La tesis doctoral analiza el funcionamiento de la audiencia de Lima en la segunda mitad del siglo XVIII, destacando que en el referido siglo fue un organismo de desacreditada actuación y en el que la justicia se inclinó primando las conexiones familiares y de negocios. En la época mencionada, el nepotismo y las innumerables quejas que llegaban al Consejo de Indias sobre el desempeño de los oidores eran las quejas recurrentes. Formando parte de las reformas implementadas por Carlos III, y con el objetivo de reformar la audiencia peruana se constituyó una visita general liderada por José Antonio de Areche. Este encargo se vio ampliado a la reforma de la hacienda, del consulado, así como proveer los primeros pasos para el establecimiento de la nueva organización territorial: las Intendencias. Estas medidas reformadoras venían precedidas por los resultados alcanzados por Gálvez en el virreinato de Nueva España, y en la que Areche también había colaborado La investigación se ha centrado también en analizar la importante red de alianzas que tejió la elite limeña que gobernaba junto al virrey Guirior, que se convirtió en su principal valedor. El propósito de la aristocracia fue que la visita fuera considerada un fracaso, aspirando a que Madrid la suspendiera sin la aplicación de las medidas reformadoras; pero además lograr el desprestigio del visitador, de manera que sus propuestas fueran descartadas. La novedad del tema radicó en realizar un estudio lo más objetivo e imparcial posible de lo que aconteció en la audiencia de Lima durante la visita general durante los años de 1776 a 1783. La investigación aporta información relevante sobre José Antonio de Areche, que continuaba guardada en los archivos, y que consideramos fundamental para entender la visita y para juzgar la conocida rivalidad con Guirior. En este aspecto, se ha investigado la relación desde las dos visiones: la del virrey y la del visitador. En definitiva, la tesis doctoral ha conseguido llenar vacíos de información que se hacían necesarios solventar para realizar un estudio objetivo tanto de la institución judicial limeña como de la personalidad del visitador vizcaíno. Los objetivos se orientaron a reconstruir la organización del tribunal de justicia durante las décadas de 1770 a 1790. Asimismo, identificar y analizar la actuación de los ministros y su reacción frente a las reformas borbónicas, destacando la relación que mantuvieron con el visitador Areche. La tesis doctoral es una investigación cualitativa e interpretativa, en la que el soporte principal es la documentación de archivos americanos y españoles. Por tanto, los métodos, técnicas e instrumentos se han orientado a la línea marcada por la investigación cualitativa. Se realizaron registros de observación para identificar al cuerpo de oidores y su desempeño durante la visita general. El método de registro nos permitió entender la estructura organizativa del tribunal de justicia limeño, las funciones específicas de cada sala: civil y judicial, así como las ocupaciones de los empleos menores. En cuanto al funcionario escogido para realizar la visita al Perú, y contrario a lo estudiado, Areche no era un advenedizo, sino que llegaba al virreinato con amplia experiencia en el gobierno de las Indias. Asimismo, le respaldaba un respetable expediente académico, así como su lealtad a la corona y al ministro de Indias. Además, llegaba convencido de que las reformas eran necesarias para mejorar el gobierno de los peruanos y no para "esquilmarlo" con impuestos. En este sentido, la investigación realizada aporta nueva información respecto a la vida y personalidad del que fuera visitador del Perú. José Antonio de Areche and overall visit to the Audiencia of Lima The dissertation analyzes the operation of the hearing of Lima in the late eighteenth century, noting that in the aforementioned century was a discredited agency action and justice in which leaned giving priority to family and business connections. In the period mentioned, nepotism and countless complaints reached the Council of the Indies on the performance of the judges were recurrent complaints. In short, the thesis has managed to fill information gaps that became necessary resolve to conduct an objective study of both Lima's judicial institution and the personality of Biscay visitor. The objectives were aimed at rebuilding the organization of the Court during the 1770s to 1790. Also, identify and analyze the performance of ministers and their reaction to the Bourbon reforms, emphasizing the relationship they had with the visitor Areche. The dissertation is a qualitative and interpretive research, which is the mainstay of American and Spanish documentation files. Therefore, methods, techniques and tools have been oriented to the line marked by qualitative research. observation records were performed to identify the body of judges and their performance during the whole visit. The recording method allowed us to understand the organizational structure of the Court of Justice of Lima, the specific functions of each room: civil and judicial, as well as minor employment occupations. As the officer chosen for the visit to Peru, and contrary to what has been studied, Areche was not an upstart, but reached the viceroy with extensive experience in the government of India. Also, we supported a respectable academic record as well as their loyalty to the crown and the colonial secretary. It also came convinced that reforms were needed to improve the Peruvian government and not for "esquilmarlo" taxes. In this sense, the research provides new information about the life and personality of the former Visitor of Peru. For the purposes of this report an undocumented worker is a foreign national who is working while overstaying their visa, working without a visa or working in breach of their visa conditions. It has been estimated that there are over 30 000 undocumented workers in Australia at any one time. These workers, which are most likely to be from Indonesia, Korea, China, India, Sri Lanka, Fiji or Bangladesh, tend to be concentrated in the hospitality, construction, agriculture, manufacturing and sex industries. A summary of the key findings The insufficiency of the current measures to combat undocumented work: The measures currently in place to control undocumented work are insufficient. This insufficiency stems from the fact that punitive and compliance measures are aimed predominantly at undocumented workers rather than the individuals and businesses that acquire their services. The inadequacy of DIMIA's current compliance operations: The effectiveness of DIMIA's compliance operations are inhibited by a lack of interagency cooperation, a lack of responsiveness to community and union tip-offs and the absence of measures by which to deal with recalcitrant employers and businesses, who do not wish to voluntarily comply with immigration law. Undocumented work and macroeconomics: Undocumented work has a positive net impact on the Australian economy. Undocumented work and wages and job displacement: , The employment of undocumented workers nearly always has a favourable short-run impact on the wages and job availability of local skilled workers. This positive economic impact may extend to local unskilled or low skilled workers to the extent that they do not directly compete with undocumented workers for jobs. Accordingly, undocumented workers may displace low skilled and unskilled local workers and depress their wages, if the two groups directly compete for the same jobs. Undocumented work on economic restructuring: The presence of undocumented workers within Australia has the ability to inhibit economic and technological restructuring. Undocumented work and fair competition: In Australia some employers and businesses are gaining an unfair advantage over their competitors by using undocumented workers to pay below award rate wages and avoid payments for superannuation, redundancy, workers compensation and tax.Undocumented work and workers' human rights: In Australia undocumented workers are often the subjects of mistreatment and/or exploitation. This is particularly common in the sex industry. A summary of the key recommendations The introduction of criminal employer sanctions as part of a comprehensive administrative, policy and legislative framework to control undocumented work: It is advisable that employer sanctions be introduced into Australia in an attempt to control undocumented work. However, the introduction of employer sanctions should not be viewed as a panacea for undocumented work, but rather, as just one part of a multi-prong strategy to control undocumented work in Australia. This multi-prong strategy should be embodied in a comprehensive administrative, policy and legislative framework, which must involve all of the reforms contained herein. The reformation of DIM/A's current compliance operations: These reforms must aim to increase the responsiveness of DIMIA's compliance division to community tip-offs and referrals, prioritise the enforcement of employer sanctions (when introduced), target 'at-risk' industries and ensure that lobby and pressure groups do not compromise enforcement efforts. The extension of labour law protections to all undocumented workers: All aspects of labour, OHS and employment law protection must be extended to undocumented workers through the introduction of legislation. In this way the health and safety and human rights of undocumented workers ca~ be better protected. The reformation of DEWR's current compliance operations: These reforms must involve the more rigorous and collective enforcement of labour and OHS laws by the DEWR, unions and employer groups. This means that the shift towards an individualised system of workplace relations must be decisively reversed. These reforms may necessitate legislative changes to the current laws governing Australian workplace relations. This approach should be considered as an appropriate alternative to the granting of an amnesty, in terms of its ability to protect the rights of undocumented and documented workers. The adoption of a whole of government approach to undocumented work: This approach should aim to improve the level of interagency cooperation, datamatching, joint field operations and information sharing, between DIMIA, ATO, DEWR, AFP and Centrelink, primarily through the creation of an interagency taskforce. The introduction of a single national work identification card and work rights verification system: The development of a single, easily identifiable and counterfeit proof worker identification card and an efficient electronic or telephone work rights verification service is imperative to controlling undocumented work in Australia. This system would need to be accompanied by a legislative provision, such as an administrative fine, requiring employers and businesses to check and verify a worker's right to work and to retain the records that document this. An extension of the current EAC to educate employers and businesses: The current EAC needs to be extended in order to educate employers, businesses and those who support them, about their obligations and rights under the employer sanction scheme. This enhanced information campaign should also seek to mitigate the possibility of employer sanction related racial discrimination. A greater amount of investment into the research of undocumented work: The investment of a greater amount of human and financial resources, into researching and analysing the extent and effects of undocumented work, the location and types of networks used to facilitate undocumented work and the ongoing social and economic costs and benefits of employer sanctions in Australia is urgently required. The development of a long-term approach to addressing labour shortages: The development of a comprehensive population policy and the removal of labour market inefficiencies are vital to the long-term alleviation of labour shortages within Australia and reducing the demand for undocumented workers. Increased international co-operation on undocumented work: Increased international cooperation on the issue of undocumented work and the adoption of a global approach to combating undocumented work are required. This approach should involve the implementation of labour market, trade and aid reforms, in order to tackle the root causes of undocumented work; the ratification of any international treaties pertaining to undocumented work and migration; and the establishment of regional partnerships to address this issue. In conclusion it must be said that this administrative, policy and legislative framework will not be able to achieve its stated objectives unless each and every one of the foregoing recommendations is successfully implemented. If just one of these recommendations is overlooked the effectiveness of the approach as a whole will be negated and its ability to control undocumented work completely undermined.
