Abstract

One of the main functions of the state is the legal regulation of heterogeneous spheres of social relations. For this purpose, certain rules are set, acceptable ways of behavior of different subjects, rights and obligations. Legal regulation covers most areas of public relations. Including the functioning of the armed forces, other armed formations, law enforcement forces.With the introduction of a legal regime of a state of emergency in the country, public authorities must move to special management methods. Special methods of legal regulation of social relations are used in many spheres of life. Their application is justified by the lack of customary remedies to ensure the functions entrusted to the State. At the same time, the regulatory influence of state institutions on public relations increases, the constitutional rights and freedoms of citizens and legal entities are restricted, and the usual regime of work of the authorities is changing. The detailed legal regulation of the conditions and procedure for the introduction and implementation of measures of the legal regime of a state of emergency should become an obstacle and prevent possible manifestations of abuse by the state authorities and their officials. This approach will provide adequate guarantees, acceptable in a democratic society, that are capable of guaranteeing the effective functioning of all state institutions and respecting the fundamental rights and freedoms of citizens.The purpose of the article is to summarize and analyze the legal acts currently in force in Ukraine. This will form the basis for further scientific study of the military command system of the National Guard of Ukraine under the conditions of introduction of a state emergency regime in the state. The final result should be to develop a methodology to justify the rational composition, activities and functional structure of the specified management system, one of the main functions of which is to perform tasks in the area of emergency. ; Проведено аналіз чинних нормативно-правових актів, які регулюють діяльність Національної гвардії України у взаємодії з іншими складовими сектору безпеки і оборони держави під час виконання завдань за правового режиму надзвичайного стану. На основі узагальнення та оцінки спеціальних норм права, що регулюють указану сферу суспільних відносин, викладено погляди і надано пропозиції щодо вдосконалення нормативного регулювання такої діяльності.
