La Sustracción Internacional de menores, se encuentra regulado en el Convenio de la Haya de 1980, de la que Nicaragua es país suscriptor. En la estructura del Convenio se establece la normativa macro a seguir para que cada Estado firmante las adapte a su ordenamiento interno. Además presenta como finalidad la protección al derecho de custodia y de visitas que es violentado con respectoa uno de los progenitores por la persona que sustrajo al niño, niña y adolescente del lugar de residencia habitual. El Código de Familia, regula la sustracción internacionalde manera general y remite a los convenios internacionales. Se demuestra con este trabajo la existencia de más normativas que tienen que ser tomadas en consideración tanto en el derecho interno como en el plano internacional. Se estudiaron las autoridades competentes, las excepciones y la tendencia de estas en el plano nacional como internacional, mediante estudios de casos y lecturas de jurisprudencia internacional. Se dio a conocer el procedimiento administrativo ante la autoridad central y el procedimiento judicial así como las prácticas que hay que seguir para garantizar una correcta aplicación del Convenio de Sustracción; en la investigación se ha encontrado problemas de interpretación de las normas,por la pluralidad de leyes que confluyen en estos casos y que de manera obligatoria tienen que ser analizadas, al igual que el régimen jurídico relativo a la sustracción internacional del país de residencia habitual. Este análisis se debe de dar especialmente cuando se oponena la solicitud de restitución inmediata del niño, niña o adolescente,haciendo uso de las excepciones Especiales que para tal efecto establece el Convenio de La Haya de 1980, entre ellas tenemos; que no ejercía el derecho de forma efectiva el derecho de custodia al momento de la sustracción internacional, que el niño o niña en su expresión ante la autoridad judicial o sicológo expresa no querer regresar, lo que deberá ser valorado tomando en consideración su grado de madurez y la edad, la otra excepción es invocar el grave riesgo en la integridad física, sicológica y Situación intolerable para el niño o niña en caso de que regrese al lugar de residencia habitual.,y la última excepción es cuando no lo permitan los principios fundamentales del Estado requerido. Según ponencia del Dr. Ignacio Goicoechea, en la 5 conferencia dada sobre los conceptos claves del convenio de 1980, establece que la interpretación que se debe de dar al contenido del convenio en mención es restrictiva, posición que mantiene la jurisprudencia de Argentina y así lo indica el informe Perez Vera, en relación a la Interpretación del Convenio. En este trabajo se pretende establecer una guía del régimen jurídico aplicable y la necesidad de regular las particularidades que caracterizan este tipo de procesos en procura de respetar los derechos del niño, niña y adolescente. ABSTRACT: The Hague Convention of 1980, which Nicaragua is a signatory country, governs the International Child Abduction. In the structure of the Convention establishes rules to follow macro for each signatory State's suits its national law. It also features intended to protect the rights of custody and visitation that is violated with respect to one parent by the individual who abducted the child and adolescent the place of habitual residence. The Family Code regulates the international abduction and refers generally to international agreements. This work demonstrated the existence of more regulations that have to be taken into consideration both domestic law and international level. The competent authorities, exceptions and the tendency of these nationally and internationally, through case studies and readings of international jurisprudence were studied. It unveiled the administrative procedure before the central authority and the judicial procedure and practices to be followed to ensure proper application of Abduction Convention; research has found problems of interpretation of the rules, by the plurality of laws that come together in these cases and that obligatorily have to be analyzed, as well as the legal regime on the international abduction of the country of habitual residence. Die Arbeit "Der genetische Vater nichtehelicher Kinder" beschäftigt sich mit der Rechtsstellung und den Rechten von genetischen Vätern, die nicht mit der Mutter des gemeinsamen Kindes verheiratet sind. Ein Schwerpunkt der Arbeit ist der Untersuchung gewidmet, inwieweit die zivilrechtliche Lage den Vorgaben der Verfassung entspricht. Dabei wird berücksichtigt, dass die Auslegung des Grundgesetzes vom Wandel der Zeit beeinflusst wird und sich somit die Frage stellt, ob die Ausgestaltung des Familienrechts im BGB mit dem modernen Verfassungsverständnis des Art. 6 GG noch vereinbar ist. Der