Более подробно этот способ работы с информацией рассматривается в подходе «инфоведения», задача которого совершить деконструкцию смысла и произвести своеобразную очистку информации. При этом «очистка» информации от ложной связности рассматривается как инструмент, позволяющий увидеть мир иначе, то есть выйти за рамки привычных парадигм. А также это возвращает человеку функцию прогнозирования с высокой степенью вероятности исполнения прогноза. Исполняющиеся прогнозы для человека являются важной составляющей его динамичного развития, подкрепленного системой внутреннего «вознаграждения». Таким образом, может преодолеваться внутренний (экзистенциальный) информационный кризис человека, а также различные другие внешние кризисы, развивающиеся в обществе. ; The article deals with the "information" phenomenon, which was considered through the lens of definitions given by various sciences. With the help of the affinity diagram, the main semantic categories of this term, such as process, transition, algorithm, reflection, code, choice and knowledge (data), were obtained. In order to give a general definition of the "information" term as the "system coherence" phenomenon the generalization method was used. This approach makes it possible to analyze modern society that is prone to constant crises (economic, political, ecological, energy and existential one, etc.) as a society of an ongoing crisis of information. The crisis of information potentiates false coherence in the society that makes both general management and individual orientation of a person in the world around more complicated. False coherence increases the level of general confusion among various groups of society. It is shown that perceived false coherence gives rise to wrong decisions and crisis phenomena in the society in the long run. The author points out that the individual ability to understand the outside world is very important from the human society development point of view. The less a person can predict their actions, the more misguided should be the results expected from them and their activities. In the article the formula for the information meaning that shows the variable nature of this phenomenon is proposed. It also explains how to reduce the variability of the information semantic load. The work with information is presented as a complex process aimed to identify the coherence of objects through the detalization of the information about them. In more detail this method of work with information is considered in the "infology" approach, which is aimed to deconstruct the meaning and make a kind of information cleaning. At the same time, information "cleaning" from false coherence is considered as a tool that makes it possible to see the world differently, that is, go beyond the usual paradigms. What is more, it returns a forecasting function to a person with a high probability of forecast completion, which is an important component of person's dynamic development supported by the internal "reward" system. Thus, the internal (existential) information crisis of a person, as well as many other external crises developing in the society, can be overcome. ; У статті розглянуто феномен «інформація» через призму визначень, які надаються різними науками. За допомогою діаграми спорідненості виокремлюються основні категорії-смисли даного терміна, були отримані наступні категорії: процес, перехід, алгоритм, відображення, код, вибір, знання (відомості). Узагальнення цих категорій дає можливість дефініювати поняття «інформація» як феномену «системної зв'язності». Такий підхід дозволяє аналізувати сучасне суспільство, яке схильне до постійних криз (економічних, політичних, екологічних, енергетичних, екзистенціальних та ін.), як суспільство інформаційної кризи, що не припиняється. Інформаційна криза спричиняє продукування в суспільстві неправдивої зв'язності, що ускладнює як загальне управління, так й індивідуальну орієнтацію людини в навколишньому світі. Помилкова зв'язність підвищує рівень загальної заплутаності в різних сферах життєдіяльності суспільства. Показано, що сприйнята помилкова зв'язність породжує помилкові рішення, а в довгостроковій перспективі – і кризові явища в суспільстві. Вказується, що індивідуальна здатність до розуміння навколишнього світу має дуже велике значення з точки зору розвитку людського суспільства. Чим менше людина здатна до прогнозування своїх дій, тим більше помилкових результатів слід очікувати від неї та її діяльності. У статті пропонується формула сенсу інформації, яка показує варіативну природу цього явища. Також вона дозволяє зрозуміти, яким чином можна знижувати варіативність смислового навантаження інформації. Сама робота з інформацією представляється як складний процес, спрямований на виявлення зв'язності об'єктів за допомогою деталізації інформації про об'єкт. Більш детально цей спосіб роботи з інформацією розглядається у підході «інфознавства», завдання якого – здійснити деконструкцію сенсу і зробити своєрідне очищення інформації. При цьому «очищення» інформації від помилкової зв'язності розглядається як інструмент, що дозволяє побачити світ інакше, тобто вийти за рамки звичних парадигм. А також це повертає людині функцію прогнозування з високим ступенем ймовірності виконання прогнозу. Прогнози, які виконуються, є для людини важливою складовою її динамічного розвитку, підкріпленого системою внутрішньої «винагороди». Таким чином, може долатися внутрішня (екзистенціальна) інформаційна криза людини, а також різні інші зовнішні кризи, що розвиваються в суспільстві.

