The dynamic growth of mobile communications technology is creating opportunities for economic growth, social empowerment, and grassroots innovation in developing countries. One of the areas with the greatest potential impact is in the contribution that mobile applications can make to agricultural and rural development (ARD), by providing access to information, markets, and services to millions of rural inhabitants. For both agricultural supply and demand, mobile phones can reduce waste, make delivery more efficient, and forge closer links between farmers and consumers. This report provides policymakers and development practitioners with a guide that facilitates the development and deployment of mobile applications for ARD. It also informs their understanding of the key drivers for promoting such applications and services in their countries. Using James Moore's (1996) revised definition of ecosystems: economic communities based on interacting organizations and individuals the report identifies a wide range of players in the ecosystem for m-ARD apps, such as mobile network operators, m-app (mobile applications) providers, content providers, and various types of users. M-apps are software designed to take advantage of mobile technology and can be developed for technology besides mobile phones. But mobile phones have many key advantages: affordability, wide ownership, voice communications, and instant and convenient service delivery. As a result, there has been a global explosion in the number of m-apps, facilitated by the rapid evolution of mobile networks and by the increasing functions and falling prices of mobile handsets. M-apps are markedly different in developing countries because they typically run on second-generation (2G) phones rather than smartphones, which are far more common in developed countries. The report reviews country examples and extracts policy lessons and good practices. It also presents detailed studies of cases from Kenya, Philippines, and Sri Lanka, as well as summarizes 92 case studies from Africa, Asia, and Latin America. The goal is to provide a comprehensive understanding of the development impact, ecosystem, and business models for mobile applications in ARD. The report is intended to complement the recent ICT in Agriculture eSourcebook. One of the main findings is that an enabling platform (or platforms) is probably the most important factor for the development of m-ARD apps. Platforms can facilitate interactions among ecosystem players, increase access to users, provide technical standards, and incorporate payment mechanisms.

This study provides an overview of Arab official development assistance (ODA) over the past four decades. Trends in volume, composition, and direction are discussed in chapter two and the institutional framework is discussed in chapter three. Over 90 percent of Arab development assistance is provided by three countries: the Kingdom of Saudi Arabia (KSA), Kuwait, and the United Arab Emirates (UAE).

This report reviews the status, opportunities and constraints of the Royal Government of Bhutan's e-Governance program, and recommends actions to enhance and accelerate it. The report is structured as follows: Part II is a strategic view and executive summary of the present situation, opportunities, constraints and suggested strategy for acceleration of e-Governance in Bhutan. Parts III through VII look at the various dimensions of the strategy, namely human resources (Part III), institutional framework (Part IV), e-governance architecture (Part V), interoperability framework (Part VI) and implementation roadmap (Part VII). The Appendices expand upon various aspects of the report and provide complementary information. Appendix (VIII) subsection F, describes an alternative strategy suggested by an external peer reviewer of the final report, which can enable the rapid rollout of e-Government in the Bhutanese context using a commercial Enterprise Resource Planning system purpose built for the public sector, albeit with certain limitations and costs which need to be evaluated in further detail.

The chief purpose of this handbook is to provide government lawyers with a framework to evaluate the quality of a country's investment legislation (if it exists) and how the legislation relates to its investment policy and investment incentives. More specifically, it deals with creating new and reforming existing investment legislation in developing and transition economies in furtherance of the World Bank Group's (WBG's) mandate to promote private investment - domestic and foreign - in those economies. Handbook appendices contain drafting guidelines and checklist of issues that foreign direct investment (FDI) laws should include and that countries can use when drafting investment legislation. The report is structured as follows: chapter one defines key terms about investment law reform in an effort to clarify terminology and concepts and show how they are related. Chapter two examines how widespread investment codes are and explains their utility and limitations. Chapter three provides recommendations on the structure of investment legislation and the key provisions to be included such as definitions, investors' guarantees, incentives, framework for investment promotion, and transitional provisions. Chapter four discusses the fundamental issue of investor entry, in particular the conditions under which foreign investors can invest including sectoral restrictions, limitations on foreign ownership, authorization and screening, minimum investment, and performance requirements. Chapter five discusses key investor guarantees including fair and equitable treatment, national treatment, most-favored-nation (MFN) treatment, protection against expropriation, guaranteed convertibility and repatriation of profits, and settlement of disputes. Chapter six looks at the issue of investment incentives, (fiscal incentives in particular) and their effectiveness. Chapter seven summarizes key aspects of investment promotion to guide legal drafters, should policymakers want the investment code to set out the basic framework of investment promotion. Chapter eight presents the various phases of investment law reform projects, from the government's request for assistance with legislation to the delivery of a project plan. Chapter nine identifies some of the challenges in preparing an investment code and the support that governments may need until the law is promulgated. Chapter ten discusses the monitoring and evaluation (M and E) of investment law reforms, including the key indicators involved in a desk review and medium- and large-scale projects.

The Asian financial crisis in the late 1990s not only highlighted the welfare consequences of transparency in the financial sector but also linked this relatively narrow problem to the broader context of transparency in governance. It has been observed that objections to transparency, often on flimsy pretexts, are common even in industrialized countries. This article argues that transparency is indispensable to the financial sector and describes its desirable characteristics: access, timeliness, relevance, and quality. The authors emphasize the need to weigh the costs and benefits of a more transparent regulatory policy, and they explore the connection between information imperfections, macroeconomic policy, and questions of risk. The article argues for developing institutional infrastructure, standards, and accounting practices that promote transparency, implementing incentives for disclosure and establishing regulations to minimize the perverse incentives generated by safety net arrangements, such as deposit insurance. Because institutional development is gradual, the authors contend that relatively simple regulations, such as limits on credit expansion, may be the most reasonable option for developing countries. They show that transparency has absolute limits because of the lack of adequate enforcement and argue that adequate enforcement may be predicated on broader reforms in the public sector.

Deutschlands Wissenschaftsfinanzierung ist eine föderale Erfolgsgeschichte – und beruht auf einem Wertekonsens, der politisch bislang nie in Frage gestellt wurde. Was wäre, wenn sich das änderte?