in Art. 6 GG niedergelegte Schutz der Väter erfährt seine zivilrechtliche Umsetzung in den §§ 1589 ff BGB. Diese haben wiederum ihre Prämisse darin, dass sie zwischen biologischer und rechtlicher Vaterschaft differenzieren. Unter biologischer Vaterschaft ist die genetische, rechtlich nicht anerkannte, Vaterschaft zu verstehen. Während diese biologische Vaterschaft ausschließlich durch die genetische (leibliche) Abstammung bestimmt wird, bedarf es für die Erlangung der rechtlichen Vaterstellung weiterer Voraussetzungen. Umgekehrt setzt die rechtlich anerkannte Vaterschaft nicht zwingend die genetische Verbundenheit voraus. Bezüglich der Rechte der genetischen Väter, die nicht mit der Mutter des Kindes verheiratet sind, kommt es dementsprechend entscheidend darauf an, ob der Erzeuger (genetischer Vater) auch rechtlich als Vater anerkannt ist. Demgemäß untersucht die Arbeit – unter Einbeziehung der verfassungsrechtlichen Ausgestaltung und deren Umsetzung im Familienrecht – zunächst die Bestimmung und Abänderung (Vaterschaftsanfechtung) der rechtlichen Vaterschaft und erörtert, ob und inwieweit ein Reformbedarf der zivilrechtlichen Ausgestaltung besteht. Im Anschluss – wiederum unter Einbeziehung der verfassungsrechtlichen Grundentscheidung – werden die Rechte der genetischen Väter ohne rechtliche Vaterstellung (biologische Vaterschaft) sowie die Rechte der genetischen Väter mit rechtlicher Vaterstellung, welche nicht mit der Mutter des Kindes verheiratet sind, näher besprochen und ebenso auf ihre Reformbedürftigkeit untersucht. Dargestellt wird jeweils ihre Rechtsstellung im Rahmen des Sorge-, Umgangs- und Auskunftsrechts, ihr Recht auf Klärung der genetischen Abstammung sowie das Recht, diese Klärung dem Kind mitzuteilen. Ferner wird ihre Stellung im Rahmen einer Adoption erörtert sowie untersucht, ob ihnen weitere Rechte in Bezug auf ihr Kind zustehen. Abschließend wird auf die Zulässigkeit von heimlichen Vaterschaftstests eingegangen und in diesen Zusammenhang die derzeitige Rechtslage sowie die rechtspolitische Entwicklung aufgezeigt. ; The doctoral thesis "The genetic father of illegitimate children" deals with the legal status and rights of genetic fathers that are not married to the mother of their child. The thesis mainly emphasizes the question, to what extent the civil law situation corresponds with the constitutional legal requirements. In this context, the author takes into consideration that the interpretation of the German Civil Code is subject to modifications in the course of time. Therefore, the question comes up if the legal definition of Family Law within the German Civil Code still conforms to the modern constitutional comprehension of Sec. 5 of the German Constitutional Law. The protection of the father defined in Sec. 6 German Constitutional Law is being implemented in Civil Law in the Sections 1589 ff German Civil Code. These Sections, in turn, have the premise that they differentiate between biological and legal paternity. Biological paternity is the genetic paternity that is not legally acknowledged. Whereas this biological paternity is solely defined by the genetic (biological) ancestry, for the legal paternity further requirements have to be fulfilled. In contrast, the legally acknowledged paternity does not have the compulsory requirement of genetic relatedness. With regard to the legal rights of the genetic fathers that are not married to the mother of their child it is accordingly decisive whether the genitor (genetic father) is also legally acknowledged as legal father. Accordingly, the thesis initially analyses the definition and modification (challenge of paternity) of the legal paternity by including the definition of Constitutional Law and its implementation in Family Law and discusses whether and to what extent there is a necessity of reform of the civil law definition. Subsequently, the legal rights of genetic fathers without legal paternity (biological paternity) as well as the rights of genetic fathers with legal paternity that are not married with the mother of their child are discussed in detail also including the definition of Constitutional Law and additionally tested for their necessity of reform. In this context, their individual legal status in connection with Right of Custody, Right of Visitation, Right of Disclosure, Right of Clarification of the genetic ancestry as well as the right to communicate this clarification to the child. Furthermore, the meaning of these rights in connection with adoption is discussed in detail and analyzed whether they have further rights in connection with their child. Finally, the legitimacy of covert paternity tests is discussed and, in this connection, the actual legal situation as well as developments in the legal framework are explained.