This article is devoted to the certain aspects of protection of liberty of thought, conscience and religion in the meaning of Art. 9 of the Convention for the Protection of Human Rights and Fundamental Freedoms. We have studied the complexity of the key concepts interpretation, the essence of which is guaranteed by the Convention, due to the lack of extensive practice of the European Commission on Human Rights and the Human Rights Court. It is noted that for a long time in a significant number of complaints the Convention body has come to the conclusion that the issues raised in the complaints, might be considered through the prism or Art. 10, as they concerned freedom of expression, or fell within the limits of Art. 11 of the Convention, which guarantees freedom of assembly and association. At the same time, the values protected by Art. 9 are related to those ones, which are provided in Art. 8 and demand the respect for privacy. It is also closely linked to the right of parents to provide such education and training as it is consistent with their religious and ideological beliefs, as guaranteed by Art. 2 of the First Protocol to the Convention.This article illustrates the fact that the conventional understanding of these complex, deep and multifaceted concepts at the present stage is formed with the development of the case law of the European Human Rights Court, which in its activities is guided by the principle of effective and dynamic interpretation of conventions and other related principles, which ensures the protective mechanism effectiveness. As the time is extended, the Court case-law has developed an approach that allows to assess the views that the petitioners plan to benefit from the protection of the Convention for the Protection of Human Rights and Fundamental Freedoms. Such views in the meaning of Art. 9 must, first of all, be to some extent "convincing, serious, holistic and meaningful" and, secondly, be "compatible with human dignity".Taking into consideration the compiled content of the right guaranteed by Art. 9, viz. that it contains two aspects such as forum internum (internal) and forum externum (external), the article notes that regulation can be involved only in the case of forum externum. As long as liberty of thought, conscience and religion remains within a human being, this right is considered to be absolute. The state has a negative obligation not to interfere in such a right.In the framework of this article, the author considers it appropriate to state the position of the European Union on the attitude and ways to effectively address these issues. As the subject of international law and one of the most influential international organizations based on the values of human dignity, freedom, equality and respect for human rights (Art. 2 of the Treaty on European Union), the EU advocates for their real protection, which requires the development of specific legal instruments.Therefore, both the EU internal and international activities are based on the principles that underlie its creation. It is the foreign policy aspect of the EU human rights activities that is the subject of our article that is reflected in the "European Union Guiding Principles on the Promotion and Protection of Religious Freedom or Belief".The article draws a number of conclusions. First of all, the right of liberty of thought, conscience and religion is one of the key principle of a democratic society and the value in European cultural and historical heritage. The issue of violation of the right to freedom of religion or belief is interrelated with freedom of expression, freedom of assembly and association. The issues of combating various forms of discrimination are not set aside. Additionally, the right, guaranteed by Art. 9, is a fundamental right and one of the democratic society foundations and the value in the law of the European Union. Moreover, the EU identifies problematic issues in the field of protection of liberty of conscience and religion as those ones that require particular attention, and the EU makes efforts to address them not only within its borders, but as well as in the foreign policy relations and initiatives ; Статья посвящена отдельным аспектам защиты свободы мысли, совести и религии в понимании ст. 9 Конвенции о защите прав человека и основных свобод. Исследована сложность толкования ключевых понятий, сущность которых гарантируется Конвенцией. Показано, что конвенциональное понимание этих сложных, глубоких и многогранных понятий на современном этапе формируется с развитием судебной практики Европейского суда по правам человека. Учитывая составленное содержание права, гарантируется ст. 9 Конвенции, а именно то, что оно включает в себя два аспекта - forum internum (внутренний) и forum externum (внешний), в статье отмечено, что регулирование может быть задействовано только в случае forum externum. Пока свобода мысли, совести и религии остается внутри человека, такое право является абсолютным. На государство возложено отрицательное обязательство относительно невмешательства в такое право. Враховуючи складений зміст права, що гарантується ст. 9 Конвенції, а саме те, що воно містить у собі два аспекти – forum internum (внутрішній) і forum externum (зовнішній), у статті наголошено, що регулювання може бути задіяним тільки у випадку forum externum. Допоки свобода думки, совісті і релігії залишається всередині людини, таке право є абсолютним. На державу покладено негативний обов'язок щодо невтручання в таке право. The article investigates the processes of the powerful financial industrial groups emerging in the Donbass region throughout the 1990-ies. It is stated that Donbass regional significance drastically raised with Ukraine's gaining independence due to fuel resources concentrated in the region and critically important for state fuel and energy supplies. The research specifically focuses upon the miner unions movement, its role in gaining Ukraine's independence, its further evolution and impact it had upon the regional elite formation. The first Donetsk elite's representative to ever acquire a top position in Kyiv was Yuhym Zviahilskiy, the Zasiadko mine's former director. What boosted his rapid promotion was his cooperation with the Ukraine's President Leonid Kuchma seeking allies for his fight