This thesis shall represent the arbitration regime under the International Centre for Settlement of Investment Disputes (ICSID) in connection with protection mechanism of Bilateral Investment Treaties (BITs). It shall analyse the achievements of ICSID and BITs and their influence of foreign direct investments, investors and the host country. Finally, this thesis will try to assess the achievements in this area and discuss advantages or disadvantages for the involved parties. Individuals and corporations are interested in foreign direct investments (FDI) to exploit new markets, to realize or to sell business ideas, and to raise their market value or personal wealth. Under an economical point of view, money or investments always found its way to the most efficient places on earth which were able to be reached in any century to produce a better or the same product or service for a better price. The raising of profit margins was the driving force to explore new markets; also foreign governments tried to attract investors from all over the world to create new jobs and import new technology for their economies to raise the capacity to compete on an international level. In the early nineteenth century the prevalent form of foreign direct investment was that carried out through loans and government bonds. In contrast, modern foreign investment is more characterized by direct investment on the spot: the building of infrastructure, like railroads or telephone networks, and the establishment of joint-ventures in the car industry, to name but two examples. Investment abroad also means to play in a new and unknown playground. Investors have to place their money in a foreign environment under different laws, different rights and duties, and with unknown future protection of their investments. This makes foreign direct investments an uncertain game, and uncertainty did always keep investors from direct investments in a foreign and unknown country. Furthermore, not only the unknown environment is an investment obstacle, investors also were faced with problems with governments in the foreign market. First foreign governments promoted foreign direct investments to raise their economic power. Large infrastructure projects had an important effect on the countries where they were constructed: they were the basis for a faster growing economy. Later the same governments or new political powers changed government positions regarding foreign investment and they restricted investment related money transfers of investors out of the investment area or they initiated measures and laws to expropriate the property of investors without financial compensation. The big infrastructure investments were seen as a necessity for the welfare of the citizens and as a security of the host state. Many host countries felt that these projects should be controlled by the government and not by foreigners. The treatment of aliens by governments was, and still is, dependent on political theories and influences. A change of the investment climate, the "political risk", can be a huge uncertainty for foreign direct investments. Every investor has to ensure that the investment is lucrative and that he has the possibility to reduce risks and cost in case of changes of the investment climate. In the past foreign investors had no direct way to enforce investments claims against a foreign state for its sovereign acts or for breach of customary international law. Instead, investors had to rely upon their own government taking up the claim on their behalf and try to solve the dispute by diplomatic measures. This dependence on others was inconvenient and unpredictable, and therefore dissatisfying for alien investors. The settlement of foreign investment disputes in the past was a question of political influence and economic power. Individuals or corporations had to influence their governments to take up their case on the state's behalf. This was only possible for very important and influential investors. The investor's state then sent warships to threaten the offending state until reparations were paid. This "gunboat diplomacy" was exercised frequently by European powers until the early twentieth century, for example when faced with Venezuela's default on its sovereign debt in 1902, the governments of Great Britain, Germany and Italy sent warships to the Venezuelan coast to demand reparation for the losses incurred by their nationals. The need for security and predictability for foreign investments was one of the main reasons to establish diplomatic relations with other states. Various ideas from the point of view of money receiving and money spending states were discussed and realized, from the Calvo doctrine - where contracts between the host state and foreign investors included an agreement in which the latter agreed to confine himself to the available local remedies without relying on diplomatic interference of his own state - to the principle of diplomatic protection - where a state espouses the claim of its nationals as a claim on its own behalf. With the Second International Peace Conference of The Hague in 1907, states agreed to a framework for the conclusion of bilateral arbitration treaties which were the basis for independent arbitration tribunals in case of a dispute between two states arising out of particular interests of its national investors. The right of diplomatic protection as mentioned above was still inadequate to promote foreign investments: the Latin American countries relied upon the Calvo Doctrine, which denied the possibility of interference under diplomatic protection principle. Also, the breach of investment treaties by states was still not sanctioned by public international law. Only expropriation was recognised quite early as a possibility for diplomatic protection claims. Furthermore diplomatic protection was only accessible for nationals of the claiming state. Questions arose what happens if transnational corporations claim protection? The obstacle for investors to convince their government to claim diplomatic protection for its nationals was very high and unpredictable to foresee. Also a claim against the home state to exercise diplomatic protection does not exist. Today, in our small world, where businesses are moved from the United States to India, industrial production is transferred from Europe to China, or new infrastructure projects are started in Central Africa, one cannot imagine international business without FDI. Foreign direct investments need security, investors need security. Security is necessary to promote foreign investment which is recognized as one of the driving forces in supporting development in developing and least developed countries. Investors want to know their rights regarding their investments and they want to enforce their rights directly in a fast and cost-effective way. The need for protection is the reason for various measures introduced by governments to secure investments. In the following the system of foreign dispute settlement under the International Centre for the Settlement of Investment Disputes (ICSID) in combination with Bilateral Investment Treaties (BITs) shall be highlighted. The ICSID is the result of the investor insecurity mentioned above. ICSID shall also support FDI in the developing countries. The focus shall be on the increased interest for BITs and the therefore increased interest in ICSID arbitrations. Why do states use BITs? Did the establishment of a neutral venue for investment dispute settlement reach its goal to depoliticise disputes? Is it used by investors, and what is protected? Do BITs play an important role in the system of dispute settlement and why? And how do they work together with the ISCID system?