EIN BLICK IN DIE WELT genügt, um zu erkennen, dass das Gedeihen der Wissenschaft von den politischen Rahmenbedingungen abhängt. Die Niederlande und Skandinavien sind aktuelle Beispiele
dafür, dass populistische Regierungen und Parlamentsmehrheiten für das Wissenschaftssystem, insbesondere die Hochschulen, spürbar negative Auswirkungen haben. Ein erstes Opfer ist regelmäßig die
Internationalisierung, indem beispielsweise englischsprachige Studienangebote gestrichen, Visabestimmungen geändert oder Kapazitäten zurückgefahren werden. Wenn in Großbritannien die Tories und
ihr Premierminister das Ziel "50 per cent of 18 to 30-year-olds being able to enter higher education" für "one of great mistakes of the last 30 years" halten, ist es höchste Zeit für eine kurze
Besinnung über die eigene Lage. 



 



75 Jahre Grundgesetz bedeuten auch eine Erfolgsgeschichte für die Wissenschaft und ihre Finanzierung in Deutschland. Die Pflicht des Staates, die Wissenschaftsfreiheit nach Artikel 5, Absatz 3
materiell zu gewährleisten, gehörte ebenso zum breiten politischen Grundkonsens aller Parteien und Regierungen wie die freie Wahl des Berufs und die Gewährleistung entsprechender
Studienmöglichkeiten, zuletzt umgesetzt im Hochschulpakt und im Zukunftsvertrag Studium und Lehre stärken. In diesen Grundkonsens haben sich die im Laufe der Jahrzehnte neu entstehenden Parteien
regelmäßig eingebracht, zunächst die Grünen und nach 1990 auch die PDS bzw. die Linkspartei. Ihre Integration in den kooperativen Föderalismus für die Wissenschaft ist überall gelungen, wo sie in
den Ländern politische Verantwortung übernommen haben.



 



Wie Bund und Länder gemeinsam
die Wissenschaft finanzieren



 



Dieser politische Grundkonsens über die Bedeutung einer den Werten der Aufklärung verpflichteten, rationalen Wissenschaft war und ist die Voraussetzung für ihre gemeinschaftliche Finanzierung
zunächst nur durch die Ländergemeinschaft, mit der Verfassungsreform von 1969 durch die Länder und den Bund. Zweimalige Änderungen des Grundgesetzes 2006 und 2015 haben die gemeinsamen
Handlungsmöglichkeiten jeweils noch erweitert. Rund 18 Milliarden Euro fließen jährlich auf dieser Basis ins Wissenschaftssystem, ein großer Teil davon über den Pakt für Forschung und Innovation
an die außeruniversitären Forschungseinrichtungen und die Deutsche Forschungsgemeinschaft (DFG) und über den "Zukunftsvertrag Studium und Lehre stärken" in die Hochschullehre.



 



Geht das Grundgesetz in der deutschen Verfassungstradition von der Trennung der Aufgabenbereiche zwischen Bund und Ländern aus, so wird mit den Gemeinschaftsaufgaben, zu denen die
Wissenschaftsfinanzierung gehört, ein gesetzlich nicht geregelter Zwischenraum eröffnet, der von den Regierungen durch Verwaltungsvereinbarungen exekutiv ausgestaltet werden kann. Die damit
verbundene finanzielle Selbstbindung der Beteiligten unterliegt dem Einstimmigkeitserfordernis, entweder der Wissenschaftsminister und Finanzminister oder der Regierungschefs von Bund und
Ländern. Die Arena für die Aushandlung ist in der Wissenschaft die Gemeinsame Wissenschaftskonferenz von Bund und Ländern. Das Risiko der damit 17 potenziellen Veto-Spieler wurde bislang durch
den wissenschaftspolitischen Grundkonsens unter allen Beteiligten wirkungsvoll eingehegt. Äußerst seltene Veto-Situationen etwa bei Haushaltsnotlagen ließen sich auf der Ebene der
Ministerpräsidenten pragmatisch auflösen. 



 



Ob das auch bei einer populistischen Landesregierung gelingen würde, deren sie tragende Partei mit ihren "verfassungsfeindlichen Strömungen" eher auf alternative Fakten und Verschwörungstheorien
als auf Aufklärung und Rationalität setzt, ist mehr als fraglich. Und was würde ein solches Szenario für die bestehenden Verwaltungsvereinbarungen bedeuten? 



 



Mit den Vereinbarungen verpflichten sich zunächst die Regierungen von Bund und Ländern, in ihren jeweiligen Haushaltsentwürfen die entsprechenden Summen vorzusehen. Alle Vereinbarungen stehen mit
Blick auf die finanzielle Ausstattung dann jedoch unter dem Vorbehalt der Zustimmung der 17 Parlamente von Bund und Ländern. Nicht zuletzt wegen der konkreten finanziellen Vorteile für die
Wissenschaftseinrichtungen im eigenen Land hat allerdings noch nie ein Parlament die Bereitstellung der notwendigen Mittel verweigert. Was bislang deshalb eher formelhaften Charakter hatte,
könnte ein Landesparlament bei entsprechenden wissenschaftsaversen Mehrheiten scharf schalten – mit dramatischen Folgen nicht nur für die Wissenschaft im Land, sondern darüber hinaus für die
Gemeinschaftsfinanzierung der Wissenschaft in Deutschland.



 



Zwei Programmgruppen,
zwei Szenarien



 



Was könnte konkret passieren? Die laufenden Programme lassen sich unter dem Risikoaspekt in zwei Gruppen unterteilen: Erstens geförderte Maßnahmen, bei denen eine bilaterale Finanzierung von Bund
und jeweiligem Sitzland vorgesehen ist ("Forschung an Fachhochschulen", "Innovative Hochschule", das Professorinnenprogramm,) oder der Bund allein die Mittel bereitstellt ("Wissenschaftlicher
Nachwuchs", "Qualitätsoffensive Lehrerbildung"). Alle diese Programme haben den Charakter eines Projekts, sind deshalb zeitlich befristet und laufen automatisch aus, wenn sie nicht durch einen
entsprechenden Beschluss in der GWK verlängert werden. Aus ihnen könnte jedes Land durch eigene Entscheidung faktisch ausscheiden, zum Beispiel indem es keine Anträge weiterreichte, mit
entsprechenden Konsequenzen für die eigenen Einrichtungen, jedoch ohne unmittelbare Folgen für das Gesamtprogramm während seiner Laufzeit. 