with the Dniepropetrovsk clan. The whole variety of the turn-of-the-century financial industrial groups is arguably divided into the following categories: 1) source-based groups (emerging mostly around coal mining and ore extraction industries typical for the Donbass region); 2) defense industry-based groups with former Komsomol and Party leaders in charge; 3) groups based on legal and secretive agencies (mostly known for Victor Medvedchuk and Surkis brothers' activities); 4) Pavlo Lazarenko's proto-agrarian clan. The establishment of System Capital Management, Donbass Industrial Union, Altcom corporations is described with direct reference to Rinat Akhmetov, Serhii Taruta, Vitalii Haiduk, Borys Kolesnikov's roles in this process. The genesis of the groups under consideration is specified through their key industrial assets, affiliated banks, legal status, transregional and international expansion. The "old elite" (mostly related to the criminal syndicates) to the "new elite" (based on income legalization through financial industrial groups and international business) generational shift is explored. Three basic stages of Donetsk clan establishment have been identified: 1) the "mafiosi wars" of the first half of the 1990-ies; 2) consolidation and driving the "old guards" out of regional political and economic field (1995 - 1999); 3) the ultimate establishment of financial industrial groups pursuing their own economical and political interests (early 2000-ies). The author argues that continuous fights between the regional mafiosi groups searching for a common spokesman was one of the reasons for "the Donetsk gang's" belated engagement into struggle for political influence and Ukraine's finance and economic markets reallocation. ; Раскрываются процессы формирования мощных финансовых и индустриальных объединений на территории Донбасса в течение 1990-х гг. Исследована роль шахтерского движения в обретении независимости Украины, его дальнейшая эволюция и влияние на формирование региональных элит. Отмечено, что после провозглашения Украиной независимости статус Донбасса вырос, в том числе из-за концентрации в регионе топливных ресурсов, необходимых для обеспечения государства топливно-энергетическими ресурсами. Первым представителем донецких элит, получивших высокую должность в Киеве, стал Ефим Звягильский, бывший директор шахты имени Засядько. Ключевым моментом его роста стало сотрудничество с Президентом Украины Леонидом Кравчуком, который искал союзников для борьбы с днепропетровским кланом. Обоснована авторская классификация финансово-промышленных групп в Украине 1990-2000-х гг .: 1) сырьевые (построенные вокруг добычи угля и руды, характерные для Донбасса) 2) комсомольско-партийные на основе ВПК; 3) юридически спецслужбистская группа (ее самыми известными представителями стали Виктор Медведчук и братья Суркисы) 4) протоаграрный клан Павла Лазаренко. Описано становление корпораций «Систем Кэпитал Менеджмент», «Индустриальный союз Донбасса», «Альтком» и роль Рината Ахметова, Сергея Таруты, Виталия Гайдука, Бориса Колесникова и других влиятельных лиц из Донбасса. Раскрыты особенности возникновения этих групп: ключевые производственные активы, банковские учреждения, юридический статус, экспансия в другие регионы и за границу. Охарактеризован переход от «старой» генерации донецких элит, тесно связанной с криминальными кругами, к «новой», основанной на легализации полученных состояний в виде финансово-промышленных групп и международного бизнеса. Выделены три основных стадии формирования донецкого клана: 1)«мафиозные войны» (первая половина 1990-х гг.) 2) консолидация и вытеснение «старой гвардии» с политического и экономического поля региона (1995-1999 гг.) 3) окончательное оформление ФПГ с собственными экономическими и политическими интересами (начало 2000-х гг.). Доказано, что одной из причин запоздалого включения «донецких» в борьбу за перераспределение финансово-экономических рынков и политической власти в Украине была долговременная борьба среди мафиозных групп региона и поиски выразителя интересов. ; Розкриваються процеси формування потужних фінансових та індустріальних об'єднань на території Донбасу протягом 1990-х рр. Досліджено роль шахтарського руху у здобутті незалежності України, його подальша еволюція та вплив на формування регіональних еліт. Відзначено, що після проголошення Україною незалежності статус Донбасу виріс, в тому числі через концентрацію в цьому регіоні паливних ресурсів, необхідних для забезпечення держави паливно-енергетичними ресурсами. Першим представ-ником донецьких еліт, що отримав високу посаду в Києві, став Юхим Звягільський, колишній директор шахти імені Засядька. Ключовим моментом його зростання стала співпраця з Президентом України Лео-нідом Кравчуком, який шукав союзників для боротьби з дніпропетровським кланом. Обґрунтовано ав-торську класифікацію фінансово-промислових груп в Україні 1990-2000-х рр.: 1) сировинні (побудовані навколо видобутку вугілля та руди, характерні для Донбасу); 2) комсомольсько-партійні на основі ВПК; 3) юридично-спецслужбівська група (найвідомішими представниками стали Віктор Медведчук та брати Суркіси); 4) протоаграрний клан Павла Лазаренка. Описано становлення корпорацій «Систем Кепітал Ме-неджмент», «Індустріальний союз Донбасу», «Альтком» та роль Ріната Ахметова, Сергія Тарути, Віталія Гайдука, Бориса Колеснікова та інших впливових осіб з Донбасу. Розкрито особливості виникнення цих груп: ключові виробничі активи, банківські установи, юридичний статус, експансія в інші регіони та за кордон. Охарактеризовано перехід від «старої» генерації донецьких еліт, тісно пов'язаної з кримінальними колами, до «нової», заснованої на легалізації отриманих статків у вигляді фінансово-промислових груп та міжнародного бізнесу. Виокремлено три головні стадії формування донецького клану: 1) «мафіозні війни» (перша половина 1990-х рр.); 2) консолідація і витіснення «старої гвардії» із політичного та економічного поля регіону (1995-1999 рр.); 3) остаточне оформлення ФПГ із власними економічними і політичними інтересами (початок 2000-х рр.). Доведено, що однією з причин запізнілого включення «донеччан» у боротьбу за перерозподіл фінансово-економічних ринків та політичної влади в України була довготривала боротьба серед мафіозних груп регіону і пошуки виразника інтересів.

