Abstract

La investigación fue una gran desconocida en la Europa comunitaria, al menos a nivel de Derecho originario, hasta que el Acta Única Europea (AUE), en virtud de lo dispuesto en su artículo 24, introdujo un Título VI, que llevaría por rúbrica "Investigación y desarrollo tecnológico" (artículos 130 F a 130 Q), a la Tercera Parte del TCEE. En el presente trabajo se estudia el desarrollo que ha experimentado esta materia hasta ocupar la posición clave que ocupa hoy en el dispositivo de actuación de la Unión Europea. Asimismo, se aborda el estudio de los distintos preceptos (artículos 179 a 189) que hoy confi guran el Título (XIX) del Tratado del Funcionamiento de la Unión Europea (TFUE) dedicado a la investigación y al desarrollo tecnológico dando cuenta de los instrumentos y herramientas que dispone. Y, por último, se analiza la novedad que ha introducido este Tratado vinculado a la I+D, esto es, el Espacio (artículo 189 TFUCE, que constituye el germen de una nueva política de la Unión.Research was largely unknown in the European community, at least at the level of primary legislation, until the Single European Act (SEA), under the provisions of Article 24, added to the third part of the EC Treaty a new Title VI called 'Research and technological development' (Articles 130 to 130 F Q). Since then to nowadays this subject has experienced a great development and it plays a key role among the European Union policies. The present paper provides an overview of that evolution and it also analyses the various provisions (Articles 179 to 189) that today make up the Title XIX of the Treaty on the Functioning of the European Union (TFEU) dedicated to research and technological development, analysing all their means and measures. And fi nally, the introduction of Space in the Article 189 of the TFEU is examined as the seed of a new European Union policy.