 



Die zweite Gruppe betrifft Verwaltungsvereinbarungen, die auf unbestimmte Zeit geschlossen wurden und die von einem einzigen Land, das den wissenschaftspolitischen Grundkonsenses nicht mehr
mitträgt, nicht einseitig gekündigt werden könnten. Das gilt für die Exzellenzstrategie, den "Zukunftsvertrag Studium und Lehre stärken" und die Innovative Hochschullehre, die für die Hochschulen
von ganz besonderer Bedeutung sind. Für eine Kündigung wären im Ernstfall zwischen drei und acht Länder notwendig, allerdings mit einer gewichtigen Ausnahme: Beim Zukunftsvertrag besteht für
jedes Land die Möglichkeit einer außerordentlichen Kündigung, also eine individuelle Ausstiegsoption. 



 



Eine wissenschaftsaverse Landesregierung beispielsweise in einem ostdeutschen Land hätte demnach die Möglichkeit, für ihre Hochschulen aus dem Zukunftsvertrag auszusteigen: mit erheblichen
Nachteilen für die betroffenen Hochschulen des Landes, jedoch ohne unmittelbare Auswirkungen auf das gesamte Hochschulsystem – zumindest so lange, wie der bestehende Zukunftsvertrag keine
Änderung erfahren soll. 



 



Der hypothetisch durchgespielte Fall verweist jedoch auf ein Defizit der bestehenden Regelungen: Es ist in der Verwaltungsvereinbarung keine Wiedereinstiegsmöglichkeit vorgesehen. Im
hypothetischen Fall bliebe das Land auch bei einem Wechsel zu einer wissenschaftsfreundlichen Landesregierung dauerhaft ausgeschlossen. Die Austrittsoption sollte deshalb durch eine entsprechende
Wiedereintrittsoption ergänzt werden.  



 



Sollte der Zukunftsvertrag inhaltliche Änderungen erfahren, würde wieder nach Grundgesetz-Artikel 91 b das verfassungsrechtliche Erfordernis der Einstimmigkeit greifen. Ähnliches gilt für den
Pakt für Forschung und Innovation, der zwar keine Kündigungsklauseln enthält, wohl aber eine zeitliche Befristung, aktuell bis zum Jahre 2030. Für seine Verlängerung wäre ein einstimmiger
Bund-Länderbeschluss notwendig. 



 



Weil keiner es sich
vorstellen konnte



 



Die grundsätzliche gemeinsame Bund-Länder-Finanzierung der außeruniversitären Forschungseinrichtungen und der DFG sieht dagegen keine Kündigungsmöglichkeit vor. Die entsprechenden Vereinbarungen
unterliegen lediglich dem Risiko, dass das Verwaltungsabkommen zwischen Bund und Ländern über die Errichtung der GWK außer Kraft tritt. Als diese Vereinbarung 2007 geschlossen wurde, wurden die
Konditionen einer möglichen Kündigung relativ dilatorisch behandelt, weil der wissenschaftspolitische Grundkonsens weitergehende Überlegungen als vollkommen abwegig erscheinen ließ. Während eine
Kündigungsfrist von zwei Jahren genannt wird, ist nicht einmal ein Länderquorum vorgesehen. Gleichwohl ist die politische Kündigungshürde außerordentlich hoch. Ob sie zur Abwehr eines
destruktiven politischen Willens ausreicht, wird hoffentlich keinem Praxistest unterzogen.



 



Wie könnte das System der gemeinsamen Wissenschaftsfinanzierung von Bund und Ländern wetterfester gemacht werden? Im Rahmen der konkurrierenden Gesetzgebung könnte der Bund zum Beispiel ein
Gesetz zur Forschungsförderung beschließen, das seine Rolle im System der Forschungsförderung gesetzlich festschriebe. Eine Option, die historisch lediglich in den 1950er Jahren der damalige
Bundeskanzler Konrad Adenauer als Drohpotenzial  ins Spiel brachte – gegenüber der Weigerung der Länder, den Bund in das Königsteiner Abkommen aufzunehmen. Der gesetzgeberische Aufwand wäre
vermutlich erheblich, die Wirkung im Vergleich mit dem Status quo begrenzt, denn die Vorhaben an Hochschulen und vor allem der Zukunftsvertrag blieben außen vor. 



 



Im Zusammenhang mit der Verfassungsreform 2006 wurden unterschiedliche Modelle einer konsequenten Entflechtung diskutiert, die dem Gedanken einer Aufgabentrennung zwischen Bund und Ländern
folgten. Sie sind damals vor allem wegen der Pfadabhängigkeit im erfolgreichen kooperativen Föderalismus nicht zum Tragen gekommen. Auch eine solche konsequente Zuständigkeitstrennung wäre sehr
aufwändig und mit großen Unsicherheiten verbunden, da verfassungsändernde Mehrheiten im Bundestag und Bundesrat notwendig wären. Der begrenzte Vorteil bestünde in der entkoppelten
Risikoverteilung für das Wissenschaftssystem auf 17 unabhängige Akteure; dem würde als Nachteil die Abhängigkeit der betroffenen Einrichtungen von einem einzigen Akteur – Land oder Bund -
entgegenstehen. Ein mit Blick vor allem auf die Länderhaushalte wenig attraktives Szenario.



 



Von der Wirkung her durchaus vergleichbar wäre, den grundsätzlichen Finanzausgleich zwischen Bund und Ländern und der Länder untereinander zu verändern. Überlegungen, das unterschiedliche
finanzielle Engagement der einzelnen Länder für ihre Hochschulen als "Hochschullast" in den vertikalen und horizontalen Länderfinanzausgleich einzubeziehen, gab es bereits in den 1950er Jahren.
Die Verlagerung zusätzlicher Umsatzsteuerpunkte vom Bund auf die Länder wäre eine weitere theoretisch denkbare Möglichkeit, die jedoch nur bei einer Entflechtung Sinn machen würde. Alle
haushaltssystematischen Varianten hätten zudem den großen Nachteil, dass die Finanzflüsse in den Finanzministerien der Länder ankämen und in Konkurrenz mit anderen Politikfeldern im Kabinett und
im Parlament für die Wissenschaft erkämpft werden müssten. Demgegenüber weist die Gemeinschaftsfinanzierung den großen Vorteil auf, dass sie ohne politische Umwegrisiken in den
Wissenschaftsministerien der Länder und damit zielgenau etwa bei den Hochschulen ankommt.