The methodology of the Cambridge School of Intellectual History, the key approach of which was dubbed "contextualism", draws particular attention to the analysis of political idioms (languages) in a given socio-political context in order to answer the key question: "what was doing the author when he uttered his statement?", and the answer to this question is used to indicate the possibilities for the study of internal Ukrainian discourse about the role of Ukraine on international arena using the example of the thesis about the imaginary "external governance" of our country. The concept of "intellectual history" itself has been applied to a wide range of research objects, and this fact provides opportunities for the study of discussions about Ukraine's foreign policy vector and Ukraine's relations with other states and international actors. It can be studied and as an intellectual history, reconstructed by analysing different language forms of political communities and statements about Ukrainian politics. It will also provide a better understanding of how concepts are used in different political contexts. Rhetorical and practical vocabulary shapes the views of political actors, expands or limits their possibilities of discursive actions. From the perspective of the Cambridge School, the study of political idioms allows us to find out how descriptive paradigms are changing and how political "accents" are placed. The example of the discourse about the role of Ukraine in international relations demonstrates that political actors who put forward the thesis of "external governance" regarding our state, question its sovereignty and international subjectivity, but with this rhetorical approach they also separate Ukraine from the West ( which, among other things, actively insists on how important it is to fight corruption) and they open opportunities for Ukraine's rapprochement with Russia by reformatting this country's position within the domestic political discourse – from an aggressor country its status changes to a potential partner, creditor or even financial donor. With the help of such a technique, there is also a shift in attention from forces that have a negative impact on the country's domestic and foreign policy (oligarchs) to imaginary external pressure. Further research into the processes of production and understanding of statements in Ukrainian politics, including its place and role in the international arena, using the methodology of the Cambridge School of Intellectual History may also contribute to an improvement in interdisciplinary links between humanities and social sciences. ; Методология Кембриджской школы интеллектуальной истории, ключевой подход которой получил название «контекстуализм», уделяющая особое внимание уделяется анализу политических идиом (языков) в конкретном общественно-политическом контексте для поиска ответа на ключевой вопрос «что пытался сделать автор, делая свои высказывания?» используется для обозначения возможностей исследования внутриукраинского дискурса о роли Украины на международной арене на примере тезисы о мнимом «внешнем управлении» нашей страной. Само понятие «интеллектуальная история» применяется к широкому спектру объектов исследований, что открывает возможности для исследования дискуссий о внешнеполитическом векторе Украины и об отношениях Украины с другими государствами и международными акторами именно как интеллектуальной истории, которую можно реконструировать путем анализа языковых форм политических сообществ, устанавливающих рамки возможных высказываний о политике. Это также позволит лучше понять использование концептов в разных политических контекстах. Риторический и практический узус формирует взгляды политических акторов, расширяет или ограничивает возможности дискурсивного действия. С позиций представителей Кембриджской школы исследования политических идиом позволяет выяснить, каким образом меняются парадигмы описания и как расставляются политические акценты. На примере дискурса о роли Украины на международной арене показано, что политические акторы, которые выдвигают тезис о «внешнем управлении» по отношению к нашему государству, ставят под вопрос ее суверенитет и международную субъектность, но с помощью этого риторического приема также отделяют Украину от Запада (который, в частности, активно настаивает на борьбе с коррупцией) и открывают возможности для ее сближения с Россией через переформатирование позиции этой страны внутри внутриполитического украинского дискурса – из страны-агрессора в возможного партнера, кредитора или даже финансового донора. С помощью такого приема также происходит смещение внимания с сил, имеющих внутри страны отрицательное влияние на ее внутреннюю и внешнюю политику (олигархи) на давление извне. Дальнейшие исследования процессов производства и понимания высказываний в украинской политике, в том числе касательно её места и роли на международной арене, с использованием методологии Кембриджской школы интеллектуальной истории могут также усилить междисциплинарные связи между гуманитарными и обществоведческими науками. ; Методологія Кембриджської школи інтелектуальної історії, ключовий підхід якої отримав назву «контекстуалізм» і в якій особлива увага приділяється аналізу політичних ідіом (мов) в конкретному суспільно-політичному контексті для пошуку відповіді на ключове питання «що намагався зробити автор, коли робив свої висловлювання?» використовується для окреслення можливостей дослідження внутрішньоукраїнського дискурсу про роль України на міжнародній арені на прикладі тези про уявне «зовнішнє управління». Саме поняття «інтелектуальна історія» застосовується до широкого спектру об'єктів досліджень, що відкриває можливості для дослідження дискусій про зовнішньополітичній вектор України та її відносин з іншими державами та міжнародними акторами саме як інтелектуальної історії, яку можна реконструювати шляхом аналізу мовних форм політичних спільнот, що встановлюють рамки можливих висловлювань про політику та дозволяють краще зрозуміти використання концептів в різних політичних контекстах. Риторичний і практичний узус формує погляди політичних акторів та розширює або обмежує спроможності дискурсивної дії. З позицій представників Кембриджської школи, дослідження політичних ідіом дозволяє з'ясувати, яким чином змінюються парадигми опису та розставляються політичні акценти. На прикладі дискурсу про роль України на міжнародній арені показано, що політичні актори через висування тези про «зовнішнє управління» по відношенню до нашої держави ставлять під питання її суверенітет та міжнародну суб'єктність, але за допомогою цього риторичного прийому також відмежовують Україну від Заходу (який, зокрема, активно наполягає на боротьбі з корупцією) і відкривають можливості для її зближення з Росією через переформатування позиції цієї країни всередині внутрішньополітичного українського дискурсу – з країни-агресора на можливого партнера чи навіть кредитора або фінансового донора. За допомогою такого прийому також відбувається зміщення уваги від тих сил, які всередині країни мають негативний плив на її внутрішню та зовнішню політику (олігархи) на тиск ззовні. Подальші дослідження процесів виробництва і розуміння висловлювань в українській політиці, зокрема й щодо її місця та ролі на міжнародній арені, з використанням методології Кембриджської школи інтелектуальної історії, можуть також посилити міждисциплінарні зв'язки між гуманітарними та суспільствознавчими науками.