Das Gesetz stellt geistig behinderte und psychisch kranke Personen, die alle oder einzelne ihrer Angelegenheiten nicht gehörig besorgen können, unter besonderen Schutz. Dieser wird unter anderem durch die Möglichkeit der Bestellung eines Sachwalters für die betroffenen Personen gewährleistet. Dies hat jedoch zugleich einen weitgehenden Eingriff in ihre Selbstbestimmung zur Folge. Ein Teil des Wirkungskreises des Sachwalters umfasst die Personensorge, die als Pendant zur Vermögensverwaltung gilt. Gerade in diesem Bereich werden häufig höchstpersönliche Rechte der behinderten Person berührt. Aufgrund der Stellvertretungsfeindlichkeit dieser Rechte können auch Personen unter Sachwalterschaft grundsätzlich nur selbst über diese verfügen. Dies hat zur Folge, dass die Vertretungsmacht des Sachwalters in einzelnen Bereichen der Personensorge eingeschränkt und teilweise sogar gänzlich ausgeschlossen ist.Ziel dieser Arbeit ist es, die Grenzen dieser Vertretungsbefugnis und die Rechte und Pflichten des Sachwalters in ausgewählten Angelegenheiten der Personensorge aufzuzeigen. However, this guardianship leads to a restriction of people?s self-determination. Apart from the administration of property, personal care is also part of a guardian?s duties. Personal care especially concerns personal rights, which do not allow unlimited representation. This effects a restriction or even an exclusion of the guardian?s representative authority.This thesis deals with the guardian?s rights and duties in selected issues of personal care. In dieser Arbeit wird zunächst das Besuchsrecht als solches behandelt. Neben den verfassungsrechtlichen Grundlagen, werden unter anderem die Rechtsnatur des Rechtes auf persönlichen Verkehr, die damit einhergehenden Rechte und Pflichten und der Zweck des Besuchsrechts erläutert. Weiters wird auf mögliche Regelungsmöglichkeiten und Inhalte der Regelungen eingegangen. Ein Teil der Arbeit widmet sich auch dem Verfahren in Besuchsrechtssachen. Hier werden die Themen der gerichtlichen Zuständigkeit, der Parteistellung, der Grundsätze im Verfahren und vor allem der Durchsetzung des Besuchsrechts umrissen. Der Schwerpunkt der Arbeit befasst sich dann mit den möglichen Rechtsfolgen, die bei der Beeinträchtigung des Besuchsrechts drohen können. Dargestellt werden dabei die möglichen Folgen sowohl für den betreuenden und den nicht mit dem Kind im gemeinsamen Haushalt lebenden Elternteil, als auch für das Kind. Behandelt werden dabei informationsrechtliche, erbrechtliche, obsorgerechtliche, besuchsrechtliche, unterhaltsrechtliche, schadenersatzrechtliche und strafrechtliche Konsequenzen für die jeweiligen Beteilgten. Im letzten Teil der Arbeit wird auf die Änderungen des geplanten Kindschaftsrechtsänderungsgesetzes 2012 eingegangen. Die Änderungen, die im aktuellen (Juni 2012) Entwurf zu dem geplanten neuen Gesetz verankert sind, werden in diesem Teil dargestellt und bewertet. Die Arbeit soll aufzeigen, wie das österreichische Recht auf persönlichen Verkehr nach der derzeit geltenden Rechtslage ausgestaltet ist, welche möglichen Rechtsfolgen bei einer Beeinträchtigung dieses Rechts eintreten können und wie der Gesetzgeber plant, das Kindschaftsrecht und insbesondere das Besuchsrecht, zu reformieren. ; This thesis deals with the subject of visiting rights in detail. Starting with constitutional basis, this paper also explains the legal nature of the right to have personal relations, as well as the rights and obligations pertaining this status that go with it. In addition, some possible regulatory options and contents of these regulations are presented.The first part of this paper also deals with the proceeding in the field of visiting rights. In this part, topics of jurisdiction, parties to the proceeding, core principles within the proceeding, and, of course, the enforcement of visiting rights, are introduced.The main part of this thesis deals with possible legal consequences which might follow any infringement of the visiting rights. Possible consequences are portrayed, for the child as well as for the parent not sharing the same household with the child. This part of the paper explains the rights to information, inheritance, custody, alimony, damage compensation, criminal law consequences, and visiting rights for each party involved. In the final part, this paper explains expected changes within the Children's Rights Reform Law of 2012. This section portrays and evaluates the changes within the latest draft (June 2012) for the new law. This dissertation examines the centrality of symbolic and actual children to the transnational processes that propelled the 1959 Cuban Revolution and the subsequent formation of the US resident Cuban exile community. It argues that the bodies and symbolic representations of children