 



Eine "Koalition der Willigen"? mithilfe
des Grundgesetz-Artikels 91b?



 



Schließlich sei im Zusammenhang mit der Ausstiegsoption beim Zukunftsvertrag der naheliegende Gedanke einer "Koalition der Willigen" weitergeführt: Der Bund legt ein Förderprogramm beispielsweise
für eine größere hochschulpolitische Zielsetzung auf, verbunden mit einem Opt-in-Angebot an die Länder, die sich beteiligen möchten. Aber auch dafür bräuchte der Bund die Zustimmung aller
Länder. 



 



Eine Zwei-Drittel-Mehrheit von Bundestag und Bundesrat wäre nötig für eine Änderung des Artikels 91b, um eine Mitfinanzierungsverpflichtung des Bundes im Bereich der Hochschulen gesetzlich zu
verankern, wie es sie beispielsweise im föderalen System der Schweiz gibt. Eine solche Änderung könnte sich für den Hochschulbereich insofern auf den Artikel 91a stützen: "(1) Der Bund wirkt
auf folgenden Gebieten bei der Erfüllung von Aufgaben der Länder mit, wenn diese Aufgaben für die Gesamtheit bedeutsam sind und die Mitwirkung des Bundes zur Verbesserung der Lebensverhältnisse
erforderlich ist (Gemeinschaftsaufgaben)", und hier den Spiegelstrich "Stärkung der Hochschulen (durch die Förderung eines angemessenen Studienangebots und eines qualitativ hochwertigen
Hochschulstudiums)" hinzufügen. Durch Bundesgesetz mit Zustimmung des Bundesrates würden die Gemeinschaftsaufgabe sowie Einzelheiten der Koordinierung näher bestimmt. Der Bund trüge einen
definierten Anteil der Ausgaben für die Hochschulen in jedem Land.



 



Es bleibt am Ende dieser Betrachtung nur eine Erkenntnis: Eine auf geteilten Werten und gegenseitigem Grundvertrauen aufgebaute institutionalisierte Kooperation zwischen Bund und Ländern, wie sie
die Gemeinschaftsfinanzierung im Bereich der Wissenschaft darstellt, muss sich ihrer Risiken bewusst sein und sie künftig verstärkt mitdenken. Ein einfacher gesetzgeberischer oder
verwaltungstechnischer Weg zu ihrer Vermeidung ist aus heutiger Sicht jedoch nicht erkennbar. Deshalb sind wir alle und unsere Institutionen aufgerufen, aktiv darauf hinzuwirken, dass
wissenschaftsaverse politische Parteien bei den bevorstehenden Wahlen zum Europaparlament und zu den drei ostdeutschen Länderparlamenten keine Chance bekommen.

