THE ORGANIZATION OF THE PUBLIC ORDER PROTECTION OF THE NATIONAL GENDARMERIE OF FRANCE AND THE POSSIBILITY OF ITS USE IN THE NATIONAL GUARD OF UKRAINE ; ОРГАНІЗАЦІЯ ОХОРОНИ ГРОМАДСЬКОГО ПОРЯДКУ НАЦІОНАЛЬНОЇ ЖАНДАРМЕРІЇ ФРАНЦІЇ ТА МОЖЛИВОСТІ ЇЇ ВИКОРИСТАННЯ У НАЦІОНАЛЬНІЙ ГВАРДІЇ УКРАЇНИ

Abstract

The activity of the French National Gendarmerie in the law enforcement sphere was analyzed in the article. In France, law enforcement bodies operate in the system of executive authorities, covering such spheres of public relations as internal affairs, finance, economics, defense, etc. Analyzing the structure and organization of law enforcement agencies in France, it should be noted that, unlike the UnitedKing dom, this state has two types of national police forces: 1) National Police and 2) National Gendarmerie.The main functions performed by the National Guard of Ukraine are: protection of public order, protection and protection of life, health, rights, freedoms and legitimate interests of citizens. The development and reformation of the National Guard of Ukraine, due to the need to develop new approaches, makes use of the best foreign practices to ensure the protection of citizens and ensure public order. An important role in this task is given to the units of the mobile gendarmerie. Mobile Gendarmerie is one of the units of the National Gendarmerie of France, which performs tasks of maintaining public order, namely security during mass events, detention of offenders, their convoy, escort, defense of diplomatic missions of France in other countries.Now, the problem of effective organization of public order protection by theun its of the National Guard of Ukraine remains unresolved, as there is an urgent need for a radical reorganization of the patrol service. ¬e French model of law enforcement has both its own special features and the general characteristics that are inherent in law enforcement systems in many European countries. The specificity of the gendarmerie, as a special military formation, is confirmed by the fact that Austria, Spain, Italy, France, which reduce the number of their armed forces, thenumber of ge ndarmes, on the contrary, increases. ¬erefore, in France, the construction of public safety services is characterize by the presence of units designed to strengthen the police functions of public order.ьRecommendations are made to use the experience of organizing a service for the protection of public order of the National Gendarmerie of France by units of the National Guard of Ukraine. ; У статті проведений аналіз діяльності Національної жандармерії Франції у правоохоронній сфері. У Франції правоохоронні органи функціонують у системі органів виконавчої влади, охоплюючи такі сфери суспільних відносин, як внутрішні справи, фінанси, економіка, оборона тощо. Аналізуючи структуру та організацію правоохоронних органів Франції, слід відмітити, що ця держава, на відміну від Великої Британії, має аж два види національних поліцейських сил: Національну поліцію та Національну жандармерію.До основних функцій, які виконує Національна гвардія України, належать: охорона громадського порядку, забезпечення захисту та охорони жит-тя, здоров'я, прав, свобод і законних інтересів громадян. Розвиток та реформація Національної гвардії України у зв'язку з необхідністю розробки нових підходів зумовлює використання кращих іноземних практик щодо забезпечення захищеності громадян та забезпечення публічного порядку. Важлива роль у виконанні цього завдання відводиться підрозділам мобільної жандармерії. Мобільна жандармерія – один із підрозділів Національної жандармерії Франції, який виконує завдання по підтриманню громадського порядку, а саме забезпечення безпеки під час проведення масових заходів, затримання порушників, їх конвоювання, супроводження, захист дипломатичних представництв Франції у інших країнах.На сьогодні проблема ефективної організації охорони громадського порядку підрозділами Національної гвардії України залишається невирішеною, адже існує актуальна необхідність кардинальної перебудови патрульної служби. Французька модель правоохоронних органів має як свої особливі риси, так і загальні характеристики, які притаманні правоохоронним системам багатьох країн Європи. Специфіку жандармерії як особливого військового формування підтверджує те, що Австрія, Іспанія, Італія, Франція, які знижують чисельність своїх збройних сил, чисельність жандармерії навпаки збільшують. Так у Франції побудова служб громадської безпеки характеризується наявністю підрозділів, покликаних посилювати поліцейські функції забезпечення громадського порядку. Запропоновані рекомендації використання досвіду організації служби з охорони громадського порядку Національної жандармерії Франції підрозділами Національної гвардії України.