were pressed into "nation-making" service by a Revolution that sought to fulfill Cubans' frustrated dreams of democratic governance, social equality, and national autonomy; however, as it turned swiftly towards socialism and the USSR in 1960, the state's imposition of new understandings and practices of childhood challenged Cuban middle class and Catholic values and traditions, provoking resistance to the new regime and sparking a massive exodus to southern Florida. Arriving in the United States at the height of the Cold War, Cuban refugees relied heavily upon child-centered anti-communist discourse to secure favorable treatment from the federal, state and municipal agencies and actors that oversaw their immigration and settlement. They and their US allies also made strategic use of representations of children to garner support from Miami's Anglo-American majority, many of whom were initially distressed by the rapid influx of Cuban refugees but sympathized with their Christian and middle class family values and anti-communist politics. Exiles thus developed a child-centered "creation myth" that explained their community's origins even as it promoted social coherence among a rapidly expanding but politically fragmented exile population. Children were similarly at the heart of exile leader's efforts to mobilize opposition to Fidel Castro's socialist Revolution and to elicit US support for their counter-revolutionary efforts and democratic-capitalist vision of their island nation's future. By 1962, when the resolution of the October Missile Crisis secured both the long-term viability of the Cuban Revolution and the indefinite extension of exiles' sojourn in the United States, struggles to define, control and make symbolic use of Cuban childhood had become inextricably intertwined with the mutually antagonistic ideologies and "nation-making" projects of the island and exilic Cuban communities. This "politics of childhood" resurfaced dramatically during the heated 1999 Elián González custody battle, revealing its ongoing importance to revolutionary and exilic community identities and to relations between the Cuba and the United States

It is estimated that approximately 8 to12% of all youth can be classified as severely emotionally disturbed (SED) (Costello, Egger, & Angold, 2005; Kessler et al., 2012). These youth exhibit a wide range of mental health disorders and symptoms (e.g., depression, anxiety, difficulty with emotion regulation or executive functioning) (Costello et al., 2005), and the extent to which to which their functioning is impaired by these symptoms and challenges varies widely (Williams, Scott, & Aarons, 2017). Only 25% of any of these children and adolescents ever access any outpatient mental health treatment (Costello et al., 2005; Costello, Messer, Bird, Cohen, & Reinherz, 1998) and even fewer obtain the intensive Home and Community-Based Services (HCBS) needed to keep youth with the most significant impairments safely in their home and communities (Owens et al., 2002; Spiker, 2017). Home and Community-Based Services (HCBS) often include in-home therapy, case management, or therapeutic behavioral support services (Kernan, Griswold, & Wagner, 2003; Marcenko, Keller, & Delaney, 2001). Without HCBS, youth with the most significant behavioral healthcare needs are at greater risk for chronic or long-term placement in a residential setting in either a psychiatric, correctional, or foster placement (Hansen, Litzelman, Marsh, & Milspaw, 2004; Knitzer & Olson, 1982; Narrow et al., 1998). Many families cite expense and lack of sufficient health coverage as barriers to service use (Owens et al., 2002; Spiker, 2017). The only type of health coverage that routinely covers HCBS is Medicaid (Howell, 2004), leaving these services mostly inaccessible to families whose incomes are above the Medicaid means-test limits. In order to access public health insurance to fund the intensive mental health care needed for their child, many parents relinquish custody to the state—either through the child welfare or juvenile justice system (U.S. Government Accountability Office, 2003).States use a variety of policy interventions to reduce income barriers to HCBS for these youth, including Medicaid waivers, the TEFRA provision, and State Plan Amendments (Friesen, Giliberti, Katz-Leavy, Osher, & Pullmann, 2003; Ireys, Pires, & Lee, 2006). However, little is known about these strategies or state motivations for choosing one policy over another. Limited evaluation also exists regarding their relative effectiveness at meeting the needs of these youth and their families. Having knowledge of the variety of policy tools available to states and how states utilize these tools, as well as the factors that increase the likelihood that a state