Baskground. The analysis of medical and statistical data сoncerning the development of a medical and demographic situation in the world and in Ukraine, scientific literature, normative legal documents of Ukraine and authoritative international organizations shows the rapid aging of population, the spread of morbidity and mortality from chronic non-infectious and infectious diseases, low availability of palliative and hospice care (PHC) for the population in Ukraine. Objective: to determine the best models for the PHC in Ukraine based on a medical and social analysis of current international definitions, approaches and standards of palliative care. Materials and methods. The legal documents of international organizations and Ukraine, informational and analytical materials of activities of palliative and hospice care institutions, statistic data and scientific literature were used. Common methods were used. Results. A comparative analysis of the normative legal documents of Ukraine and authoritative international organizations shows that the definition of palliative care in the Ukrainian legislation is somewhat inconsistent with modern international practice; in accordance with the legal and regulatory framework of Ukraine, the definition of palliative care is a kind of medical care and relates only to terminally ill patients with predicted (limited) longevity and their family members, while World Health Organization (WHO) defines palliative care as an approach that improves the quality of life of patients and their families facing the problem associated with life-threatening illness. Of course, such approach greatly expands the cohort of patients and increases the need for PHC. Medico-statistical data testify to the rapid aging of the population in Ukraine and in the world, the spread of mortality from life-threatening and incurable diseases, in particular from cancer and chronic non-infectious and infectious diseases, low availability of palliative care for the population. The article substantiates multidisciplinary and intersectoral model of the palliative care in in-patient and out-patient settings, including home care, the conditions for the creation and implementation of affordable, high-quality and efficient palliative care system in Ukraine. The authors demonstrate the importance and implications of a strategy of PHC development in Ukraine based on internationally recognized definitions, and discuss possible models and levels of PHC integration in health care practice. Conclusions. According to the WHO definition, palliative care is an approach that can improve the quality of life of patients (children and adults) and their families facing with life-threatening illnesses that significantly expands the cohort of patients and increases the need for PHC. Now, PHC is a modern multidisciplinary patient-family-oriented approach that most adequately provides the needs and quality of life of palliative patients and their families, promotes the protection of rights and the preservation of the human dignity of the severely ill persons, including incurable patients with limited life expectancy. A comparative analysis of the normative legal documents of Ukraine and authoritative international organizations shows that the definition of palliative care in Ukrainian legislation is not entirely consistent with current international practice, because in Ukraine, palliative care is a kind of medical care and applies only to incurable patients with a limited prognosis of a life length and members of their families. The government officials, politicians, PHC specialists, human rights defenders and public organizations representatives should take responsibility for the creation and implementation of an innovative approach — an affordable, high-quality, and efficient PHC system for the population and optimization of regulatory documents in accordance with international approaches and standards in the context of reforming the public health system in Ukraine. PHC service, based on international standards and approaches, should become an integral part of the health care system and social protection for Ukraine population. ; Актуальность. Анализ медико-статистических данных по развитию медико-демографической ситуации в мире и Украине, научной литературы, нормативно-правовых документов Украины и авторитетных международных организаций свидетельствует о быстром старении населения, распространении заболеваемости и смертности от хронических неинфекционных и инфекционных заболеваний, низкой доступности паллиативной и хосписной помощи (ПХП) для населения Украины. Цель. На основании медико-социального анализа современных международных определений, подходов и стандартов паллиативной помощи определить оптимальные модели оказания ПХП в Украине. Материалы и методы. При выполнении работы были использованы нормативно-правовые документы международных организаций и Украины, информационно-аналитические материалы деятельности учреждений паллиативной и хосписной медицины, данные отраслевой статистики, научная литература. При обработке использовались общепринятые методы. Результаты. Сравнительный медико-социальный анализ отечественного законодательства, нормативно-правовых документов Украины и авторитетных международных организаций свидетельствует, что определение «паллиативная помощь» в украинском законодательстве не совсем соответствует современной международной практике, поскольку в соответствии с нормативно-правовой базой Украины, понятие «паллиативная помощь» является видом медицинской помощи и применяется только в отношении инкурабельных пациентов с прогнозируемой (ограниченной) продолжительностью жизни и членов их семей, в то время как Всемирная организация здравоохранения (ВОЗ) определяет паллиативную помощь как подход, позволяющий улучшить качество жизни пациентов (детей, взрослых) и их семей, столкнувшихся с проблемами, связанными с угрожающими жизни заболеваниями. Безусловно, такой подход значительно расширяет контингент пациентов, увеличивает потребность в ПХП. Обосновывается мультидисциплинарная и межсекторальная модель оказания паллиативной помощи в стационарных и амбулаторных условиях, в том числе на дому, условия