Abstract

В процессе производства и распределения продукции военного назначения происходит вовлечение в гражданский оборот основной части результатов интеллектуальной деятельности, созданных в Российской Федерации и бывшем СССР. Анализ законодательных актов, позволяет сделать вывод, что принадлежность прав на результаты научно-технической деятельности военного, специального и двойного назначения определено постановлением Правительства РФ «О первоочередных мерах по правовой защите интересов государства в процессе экономического и гражданско-правового оборота результатов научно-исследовательских, опытно-конструкторских и технологических работ военного, специального и двойного назначения». ; In the process of production and distribution of goods for military use is the involvement in civil circulation of the results of intellectual activity created in the Russian Federation and the former Soviet Union. Analysis of legislative acts, leads to the conclusion that ownership of the rights to the results of scientific and technological activities of military, special and dual-use goods is determined by resolution of the Government of the Russian Federation "on priority measures for the legal protection of the interests of the State in economic and civil traffic results of research, development and technological works, special military and dual-use goods".