will opt to use a particular tool, will allow future research to control for such variables, and better discern the effects of the policy on state level mental health system outcomes. This two-part mixed methods study aims to discern state policies that are more and less effective at reducing access barriers to home and community-based mental health care for non-Medicaid eligible youth with SED. The first, qualitative portion of the study aims to 1) identify policy mechanisms utilized by states to deliver HCBS to youth with SED and their families, particularly for youth whose family income disqualifies them for Medicaid and 2) understand what motivates State Mental Health Authorities and Medicaid Agencies to utilize current policy tools and structures for HCBS delivery for both Medicaid and non-Medicaid eligible youth with SED. The second, quantitative analysis seeks to 1) assess the relationship between a state's use of a Medicaid waiver and the odds that a youth with SED will have public health coverage, 2) assess the relationship between public health coverage and unmet mental health care needs and cost barriers to care for youth with SED, and 3) assess the direct relationship between a youth's residence in a state with a Medicaid waiver, and the odds that the youth will have unmet mental health care needs and cost barriers to care.Part I of this study gathered qualitative data through semi-structured interviews with officials from 32 state mental health systems about policy tactics for funding and delivering HCBS to Medicaid and non-Medicaid eligible youth with SED in their state. Interviews also gathered information about each state administration's motivation and history that shaped the use of current HCBS policies for this population. Part II of the study utilized data created from information and observations in Part I in conjunction with data from the National Survey for Children with Special Health Care Needs from 2009/2010. Multi-level, random-intercept logistic regression models assessed the relationship between Medicaid waivers and unmet mental health care needs and cost barriers to treatment for youth with SED. Results indicate that states use many strategies for funding and organizing care for the non-Medicaid eligible population of youth with SED, but that strategies generally involve the allocation of state general revenue funds or the use of a policy that expands the financial eligibility limits of Medicaid for children. Reasons for the use of each approach are most related to the size and flexibility of Medicaid budgets, political prioritization of children and families, and political ideology related to the role of the state in providing for the welfare of children and families. The quantitative analysis found that policies expanding financial eligibility for Medicaid were related to reductions in cost-related barriers to treatment, even controlling for the mediating effect of these policies in changing the insurance status of children. However, the use of these policies and a child's coverage under public health insurance was not significantly predictive of reduced odds of having unmet mental health care needs. By controlling for the severity of a child's mental health care needs, and the interaction between their level of need and type of health insurance coverage, this analysis also highlighted the role of clinical severity in unmet treatment needs and barriers to care and the ways in which public insurance moderated this relationship.This study concludes that, though states have many means of funding care for non-Medicaid eligible youth with complex behavioral healthcare needs and have various reasons specific to state environments for choosing a particular approach, states with policies that allow children to more easily access Medicaid appear to have fewer families experiencing cost barriers to mental health services. However, these state policies do not address other, unknown barriers to obtaining mental health services for families in their states. Expansion of Medicaid eligibility for children can help to reduce unmet need due to financial obstacles but does not solve all problems related to service accessibility. Additional barriers to treatment access must be identified at the individual, organizational and policy levels for children with all levels of clinical need. Policies and practices aimed at reducing these must be identified and implemented in the manner most suitable and applicable to the unique political, fiscal, and structural concerns of each state and community. Then, these practices and policies must be rigorously evaluated for effectiveness in achieving equitable access to high quality and effective mental health treatment for all children with behavioral health concerns.