En materia de economía internacional todas las miradas conducen al continente asiático. Actualmente, China e India son los modelos más analizados, mientras que tiempo atrás fueron protagonistas Corea del Sur, Taiwán, Hong Kong y Singapur, los llamados tigres asiáticos. A lo largo de los años se ha dejado de lado el estudio de otros países de gran crecimiento ¿Cuál es la situación de las potencias intermedias como Malasia, Indonesia y Tailandia? En esta entrega nos dedicaremos al primero de ellos, país que logró su independencia del Reino Unido en 1959.Malasia es una monarquía parlamentaria: una democracia con carencias. Al ser el Islam la religión oficial del país, las libertades se reducen en diversas áreas donde las cortes religiosas poseen mucho poder (drogas, familia, alcohol y sexo son algunos ejemplos). El rico y burocrático gobierno musulmán creó su sede administrativa en Putrajaya. Esta ciudad jardín con arquitectura islámica, ubicada a 35 kilómetros de la capital y centro económico Kuala Lumpur (KL), nada tiene que envidiarle a Dubai y otras metrópolis del golfo pérsico.Gobernado por una coalición multi partidaria realizó un cambio de política económica en la década del ochenta, bajo el mandato de Bin Mohamad. Las reformas estructurales buscaron transformar la economía agrícola en una tecnológica basada en la informática, tomando como ejemplo los famosos tigres asiáticos. Malasia logró un crecimiento económico promedio de 8% entre 1991 y 1997, año en que sufrió la crisis financiera, al igual que todo el sudeste asiático. La base de su desarrollo fue la industria de alta tecnología, las grandes reservas de gas, petróleo y estaño, mientras que se complementó con la actividad agrícola, al ser productor de caucho, aceite de palma, cacao y arroz.Diferentes megaproyectos son consecuencia de una década de gran crecimiento económico. La inauguración de un aeropuerto ejemplar ubicado a 30 kilómetros del centro de KL y unido a la ciudad por anchas autopistas, que recorren la vegetación abundante y las tierras rojas del país, es icono de dicha época. Sin embargo, el emblema principal son las Torres Petronas construidas en 1998, que fueron en su momento el edificio más alto del mundo. La sede de la compañía nacional de petróleo y gas se puede observar desde las distintas regiones metropolitanas de la capital, cuando el smog provocado por el intenso tráfico lo permite.El despegue del país se observa en infraestructura, un sistema de transporte moderno (basado en trenes subterráneos y monorraíles), un boom arquitectónico y también en el consumo. Los "malls" malayos de no menos de seis pisos se muestran repletos y cierran a altas horas de la noche. En los barrios periféricos, los ciudadanos luego de largas jornadas laborales inundan las plazas de comidas que se montan en distintas esquinas, donde se puede observar la economía informal en su máximo esplendor. La humedad, el calor sofocante y el precio accesible de los alimentos provocó que la población malaya se acostumbrara a consumir las tres comidas principales del día fuera del hogar.Malasia ha logrado con el correr de las décadas y luego de haber sufrido diversos in sucesos, un equilibrio étnico-político entre musulmanes, chinos e hindúes. El 50% de la población es de etnia malaya - musulmana (bumiputras) y han sido favorecidos por el gobierno, a través del acceso a empleos públicos y becas de estudio. Un cuarto de la ciudadanía de origen chino domina la economía y los grandes emprendimientos, siendo parte del desarrollo del sector tecnológico industrial. Los hindúes (10%), llegados en épocas de la colonia británica principalmente para trabajar en los cultivos o en las minas, se establecieron en comunidades a lo largo y ancho del país. Económicamente débiles, reclaman los mismos beneficios que los bumiputras.Malasia posee 27 millones de habitantes, una población mayoritariamente joven en la que tan sólo un 5% supera los 65 años y con una edad media de 26 (en comparación, la de Uruguay es 33 y en Japón 44). El crecimiento económico permitió reducir la pobreza y a través de las políticas enfocadas a los sectores más sumergidos, se redujo la desigualdad medida en el Índice Gini. En la capital se pueden observar enormes complejos habitacionales donde se ha instalado la nueva clase media malaya, suprimiendo los bolsones de pobreza tan comunes en el mundo subdesarrollado. La bonanza económica y la necesidad de mano de obra han permitido la llegada de flujos extranjeros, principalmente ilegales. Filipinas, Myanmar e Indonesia, entre otros, han expulsado trabajadores hacia la península malaya. Al igual que en los países desarrollados, los inmigrantes acceden a puestos de trabajo en el área de servicios. Por otro lado, al ser un país musulmán "abierto" han llegado familias islámicas en busca de más libertades. En Malasia las mujeres tienen permitido trabajar y manejar vehículos, situación muy distinta a monarquías como Arabia Saudita. Es común ver a las mujeres con el velo islámico trabajando en empleos públicos, algo impensado en otras partes del mundo musulmán.El desafío y principal objetivo de Malasia como economía abierta es reducir su dependencia del comercio internacional. Como consecuencia de la crisis global la caída de las exportaciones ha sido estrepitosa, lo que determinó la desaceleración de la economía, disparándose la tasa de desempleo de 3 a 4.5%. Para mitigar sus efectos, el gobierno busca diversificar sus exportaciones a través de nuevos socios y mercados emergentes. La formación de la comunidad económica de la Asociación de Naciones del Sudeste Asiático (mercado de 560 millones de consumidores) y la firma de Tratados de Libre Comercio (Japón, Nueva Zelanda y Chile entre otros) es un gran punto de avance. A su vez se han establecido diversas políticas para incentivar la inversión extranjera, como la enseñanza del idioma inglés a su fuerza de trabajo o la creación de ciudades tecnológicas como Cyberjaya. Sin embargo, según el informe del Banco Mundial (Malaysia Economic Motor), "la fuga de cerebros toca el corazón y las aspiraciones de Malasia de convertirse en una nación de altos ingresos".Este país, dividido por las aguas del mar de la china meridional, apuntó a un proceso de largo plazo con el objetivo de convertirse en una nación desarrollada para 2020. En los últimos años se ha transformado en un centro bancario y financiero del mundo islámico y así se presenta ante los inversores extranjeros. Las enormes riquezas naturales se combinan con la disciplina de la comunidad china que empuja la economía. En los últimos años, debido a una buena política de inserción internacional, el comercio se convirtió en factor fundamental para su crecimiento. El desafío actual es aumentar la demanda interna para no depender de las fluctuaciones del exterior. A lo largo de la historia encontramos sistemáticamente procesos de auge y declinación que llevan a determinados estados o imperios relevantes a convertirse en actores secundarios (1). El punto de inflexión es difícil de determinar ya que la declinación no refleja un hecho sino una sucesión de acontecimientos que contribuyen al debilitamiento de la hegemonía en el concierto internacional. En la última década, muchos pensadores se han cuestionado el poder de la principal potencia, particularmente a partir del atentado terrorista del 11 de setiembre del 2001 y las posteriores crisis económicas. De esta forma, hay quienes sostienen que el ícono de la democracia liberal estaría atravesando un proceso de declinación cada vez más sobresaliente. Con esta hipótesis planteada, presentaremos algunos indicadores que podrían reflejar la hipotética situación estadounidense. Para ello, recurriremos a una comparación con China, Brasil, Reino Unido y Japón.La muestra de países ha sido elegida para reflejar cómo EE.UU. podría estar perdiendo poder en un marco donde países emergentes, como China y Brasil, estarían posicionándose, en un mundo crecientemente multipolar. A su vez, la presencia de Reino Unido es relevante debido a que fue la potencia hegemónica que EE.UU. sucedió. Finalmente, Japón ha pasado de segunda a tercera economía mundial. Podría decirse que ha sido una "víctima" del ascenso chino, economía que hoy ocupa el segundo lugar y que determinadas proyecciones ubican en el primero hacia el año 2018 (2). La creatividad siempre ha sido un elemento fundamental para el progreso económico. Es por ello que la propiedad intelectual juega un rol destacado en la escena internacional. La solicitud de patentes por residentes demuestra un fuerte compromiso con los nuevos desafíos globales, donde la competitividad y la innovación son palabras con gran resonancia. Por patentes se entiende aquel derecho exclusivo de los solicitantes por la creación de un producto o proceso innovador por un tiempo determinado.A partir de este relevante indicador, surgen distintas implicancias. Por un lado, EE.UU. continua siendo una economía esencialmente innovadora. Aquí, no puede hablarse de declinación. Mas aún, no puede siquiera pensarse en declinación relativa. Por otro lado, es cierto que determinados países emergentes, como China, están creciendo a pasos más acelerados (3). Mientras EE.UU. pasó de abarcar el 20 al 22% de las patentes solicitadas por residentes a nivel mundial en el período comprendido entre 2000 y 2006, China pasó de representar el 3% al 12%. Así, la brecha entre éstos ha disminuido notablemente. Partiendo de este criterio, podemos sostener que EE.UU. estaría dejando de ser un potencia hegemónica.Es necesario destacar que la creciente solicitud de patentes en los países emergentes ha derivado en una importante caída porcentual japonesa. Hace ya décadas (desde finales de los 70´s) que Japón es considerado un país industrializado con tecnología de punta. Esta caída porcentual no significa que lo haya dejado de ser, sino que hay otros Estados que también están apuntando a los avances innovadores por lo que el peso japonés cae en el total. Aún así, Japón continua reflejando un gran dinamismo innovador en sectores tecnológicos de punta como la telefonía celular. Siguiendo dentro de la misma lógica de ciencia y tecnología, otro indicador relevante es el gasto en Investigación & Desarrollo medido en % del PIB. Por éste nos referimos a aquellos "… gastos corrientes y de capital (público o privado) en trabajo creativo realizado sistemáticamente para incrementar los conocimientos…" (4)Aquí se repite la situación