Ziel dieser Arbeit ist es, festzustellen, ob es aufgrund der landwirtschaftlichen Rahmenbedingungen zukünftig einen Markt für ein System zur Prozessdatenerfassung geben wird. Zuerst werden in einem theoretischen Teil die verschiedenen Einflussfaktoren erarbeitet, um diese danach mittels Expertengesprächen mit potentiellen Kunden zu überprüfen und ihre Auswirkungen auf die Marktchancen des Systems zur Prozessdatenerfassung abschätzen zu können. Bei der Erarbeitung der verschiedenen Aspekte, die die Marktchancen beeinflussen, wird nach dem Modell der Marketing-Konzeption von BECKER 1993 vorgegangen, wobei die Umweltanalyse zur genaueren Betrachtung herausgegriffen wird. Der Leitfaden der Expertengespräche orientiert sich an den theoretisch erarbeiteten Aspekten. Die Ergebnisse lassen sich wie folgt zusammenfassen: Stetig steigende Betriebsmittelkosten und sinkende Erzeugerpreise machen eine Optimierung der Produktionsverfahren notwendig. Über das Einsparungspotential bei Betriebsmitteln, das durch die neue Technologie realisiert werden kann, besteht von Seiten der Befragten noch Unklarheit. Beim Produktionsfaktor Arbeit werden hingegen deutliche Einsparungsmöglichkeiten gesehen. Das Wachsen der Betriebe führt dazu, dass immer häufiger Standortwissen auf den Flächen fehlt (hoher Pachtanteil, Vergabe der Arbeit an Dritte), wodurch der Landwirt auf unterstützende Entscheidungsgrundlagen z.B. digitale Karten angewiesen ist. Die Ausstattung mit Computern sowie das Know how der Betriebe im Umgang mit Computern und GPS, werden die Markteinführung des Systems nicht negativ beeinflussen. Allein der hohe Preis von GPS-Empfängern kann problematisch sein. Den schärfer werdenden Umweltauflagen wird ein positiver Einfluss auf die Marktchancen beigemessen. Des weiteren wirkt sich auch das bisherige Fehlen eines automatischen Kontrollsystems günstig aus, da manche Auflagen zwar honoriert werden, aber ihre Einhaltung bisher noch nicht kontrollierbar ist. Die Befragten "Umweltschützer" halten das System zur Prozessdatenerfassung für ein optimales Kontrollinstrument für Umweltauflagen. Die "Neue Agrarpolitik" und das Umweltbewusstsein der Bevölkerung bleiben ohne Auswirkungen für das System. Die weitreichende Ausstattung der Maschinenparks der Befragten mit Elektronik zeigt, dass bereits Interesse für die Erfassung von Einsatzdaten besteht. Auch die Vielzahl der Daten, die gerne erfasst werden würde, verstärkt diesen Eindruck. Trotzdem besteht von Seiten der potentiellen Kunden kein akuter Bedarf an dieser Technologie, da auf dem Markt bisher noch kein abgerundetes Produkt angeboten wird. Besonders die Kompatibilität der Geräte untereinander, die Erfassung exakter und aussagekräftiger Daten und die Bedienerfreundlichkeit sind nach Meinung der Befragten wichtige Qualitätsmerkmale. Auch die Dienstleister können einen erheblichen Beitrag zum Erfolg der Markteinführung beitragen z.B. Datenanalyse, Reparaturservice. Neben der Entwicklung eines abgerundeten Produktes wird auch der Zeitpunkt der Markteinführung die Verkaufschancen beeinflussen, denn das Interesse an der automatisierten Datenerfassung in der Landwirtschaft hat bereits deutlich nachgelassen. ; The aim of this essay is to find out if taking the agricultural conditions into consideration, there is a demand for the automatic process data recording. In the theoretical part of this essay, the different influences are worked out. Then they will be verified by discussions with experts who are potential clients to estimate their consequences on the demand for a system for automatic process data recording. The different aspects which influence the demand were worked out according to the model of the "Marketing Konzeption" by BECKER 1993; this essay concentrates on the analysis of the environment. The structure of the discussions with the experts is orientated at the different found influences. The summary of the results follows: Constantly increasing costs of production and decreasing producer' s prices require an optimisation of the production process. For the moment, the questioned experts are not certain about the savings of production means that could be realized by the application of this system. But for the factor work they see a real possibility for savings. The growth of farms leads to a lack of site-specific-know-how (growing percentage of leasehold property, outsourcing of work), therefore farmers depend more and more on decision-supporting material e.g. digital maps. The equipment with computers and the knowledge how to deal with computers and GPS will not have a negative influence on the introduction of the system. Only the high price for GPS receiver may cause a problem. Increasingly strict environmental impositions are considered to have positive effects on the demand. Moreover, the existing lack of an automatic control system will also be positive because there are impositions that are paid but not controlled. The interviewed "environmental protectors" are convinced that the system for automatic process data recording is the optimal method for controlling environmental impositions. The "New Agricultural Policy" and the environmental consciousness are considered to be without any effect for the demand on the system. With regard to their machines, the interviewed experts are well equipped with electronic; this shows that interest for process data recording is already existing. Also the large scale of data that should be recorded, emphasizes this impression. Nevertheless, at the moment there is no demand for the new technology because there is no product on the market that is ready for practical use. According to experts, especially the compatibility, the recording of exact and relevant data and the easy usage are rather important aspects of a high-quality product. Also the service sector has to contribute its part to a successful market introduction e.g. through data analysis, after sales service. Furthermore, the market performance is not only influenced by the development of a high-quality product, but also by the point of time when the product is first sold; because it is obvious that the interest in automatic process data recording has already decreased.

Motivo de la investigación: La mayoría de países de la Unión Europea han adoptado planes públicos de acción de Compra Pública Verde, pero esto no es suficiente, es necesario que las Administraciones dispongan de herramientas que faciliten su implementación.Objetivo: Diseñar una ficha de criterios de Compra Pública Verde (CPV) para la contratación del servicio de Restauración externa por el Servicio Andaluz de Salud (SAS), a partir de la recopilación de políticas, legislación y guías europeas.Método: Trabajo de revisión basado en la consulta de fuentes secundarias e informantes clave. Tres fases: 1a: recopilación de directivas, reglamentos y otros documentos de CPV emitidos por la UE. 2a: recopilación de manuales e informes de la UE que desarrollen criterios de CPV en servicios de Restauración externa. 3a: diseño de una ficha de criterios de CPV.Resultados: Se diseñó una ficha de criterios de CPV con 21 criterios, teniendo en cuenta los impactos ambientales más significativos, directivas de contratación pública, normas sectoriales y manuales e informes europeos de CPV. 10 de ellos son especificaciones técnicas, 5 son criterios de adjudicación y 6 son condiciones de ejecución.Conclusión: La CPV es una herramienta que las autoridades públicas pueden utilizar para estimular la oferta de productos y servicios con reconocidos valores ambientales, a la vez que ayudará a alcanzar los retos ambientales. Las Directivas europeas de contratación pública de 2014 y otras normas sectoriales nos guían en su integración en los contratos públicos. ; Reason for the investigation: Most European Union countries have devised and implemented public Green Public Procurement (GPP) action plans, but this is not enough: It is necessary for public administrations to have tools that facilitate their implementation.Objective: To design a Green Public Procurement (GPP) criteria sheet for the Andalusian Healthcare Service to use for outsourcing its catering service based on the compilation of European policies, laws and guides on the subject.Method: A review based on checking secondary sources and talking to key informants.The methodology was structured around three phases.1st phase: Compilation of directives, regulations and other GPP documents issued by the EU. 2nd phase: Compilation of EU manuals and reports that set GPP criteria for external catering services. 3rd phase: Design of a GPP criteria sheet.Results: A GPP criteria sheet was designed for the Andalusian Heathcare Service to outsource its catering service to an external company. 21 criteria were selected according to the most significant environmental impacts, public procurement directives, sectoral standards and European GPP manuals and reports.10 of them were technical specifications, 5 award criteria and 6 conditions for execution.Conclusion: GPP is a tool that public authorities can use to stimulate the supply of products and services with recognized environmental values, while helping to deal with environmental challenges.The 2014 European Public Procurement Directive and other sectoral regulations have been the guide for the inclusion of the above in public contracts. ; Motivo da investigação: A maioria dos países da União Europeia adotou estratégias nacionais para as compras públicas ecológicas, mas isto não é suficiente, é necessário que as Administrações disponham de instrumentos que facilitem a sua implementação.Objetivo: Elaborar um formulário de critérios de Compra Pública Ecológica (CPE), para a contratação de serviço de catering pelo Serviço de Saúde da Andaluzia, com base na compilação de políticas, legislação e diretrizes europeias.Método: Trabalho de revisão baseado na consulta de fontes secundárias e informadores-chave. Três fases: 1.a - compilação de diretivas, regulamentos e outros documentos de CPE emitidos pela UE; 2.a - compilação de manuais e relatórios da UE que desenvolvem critérios de CPE em serviços de catering: 3.a - elaboração de uma folha de critérios de CPE.Resultados: Elaborou-se um formulário de critérios de CPE com 21 itens, tendo em conta os impactos ambientais mais significativos, diretivas de contratos públicos, normas e manuais setoriais e relatórios de CPE europeus. 10 deles são especificações técnicas, 5 são critérios de adjudicação e 6 são condições de execução.Conclusão: A CPE é uma ferramenta que as autoridades públicas podem usar para estimular o fornecimento de produtos e serviços com valores ambientais reconhecidos, ajudando a enfrentar os desafios ambientais. As diretivas europeias relativas aos contratos públicos de 2014 e outros regulamentos setoriais orientam-nos na sua integração nos contratos públicos.