This system is extraordinary for the presence of two sets of multiple images at different redshifts, which provide the opportunity to obtain more information at the cost of increased modelling complexity with respect to previously analysed systems. We perform detailed modelling of the mass distribution for this lens system using three band Hubble Space Telescope imaging. We combine the measured time delays, line-of-sight central velocity dispersion of the deflector, and statistically constrained external convergence with our lens models to estimate two cosmological distances. We measure the 'effective' time-delay distance corresponding to the redshifts of the deflector and the lensed quasar DΔ t eff=3382-115+146 Mpc and the angular diameter distance to the deflector Dd = 1711-280+376 Mpc, with covariance between the two distances. From these constraints on the cosmological distances, we infer the Hubble constant H0= 74.2-3.0+2.7 km s-1 Mpc-1 assuming a flat ΛCDM cosmology and a uniform prior for ωm as \Omega m ∼ \mathcal {U(0.05, 0.5). This measurement gives the most precise constraint on H0 to date from a single lens. Our measurement is consistent with that obtained from the previous sample of six lenses analysed by the H0 Lenses in COSMOGRAIL's Wellspring (H0LiCOW) collaboration. This article is devoted to the certain aspects of protection of liberty of thought, conscience and religion in the meaning of Art. 9 of the Convention for the Protection of Human Rights and Fundamental Freedoms. We have studied the complexity of the key concepts interpretation, the essence of which is guaranteed by the Convention, due to the lack of extensive practice of the European Commission on Human Rights and the Human Rights Court. It is noted that for a long time in a significant number of complaints the Convention body has come to the conclusion that the issues raised in the complaints, might be considered through the prism or Art. 10, as they concerned freedom of expression, or fell within the limits of Art. 11 of the Convention, which guarantees freedom of assembly and association. At the same time, the values protected by Art. 9 are related to those ones, which are provided in Art. 8 and demand the respect for privacy. It is also closely linked to the right of parents to provide such education and training as it is consistent with their religious and ideological beliefs, as guaranteed by Art. 2 of the First Protocol to the Convention.This article illustrates the fact that the conventional understanding of these complex, deep and multifaceted concepts at the present stage is formed with the development of the case law of the European Human Rights Court, which in its activities is guided by the principle of effective and dynamic interpretation of conventions and other related principles, which ensures the protective mechanism effectiveness. As the time is extended, the Court case-law has developed an approach that allows to assess the views that the petitioners plan to benefit from the protection of the Convention for the Protection of Human Rights and Fundamental Freedoms. Such views in the meaning of Art. 9 must, first of all, be to some extent "convincing, serious, holistic and meaningful" and, secondly, be "compatible with human dignity".Taking into consideration the compiled content of the right guaranteed by Art. 9, viz. that it contains two aspects such as forum internum (internal) and forum externum (external), the article notes that regulation can be involved only in the case of forum externum. As long as liberty of thought, conscience and religion remains within a human being, this right is considered to be absolute. The state has a negative obligation not to interfere in such a right.In the framework of this article, the author considers it appropriate to state the position of the European Union on the attitude and ways to effectively address these issues. As the subject of international law and one of the most influential international organizations based on the values of human dignity, freedom, equality and respect for human rights (Art. 2 of the Treaty on European Union), the EU advocates for their real protection, which requires the development of specific legal instruments.Therefore, both the EU internal and international activities are based on the principles that underlie its creation. It is the foreign policy aspect of the EU human rights activities that is the subject of our article that is reflected in the "European Union Guiding Principles on the Promotion and Protection of Religious Freedom or Belief".The article draws a number of conclusions. First of all, the right of liberty of thought, conscience and religion is one of the key principle of a democratic society and the value in European cultural and historical heritage. The issue of violation of the right to freedom of religion or belief is interrelated with freedom of expression, freedom of assembly and association. The issues of combating various forms of discrimination are not set aside. Additionally, the right, guaranteed by Art. 9, is a fundamental right and one of the democratic society foundations and the value in the law of the European Union. Moreover, the EU identifies problematic issues in the field of protection of liberty of conscience and religion as those ones that require particular attention, and the EU makes efforts to address them not only within its borders, but as well as in the foreign policy relations and initiatives ; Статья посвящена отдельным аспектам защиты свободы мысли, совести и религии в понимании ст. 9 Конвенции о защите прав человека и основных свобод. Допоки свобода думки, совісті і релігії залишається всередині людини, таке право є абсолютним. На державу покладено негативний обов'язок щодо невтручання в таке право. Наведено позицію Європейського Союзу щодо розглядуваних проблем і шляхів ефективного їх вирішення