anterior. Si bien los países desarrollados son quienes destinan más de su PBI para Investigación y Desarrollo, el crecimiento a lo largo de los años no ha sido abrupto (a excepción de Japón), sino más bien moderado. Sin embargo, en otros países como China y Brasil se han experimentado importantes variaciones. Esto refleja una decisión económica que posee un respaldo político. Los entes estatales (como las universidades) reciben creciente cantidad de subsidios para desarrollar tecnologías de punta en áreas sensibles como la biotecnología o la tecnología misilística y espacial.Para finalizar, es pertinente analizar la Inversión Extranjera Directa (IED) en % del PIB dentro del marco de las finanzas. Este indicador refleja lo atractivo que puede ser un país para captar capitales extranjeros, donde el inversor estudia el mercado objetivo tomando en cuenta distintos aspectos: económicos, políticos, sociales y tecnológicos.Este indicador manifiesta una realidad distinta a las vistas anteriormente. EE.UU. ha sido el Estado con mayor crecimiento de IED en base al PBI, dentro del grupo de países seleccionados. Esto se debe a que, a pesar (5) que su poder a nivel global se está debilitando en contraposición al ascenso de los países emergentes, los inversores continúan apostando al mercado norteamericano por la seriedad y estabilidad que ha brindado a lo largo de la historia. EE.UU. continúa siendo una economía dinámica con la capacidad intacta para innovar. La calidad de la educación universitaria es un buen ejemplo. Los indicadores utilizados en este trabajo tienen una directa relación con la calidad de los sistemas educativos de cada uno de los países involucrados en la muestra. Según los distintos rankings, las mejores universidades del mundo permanecen en EE.UU. Por su parte, también es cierto que comienzan a aparecer universidades de los países emergentes. Podemos pensar que EE.UU. no está en un proceso de declive como tal. En cambio, asistimos a un período donde los países emergentes están creciendo a pasos más acelerados que el resto del mundo, haciendo que los Estados hegemónicos se vean obligados a convivir con otros centros de poder. Los actores principales del comercio ya no son sólo EE.UU, Japón y la Unión Europea, sino que ahora entraron en juego países como China, India, Corea del Sur, Brasil y Rusia que también tienen poder de decisión en el ámbito internacional. El régimen de Corea del Norte, si no estuviese armado hasta los dientes, si no insistiese en desarrollar militarmente el arma nuclear y si no contase con la connivencia de la China, sería una caricatura. Políticamente es una satrapía hereditaria, económicamente es incapaz de alimentar, vestir y alojar a su población e ideológica y culturalmente cohabita, entre las telas de araña del archivo de la Guerra Fría, con un puñado de totalitarismos que vegetan en las orillas de la historia. Su posición no es cómoda en el concierto internacional y, menos aún, en el regional. Su enemigo de antaño, Corea del Sur, en los últimos 60 años se ha transformado en la 13ava. economía del mundo con un producto per cápita que ya superaba los U$ 25.000 hacia el año 2007.En este contexto la dinastía de los Kim insiste en intentar convencer a su sufrida población de la superioridad del régimen comunista. Aunque la opacidad de las cifras es casi total, hay indicios para creer que, en realidad, los norcoreanos se alimentan con mucha dificultad (1/4 de ellos declararía que algún familiar ha muerto de hambre en los últimos años) y cuando lo hacen es gracias a la ayuda alimentaria china y sudcoreana.Por qué razones, el 23 de noviembre, el ejército de Corea del Norte procedió a atacar la isla sudcoreana de Yeonpyeong, es algo de difícil interpretación. Es cierto que los norcoreanos vienen mostrándose incrementalmente agresivos desde 2007 cuando probaron su primer misil de largo alcance, luego procedieron a una explosión nuclear subterránea, a inicios de 2010 hundieron un barco sudcoreano y, ahora, proceden a este bombardeo que, al desatar la respuesta del régimen del sur, pareció por unas horas un "remake" del escenario de los años 1950.Una cosa es segura. La comunidad internacional reaccionó casi unánimemente y con vehemencia a un ataque que es de los más graves desde que la guerra se "congeló" en 1953. Los EE.UU., Gran Bretaña, Japón, Rusia, Alemania, España, Canadá, Brasil, etc., así como las Naciones Unidas condenaron, con energías diversas, el ataque norcoreano. Pero, quien se limitó a mostrar preocupación y a instar a las partes a "la mesura" fue China, es decir, una forma ni siquiera elegante de endosar la agresión de su satélite.Los analistas han esgrimido varias hipótesis para explicar este incidente y, todas ellas, parten de un mismo supuesto: que la reciente agresión tiene su explicación en la situación interna de Corea del Norte. Una de estas hipótesis tiene que ver con la creciente carencia de alimentos ya que, ante la escalada de agresividad norcoreana los vecinos del sur han disminuido los aportes humanitarios. Otra interpretación se vincula al inminente cambio de "líder" que ya se ha anunciado en el país. Estando Kim Jong II debilitado en su salud, hace algún tiempo decidió ungir a uno de sus hijos, Kim Jong-Un, como su heredero y la asunción de este nuevo "líder" requeriría de una "demostración de fuerza". Esta tesis tiene a su favor el hecho de que, el 12 de noviembre pasado, el régimen norcoreano prácticamente "invitó" a un especialista nuclear norteamericano a visitar su nueva (y hasta ese momento secreta) planta de enriquecimiento de uranio en un notorio acto de desafío a los EE.UU. y a la comunidad internacional. En otros términos: una fanfarroneada más destinada a decirle al mundo "sepan que, aunque cambiamos de "líder", no tenemos arroz, pero sí bastante uranio enriquecido". Hay, por otra parte, también una tercera hipótesis que intenta vincular el incidente con la inminencia de maniobras aeronavales conjuntas (en los hechos en el momento de publicarse este editorial ya se habrán llevado a cabo) entre Corea del Sur y los EE.UU. El nexo es imaginable pero dichas maniobras estaban previstas y anunciadas de larga data y si algún nuevo elemento hubiesen de incorporar, ello estaría seguramente vinculado al reciente ataque norcoreano.Han pasado 6 días desde que se llevó a cabo el bombardeo iniciado por Corea del Norte y hasta ahora, los dos bloques en disputa juegan a "subir" la apuesta lo que, dentro de ciertos límites, forma parte del juego. Pero también es cierto que el tiempo ha pasado y el conflicto tiende a "instalarse" en este nuevo escalón de agresividad.Pero quizás, para intentar comprender mejor el "nuevo" conflicto, exista un segundo enfoque que conviene traer a colación porque supone una aproximación más "macro" del incidente que es, al mismo tiempo, una interpretación más "actual" de lo que está sucediendo. Aunque tiene el inconveniente de marginar casi totalmente el papel del régimen norcoreano del desarrollo de los acontecimientos, posee al mismo tiempo la capacidad de explicar la clara negativa china a proceder a la condena de su aliado. En otras palabras, este segundo enfoque parte de la base que el problema que detona el incidente no es Corea del Norte sino que, en realidad, el verdadero problema es la China.En las últimas semanas, y aunque la opinión pública no haya reparado demasiado en ello, la administración Obama procedió a dar dos pasos estratégicos de importancia en el sentido de una potencial redefinición significativa del escenario político internacional. Y estos dos pasos hubieron de desencadenar, con toda seguridad, un enorme malestar en la China.En efecto, en la reciente reunión de Lisboa donde se comenzó a discutir sobre el reperfilamiento de la OTAN, finalmente parece haberse avanzado en el viejo problema de encontrar algún modelo de "asociación" de Rusia a lo que algún día será la nueva organización del Atlántico Norte. Los lectores recordarán que este tema lleva casi 2 décadas (en realidad desde la caída del Muro de Berlín) sin avance alguno. De confirmarse este tema, el cambio en la configuración de fuerzas entre EE.UU, Europa y Asia sería muy significativo.Y ello no es todo: al mismo tiempo conviene recordar que, a inicio de este mes, el presidente Obama declaró (en un seguramente muy meditado arranque de "sinceridad") que "deseaba" ver a la India, con su veto en mano, sentada en el Consejo de Seguridad de la ONU.En resumidas cuentas, los EE.UU., además de sus reiterados y conocidos reproches a la China en los temas comerciales y monetarios, están desplegando una muy amplia estrategia de "contención" de la creciente influencia de la China en el mundo y todo indica que esta última ya ha registrado la importancia de los movimientos diplomáticos norteamericanos. Utilizar a Corea del Norte para recordarle a Obama que consultar la opinión de la dictadura china (en temas fundamentales como los arriba citados y que, además, involucran a dos de sus grandes y tradicionales contendientes históricos en Asia) es fundamental, no deja de ser una hipótesis a considerar muy seriamente.
