Abstract

The reasoning developed in the nullity ruling show that the grounds for nullity contained in Labor Code's article 477, about breach of law that that influences the resolution of the ruling, specifically in the hypothesis of false application of law, could subsume the grounds of nullity contained in Labor Code's article 478 c), that is the alteration of the legal category of the facts without changing the factual findings of the lower court, because the latter is merely the result of a defective legislative technique and its scope can not be differentiated from the first grounds of nullity. ; Los razonamientos desarrollados en el fallo de invalidación demuestran que la causal de nulidad contenida en el artículo 477 del Código del Trabajo, sobre infracción de ley que influye en lo dispositivo del fallo, específicamente en la hipótesis de falsa aplicación de ley, podría subsumir la causal de nulidad contenida en artículo 478 letra c) del mismo cuerpo legal, esto es, la alteración de la calificación jurídica de los hechos, sin modificar las conclusiones fácticas del tribunal inferior, ya que ésta última no es más que el resultado de una defectuosa técnica legislativa y su ámbito de aplicación no se puede diferenciar de la primera, al existir una relación de género a especie entre ambas.