El propósito de este artículo es tanto teórico como metodológico: busca contribuir a la reflexión de la sociología acerca de los usos de las políticas sociales, mostrando que el estudio de una determinada "política" como Bolsa Familia requiere un dispositivo de investigación multi-escalar que permita captar los diversos conflictos que atraviesan su concretización, desde su emergencia hasta su despliegue en el territorio. En este sentido, a modo de ejercicio, se interroga la trayectoria de implementación del programa Bolsa Familia en dos momentos distintos en torno a su tecnología política "por arriba" y "por abajo": como dispositivo de gobierno (Foucault, 1976), emblemático durante el período de "Lula", y como dispositivo de gestión del territorio y de las poblaciones a través de la externalización o tercerización asistencial. En uno y otro momento, lo social adquiere valor de "mercadería política" a distintos niveles. Mostraremos cómo se produce en ellos el despliegue de la política de asistencia social: a nivel de Estado y lo público, y a nivel del territorio y la acción privada y no gubernamental. A nivel de su concretización, mostraremos, a partir de un caso de estudio en São Paulo, la importancia de seguir la cadena de producción de la política. Asistencia social.BOLSA FAMILIA AND SOCIAL WELFARE IN BRAZIL: from political debate to local mercantilization Isabel Georges Marco Ceballos The goal of this article is both theoretical and methodological: to contribute for a reflection in sociology regarding the use of social policies by showing that the study of a particular "policy", like Bolsa Família, requires a multiscaled investigation model which allows the capture of the many conflicts crossing its concretization from its creation until its spreading over the country. This way, as an exercise, the trajectory of the implementation of Bolsa Família is questioned, in two different moments, as to its political technology "over" and "under": as a governmental device (Foucault, 1976), emblematic during Lula's government, and as a device for the management of territory and population through externalization or assistance outsourcing. In both these moments, the social acquires value as political merchandise in different levels. We will show how the unfolding of social assistance policies happens in them: in the scope State and public, and in the scope of private, non-governmental territory and action. As to its concretization, we will show, from a case study done in São Paulo, the importance of following the rhythm of political production. Thus, we will highlight some of the central elements of what could be called the "PSDB" model, active in this city, as shown at the end of the article. KEYWORDS: Bolsa familia. Welfare policies. Dans ce sens, à titre d'exercice, on interroge la trajectoire de mise en oeuvre du programme Bolsa Família à deux moments différentes autour de sa technologie politique "par le haut" et "par le bas": en tant que dispositif de gouvernement (Foucault, 1976), emblématique sous la période de "Lula", et en tant que dispositif de gestion du territoire et des populations à travers la sous-traitance de l'assistance. À ces deux moments, le social acquière une valeur de "marchandise politique" à deux niveaux: au niveau de l'État et du domaine public, et au niveau du territoire et de l'action privée et non gouvernementale. Problem setting. The status of comprehensive support of military units in the world's leading powers is considered to be one of the key factors which defines the success of the social emergency settling operations. The experience of service and military application of the National Guard of Ukraine in the anti-terrorist operation zone on the South-East of Ukraine shows that emergency response tasks are generally carried out in cooperation with other Ukrainian security sector authorities, mostly with the Security Service of Ukraine. However, the forces joint managing authority chiefs usually do not cover the matter of such activities' comprehensive support, which forces the commanders of the military units to rely on themselves in this question.Recent research and publications analysis. The analysis of research of status and development prospects of the comprehensive support of the Armed Forces of Ukraine, other security authorities, armies of the world's leading powers, peculiarities of creation and functioning of such systems, application of their means and