One of the main goals of most governments and international agencies is to improve education, but this task has proven to be elusive. Evidence shows that just increasing resources is not enough to improve outcomes. Therefore, institutional reforms have been proposed to improve the delivery and financing of education. School Based Management (SBM) is one such institutional reform where decision making is transferred to the school level. Funds are transferred directly to the school and parents, along with teachers and the principal, allocate and oversee the use of program funds. By increasing parental and community involvement in schools, SBM is expected to improve education because it is expected to increase accountability and monitoring of school personnel, align incentives and match resource allocation to school needs. Additionally, SBM seeks to increase school autonomy and implement assessments and evaluations. With these ideas in mind, the Mexican Education Ministry has implemented SBM programs in over 30% of elementary public schools in the country.Even though SBM programs are popular, evidence on the effects of such programs in the country show mixed results. Moreover, there has been no attempt in the literature to explore the underlying mechanisms at work. This dissertation is an effort to learn from the Mexican experience with two SBM programs: The largest SBM program in Mexico and a randomly allocated program in the state of Veracruz. The Quality Schools Program ( Programa Escuelas de Calidad , PEC) was first implemented in 2001 and provides an opportunity to learn how SBM has evolved with time. The Veracruz experiment provides short run information on participation by parents on school related activities which is not available for PEC and overcomes the potential self selection problem that has plagued SBM evaluations so far. The mechanisms I explore are five. First, I analyze how the programs change the cash transfers that parents voluntarily make to the school. If parents substitute voluntary contributions with program funds then the program causes crowding out. In this case there would be no change in resources available to the school and therefore no effect from improved conditions on the quality of education. Second, I analyze whether the matching scheme of PEC creates incentives for parents to increase voluntary contributions and if so, whether the incentive is different for rich and poor schools. Third, I analyze how the program caused parents to change their time investment. Parents may use program funds to either complement or substitute their participation on school related activities. Fourth, I make use of improved data availability to make a more accurate assessment of the effects of the programs on the quality of education as measured by standardized test scores and failure rates. Finally, I analyze if the effects of PEC change over time. Evidence in the United States shows that it may take five to eight years to see improvements in education because school constituents need to learn and adjust to the new institutional framework. On average, Mexican elementary schools have fewer resources than those in the United States and therefore they may face higher returns. As a result, the program may have an effect in the short run. This dissertation is organized as follows: Chapter I is an analysis of the effects of PEC on voluntary contributions, standardized test scores, failure rates and dropout rates over time, chapter II is a study on the effects of PEC on voluntary contributions as a function of school income and chapter III analyzes the effect of the randomized Veracruz experiment on voluntary contributions, parent participation, standardized test scores and failure rates. Voluntary contributions are cash transfers that parents choose to make to the school to cover salient needs. The contribution amount is set at the beginning of the school year by the parent's association and once it is set, all parents are expected to pay it. Payment is socially enforced. I find no evidence of any of the two programs causing crowding out. Moreover, I find that the matching scheme of PEC creates an incentive for parents in the poorest schools to increase voluntary contributions more. Therefore matching works as a targeting device because more government resources go to the schools with greater needs. More specifically, schools located in localities with medium, high and very high marginality increase voluntary contributions by $0.22.- while those in low or very low marginality areas increase them in $0.11.-. Both increases are small compared to a typical voluntary contribution of $10.72.- and therefore there is no increase in dropout rates as a result of larger voluntary contributions. On the opposite, PEC decreases the probability of a student moving to a different school in urban areas. Therefore parents may be more satisfied with school services. There is no effect on voluntary contributions on the Veracruz experiment which lacks the matching scheme in PEC. In this program, funds and institutional improvements in the school act as a way to balance parent participation. I find that parents that spent less than 5 hours per month in school related activities increase participation while those that spent more than 7 decrease it. I find no effects of either of the two programs in the short run on the quality of education as measured by standardized test scores and failure rates. For the Veracruz experiment where data is available, it is observed that most program funds were invested on infrastructure improvements and therefore it is not surprising not to find effects in the short run. Consistent with findings in the US, the effects of PEC are larger as the school gains experience. Moreover, initial adjustments have a slight negative effect. For example, the average math test score decreases in one point the first year but increases 4 points in the fourth year. The average math test score is 487 points on a scale that ranges from 200 to 800, therefore changes are small but increasing. Future research is needed to better understand the effects of SBM. More detailed data on how parents and other school constituents react to the program is needed. It is important to explore the processes that the program put at work to understand why the effects change with time. More importantly, it is relevant to analyze the changes that bring improvements on the quality of education. More detailed data and more experiments with careful variation in intervention components could shed light on the underlying mechanisms at work. This is relevant given the large investment the country is making on these kinds of programs. If we learn from the experience, future programs can be adjusted and improved to further improve the quality of education in the country more efficiently. This knowledge could not only benefit Mexico but other countries such as Argentina, Bangladesh, Guatemala, Honduras, India and Sri Lanka which are implementing and operating similar programs.

El atentado terrorista es el más importante desde el mes de junio, cuando las fuerzas norteamericanas comenzaron a delegar parte de la seguridad en las tropas iraquíes. La prensa internacional interpreta el atentado como un nuevo desafío a los invasores norteamericanos y, por la fecha, como una forma de "recordar" el atentado que, 6 años atrás, arrasara a la misión de las Naciones Unidas en esa misma capital.En días inmediatamente previos al evento de ayer, y en clara referencia a las elecciones a realizarse en Afganistán, los talibanes afganos realizaron una serie de ataques terroristas que causaron decenas de muertes en Kabul y otros centros poblados, a los efectos de amedrentar a la población e impedir que ésta concurra a votar. Dada la cercanía del acto electoral es altamente factible que este artículo no llegue a reseñar los últimos atentados que, muy probablemente, habrán de tener lugar en las próximas horas en ese país.El 14 de agosto, milicianos del grupo Hamas -(hasta ese día, conjuntamente con Hizbollah, la fracción más radical y fundamentalista que se opone a la no tan moderada Autoridad Palestina, heredera de Al Fatah)- hubieron de invadir por la fuerza, en la Franja de Gaza, una mezquita que había sido tomada por el grupo de los "Guerreros de Dios" causado la muerte de 6 personas e hiriendo a más de una docena. Éstos serían seguidores de Abdel Latif Moussa, lugarteniente, a su vez, de Abu Noor al-Maqdisi. El grupo y estos personajes no son demasiado conocidos, al menos en estas latitudes, pero lo poco que se sabe es que su "programa" se opone al de Hamas por entender que este último grupo es demasiado "liberal" y que es necesario hacer reinar la "ley de Dios" en el territorio de Gaza.Quien se apresurase a interpretar que esta sucesión de acontecimientos estrictamente demenciales pertenecen exclusivamente a acciones llevadas a cabo por grupos radicales islámicos, se equivocaría de manera rotunda.Si seguimos solamente las recientes hazañas del grupo ETA, encontraremos que realizó tres atentados el día 10 de agosto en Palma de Mallorca, precedidos de atentados el 8 de agosto, el 30 de julio y el 19 de junio, respectivamente, para no remontarnos más lejos en el tiempo. Es pertinente señalar que ETA, es algo menos indiscriminada: trata de matar solamente policías y militares. Las bajas civiles que causa son daños colaterales.ETA no tiene nada que ver con el Islam, no opera en un país privado de libertades, ni en una sociedad pobre: todo lo contrario. Opera en uno de los países más ricos del mundo, poseedor de una sociedad altamente liberal y políticamente dirigida por un gobierno socialista. Es más: España es un país que ha desarrollado una sorprendente institucionalidad, especialmente orientada a contemplar a las distintas autonomías que históricamente conformaron su unidad nacional.En este breve resumen, hemos dejado de lado, conscientemente, la reseña de atentados realizados, en los últimos dos meses, en México, Pakistán, la India, Sudán y todo el continente africano, así como en extremo Oriente o en Norte o Latinoamérica. Aunque menos publicitados, seguramente guardan proporción con los que agitan al mundo islámico ya que por lo menos sabemos que, en México, hay anualmente un número de muertes igual o superior a las que se constatan en Irak En realidad, en la actualidad internacional de hoy resulta prácticamente imposible reseñar con exactitud el número de atentados, más o menos indiscriminados, que se llevan a cabo diariamente en el mundo "en defensa" de algún elementoidentitario. Y cuando decimos "identitario", es necesario entender el término, tanto en su sentido fuerte o tradicional (referido a identidades religiosas, étnicas, lingüísticas, nacionales, ideológicas, tribales, etc.) como en un nuevo sentido que refiere a "identidades" de nuevo tipo como aquellas que generan las "maras", las "familias mafiosas" de narcos, las sectas de todo tipo, la "narco-guerrilla", etc.La frase de Amin Maalouf, con la que iniciamos este editorial, corre el riesgo de no ser totalmente exacta para reflejar el mundo de hoy. Habría que modificarla y, trayéndola al presente, iniciarla diciendo: "Particularmente en nuestra época, se encuentra gente….". Lo que parece haberse extendido de manera incontrolable es el proceso de reducción de los infinitos rasgos de pertenencia, que contiene y comporta toda la necesaria complejidad de las identidades individuales o grupales, a un solo rasgo, a una sola pertenencia predominante y exclusiva. Esa reducción de la identidad a un solo rasgo de pertenencia es la forma misma de "la deshumanización".Así, el joven afgano recién salido de la "madrasa" coránica dispuesto a sacrificar su vida en un atentado, es capaz de hacerlo, porque ha perdido sus rasgos de afgano, de hijo, de hermano, de amigo, y de hombre: él es "El Islam" y nada más. El campesino colombiano reclutado, quizás a la fuerza, por las FARC hace 30 años, que está dejando su vida en secuestros de personas inocentes, es capaz de hacerlo porque ya no es ni colombiano, ni campesino, ni esposo, ni hombre: él es "El Combatiente" y nada más. El migrante salvadoreño incorporado en su "mara"tampoco es más salvadoreño, hijo, esposo y padre de familia, trabajador carpintero u hombre: el es "La Mara" y nada más y, en su nombre, cometerá todos los crímenes y dejará su vida sin dudarlo. No creamos que los ejemplos pertenecen sólo a países lejanos. Hasta el hincha de fútbol que, en una refriega momentánea, es capaz de asesinar a un partidario de otro equipo, funciona como asesino sólo porque, siquiera momentáneamente, logra despojarse de todos sus rasgos humanos de pertenencia y transformarse, por un instante, en "El Hincha" y nada más.Los ejemplos pueden ser más o menos felices, pero son infinitos. Como procesos aislados, individuales, o parcialmente grupales y relativamente momentáneos, siempre han existido. También procesos similares hubieron de verse, a gran escala, a la sombra de los grandes totalitarismos del siglo XX.Pero las sociedades contemporáneas parecen comenzar a marcar una diferencia. La diferencia radica en que, en determinadas circunstancias políticas, sociales y culturales que tienden a hacerse cada vez más extendidas, estos procesos de esquematización de la identidad que conlleva el establecimiento de identidades unilaterales y la consecuente "deshumanización" de los individuos aparecen como cada vez más sistemáticos, generalizados, promovidos y voluntariamente organizados en las más diversas regiones del planeta. Una urgente reflexión sobre la cuestión de la violencia en las sociedades contemporáneas no puede ignorar esta dimensión de la cuestión.