From the economic and legal point of view the author made generalization and formation of the view on the development of the national accounting of intangible assets (IA) under the influence of changes in the European Union as a condition for advancement to the neo-economy. It is considered essentially the national standard — Provision (Standard) of Accounting 8 «Intangible assets» in comparison with the analogous international accounting standard of IAS 38 «Intangible assets». It is noted that, in contrast to the domestic standard, IAS 38 describes the procedure for analyzing compliance of IA with the criteria of an asset as an intangible resource. It is taken into account that in the course of the operation of the IA the enterprise may incur costs: related to the improvement (modernization) of such assets; aimed at supporting the IA facility in a serviceable condition.It is stated that an asset is identifiable if it: (a) can be separated, that is, it can be separated or separated from the entity and sold, transferred, licensed, leased or exchanged individually or in conjunction with a related contract, an identified asset or liability, whether or not the entity intends to do so, or b) arises as a result of contractual or other legal rights, whether or not they may be transferred or separated from the entity or from other rights and obligations. It is stated that an entity controls the asset if it is empowered to obtain future economic benefits coming from the primary resource and restrict others from accessing those benefits.It is noted that the use of intellectual property rights in the production process may reduce future production costs rather than increase future revenues. The ability of an entity to control the future economic benefits of IA is largely based on the legal rights that can be assured through litigation. Legislative requirements have been createdto align Ukrainian accounting standards with EU law and update the procedure for applying the International Financial Reporting System, which is also related to IA, especially for large companies. The introduction of digital finances and digital accounting can make significant changes. The applying of International Financial ReportingStandards in European countries supports to ensure compliance with the rules of national legislation of Ukraine in the field of accounting. ; С экономико-правовых позиций осуществлено обобщение и формирование взгляда на развитие национального бухгалтерского учета нематериальных активов (НА) под влиянием изменений в Европейском Союзе как условие продвижения к неоэкономике. Рассматривается по сути национальный стандарт П (С) БУ 8 «Нематериальные активы» в сравнении с аналогом международным стандартом бухгалтерского учета МСБУ 38 «Нематериальные активы». Отмечено, что в отличие от отечественного стандарта, в МСБУ 38 описывается процедура анализа соответствия НА критериям актива в качестве нематериального ресурса. Учитывается, что в процессе эксплуатации НА у предприятия могут быть расходы: связанные с совершенствованием (модернизацией) таких активов; направленные на поддержание объекта НА в состоянии, пригодном для эксплуатации. Содержательное наполнение изменений может внести внедрение диджитал-финансов и диджитал-бухгалтерии. Зазначено, що суб'єкт господарювання контролює актив, якщо він має повноваження отримувати майбутні економічні вигоди, що надходять від основного ресурсу, та обмежувати доступ інших до цих вигод. Зазначено, що використання права інтелектуальної власності у виробичому процесі може зменшити майбутні виробничі витрати, а не збільшити майбутні доходи. Здатність суб'єкта господарювання контролювати майбутні економічні вигоди від НА здебільшого виходить із юридичних прав, які можна забезпечити у судовому порядку. Створені законодавчі вимоги щодо приведення українських норм бухгалтерського обліку у відповідність до законодавства ЄС та оновлення порядку застосування Міжнародної системи фінансової звітності, що також пов'язано з НА, особливо для великих компаній. Змістове наповнення змін може внести впровадження діджитал-фінансів і діджитал-бухгалтерії. Застосування Міжнародних стандартів фінансової звітності в європейських країнах сприяє забезпеченню відповідності норм національного законодавства України у сфері бухгалтерського обліку.

The position of Indonesia which is located at the confluence of three plates (Eurasia, Indies Australia, and the Pacific) causes the formation of a series of volcanoes in some parts of the country and causes the formation of geothermal energy sources around the volcano. Geothermal energy is the energy of natural resources in the form of hot water or steam formed in a reservoir inside the earth through heating of subsurface water by igneous rocks (Team Pertamina, 2010). This geothermal energy can be used directly for drying agricultural production, tourism, and household needs or indirectly as a driver of electricity-generating turbines.In this study focused in East Java, the author discusses geothermal potential by using geoelectric methods in the never-ending area of fire to contribute manifestation information as one of the answers to the community and government which is expected to provide an idea of how large geothermal potential is using the geoelectric method in the fire area has never been extinguished by Pamekasan Madura. the distance between the 5-meter electrode. Events with two same-sign leptons l (electrons or muons) and at least two reconstructed jets are selected to search for WWW -> l nu l nu qq. Events with three leptons without any same-flavour opposite-sign lepton pairs are used to search for WWW > l nu l nu l nu, while events with three leptons and at least one same-flavour opposite-sign lepton pair and one or more reconstructed jets are used to search for WWZ -> l nu qqll. Finally, events with four leptons are analysed to search for WWZ > l nu l nu ll and WZZ > qqllll. Background Nutritional interventions to prevent stunting of infants and young children are most often applied in rural areas in low-and middle-income countries (LMIC). Few interventions are focused on urban slums. The literature needs a systematic assessment, as infants and children living in slums are at high risk of stunting. Urban slums are complex environments in terms of biological, social, and political variables and the outcomes of nutritional