Abstract

During the '90s and in the context of broad economic and political reforms aimed at opening markets, promoting foreign investment, and the attack of the troublesome endemic inflation Argentine Governments held numerous bilateral treaties of investment (TBI). According to the TBI, it is possible to get the international responsibility of the host State of the investment by the dictates of an arbitral award in the framework of the institutional of the ICSID or by the dictates of an award by an "ad hoc" arbitration. Breach by the signatory of a TBI of any of its provisions can lead to that State responsibility for breach of its international obligations. ; Durante los años '90 y en el marco de amplias reformas económicas y políticas dirigidas a la apertura de los mercados, promoción de inversiones extranjeras, y al ataque de la problemática endémica inflación del país, los gobiernos argentinos celebraron numerosos tratados bilaterales de inversión (TBI). De acuerdo con lo establecido en los TBI, es posible obtener la responsabilidad internacional del Estado receptor de la inversión mediante el dictado de un laudo arbitral en el marco del institucional del CIADI o mediante el dictado de un laudo por parte de un arbitraje "ad hoc". El incumplimiento por parte del Estado signatario de un TBI de alguna de sus cláusulas puede acarrear la responsabilidad de dicho Estado por incumplimiento de sus obligaciones internacionales.