This study seeks to address a gap in the study of nonviolent action. The gap relates to the question of how nonviolence is performed, as opposed to the meaning or impact of nonviolent politics. The dissertation approaches the history of nonviolent protest in South Asia through the lens of performance studies. Such a shift allows for concepts such as performativity and theatricality to be tested in terms of their applicability and relevance to contemporary political and philosophical questions. It also allows for a different perspective on the historiography of nonviolent protest. Using concepts, modes of analysis and tropes of thinking from the emerging field of performance studies, the dissertation analyses two different cases of nonviolent protest, asking how politics is performatively constituted. The first two sections of this study set out the parameters of the key terms of the dissertation: nonviolence and performativity, by tracing their genealogies and legacies as terms. These histories are then located as an intersection in the founding of the nonviolent. The case studies at the analytical core of the dissertation are: fasting as a method in Gandhi's political arsenal, and the army of nonviolent soldiers in the North-West Frontier Province, known as the Khudai Khidmatgar. The study begins with an overview of current theorisations of nonviolence. The approach to the subject is through an investigation of commonly held misconceptions about nonviolent action, such as its supposed passivity, the absence of violence, its ineffectiveness and its spiritual basis. This section addresses the lacunae within existing theories of nonviolence and points to possible fertile spaces for further exploration. Section 3 offers an overview of the different shades of the concept of performativity, asking how it is used in various contexts and how these different nuances can be viewed in relation to each other. The dissertation explores how a theory of performativity may be correlated to the theorisation of nonviolence. The correlations are established in four boundary areas: action/inaction, violence/absence of violence, the actor/opponent and the body/spirit. These boundary areas allow for a theorising of nonviolent action as a performative process. The first case study is Gandhi's use of the fast as a method of nonviolent protest. Using a close reading of his own writings, speeches and letters, as well as a reading of responses to his fast in British newspapers and within India, the dissertation asks what made fasting into Gandhi's most favoured mode of protest and political action. The study reconstructs his unique praxis of the fast from a performative perspective, demonstrating how display and ostentation are vital to the political economy of the fast. It also unveils the cultural context and historical reservoir of body practices, which Gandhi drew from and adapted into 'weapons' of political action. The relationship of Gandhian nonviolence to the body forms a crucial part of the analysis. The second case study is the nonviolent army of the Pashtuns, Khudai Khidmatgar (KK), literally Servants of God. This anti-imperialist movement in the North-West Frontier Province of what is today the border between Pakistan and Afghanistan existed between 1929 and 1948. The movement adopted the organisational form of an army. It conducted protest activities against colonial rule, as well as social reform activities for the Pashtuns. This group was connected to the Congress party of Gandhi, but the dissertation argues that their conceptualisation and praxis of nonviolence emerged from a very different tradition and worldview. Following a brief introduction to the socio-political background of this Pashtun movement, the dissertation explores the activities that this nonviolent army engaged in, looking at their unique understanding of the militancy of an unarmed force, and their mode of combat and confrontation. Of particular interest to the analysis is the way the KK re-combined and mixed what appear to be contradictory ideologies and acts. In doing so, they reframed cultural and historical stereotypes of the Pashtuns as a martial race, juxtaposing the institutional form of the army with a nonviolent praxis based on Islamic principles and social reform. The example of the Khudai Khidmatgar is used to explore the idea that nonviolence is not the opposite of violent conflict, but in fact a dialectical engagement and response to violence. Section 5, in conclusion, returns to the boundary areas of nonviolence: action, violence, the opponent and the body, and re-visits these areas on a comparative note, bringing together elements from Gandhi's fasts and the practices of the KK. The similarities and differences in the two examples are assessed and contextualised in relation to the guiding question of this study, namely the question of the performativity of nonviolent action. ; Die Dissertation widmet sich einer bislang wenig untersuchten Frage in der Forschung zur gewaltfreien Aktion, nämlich der Performativität des gewaltfreien Protests, im Gegensatz zur viel untersuchten Frage der Wirksamkeit von gewaltfreien politischen Ansätzen. Woraus besteht ein gewaltfreier Akt, wenn man ihn als Handlungsfeld und nicht im gängigen Sinne eines Zustands der Abwesenheit von Gewaltanwendung sieht? Was können theaterwissenschaftliche Theorien zum Verständnis gewaltfreien Handelns beitragen? Die Studie hinterfragt die Geschichtsschreibung des gewaltfreien Protestes in Südasien durch die Einbeziehung von theaterwissenschaftlichen Begriffen, Analysemethoden und Denkfiguren. Die ersten zwei Abschnitte der Studie erläutern die begrifflichen und interdisziplinären Parametern der Dissertation, und zwar einerseits die Gewaltfreiheit und andererseits die Performativität. Die Genealogien der beiden Begriffe werden kritisch beleuchtet und durch wiederkehrende Bezugsfelder in Verbindung zueinander gesetzt. Zwei Fallbeispiele ermöglichen eine tiefergehende Untersuchung von der Performativität der Gewaltfreiheit: erstens das Fasten als Protestwaffe in Gandhis politischem Arsenal und zweitens die Khudai Khidmatgar, die Armee der gewaltfreien Soldaten in der Nordwestfrontierprovinz von heutigem Pakistan. Die Dissertation beginnt mit einem typologischen Überblick von Theorien der Gewaltfreiheit. Die Theorien werden zusammengefasst im Hinblick auf häufig vorkommende Missverständnisse über Gewaltfreiheit, wie beispielsweise die Opposition zwischen passivem und aktivem Handeln, die Infragestellung der tatsächlichen Abwesenheit von Gewalt oder die mangelnde Wirksamkeit des politischen Ansatzes. Dieser Abschnitt zeigt die Lücken in existierenden Theorien der Gewaltfreiheit auf und weist auf potentielle Erörterungs- und Forschungsmöglichkeiten darin. Kapitel 3 bietet einen Überblick über die verschiedenen Begriffsabschattungen des Begriffs der Performativität, und stellt die unterschiedlichen Anwendungsfelder kritisch in Bezug zueinander. Die Dissertation fragt nach dem Potential des Begriffs der Performativität in einer Theoriebildung zur Gewaltfreiheit und schlägt dann vier Grenzfelder vor: Handeln/ Handlungsunfähigkeit, Gewalt/ Abwesenheit von Gewalt, der Akteur/ der Gegner und Körper/ Geist. Diese Grenzfelder ermöglichen eine theoretische Annäherung von Gewaltfreiheit als einen performativen Prozess. Das erste Fallbeispiel der Dissertation ist Mohandas Gandhis Gebrauch des Fastens als Methode des gewaltfreien Protestes. Mithilfe einer Lektüre seiner eigenen Äußerungen zum Thema, seiner Reden und Briefe sowie durch eine Diskursanalyse der Reaktionen zu Gandhis Fasten in der britischen Presse untersucht die Studie wie das Fasten zu einem der erfolgreichsten Methoden in Gandhis politischer Kommunikation wurde. Der Abschnitt erläutert den kulturellen Kontext und die historischen Bezugsquellen, aus denen Gandhi seine Methoden geschöpft und neu interpretiert hat. In der kritischen Analyse liegt der Schwerpunkt auf Gandhis performative Körperkonzeption. Das zweite Fallbeispiel ist die gewaltfreie Armee der Paschtunen, Khudai Khidmatgar (KK), wörtlich die Diener Gottes. Diese anti-imperialistische Bewegung in der Nordwestfrontierprovinz des heutigen Pakistans existierte zwischen 1929 und 1948. Die antimilitaristische Bewegung adoptierte die Organisationsform einer Armee. Ihre Aktivitäten variierten zwischen Protestaktionen gegen die britische Herrschaft und Sozialreformaktionen innerhalb der eigenen Bevölkerung. Die KK war formal mit der indischen Kongress-Partei verbunden, in ihrer Praxis und in der Konzeptualisierung von Gewaltfreiheit war sie jedoch von einer ganz anderen Tradition inspiriert als Gandhi, nämlich vom Islam und von der Paschtunkultur. Die Studie erforscht die Aktivitäten der gewaltfreien Armee durch eine Neulektüre des existierenden historiographischen Materials, besonders im Hinblick auf ihr Verständnis von gewaltfreier Aktion und Konfrontation. Von besonderem Interesse ist die Art, wie scheinbar gegensätzliche Ideologien und Haltungen in der KK performativ miteinander kombiniert wurden. Das Beispiel der KK dient zu einer dialektischen, sich aus Gegensätzen hervorhebenden Beschäftigung mit dem Begriff der Gewaltfreiheit. Das letzte Kapitel der Dissertation bietet eine vergleichende Interpretation von Gandhis Fasten und die Aktionen der KK. Die Unterschiede und die Gemeinsamkeiten werden in Bezug auf die Grundfrage der Dissertation erläutert, nämlich die der Performativität der Gewaltfreiheit.