powers, scientific thought on the problems of service and military application of the National Guard units has shown the problematic tasks of the joint unit comprehensive support system optimization. Therefore, the question of regulatory and legal support of this process is of current importance.Paper objective. The objective of this paper is to define regulatory and legal aspects of comprehensive support optimization of the Security Service of Ukraine and the National Guard of Ukraine service and combat activities during social emergencies.Paper main body. According to the current legislation, comprehensive support comprises of the following types of support: operative (also called military), moral and psychological, materiel (logistical). All other types of support are parts of these three basic ones. Their examination is necessary due to the fact, that there is confusion in the legislation regarding the classification of support types. A clear gradation of the support types is required for effective comprehensive support of the law enforcement forces service and combat activities while performing social emergencies response tasks. This question particularly arises during collateral execution of service and military tasks by different authorities, for example, joint duties of National Guard of Ukraine and Security Service of Ukraine personnel. The most problematic of the abovementioned now is the materiel support.The special operation materiel support should be headed by a National Guard of Ukraine officer, as National Guard military units and subdivisions, unlike the Security Service of Ukraine units or other law enforcement forces, have assigned materiel subdivisions, trained specialists and are able to rapidly deploy logistics objects.The use of contemporary IT is one of the means of comprehensive support optimization, in particular: use of mobile computer equipment in field conditions, application of modern geoinformational technologies, implementation of electronic data exchange, introduction of up-to-date digital communication. In order to augment the materiel support, effective public anti-corruption policy has to be established during tender supplies purchases for the security and defense sector; legislative environment on public-private partnership in the state defense field has to be improved, considering foreign experience and mistakes of outsourcing implementation in the Armed Forces of Ukraine. Conclusions of the research. Following regulatory and legal measures need to be taken: conduct a statutory regulation of centralization of comprehensive support of joint activities of Ukrainian security and defense sector authorities during social emergencies settlement; enhance the legislative environment of the tender purchases system in order to minimize corruptive abuse and reduce the bureaucratic component; form a unified legal framework for orders planning, weapons and military equipment delivery and exploitation and other support types. ; Проведен анализ видов обеспечения служебно-боевой деятельности сил охраны правопорядка. Аргументирована целесообразность создания единого органа обеспечения при урегулировании чрезвычайных ситуаций. RIASSUNTO IN ITALIANO Il progetto di studio alla base della seguente ricerca vorrebbe rendere più chiaro il rapporto tra la normativa sottesa al controllo degli armamenti e la funzione di difesa cui le Forze Armate assurgono. Il ruolo delle Forze Armate ha subito, o determinato a seconda dei casi, l'evolversi della funzione di difesa all'interno dell'ordinamento giuridico. I più recenti sviluppo hanno visto un'iniziale apertura verso le esternalizzazioni con la legge 130/2011 e la creazione di Difesa Servizi S.p.a., società in house con funzioni di centrale di committenza. La scelta di porre alla base della struttura di regolamentazione del mercato degli armamenti la funzione di difesa può apparire anacronistica, tuttavia proprio la delicata funzione che i materiali in oggetto ricoprono, giustifica l'attenzione particolare verso il settore. A lungo gli interessi economici hanno approfittato della scarsa regolamentazione del mercato, fino alla legge 185/1990, la quale invece ha reso chiara l'importanza del controllo del settore e la rendicontazione al cittadino, sottolineando nuovamente il ruolo di difesa del metodo democratico ai cui principi si ispira l'operato delle Forze Armate. L'assenza della normativa europea ha poi trovato risposta nei tentativi di accordo multilaterale e nei progetti avviati ad esempio in ambito Organisation Conjointe de Coopération en matière d'ARmement (OCCAR), fino alla formazione della European Defence Agency (EDA), da cui si attende un indirizzo univoco di sviluppo standardizzato del settore nel rispetto delle singole nicchie di eccellenza industriale. Il ruolo della NATO ha fornito un ottimo esempio di operatività a controllo congiunto sul settore degli armamenti, anche se non pare sufficiente a garantire la futura operatività proiettata in uno spazio internazionale. Tra il sistema giuridico nazionale ed il mercato internazionale di riferimento si intravedono ampie