создания и внедрения доступной, качественной и эффективной системы паллиативной помощи в Украине. Авторы показывают важность и значение разработки стратегии создания и развития системы ПХП в Украине, основанной на международно признанных определениях, а также обсуждают возможные модели и уровни интеграции ПХП населению в практику здравоохранения. Выводы. Согласно определению ВОЗ, паллиативная помощь является подходом, позволяющим улучшить качество жизни пациентов (детей, взрослых) и их семей, столкнувшихся с проблемами, связанными с угрожающим (опасным) для жизни заболеванием, что значительно расширяет контингент пациентов, увеличивает потребность в ПХП. Сегодня ПХП является современным мультидисциплинарным пациент-семья-ориентированным подходом, который наиболее адекватно обеспечивает потребности и надлежащее качество жизни паллиативных пациентов и членов их семей, способствует обеспечению прав, сохранению человеческого достоинства тяжелобольных, в том числе инкурабельных пациентов с ограниченным прогнозом продолжительности жизни. Сравнительный анализ нормативно-правовых документов Украины и авторитетных международных организаций свидетельствует, что определение «паллиативная помощь» в украинском законодательстве не совсем соответствует современной международной практике, поскольку в Украине паллиативная помощь является видом медицинской помощи и применяется только в отношении инкурабельных пациентов с ограниченным прогнозом продолжительности жизни и членов их семей. В условиях реформирования системы общественного здравоохранения в Украине чиновники, политики, специалисты по ПХП, правозащитники, представители общественных организаций должны взять на себя ответственность за создание и внедрение инновационного подхода — доступной, качественной и эффективной системы ПХП населению, что требует усовершенствования и оптимизации нормативно-правовых документов в соответствии с международными подходами и стандартами. Служба ПХП, основанная на международных стандартах и подходах, должна стать неотъемлемой интегрированной составляющей системы здравоохранения и социальной защиты населения Украины, что будет свидетельством европейского выбора нашего государства. ; Актуальність. Аналіз медико-статистичних даних щодо розвитку медико-демографічної ситуації у світі і в Україні, наукової літератури, нормативно-правових документів України і авторитетних міжнародних організацій свідчить про швидке постаріння населення, поширення захворюваності та смертності від хронічних неінфекційних та інфекційних захворювань, низьку доступність паліативної та хоспісної допомоги (ПХД) для населення в Україні. Мета. На підставі медико-соціального аналізу сучасних міжнародних визначень, підходів і стандартів паліативної допомоги визначити оптимальні моделі надання ПХД в Україні. Матеріали та методи. Під час проведення роботи були використані нормативно-правові документи міжнародних організацій і України, інформаційно-аналітичні матеріали діяльності закладів паліативної та хоспісної медицини, дані галузевої статистики, наукова література. При обробці матеріалів використовувались загальноприйняті методи. Результати. Порівняльний медико-соціальний аналіз вітчизняного законодавства, нормативно-правових документів України та авторитетних міжнародних організацій свідчить, що визначення «паліативна допомога» в українському законодавстві не зовсім відповідає сучасній міжнародній практиці, оскільки відповідно до нормативно-правової бази України, поняття «паліативна допомога» є видом медичної допомоги та застосовується тільки стосовно інкурабельних пацієнтів із прогнозованою (обмеженою) тривалістю життя і членів їх сімей, у той час як Всесвітня організація охорони здоров'я (ВООЗ) визначає паліативну допомогу як підхід, що дозволяє поліпшити якість життя пацієнтів (дітей, дорослих) і їх сімей, які зіштовхнулися з проблемами, пов'язаними із загрозливими для життя захворюваннями. Безумовно, такий підхід значно розширює контингент пацієнтів, збільшує потребу у ПХД. Обґрунтовується мультидисциплінарна та міжсекторальна модель надання паліативної допомоги у стаціонарних і амбулаторних умовах, зокрема вдома, умови створення та впровадження доступної, якісної й ефективної системи паліативної допомоги в Україні. Автори показують важливість і значення розробки стратегії створення та розвитку системи ПХД в Україні, заснованої на міжнародно визнаних визначеннях, а також обговорюють можливі моделі й рівні інтеграції ПХД населенню в практику охорони здоров'я. Висновки. Відповідно до визначення ВООЗ, паліативна допомога є підходом, що надає можливість поліпшити якість життя пацієнтів (дітей, дорослих) і їх сімей, які зіштовхнулися з проблемами, пов'язаними із загрозливим (небезпечним) для життя захворюванням, що значно розширює контингент пацієнтів, збільшує потребу у ПХД. Сьогодні ПХД є сучасним мультидисциплінарним пацієнт-сім'я-орієнтованим підходом, який найбільш адекватно забезпечує потреби та належну якість життя паліативних пацієнтів і членів їх сімей, сприяє забезпеченню прав, збереженню людської гідності тяжкохворих, зокрема інкурабельних пацієнтів з обмеженим прогнозом тривалості життя. Порівняльний аналіз нормативно-правових документів України й авторитетних міжнародних організацій свідчить, що визначення «паліативна допомога» в українському законодавстві не зовсім відповідає сучасній міжнародній практиці, оскільки в Україні паліативна допомога є видом медичної допомоги і застосовується тільки стосовно інкурабельних пацієнтів з обмеженим прогнозом тривалості життя і членів їх сімей. В умовах реформування системи громадської охорони здоров'я в Україні урядовці, політики, фахівці з ПХД, правозахисники, представники громадських організацій повинні взяти на себе відповідальність за створення та впровадження інноваційного підходу — доступної, якісної та ефективної системи ПХД населенню, що вимагає удосконалення, оптимізації нормативно-правових документів відповідно до міжнародних підходів та стандартів. Служба ПХД, яка базується на міжнародних стандартах і підходах, повинна стати невід'ємною інтегрованою складовою системи охорони здоров'я та соціального захисту населення України, що буде свідченням європейського вибору нашої держави.

