ПРОЦЕССУАЛЬНЫЕ ОСОБЕННОСТИ РАССМОТРЕНИЯ ЗАЯВЛЕНИЙ О ВОЗВРАЩЕНИИ РЕБЕНКА ИЛИ ОБ ОСУЩЕСТВЛЕНИИ В ОТНОШЕНИИ РЕБЕНКА ПРАВ ДОСТУПА НА ОСНОВАНИИ МЕЖДУНАРОДНОГО ДОГОВОРА РОССИЙСКОЙ ФЕДЕРАЦИИ

Abstract

Статья посвящена анализу изменений, внесенных в Гражданский процессуальный кодекс Российской Федерации Федеральным законом от 5 мая 2014 г. № 126-ФЗ «О внесении изменений в отдельные законодательные акты Российской Федерации в связи с присоединением Российской Федерации к Конвенции о гражданско-правовых аспектах международного похищения детей». Отмечаются основные процессуальные особенности рассмотрения дел по искам о возвращении ребенка или о праве доступа к нему. ; The article analyzes the process of implementation of the Convention on the Civil Aspects of International Child Abduction, 1980 in the system of the Russian legislation. The specified Hague convention came into force for Russia on October 1, 2011. The federal law No. 126-FZ of May 5, 2014 made changes to the Civil Procedure Code of the Russian Federation, the Family code of the Russian Federation, the Federal law "On bailiffs", the Federal law "On executive production", and also to the Law of the Russian Federation "On private detective and security activity". The Code of Civil Procedure of the Russian Federation is added with new chapter 22.2 "Production on applications for return of the child or on the implementation of the rights of the child on the basis of an international agreement of the Russian Federation". This chapter contains nine articles which establish the following procedural features: 1) the statement about the return of a child or realization of rights to access him/her is subject to consideration in a court in a lawsuit production; 2) the right to apply for return of a child belongs to the child''s parents, other persons who consider that their rights have been violated by the defendant in respect of the child, as well as prosecutor (Part 1, Article 244.11); 3) the law defined a special tribal jurisdiction in the specified categories of cases (Part 2, Article 244.11); 4) the reduced procedural terms for trial on the merits (Part 2, Article 244.15), for the appeal of a judgment and consideration of the case of appeal instance by court (article 244.17), and also for sending copies of court rulings (Article 244.19); 5) Part 1, Article 244.15 states the investigated cases are to be heard with obligatory presence of the Department of Custody and Guardianship authorities and the prosecutor; 6) under this category of cases, the new regulations do not permit several requirements and counter-claims (Article 244.14); 7) one of the novels of procedural law is the establishment of new types of interim measures: the defendant is prohibited to change the place of residence of the child and temporarily restrict the child''s departure from the Russian Federation before the the court verdict on the case for the return of the child or on the exercise of the rights to access comes into force (Article 244.13), etc. In conclusion, the author claims that many questions on the topic are still not accounted for by legislators. A number of provisions of the Russian legislation conflicts with the international standards in the field of protection of the rights of the child. Therefore, for the effective implementation of the 1980 Convention, it is necessary to bring domestic laws into conformity with its provisions.
