Günter Jakobs, ¿el enemigo del derecho penal?

Abstract

El llamado "Derecho Penal del Enemigo" propuesto por el Prof. Günter Jakobs recientemente, ha generado en la Doctrina penal internacional una estrepitosa reacción. Empero dicha reacción no ha tenido el efecto esperado; es decir, que los gritos de alarma de la comunidad jurídica se han ahogado en una serie de injustas caracterizaciones hacia la figura del autor más que en una seria alternativa de cambio a un Derecho Penal que se expande impredeciblemente. Por ello el presente trabajo pretende ser, por un lado, una férrea oposición a dicha teoría, por ser ésta incompatible con el Estado de Derecho, y a su vez la manifestación que el "Derecho Penal del Enemigo" existe, pero que éste no se encuentra personificado en el autor, si no, en las legislaciones marcadas por un excesivo punitivismo y por la reducción de las garantías individuales, consentidas o propugnadas desde varios sectores de la sociedad. / This "Criminal Law of the Enemy" (or Criminal Law for the Enemy), recently suggested by Professor Günter Jakobs, has generated a defeaning reaction in the international criminal law. But that reaction hasn't had the expected effect; it means, the alarm screams of the juridical comunity have sunk in a sort of unfear characterizations towards the character of the author more than in a real option of changing towards an unpredictable and expanding Criminal Law. That's why, this article pretends to be, in some way, a severe opposition to that theory, for being uncongenial with the Democratic State, and, at the same time, the expression that "Criminal Law of the Enemy" does exist; althout it is not personified in the author, but in the legislation distinguished for an excesive punishment and the reduction of individual guaranties, accepted y proposed from different parts of society.
