This book addresses the impact of migration on the formation and transformation of identity and its continuous negotiations. Its ground is the understanding of identity as a complex social phenomenon resulting from constant negotiations between personal conditions, social relationships, and institutional frameworks. Migrations, understood as dynamic processes that do not end when landing in the host country, offer the best conditions to analyze the construction and transformation of social identities in the postcolonial and globalized societies. Searching for novel epistemologies and methodologies, the research questions here addressed are how identity is negotiated in migration processes, and how these negotiations work in contemporary multiethnic Europe. This edited volume brings to the field a novel convergence of theoretical and empirical approaches by gathering together scholars from different countries of Europe and the Mediterranean area, from different disciplines and backgrounds, challenging the traditional discipline division.

The hyperconnection, de-escalation and acceleration of social life that characterise globalisation mean that the concepts of territory, border and belonging to the political community are remarkable. While capital, business and tourism are becoming increasingly transnational, in the era of globalisation, walls, fences and restrictive migration policies are proliferating, putting migrants in a particularly vulnerable situation. The perspective of intersectionality makes it possible to identify both the situations of particular vulnerability of migrants — at the intersection of multiple generalised and racialised structures of migration — and the interconnection between the various factors that define the situations of power and privilege in a dynamic manner. Putting the focus on the negotiation of identity in migration processes from this perspective makes it possible to see a space for redefining resilience and the individual agency. This article argues that the preliminary position of 'living between borders' can create fertile ground for rethinking the basic concepts of social organisation, abandoning outdated concepts. intersectionality as a paradigm has become increasingly popular at the English-speaking academy over the last 25 years. Here are a brief illustration of their conceptual origins and their connection with anti-hegemonic feminist theories. It is highlighted as originating in the framework of Critical Legal Studies in the US socio-legal context of the 70s. Intersectionality is presented as an analytical category to identify how the intersection of social structures (gender, sexuality, race, nationality, class, dis-ability) leads to complex situations of discrimination that are maintained and replicated at both structural, political and discursive levels. La hiperconexión, desterritorialización y aceleración de la vida social que caracterizan la globalización implican una resignificación de los conceptos de territorio, frontera y pertenencia a la comunidad política. Mientras capitales, negocios y turismo son cada vez más transnacionales, en la era de la globalización proliferan muros, vallas y políticas migratorias restrictivas que ubican a las personas migrantes en situación de especial vulnerabilidad. La perspectiva de la interseccionalidad permite identificar tanto las situaciones de especial vulnerabilidad de las personas migrantes –en la intersección de múltiples estructuras generizadas y racializadas de exclusión– como la interconexión entre los distintos factores que definen las situaciones de poder y privilegio de manera dinámica. Poner el foco en la negociación de la identidad en los procesos migratorios desde esta perspectiva permite vislumbrar un espacio para redefinir la resiliencia y la agencia individual. La interseccionalidad nació como herramienta para los análisis críticos del derecho. Permitió identificar la multiplicidad de interacciones entre las causas de exclusión social, como el género, orientación sexual, raza, religión, origen nacional, (dis)capacidad y estatus socioeconómico entre otras, arrojando luz sobre los mecanismos de poder y privilegio en las relaciones sociales. La interseccionalidad como concepto jurídico ha ganado popularidad creciente en la academia de habla anglosajona en los últimos veinticinco años y, sin embargo, ha tenido difusión desigual en los diferentes contextos socio-políticos. Este artículo aborda sus orígenes conceptuales, proporcionando una genealogía que conecta la interseccionalidad con las teorías feministas contra-hegemónicas. Relaciona después la interseccionalidad con los Critical Legal Studies en el contexto socio-jurídico estadounidense de los años 70 dónde se elaboró como categoría de análisis jurídico. Finalmente, considerando los desafíos que supone la trasposición en el marco jurídico de un concepto que ha viajado desde un sistema jurídico a otro, el articulo ofrece un recorrido del desarrollo reciente del derecho de la Unión Europea como ejemplo de los avances y desafíos que la implementación de la interseccionalidad en la praxis jurídica europea puede suponer. El artículo finalmente defiende la utilidad de la interseccionalidad para los estudios jurídicos en el contexto de las sociedades democráticas que tienen como objetivo eliminar los obstáculos formales y sustantivos para alcanzar la igualdad de sus miembros. ; Peer reviewed

While enormous and growing sums of money are spent each year in genital cosmetic surgeries, ritual female genital interventions increasingly meet strong political and social opposition. Which interpretative models have been adopted to define some interventions as "cosmetic" and the others as "criminal"? Is there a colonialist attitude implicit in banning ritual female genital interventions? This appear to be the case after a joint examination of the health risks associated with the breast implant, the symbolic meanings of the ritual interventions, the strategic reinvention of traditional practices, and the use of the binomy health/pathology as a "controlling process". This paper challenges the assumption that who is exposed to the plastic surgeon's scalpel enjoys freedom and autonomy in an oppression-free society, while who is subjected to the ritual knife is a passive victim of traditional patriarchal societies. ; Mientras se gastan cifras enormes y cada año crecientes en intervenciones quirúrgicas que modifican los órganos sexuales, las intervenciones rituales sobre los genitales femeninos encuentran una oposición política y social cada vez más fuerte. ¿Cuáles son los modelos interpretativos adoptados para definir como estéticas a unas y criminales a las otras? ¿Existe una actitud colonialista implícita en la condena de las intervenciones rituales sobre los genitales femeninos? Este parece ser el caso cuando se examinan conjuntamente los daños para la salud derivados del implante mamario, los significados simbólicos de las intervenciones rituales, la reinvención estratégica de las prácticas tradicionales y el uso del binomio salud/patología como "proceso de control". Este artículo propone cuestionar la idea de que quien se somete al bisturí del cirujano plástico disfruta de libertad y autonomía en una sociedad libre de opresión, mientras que quien se expone al cuchillo ritual es víctima pasiva de las sociedades patriarcales tradicionales.

ABSTRACTDiscursive factors have not figured prominently in implementation research. This article fills this gap by addressing the material and discursive conflicts articulated around equality at workplace between women and men in multilevel judicial contexts. It studies obstacles to and opportunities for the judicial implementation of EU equal employment policies in Spain by analyzing two cases of parental rights to childcare litigated before Spanish and supranational courts, namely the Court of Justice of the European Union and the European Court of Human Rights. The claimants are working parents who litigate for the recognition of their right to provide childcare. In judicial implementation multiple meanings about women, gender and intersectionality can be articulated and counteracted at different levels. Frame analysis of selected judicial documents and content analysis of legal proceedings and interviews show that simultaneous favorable institutions, framing, and actors are needed for implementing EU equal employment policies in a way that allows overcoming the gendered division of care and paid work. Distinguishing among 'women', 'gender' and 'intersectionality' approaches, we assess the extent to which the result of judicial implementation is the transformation of gender roles towards equal sharing of care.