En estos últimos días, el escenario internacional se hizo eco del cruentísimo combate que tomó lugar en Sri Lanka entre el movimiento guerrillero separatista conocido como "Los Tigres Tamiles" y el gobierno esrilanqués. La batalla librada entre estos dos combatientes, calificada por la ONU como "catastrófica", dejó como saldo escandalosas cifras: más de 170.000 personas hacinadas en condiciones materiales y espirituales paupérrimas, más de 50.000 desplazadas de la zona de batalla –al norte del país-, 20.000 atrapadas como rehenes y por si eso fuera poco ya se cuentan miles de muertos civiles.Si bien la situación ha llegado a su punto más álgido en las pasadas horas, cabe destacar que el conflicto no es nuevo sino que cuenta con una larga historia que se inicia propiamente con la creación del movimiento subversivo LITTE (Tigres para la liberación de la Patria Tamil) en 1976. Con el objetivo manifiesto de crear un estado independiente en el distrito de Mullaitivu, al noreste de Sri Lanka –lugar en donde es predominante la etnia tamil-, esta organización militar se ha enfrascado en una lucha armada, desde su creación hasta la actualidad, para alcanzar dicho propósito. Lejos de ser improvisado, este movimiento secesionista ha consagrado su profesionalidad. Los insurgentes están equipados con armas que no sólo tienen alto poder destructor, entre las que se encuentran granadas y hasta lanzamisiles, sino que también son de avanzada, y que fueron posibles de conseguir gracias a los varios tentáculos que la organización tiene extendidos por diversos países. Además, cuenta con más de 10.000 personas (entre ellas niños y niñas) que están bajo sus órdenes, y que se caracterizan por su disciplina y por su buen entrenamiento. Sin embargo, el grupo resulta ser radicalmente más letal cuando vemos que propugna y aplaude los ataques suicidas; cualidades todas que determinaron su infeliz fama a nivel mundial y que le valieron el status internacional de "organización terrorista" y su inmediata y subsiguiente proscripción en aproximadamente 32 países del mundo. La guerrilla que se ha venido desarrollado en Sri Lanka –también conocida como lalágrima de la India- puede perfectamente catalogarse como una de las de mayor envergadura de toda el Asia. Desde que se inició le ha costado la vida a aproximadamente 70.000 personas, y ha desafiado seriamente a las fuerzas armadas esrilanqués, poniendo en jaque a todo el país durante largos períodos, en reiteradas ocasiones. A pesar de que ha habido cuatro intentos efectivos de acercamiento entre ambas partes -en muchas ocasiones Noruega actuó como mediadora- ninguna de las negociaciones prosperó y los conflictos armados, como consecuencia, continuaron sin vacilación. Sin embargo, no sería sino hasta el 2006 cuando la situación tomaría un giro diametral: luego de que la organización de los Tigres Tamiles montara una especie de "mini-estado" en el noreste del país, la armada esrilanquesa reforzó su ofensiva hasta reducir al enemigo a una ínfima porción de territorio de tan sólo 20 kilómetros cuadrados. Éste, a su vez, sería declarado por el armada esrilanquesa como una "zona segura" para los civiles. Aquel suceso tuvo consecuencias importantísimas para el posterior desenvolvimiento de los hechos. Por un lado, supuso una significativa anotación militar para el gobierno de la isla. Por otro, y desde una lectura más psicológica, podemos decir que inflamó el espíritu de la administración esrilanquesa que, desde aquel entonces, y junto con el concierto internacional, han sentido que la organización terrorista tiene los días contados. Tal es así que las peticiones de rendición realizadas a LITE por gran parte de la comunidad internacional –integrada por los Estados Unidos, la Unión Europea y Japón- se han incrementado considerablemente en los últimos meses.Lejos de querer mantener el status quo, la milicia esrilanquesa ha decidido lanzarse de lleno a dar el golpe final. Con ese objetivo, el Ministro de Defensa anunció, dos semanas atrás, el inminente avance de las tropas militares a la denominada "zona segura" que, con una ofensiva sanguinaria, dieron comienzo al actual enfrentamiento, que lleva a cientos de miles de civiles como rehenes. El lunes pasado, y luego de que el ejército atacara y destruyera una de las últimas fortificaciones de los tamiles, 50.000 personas felizmente pudieron escapar de la zona de guerrilla. Sin embargo, y pese a que fueron salvadas de los insistentes bombardeos, su situación presente es calamitosa, ya que el gobierno esrilanqués ha negado sistemáticamente el acceso de ayuda humanitaria de la ONU a dicha zona. Esa decisión responde sencillamente a que si se permitiese la entrada de ayuda exterior debería haber primero una declaración temporal de cese del fuego, algo que el Ministerio de Defensa de la isla asiática entiende sería inoportuno ya que le permitiría al grupo rebelde ganar un tiempo vital para reorganizarse y volver a combatir, en un momento en donde están a punto de ser derrotados completamente a manos del gobierno. Pero no sólo la ayuda humanitaria tiene el trabajo difícil, sino que también la propia prensa internacional se ve imposibilitada de acceder al lugar de los hechos, lo que complica más aún la situación ya que las fuertes acusaciones cruzadas que se adjudican los combatientes no pueden ser verificadas, de manera independiente, por la prensa extranjera.En esta situación de máxima tensión y de intranquilidad internacional, la ONU envió al responsable de Asuntos Humanitarios, John Holmes, al que se le sumaron los Ministros de Exteriores de Francia, Suecia y Reino Unido, a fin de que manifestase la preocupación mundial por los hechos sucedidos allí y con la intensión de presionar al gobierno para hacer una breve pausa en los combates para atender adecuadamente a todos los civiles afectados. Pero, en realidad, la situación no parece haber variado mucho ya que si bien el gobierno anunció, esta semana, que dejaría de usar armamento pesado para reducir al mínimo las bajas civiles, éste igualmente reanudó, este martes, los bombardeos con dos aviones que arrasaron con la zona estipulada, para lograr apoderarse de dos de los últimos bastiones de los Tigres de Liberación Tamil. Pese a que la guerrilla no parece tener fin, la situación presente hace pensar que un punto final está por escribirse, dada la patente debilidad que ha demostrado, en las postrimeras horas, el movimiento tamil. Acompañando el progresivo declive de esta organización terrorista, uno de sus principales portavoces, Velayudam Dayanidi, se rindió, entregándose a las fuerzas militares durante la semana pasada. Sólo resta esperar que este lamentable escenario se subsane prontamente, y que estos sucesos queden asentados en la historia esrilanquesa como los que consignan los últimos y vencidos coletazos de una organización condenada a desaparecer. * Estudiante de la Licenciatura en Estudios Internacionales. The book has described the dynamics of disease occurrence in populations and gives an overview of the major known health determinants of mortality decline, health risk factors and health services, and studies the health interventions options in two example diseases i.e. diabetes and stroke. We postulated that a lifetime multi-state modelling approach can be useful to describe disease processes and health care costs in populations and outlined the approach in the second chapter. After describing various case studies in the five application sections, a number of conclusions can be drawn. The multi-state models allow for analysing dynamic disease processes throughout a lifetime in relation to the actual stage of the health transition in a country. The dynamic components are threefold: 1) the substitution, clustering and synergism of health determinants and diseases, 2) the effectiveness and efficiency of health services, and 3) the effect of ageing of populations in quantitative and qualitative terms as both early and late survival improves. At all stages, there is a trade-off with other diseases when a first disease is treated. The model approach quantifies these effects and allows for an analysis in time. Chapter 4 shows that substitution and competition of multiple health risks, at all ages, may partly explain the lack of results of the introduction of health programmes as in international co-operation in health. The same chapter shows that multiple, also low cost, roads to population health exist by elimination of health risks and by improvement of disease survival. Computation of optimal pathways is possible. The chapters on stroke and diabetes show the relationship of health intervention mixes options, available resources, health benefits, and optimisation options. The stroke analysis shows that, in case of high available budgets, costly clinical interventions for all patients can be more cost-effective than low cost clinical interventions for small groups of high-risk patients. The diabetes chapter shows that, in case of low available budgets, low cost clinical interventions for small groups of high-risk patients can be more cost-effective than prevention. The general conclusion is that multi-state models allow for computation of multiple, optimum paths to health throughout a lifetime, depending on the societal resources available. Health policy relevance As multi-state models allow for quantification of the health and costs influences of each health determinant, including health interventions, they facilitate rational policy making. Broad policy questions in relation to the role of health determinants and health care provision can be specified, modelled and explored like e.g. the use of a zero health expenditure scenarios (chapter 4) and in the use of interventions proposed in guidelines (chapter 5-8). For other broad or detailed policy questions the model approach can be expanded or simplified according depending on the nature of the question. Ethical and political choices will have to remain with the domain of politicians and the public. A lot of the evidence-based approaches, prominent on the national and international agendas for health policy and health research, frequently and increasingly make use of health modelling approaches. It is unclear what the implications of this policy approach are for the production and distribution of health in populations, given the notion of multiple determinants in health. It is equally unclear what kind of barriers there are to the adoption of evidence-based approaches in health care practice. Chapter 9 outlines the ways in which health policy is informed by the results from health research and health modelling. It summarises approaches in health at three impact levels: inter-sectoral assessment, national health care policy, and evidence-based medicine in everyday practice. Consensus is growing on the role of broad and specific health determinants, including health care, as well as on priority setting based on the burden of diseases. In spite