Abstract

National security and protection ofcitizenship of Ukraine: realities of the present, prospectsfor the future. – Article.The offered scientific article clarifies that temporaryoccupation of national territory is one of the mainreasons for the decrease in the population of Ukraine. Itis also noted that the act of aggression of the RussianFederation against Ukraine has led and is leading tothe acquisition by the citizens of Ukraine of alternativecitizenship of another state, which is also a threateningnational security challenge. The policy of the state in thefield of protection of citizenship in the circumstancesof temporary occupation of part of the state territory ofUkraine requires a concentrated dualism, in particularconceptual-national and constructive-internationalapproaches. It is established that in the current conditionsthe protection of Ukrainian citizenship is an objectivereaction of a sovereign state to external challenges. Thisinvolves the development of the Concept of legal policyof the state in the field of protection of citizenship inthe circumstances of temporary occupation of part ofthe state territory of Ukraine from threats to nationalsecurity, development of new and improvement of theexisting legal framework in this area and also the judicialsystem, in particular by ratifying the Statute of theInternational Criminal Court. Ukraine's participation ininternational governmental organizations and accessionto international agreements provides a number ofopportunities to use the international human rightsnetwork as an additional effective tool to influencethe protection of citizenship in the circumstances ofthe temporarily occupied territory of Ukraine, whichsignificantly increases ability and effectiveness of itsimplementation. ; Кінаш Н. Національна безпека та захист грома-дянства України: реалії сьогодення, перспективи май-бутнього. – Стаття.У статті з'ясовано, що однією з основних причинзменшення чисельності населення України є тим-часова окупація національної території, а також за-значено, що акт агресії Російської Федерації протиУкраїни призвів та призводить до набуття громадя-нами України альтернативного громадянства іншоїдержави, що також є загрозливим викликом у сферінаціональної безпеки. Політика держави у сфері реа-лізації захисту громадянства за обставин тимчасовоїокупації частини державної території України вима-гає концентрованого дуалізму, зокрема концептуаль-но-національного та конструктивно-міжнародногопідходів. Установлено, що у нинішніх умовах захистгромадянства України є об'єктивною реакцією суве-ренної держави на зовнішні виклики. Це передбачаєрозроблення Концепції правової політики державиу сфері захисту громадянства за обставин тимчасо-вої окупації частини державної території Українивід загроз національній безпеці, вироблення новоїта вдосконалення чинної нормативно-правової базиу цій сфері, а також судової системи, зокрема шля-хом ратифікації Статуту Міжнародного криміналь-ного суду. Участь України у міжнародних урядовихорганізаціях та приєднання до міжнародних угоднадає низку можливостей для використання міжна-родної правозахисної мережі як додаткового дієвогоінструментарію впливу на захист громадянства за об-ставин тимчасово окупованої території України, щозначно підвищує здатність та результативність йогореалізації.