interventions need to be assessed in relation to these variables. For the purposes of this review, we followed the UN-Habitat 2004 definitions for low-income informal settlements or slums as lacking one or more indicators of basic services or infrastructure. Objectives To assess the impact of nutritional interventions to reduce stunting in infants and children under five years old in urban slums from LMIC and the effect of nutritional interventions on other nutritional (wasting and underweight) and non-nutritional outcomes (socioeconomic, health and developmental) in addition to stunting. Search methods The review used a sensitive search strategy of electronic databases, bibliographies of articles, conference proceedings, websites, grey literature, and contact with experts and authors published from 1990. We searched 32 databases, in English and non-English languages (MEDLINE, CENTRAL, Web of Science, Ovid MEDLINE, etc). We performed the initial literature search from November 2015 to January 2016, and conducted top up searches in March 2017 and in August 2018. Selection criteria Research designs included randomised (including cluster-randomised) trials, quasi-randomised trials, non-randomised controlled trials, controlled before-and-after studies, pre-and postintervention, interrupted time series (ITS), and historically controlled studies among infants and children from LMIC, from birth to 59 months, living in urban slums. The interventions included were nutrition-specific or maternal education. The primary outcomes were length or height expressed in cm or length-for-age (LFA)/height-for-age (HFA) z-scores, and birth weight in grams or presence/absence of low birth weight (LBW). Data collection and analysis We screened and then retrieved titles and abstracts as full text if potentially eligible for inclusion. Working independently, one review author screened all titles and abstracts and extracted data on the selected population, intervention, comparison, and outcome parameters and two other authors assessed half each. We calculated mean selection difference (MD) and 95% confidence intervals (CI). We performed intervention-level meta-analyses to estimate pooled measures of effect, or narrative synthesis when meta-analyses were not possible. We used P less than 0.05 to assess statistical significance and intervention outcomes were also considered for their biological/ health importance. Where effect sizes were small and statistically insignificant, we concluded there was 'unclear effect'. Main results The systematic review included 15 studies, of which 14 were randomised controlled trials (RCTs). The interventions took place in recognised slums or poor urban or periurban areas. The study locations were mainly Bangladesh, India, and Peru. The participants included 9261 infants and children and 3664 pregnant women. There were no dietary intervention studies. All the studies identified were nutrient supplementation and educational interventions. The interventions included zinc supplementation in pregnant women (three studies), micronutrient or macronutrient supplementation in children (eight studies), nutrition education for pregnant women (two studies), and nutrition systems strengthening targeting children (two studies) intervention. Six interventions were adapted to the urban context and seven targeted household, community, or 'service delivery' via systems strengthening. The primary review outcomes were available from seven studies for LFA/HFA, four for LBW, and nine for length. The studies had overall high risk of bias for 11 studies and only four RCTs had moderate risk of bias. Overall, the evidence was complex to report, with a wide range of outcome measures reported. Consequently, only eight study findings were reported in meta-analyses and seven in a narrative form. The certainty of evidence was very low to moderate overall. None of the studies reported differential impacts of interventions relevant to equity issues. Zinc supplementation of pregnant women on LBW or length (versus supplementation without zinc or placebo) (three RCTs) There was no evidence of an effect on LBW (MD-36.13 g, 95% CI-83.61 to 11.35), with moderate-certainty evidence, or no evidence of an effect or unclear effect on length with low-to moderate-certainty evidence. Micronutrient or macronutrient supplementation in children (versus no intervention or placebo) (eight RCTs) There was no evidence of an effect or unclear effect of nutrient supplementation of children on HFA for studies in the meta-analysis with low-certainty evidence (MD-0.02, 95% CI-0.06 to 0.02), and inconclusive effect on length for studies reported in a narrative form with very low-to moderate-certainty evidence. Nutrition education for pregnant women (versus standard care or no intervention) (two RCTs) There was a positive impact on LBW of education interventions in pregnant women, with low-certainty evidence (MD 478.44g, 95% CI 423.55 to 533.32). Nutrition systems strengthening interventions targeting children (compared with no intervention, standard care) (one RCT and one controlled before-and-after study) There were inconclusive results on HFA, with very low-to low-certainty evidence, and a positive influence on length at 18 months, with low-certainty evidence. Authors' conclusions All the nutritional interventions reviewed had the potential to decrease stunting, based on evidence from outside of slum contexts; however, there was no evidence of an effect of the interventions included in this review (very low-to moderate-certainty evidence). Challenges linked to urban slum programming (high mobility, lack of social services, and high loss of follow-up) should be taken into account when nutrition-specific interventions are proposed to address LBW and stunting in such environments. More evidence is needed of the effects of multi-sectorial interventions, combining nutrition-specific and sensitive methods and programmes, as well as the effects of 'up-stream' practices and policies of governmental, non-governmental organisations, and the business sector on nutrition-related outcomes such as stunting.