of methodological constraints, there is a demand for inter-sectoral assessments, especially in health sector reform. Initiators of policy changes in other sectors may be held responsible for providing the evidence related to health. There are limited possibilities for priority setting at the national health care policy level. Hence, there is a decentralisation of responsibilities for resource use towards providers and health insurance companies. They are encouraged to assume agency roles for both patients and society and ask to promote and deliver effective and efficient health care. Governments need to design national frameworks to strengthen their organisation to enhance their roles. The formulation of national health guidelines supported by evidence on effectiveness and efficiency will be one essential element in this process. With the increasing number of advocates for the enhancement of population health in the policy arenas, evidence-based approaches provide the insights, information, and tools to help with priority setting. RESEARCH RECOMMENDATIONS Model validation The book observes the start of multi-state modelling of population health in epidemiology, demography, public health, and health economics research. Up to now there are relatively few related research efforts. The designs, implementation, and application of generic multi-state approaches have been initiated. Important is the validity of the results. More model calibration and validation can and should take place. Validation can be structural validation (chapter 3) or external validation, using external time series (chapters 4 and 5). The developed models have relatively few free variables that can be used for calibration and reproduction of population-based time series of morbidity and mortality. An important free variable to be use for calibration is the non-attributable incidence of diseases. In combination with the risk-attributable fraction, it results in the observed disease incidence. The population attributive risk approach should be developed further to account for regression dilution bias and the occurrence of multiple diseases and multiple determinants. Another important calibration parameter is the effectiveness of prevention and curative services in daily settings. Related parameters, such as coverage, are usually based on cross-sectional studies. Incidentally, longitudinal follow-up may be able to give data on day-to-day effectiveness. Also comparison with special population groups that have remained without an intervention may give supportive evidence like studies on religious, cultural groups, on the uninsured, or on 'natural' experiments like war or strikes. A third group of calibration parameters is disease-specific mortality and morbidity. This group can be used for the large disease categories that we used for the applications (chapter 3-5). This would be for Mexico for the period 1950-1990 and for India for the period 1980-1990 based on the Federal Sample Registration Survey. Last, disease-specific calibration is possible for The Netherlands 1900-1990 and also, but with more uncertainties, from 1860 onwards. Expert validation of model structure and assumptions could be more explored and transparency increased. Examples are review procedures and panel discussions with researchers, policy makers and the public or its representatives. This would also give more room to account for the more subjective or political choices to be a priori made. Future research The main characteristic of the multi-state approach is a comprehensive consideration of disease occurrence, disability and the cost of disease through a lifetime at the population

Although the term is used freely in translation of the Old Testament, most leprologists do not belive the Hebrew word "zaraeth'" has been correctly interpreted. Certainly some of the lesions described by Moses do not suggest leprosy as it is known today. Greek records of about 500 B.C. indicate a knowledge of the disease which was called "elephantiasis graecorum." Various historian would consider India as being the cradle of leprosy. From the shores of the Indus, this dermatosis, according to tradition, spread itself out by the earth to entire Asia and to Egypt, whence, through the sea, Phenicians brought it to almost all countries of Occident. Hippocrates (460 B.C.), the Father of Medicine, studied it and named it "Phoenicians" disease. The earliest record of leprosy in Korea gose back to around the end of 13th century. By the end of World War�뀫, under the Japanese administration, about 8,000 leprosy patients were institutionalized under the concept of segregation. By 1968, a total of known, registered leprosy cases in Korea sums 37,571, among which 7,479 are institutionalized and 30,092 are being treated as domiciliary patients either at home or in settlement and in resettlement villages. The modern western medicine was introduced to this country in early 20th century. In 1909 Rev. Drs. W.H. Forsythe and R.M. Wilson founded the first private leprosarium in Kwangju and this was the very beginning of introduction of modern medicine into the treatment of leprosy patients in this country. Dating the past two and a half decades, many significant progresses have been made in the treatment of leprosy. The greatest advances was the discovery that sulfone drugs were effective in leprosy. The sulfone drugs were introduced in this country in 1953. Since significant progresses have been attained in recent year in Korea. In 1955, a leprosy out-patient clinic, and in 1957, a leprosy mobile clinic were started. In 1963, the over-all compulsory segregation law abolished, and this resulted in a great shift from the previous compulsory institutionization of the patients, and leprosy out-patient akin clinics and University hospitals have been engaged in the treatment of domiciliary patients. Following the initiation of leprosy mobile service by Catholic Mission in 1955, additional government or voluntary mobile teams have been established and these haute been actively participating incase finding, treatment of home-patients and publicity campaign in rural areas. In response to sudden increase in the number of beggar leprosy canes appeared on the streets from hiding, due to loose administrative control in 1946, after the end of the World War�뀫, the Korean Leprosy Prevention Association, the forerunner of the present-day Korean Leprosy Association, was organized in 1947 by enthusiastic, volunteers, J. Lew, S.W. Bang and their collegues. This laid the fomndation social rehabilitation of cured ex-leprosy cases in this country. By 1968, Government and Korean Leprosy Association have rehabilitated a total of 10,865 ex-leprosy cases in 68 resettlement or settlement villages. By 1968, there existed six leprosy institutions, i.e., three of national leprosarium with 5,800 patients and three of private cripple institutions with 1,779 patients throughout the nation. In this study, a series of studies i.e., extensive review on historical background of leprosy in Korea, analyses of the leprosy control and evaluation of clinical epidemiology and socio-economical aspects and the trends of leprosy in Korea for the past 21 years, i.e., soon after the liberation of this nation in 1948 up to the 1968 were carried out in order to define the future plan of operation and policy for control of leprosy in Korea. Materials and Methoeds A. Analyses of the leprosy control based on the governmental organization, policy making, budgetary allocation and effectiveness, governmental and private leprosy institutions and changing their status, activities by out-patient clinics and mobile teams and rehabilitation of cured exleprosy cases. B. Analyses of clinical epidemiology and the trends of the leprosy on the basis of data obtained from total number of known, registered cases, classification of type of disease, bacteriology, lepromatous rate, positive rate, present age and the age of the onset of the disease and relapse rate during the period of full 21 years from 1948 to 1968. Results and Summary With these extensive review on historical background of leprosy in Korea, author attempted to can out a series of analyses of the leprosy control, evaluation of clinical epidemiological survey and socio-economical aspects of leprosy in Korea during the period of full 21 years from soon after the liberation of this nation in 1948 to 1968 in this studies and hoped to clarify the recent trends in the epidemiology and to reevaluate the previous reports and to uncover some of hitherto unknown aspects in epidemics of leprosy in Korea. The control of leprosy, there existed five national and three private leprosy hospitals until 1967, but two of national leprosariums were transformed into resettlement villages in 1968 and number of in-patients also reduced. There were 18,307 patients in leprosariums and colonies by the end of 1961, but only 7,479 patients remained in the leprosy hospital in 1968, 10,894 negative cured ex-leprosy cases have keen resettled in 62 villages during the past year. The leprosy mobile teams, out-patient skin clinic and local health centers have been actively engaged in the case finding and treatment of domiciliary patients, thus economically more efficient and will have no problem of social rehabilitation and 19,092 cases are receiving domiciliary treatment in 1968. Reconstructive surgery have been performed since 1962, and total 863 cases have received corrective surgery for deformities in leprosy. Since 1960, the gradual and significant increases in the number of new leprosy patients are detected and registered to the authorities. This increses in the number of cases indicated that the public understanding on leprosy itself has been greatly promoted year by year. The epidemiological studies, the classification of the disease types revealed that the lepromatous type occupied predominantly 80.5%: tuberculoid, 18.7% and indeterminate group, 0.8% in 1968. The number of patients of lepromatous type leprosy has increased year by year and has become greater than that of tuberculoid type of leprosy. Bacteriological examination of the in-patients showed that 15.2% positive in 1968. This fact is interpreted as that the epidemicity of leprosy in Korea has been decreasing, and that the effectiveness of chemotherapy and general immunity in community against leprosy has been lowered. Survey on the age of the onset of the disease established that the peak shows between 15 and 19 years of age, also peak of present age group shows between 50 and 54 years of age. The peak of these delay will certainly provide a significant progress in the control of leprosy in Korea. Throughout the studies, the leprosy problem in Korea is under controlled and it became more evident that early diagnosis and treatment of early cartes at the out-patient clinics and leprosy mobile teams are distinctly effective in the control of leprosy in Korea. ; restriction