Since 2007, after the election of the economist Rafael Correa Delgado for president of the Republic of Ecuador, the country has been experiencing a series of ideological, structural and political changes. A Constitutional Assembly, demanded by a Popular Consultation, materialized Correa's project of "homeland refoundation" (Ulloa, 2020, p. 19). In 2008, once the Constitution had been drafted, 63,93% of the voting population said "Yes" to the new Constitution, thus establishing what would be a turning point in national politics.On the one hand, until the fall of Colonel Lucio Gutiérrez (2003-2005), the country had undergone turbulence during the nineties due to significant political-institutional instability. There were three political leaders toppled in total; an armed conflict with its neighbor country, Peru; and a deep economic crisis that led the country to embark on dollarization. Correa's presidency, on the other hand, lasted ten years (2007-2017), after which time he left one of his vice-presidents Lenín Moreno as successor (2017-2021). In addition, despite the corruption during his government, he continues to lead the second largest political party, as can be seen in the 2021 elections.His Plan of Government, called 'Plan Nacional para el Buen Vivir,' introduced the indigenous worldview of Sumak Kawsay. Translated from quichua language as Buen Vivir, this philosophy enabled the adoption of social inclusion measures, the enlargement of minority rights, including the expansion of the liberal juridical anthropocentric concept, by offering nature rights (Hernández, 2017). Sumak Kawsay means "life in its fullness […] in its material and spiritual excellence […] in its inner and outer balance of the community" (Macas, 2010, p. 14).Based on this philosophy, Ecuador started moving towards social change, which was impossible without the inclusion of gender equality (Zaragocín, 2017, p. 64). In that sense, many public policies have been planned, creating debates on economic, political and social issues (Acosta, 2012; Acosta y Cajas-Guijarro, 2018; Hernández, 2017; Radcliffe, 2017). Furthermore, these policies targeted one of the most hermetic institutions: the Armed Forces.In this respect, this paper aims to analyze the discursive reproductions and disruptions in gender categories (masculine and feminine) based on an analysis of Ecuadorian defense documents. The masculinities constitute a gender category that reflects the subjugation of the feminine by the masculine, and is connected to a superiority associated with strength, rationality, command, in opposition to feminine values (weakness, emotionality, anarchy) (Hooper, 1999). Nevertheless, masculinities are not personal characteristics concerning individuals. Instead, they should be understood as configurations produced by social actions in a particular context (Connell y Messerschmidt, 2005, p. 832). In this paper, Maya Eichler's militarized masculinities (MM) concept is used as a reference to the stereotypical masculine characteristics created by the exacerbation of virility in military rituals (military service, combat) (Eichler, 2014, pp. 83-85). The author highlights that the MM are regularly and dynamically produced, making necessary an analysis on its features. Therefore, it is used to identify discursive and ideological formations and interdiscourses associated with gender notions present in the documents through a post-structural feminist approach and a discourse analysis methodology.Gender equality constitutes an unavoidable issue in contemporary democracies and consequently the inclusion of women in the Ecuadorian Armed Forces is an ongoing challenge. Recent studies on the integration of women in the military demonstrate that public policies, mainly regarding gender equality and interculturality, have been militarized (Zaragocín, 2018, p. 436). In other words, the potential for social change has been lost. From this fact, this paper argues that the militarization of gender equality, besides undermining the transformative potential of social inclusion, allowed the reproduction of new manifestations of militarized masculinities in the defense documents, updating the dynamics based on a dialectic and negative masculine/feminine dichotomy.Furthermore, the existence of a gap in the Ecuadorian security and defense literature is identified; despite the increase of women in the military, studies on this phenomenon remain incipient (Chacón, 2014; Iturralde, 2015; Morales et al., 2017; Zaldumbide, 2020; Zaragocín, 2018). Issues concerning military masculinities, hegemonic masculinity in these places and in Ecuadorian society —and their discursive reproductions, continuities and resistances— constitute a fertile ground for the analysis of the consequences of militarization for social inclusion. This paper fills this gap by analyzing the transformation in militarized masculinities in national defense discourse, and it does so through innovative methodological resources that allow a critical perspective on the results of the policies implemented since 2007.In terms of methodology, a framework of analisis is used consisting of defense documents published from 2002 to 2017, namely: Libro Blanco de Defensa (2002, 2006), Agenda Política de Defensa (2009-2013 and 2014-2017), Política de Género de las Fuerzas Armadas del Ecuador (2013) and the Cartilla de Género Fuerzas Armadas del Ecuador (2017). This framework refers to the year of 2002 due to the release of the first Libro Blanco during Gustavo Noboa's administration (2000-2003). This permits us to determine to what extent the inclusion of gender politics was an unavoidable issue in national defense politics during the documents' transition.The body of analysis is addressed through the combination of a discourse analysis and a post-structural feminist perspective on gender, using Laura Shepherd's theoretical lens. The connection between these methodologies permits the identification of the ways that gender manifests itself as an element of power in discourses. It is highlighted how the post-structural feminist perspective allows us to question how the texts signify, enabling the realization of profound analyses that address the documents' discursive meanings (Shepherd, 2010, p. 9). Discourse should be understood as "word in motion", whose purpose is the production of effects of meaning (Orlandi, 2012, p. 15). Discourse is represented by oral and written word, and symbols that dispute meanings in subjective and ideological fields (Brandão, 2012, p. 9). For this study, the texts that form the body of analysis are considered discourses. In this way, discourses are understood as neither transparent nor inert (Orlandi, 2012, p. 15), but dynamic and contingent.Besides the introduction and the final considerations, the work has three sections. The first section presents the conceptual tools that will be used to understand the relation between gender and masculinities. After that, a brief description of the methodology employed in the study is developed. Finally, the analysis is conducted on the manifestations of militarized masculinities in the documents. The work finishes by presenting a final argument, that is: besides undermining the transformative potential of social inclusion, the militarization of gender equality allows for the reproduction of new manifestations of militarized masculinities in the defense documents. The dynamics are updated based on a dialectic and negative masculine/feminine dichotomy.Through this analysis three illustrative images of women's presence in the defense documents were created: "partial citizen", "authorized citizen" and "military woman". The three representations show, in a "before" and "after" comparison of gender politics, that women continue experiencing rejection in military spaces, being the "Other", and inherently a stranger to the ideal of militarized masculinity that prevails in the barracks. The conclusion is that militarized masculinities have experienced a discursive metamorphosis, demonstrating the subtle and resistant armor of the masculine military ethos. ; El presente trabajo busca analizar las manifestaciones, reproducciones y rupturas discursivas que experimentan las nociones de género a partir de las masculinidades militarizadas presentes en los documentos de defensa del Ecuador. El corpus de análisis está constituido por las políticas de defensa producidas entre 2002 y 2017, considerando el periodo presidencial de Rafael Correa (2007-2017). La Constitución de 2008, con la inclusión de la filosofía indígena del Buen Vivir (Sumak Kawsay), permitió la promoción de políticas públicas direccionadas a alcanzar la equidad de género y la interculturalidad. Las instituciones castrenses se han mostrado especialmente reticentes a los cambios producidos por dichas medidas, generando una militarización de las políticas de género. Es decir, el potencial de cambio que las caracteriza ha sido contenido por la supremacía del ethos militar masculino. El efecto de esa contención —en un país que se autodenomina plurinacional, que reconoce la presencia de diversos pueblos en su territorio— necesita ser analizado, puesto que impacta directamente con las propuestas de inclusión social. Se argumenta que la militarización de elementos como la equidad de género y la interseccionalidad del Buen Vivir, además de corroer el potencial transformador de inclusión social, permite reproducir nuevas formas de manifestación de las masculinidades militarizadas en los documentos de defensa, actualizando las dinámicas que responden a la dicotomía masculino/femenino en un sentido dialéctico y negativo. Para el análisis se emplea una perspectiva de género feminista aliada al análisis del discurso de vertiente francesa, visando examinar las manifestaciones discursivas de las masculinidades militarizadas en los documentos de defensa. A partir del análisis se crearon tres categorías ilustrativas de la presencia de la mujer en los documentos de defensa: ciudadana parcial, ciudadana autorizada, mujer militar. Las tres representaciones muestran, en un antes y un después de las políticas de género, que las mujeres continúan vivenciando rechazo en los espacios militares, ocupando el lugar de un otro. Se concluye que las masculinidades militarizadas han experimentado una metamorfosis discursiva, mostrando el blindaje resistente y sutil del ethos militar masculino. En términos de estructura, el trabajo posee tres secciones. En la primera, se despliegan los instrumentos conceptuales para comprender la relación entre género y masculinidades. Enseguida, se desarrolla una breve descripción de la metodología utilizada. Finalmente, se aplica el dispositivo de análisis a la localización de las manifestaciones de las masculinidades militarizadas en los documentos.