From the economic and legal point of view the author made generalization and formation of the view on the development of the national accounting of intangible assets (IA) under the influence of changes in the European Union as a condition for advancement to the neo-economy. It is considered essentially the national standard — Provision (Standard) of Accounting 8 «Intangible assets» in comparison with the analogous international accounting standard of IAS 38 «Intangible assets». It is noted that, in contrast to the domestic standard, IAS 38 describes the procedure for analyzing compliance of IA with the criteria of an asset as an intangible resource. It is taken into account that in the course of the operation of the IA the enterprise may incur costs: related to the improvement (modernization) of such assets; aimed at supporting the IA facility in a serviceable condition.It is stated that an asset is identifiable if it: (a) can be separated, that is, it can be separated or separated from the entity and sold, transferred, licensed, leased or exchanged individually or in conjunction with a related contract, an identified asset or liability, whether or not the entity intends to do so, or b) arises as a result of contractual or other legal rights, whether or not they may be transferred or separated from the entity or from other rights and obligations. It is stated that an entity controls the asset if it is empowered to obtain future economic benefits coming from the primary resource and restrict others from accessing those benefits.It is noted that the use of intellectual property rights in the production process may reduce future production costs rather than increase future revenues. The ability of an entity to control the future economic benefits of IA is largely based on the legal rights that can be assured through litigation. Legislative requirements have been createdto align Ukrainian accounting standards with EU law and update the procedure for applying the International Financial Reporting System, which is also related to IA, especially for large companies. The introduction of digital finances and digital accounting can make significant changes. The applying of International Financial ReportingStandards in European countries supports to ensure compliance with the rules of national legislation of Ukraine in the field of accounting. ; С экономико-правовых позиций осуществлено обобщение и формирование взгляда на развитие национального бухгалтерского учета нематериальных активов (НА) под влиянием изменений в Европейском Союзе как условие продвижения к неоэкономике. Рассматривается по сути национальный стандарт П (С) БУ 8 «Нематериальные активы» в сравнении с аналогом международным стандартом бухгалтерского учета МСБУ 38 «Нематериальные активы». Отмечено, что в отличие от отечественного стандарта, в МСБУ 38 описывается процедура анализа соответствия НА критериям актива в качестве нематериального ресурса. Учитывается, что в процессе эксплуатации НА у предприятия могут быть расходы: связанные с совершенствованием (модернизацией) таких активов; направленные на поддержание объекта НА в состоянии, пригодном для эксплуатации. Отмечено, что актив является идентифицированным, если он: a) может быть отделен, то есть его можно отделить или отделить от предприятия и продать, передать, лицензировать, сдать в аренду или обменять индивидуально или вместе со связанным с ним контрактом, идентифицированным активом или обязательством, независимо от того, имеет ли намерение субъект хозяйствования сделать это, или б) является результатом договорных или других юридических прав, независимо от того, могут ли они быть переданы или отделены от субъекта хозяйствования или от других прав и обязательств. Отмечено, что предприятие контролирует актив, если он имеет полномочия получать будущие экономические выгоды, поступающие от основного ресурса, и ограничивать доступ других к этим выгодам. Отмечено, что использование интеллектуальной собственности в производственном процессе может уменьшить будущие производственные затраты, а не увеличить будущие доходы. Способность субъекта хозяйствования контролировать будущие экономические выгоды от НА в основном исходит из юридических прав, которые можно обеспечить в судебном порядке. Созданные законодательные требования по приведению украинских норм бухгалтерского учета в соответствие с законодательством ЕС и обновления порядка применения Международной системы финансовой отчетности, что также связано с НА, особенно для крупных компаний. Содержательное наполнение изменений может внести внедрение диджитал-финансов и диджитал-бухгалтерии. Применение Международных стандартов финансовой отчетности в европейских странах способствует обеспечению соответствия норм национального законодательства Украины в сфере бухгалтерского учета. ; З економіко-правових позицій здійснено узагальнення та формування погляду на розвиток національного бухгалтерського обліку нематеріальних активів (НА) під впливом змін у Європейському Союзі як умови просування до неоекономіки.Розглядається за суттю національний стандарт П(С)БО 8 «Нематеріальні активи» в порівнянні з аналогом — міжнародним стандартом бухгалтерського обліку МСБО 38 «Нематеріальні активи». Зазначено, що на відміну від вітчизняного стандарту, у МСБО 38 описується процедура аналізу відповідності НА критеріямактиву як нематеріального ресурсу. Ураховується, що у процесі експлуатації НА у підприємства можуть бути витрати: пов'язані з удосконаленням (модернізацією) таких активів; спрямовані на підтримку об'єкта НА у стані, придатному для експлуатації. Зазначено, що актив є ідентифікованим, якщо він: a) може бути відокремлений, тобто його можна відокремити або відділити від суб'єкта господарювання і продати, передати, ліцензувати, здати в оренду або обміняти індивідуально або разом з пов'язаним із ним контрактом, ідентифікованим активом чи зобов'язанням, незалежно від того, чи має суб'єкт господарювання намір зробити це, або б) виникає внаслідок договірних або інших юридичних прав, незалежно від того, чи можуть вони бути передані або відокремлені від суб'єкта господарювання або ж від інших прав і зобов'язань. Зазначено, що суб'єкт господарювання контролює актив, якщо він має повноваження отримувати майбутні економічні вигоди, що надходять від основного ресурсу, та обмежувати доступ інших до цих вигод. Зазначено, що використання права інтелектуальної власності у виробичому процесі може зменшити майбутні виробничі витрати, а не збільшити майбутні доходи. Здатність суб'єкта господарювання контролювати майбутні економічні вигоди від НА здебільшого виходить із юридичних прав, які можна забезпечити у судовому порядку. Створені законодавчі вимоги щодо приведення українських норм бухгалтерського обліку у відповідність до законодавства ЄС та оновлення порядку застосування Міжнародної системи фінансової звітності, що також пов'язано з НА, особливо для великих компаній. Змістове наповнення змін може внести впровадження діджитал-фінансів і діджитал-бухгалтерії. Застосування Міжнародних стандартів фінансової звітності в європейських країнах сприяє забезпеченню відповідності норм національного законодавства України у сфері бухгалтерського обліку.