The Court Jurisdiction and Proceedings Transfer Act might easily have been two statutes rather than one. There could have been a pair of uniform acts, one delineating the territorial competence of the provinces' superior courts and the other implementing a regime for the cross-border transfer of court proceedings. After all, these two matters are neither logically interdependent nor especially tightly linked. Part 3 of the CJPTA, dealing with transfers of proceedings, is not confined to lawsuits where the initial court takes jurisdiction under Part 2. It applies regardless of whether the initial court bases its jurisdiction on the CJPTA or on some other legislation, such as a specialized family law statute. Indeed, it applies when the transferring court does not have territorial competence at all. While the matters dealt with, respectively, in Parts 2 and 3 of the CJPTA certainly fall within the broad domain of private international law, they are no more closely affiliated than other fields where the CJPTA's progenitor, the Uniform Law Conference of Canada ("ULCC"), elected to deal with matters in discrete statutes. For example, the ULCC chose to address cross-border enforcement by drafting separate uniform acts dealing with recognition of (1) Canadian civil judgments, (2) foreign-country civil judgments, (3) international arbitral awards, (4) foreign subpoenas, (5) foreign maintenance and custody orders, (6) foreign child welfare orders, and (7) foreign judgments based on a contract containing an exclusive forum-selection clause. In short, the ULCC has not been in the habit of drafting sweeping, comprehensive uniform acts but rather has elected to advance in increments. It has been a splitter, not a lumper.

Rezultātā autore izdara secinājumu, ka mediācijas definīcija ir pretrunā ar konsultēšanas funkciju un to nav iespējams veikt Latīņu tipa notariāta valstī. Darba autore iesaka mediācijas vietā lietot jēdzienu samierināšana un veikt grozījumus Notariāta likumā. Trešajā nodaļā darba autore apskata vienošanās par kopīgā nepilngadīgā bērna aizgādību, saskarsmes tiesībām, bērna uzturlīdzekļiem un kopīgās mantas sadali(turpmāk-vienošanās) notariāla akta formā priekšrocības un izvērtē, vai likumdevējs ir bijis konsekvents nenosakot vienošanai obligātu notariāla akta formu. Izpētes rezultātā autore secina, ka likumdevējam vienošanai jānosaka obligāta notariāla akta forma un iesaka veikt grozījumus Notariāta likumā. ; In the first section of the thesis the author reviews the functions performed by the notary in the divorce matter. In the second section the author reviews mediation as the function performed by the notary in the divorce matter, analysing whether the mediation under the classical interpretation does not contradict with the consulting function of the notary. As a result the author concludes that the definition of the mediation contradicts to the consulting function and it may not be performed in the state of the Latin notary. The author of the thesis proposes using the term "reconciliation" instead of "mediation" and make amendments to the Notariate Law. In the third section of the thesis the author reviews the advantages of the agreement for custody of the joint minor child, rights of access, child's means of support and division of the joint property in the form of the notarial act and evaluates whether the legislator has been consequent in not making

My thesis explores the experiences of women who suffered from mental disorder related to childbirth and pregnancy, looking in particular at Dundee, Fife and Forfarshire in the north-east of Scotland, during the period 1820 to 1930. This study offers a new perspective on women's lives, wellbeing and healthcare in this region by examining at a local level the ideas surrounding postpartum mental illness. By the mid-nineteenth century, the term 'puerperal insanity' was widely known and much discussed and deliberated in medical literature. However, the day-to-day care and treatment of postpartum women suffering from mental disorder was not straightforward. My findings demonstrate that the diagnosis and treatment of postpartum mental illness in nineteenth- and early twentieth-century Scotland was a complex issue influenced as much by social and economic factors as by medical ideas. Using records from the chartered asylums at Montrose and Dundee, court and prison records, and newspaper accounts, I have uncovered how childbearing-related mental illness was recognised, accepted and supported by families, neighbours, friends and authorities. Within the asylum, I have revealed how physicians assessed their patients' characters and status as much as their physical conditions, but nevertheless in many cases provided positive medical care and much-needed rest and nourishment. In criminal cases, my study has looked beyond legislation and verdicts to reveal a positive and constructive approach to the care and custody of women who had committed child murder. Awareness of postpartum mental illness in the community was developed through a collaboration of medical and lay knowledge, acquired through interactions between physicians, families and communities, and filtered through pre-existing understandings and ideas. I have identified a lay understanding and accepted discourse which guided the ideas and actions of friends, family and community in dealing with the problems associated with mental illness among postpartum women.