Opći cilj istraživanja prikazanog u ovom radu jest teorijsko i empirijsko razmatranje različitih modela urbanog upravljanja na primjeru urbano-okolišnog sektora Grada Zagreba, pri čemu se posebna pažnja daje mogućnostima i preprekama za integrirano urbano upravljanje, s fokusom na koordinaciju i participaciju. Tema je razrađivana kroz različite teorijske pristupe s namjerom holističkog obuhvata područja istraživanja. Tipologija urbanog upravljanja koju su razvili DiGaetano i Strom (2003) koristi se za analizu i interpretaciju tipova upravljanja u urbano-okolišnom sektoru Grada Zagreba. Vezano specifično uz integrirano upravljanje, istraživanjem je obuhvaćena horizontalna integracija, kao dimenzija integriranog upravljanja, odnosno njezina dva aspekta: a) segment integriranog urbanog upravljanja koji pretpostavlja intenzivniju i kvalitetniju suradnju i koordinaciju formalnih aktera unutar gradske uprave; te, b) participacija neformalnih aktera u procesu donošenja odluka i kreiranja javnih politika. Aspekt koordinacije formalnih aktera interpretiran je u ovom radu temeljem teorije koordinacije javnih politika, pri čemu se preuzimaju sukcesivne razine ostvarivanja koherentnosti u oblikovanju javnih politika koje je razvio Peters (2004). U dijagnostičke svrhe utvrđivanja suradnje različitih gradskih tijela u urbano-okolišnom sektoru u ostvarivanju zajedničkih ciljeva korišten je i Metcalfeov (1994) pristup analizi izmjere kapaciteta koordinacije javnih politika. Što se tiče participacije neformalnih aktera, u interpretaciji se koristi tipologija razine participacije koju je izradila Arnstein (1969) kao i klasifikacija jednosmjernih i dvosmjernih participativnih metoda od Anokye (2013). U kontekstu ovog istraživanja razmatra se i redistribucija moći između formalnih i neformalnih aktera izražena kao odnos snaga u kojem su u poziciji moći formalni akteri, a neformalni akteri svojim djelovanjem dovode u pitanje granice i raspodjelu moći (Arnstein, 1969). Istraživanje je dizajnirano kao studija slučaja urbanog upravljanja u Gradu Zagrebu korištenjem metode polu-strukturiranog intervjua i fokusne grupe uz pregled relevantnog normativnog i strateškog okvira. Istraživanjem je utvrđen hibridni tip upravljanja u urbano-okolišnom sektoru, specifičnije, korporativno-klijentelistički tip urbanog upravljanja. Uočene specifičnosti u modelu upravljanja odnose se na nepovjerenje neformalnih aktera u tijela lokalne samouprave što je dodatno naglašeno uvjerenjem kako lokalna samouprava počiva na principima klijentelizma i pomanjkanja odgovornosti te sektorskom i piramidalnom sustavu upravljanja s koncentracijom moći u samome vrhu gradske vlasti. Navedeno je u suprotnosti sa integriranim modelom upravljanja koje pretpostavlja ostvarenje moći kroz pozitivan kontekst "power with" (Gaventa, 2009), odnosno, ostvarenje moći kroz suradnju i konsenzus, partnerstvo i procese kolektivnog djelovanja. Koordinacija odabranih gradskih ureda unutar urbano-okolišnog sektora svrstana je, sukladno Petersu (2004) na najnižu razinu negativne koordinacije, te sukladno Metcalfeu (1994), na četvrtu razinu koja isto spada u negativnu koordinaciju s obzirom na manjkavosti koje se očituju u: preklapanjima u obavljanju poslova, pri čemu se ističe nedostatak adekvatne koordinacije aktivnosti i projekata (izostanak strukturirane koordinacije) odnosno komunikacije (različite informacije, različite vizije, različite i nepovezane aktivnosti, nedostatak adekvatne baze podataka koju bi mogli koristiti svi uredi i sektori), kako unutar ureda i sektora (naglasak na nepostojanje adekvatne horizontalne koordinacije), tako i među sektorima (nepostojanje adekvatne međusektorske koordinacije), ali i spram civilnog sektora (u vezi programa i aktivnosti od zajedničkog interesa). Naposljetku, razina participacije u urbano-okolišnom sektoru prema Arnsteininoj gradaciji participacije spada u kategoriju tokenizma. Općenito, građane se ne potiče na preuzimanje aktivne uloge prilikom donošenja relevantnih odluka u domeni djelokruga lokalne samouprave kao ni na ostvarivanje partnerstva sa formalnim akterima. Sukladno klasifikaciji metoda participacije prema Anokye (2013), utvrđeno je prisustvo dominacije jednosmjernih uz ponešto dvosmjernih metoda participacije u kategoriji tokenizma. Navedeno upućuje na instrumentalni pristup (Hordijk, 2015) u participaciji neformalnih aktera koji, iako su uključeni u procese odlučivanja, nisu ravnopravni političkim akterima. Na tragu Arnsteininog (1969) poimanja moći, rezultati istraživanja s jedne strane ilustriraju moć kao asimetričnu (centraliziranu) odnosno hijerarhijsku (podređenost većine i zapovijedanje manjine) strukturu koju karakterizira koncentracija moći u samome vrhu upravljačke strukture (Ured Gradonačelnika), a što kod nekih formalnih kao i kod neformalnih aktera stvara osjećaj bespomoćnosti. S druge strane, nalazi ilustriraju moć kao procesnu, što je vidljivo kroz primjere suradnje među akterima koji ukazuju kako neformalni akteri višom razinom participacije u nekim slučajevima dovode uvriježene hijerarhije u pitanje. Međutim, pritom je isključivo riječ o partnerstvu, ali ne i o delegiranju moći ili pak građanskom nadzoru koje Arnstein svrstava u najviše razine građanske moći. ; The general purpose of the research presented in this thesis is to theoretically and empirically consider different models of urban governance based on the example of the environmental sector of the City of Zagreb. Particular attention is given to the opportunities and barriers to integrated urban governance with a focus on participation. The research engages with different theoretical approaches with the intention to have a holistic approach to the subject of research. The typology of urban governance developed by DiGaetano and Strom (2003) is utilized for the analysis and interpretation of types of governance present in the environmental sector of the City of Zagreb. Specifically with regard to integrated governance, the research encompasses horizontal integration – as a dimension of integrated governance – and particularly its two aspects: a) the dimension of integrated urban governance which implies more intensive and enhanced cooperation and coordination between formal actors within the city administration; and b) informal actors' participation in the decision making process and the process of creating public policies. The coordination of formal actors' is interpreted through public policies coordination theory by way of adopting successive levels of coherence implementation when shaping public policies as developed by Peters (2004). Metcalfe's (1994) approach to the analysis of public policies capacity coordination is also utilized as a diagnostic tool with the aim of determining the level of cooperation among the different city offices within the environment sector. With regard to capturing the participation of informal actors, the study utilizes Arnstein's (1969) typology of the level of participation, as well as the one-way and two-way classification of participation methods developed by Anokye (2013). In the context of this study, the redistribution of power between formal and informal actors is conveyed as a struggle between formal actors being in the position of power, and informal actors who through their activities question the boundaries and distribution of power. The research was designed as a case study of urban governance in the City of Zagreb. Semi-structured interviews and focus groups were conducted, and relevant legal and strategic documents were analyzed. The research has identified a hybrid governance model, more precisely, a corporate-clientelist model of urban governance. The governance model's specificities are reflected in the informal actors' distrust of local level administration, further emphasized through the conviction that the local administration relies on a clientelist agenda, lack of responsibility, and sectorial and pyramidical system of governance whereby the power resides in the highest echelons of city government. The highlighted findings are contrary to the model of integrated governance that presupposes empowerment through a positive context of "power with" (Gaventa, 2009), through cooperation and consensus, partnership and collective actions. The coordination of examined city offices within the sector of environment is categorized, according to Peters (2004), as the lowest level of negative coordination, and, according to Metcalfe (1994), on the fourth level, which also represents negative coordination, given the noted shortcomings: overlaps in activities conducted and specifically lack of adequate levels of coordinating activities and projects (lack of structured coordination), lack of communication (different information, different visions, different and disconnected activities, lack of an adequate database to be used by all offices and sectors), both within offices and sectors (lack of adequate horizontal coordination) as well as between sectors (lack of adequate inter-sectorial coordination), but in relation to the civil sector (with regard to programs and activities of common interest). Finally, the level of participation in the environment sector, in accordance with Arnstein's participation gradation, falls into the category of tokenism. Overall, citizens are not encouraged to assume active roles in the local administration's decision-making process or realize partnerships with formal actors. Based on Anokye's (2013) classification of participation methods, the study identifies the dominance of one-way participation methods and a handful of two-way participation methods in the tokenism category. This points to an instrumental approach (Hordijk, 2015) to the participation of informal actors', who, although involved in the decision-making process, are not equal to political actors. Drawing on Arnstein's (1969) understanding of power, the study illustrates, on one hand, power as asymmetrical (centralized) and hierarchical (subordination of majority, command of minority), characterized by the concentration of power at the top of the local government structure (Mayor's office), which, in turn, creates a feeling of helplessness both among certain formal as well as informal actors. On the other hand, the study results illustrate that power can also be understood as a process which is exemplified with instances of cooperation between actors showing that informal actors when achieving a higher level of participation bring established hierarchies into question. However, this is strictly reserved for partnership, and not for the delegated power or citizen control which are ranked by Arnstein as the highest levels of citizens' power.