prospettive per una regolamentazione dinamica, saldamente connessa ai principi della funzione di difesa globalmente intesa. ABSTRACT (ENGLISH) This research is a study project based upon the objectives to understand the connection between the rule of laws that assures functionality in the market of armaments and permits to the army forces to do the function that they are supposed to carry out. The role that the army forces has in the State organization has changed depending on the evolution of laws, technologies and markets. In Italy, the last juridical development of army forces function has moved the management of armaments to the outsourcing process, initially with the creation of an "in house" company, called Difesa Servizi S.p.a., later on with a specific law regarding contractors use, law 130/2011. At the first glance, the decision to study the market of armaments regulation based upon the interpretation of the function of defense in a modern democracy, might appear anachronistic but the armaments are the tools that the combatants can use to carry out the orders received. For a long period the economic interests has trade on the leakage of laws for this market until the law 185/1990. This law has made it clear the importance of regulation on this sensitive market. After it implementation finally the citizen can know the importance of the connection between the international relations and the choices for the armaments production and exchange. The annual report, instituted with the law, can be a great democratization for the decisions of this production sector. Due to the absence of a clear European regulation, with a coherent application all over the European area, some multilateral arrangements have result as an important input for the different national laws. Several projects of cooperation has started during the last century, from the Organisation Conjointe de Coopération en matière d'ARmement (OCCAR) institution up until the foundation of the European Defence Agency (EDA). Although the expectation for standardization of the requirements, the revaluation of national niches of excellence and the efficiency due to the scale production are not reach yet. Waiting for a Europe with a stronger position in foreign policy, the NATO has given a good example of operative control with a standardization of the usage of arms but not yet on the supply side. Today the NATO can plan, not without difficulties, complex campaign with several different armaments involved, but the objective is to gain the needed standards and to be able to use all the assets in a more valuable and flexible way. Today the relationship between the national regulation and the international market of armaments is undoubtedly more complex than the last century, but this is also a strong opportunity for a dynamic perspective of defense function with a global vision.

Рассмотрен правовой аспект оказания образовательных услуг в сфере дополнительного образования с использованием дистанционных образовательных технологий, направленный на реализацию социально-правовых гарантий и повышение качества образования. Изменения, происходящие в современном мире, повышают значимость дополнительного образования, необходимого для формирования и удовлетворения потребностей человека в обучении на протяжении его жизни. Всем гражданам без исключения предоставляется возможность овладевания научными и профессиональными знаниями. Все большую значимость приобретает дистанционное обучение как наиболее востребованная форма обучения в сфере повышения квалификации и профессиональной переподготовки кадров. В связи с чем важно, чтобы современное качество образования с использованием дистанционных образовательных технологий (далее – ДОТ) соответствовало современным требованиям науки и производства. Это формирует необходимость координации образовательной политики с опорой на общегосударственное законодательство. Преимуществом использования ДОТ образовательным учреждением является предоставление обучающимся возможности освоения образовательных программ непосредственно по месту жительства обучающегося или его временного пребывания (нахождения). При реализации образовательных программ с применением электронного обучения, дистанционных образовательных технологий местом осуществления образовательной деятельности является место нахождения организации, осуществляющей образовательную деятельность, или ее филиала независимо от места нахождения обучающихся. Кроме того, реализация программ переподготовки и повышения квалификации, обеспечивающая кадровое, научное, учебно-методическое, информационное и материально-техническое обеспечение системы обучения с использование ДОТ, не исключает возможности проведения учебных, лабораторных и практических занятий, практик, текущего контроля, промежуточной и итоговой аттестаций путем непосредственного взаимодействия педагогического работника с обучающимся. Соотношение объема проведенных учебных, лабораторных и практических занятий с использованием ДОТ или путем непосредственного взаимодействия педагогического работника с обучающимся определяется образовательным учреждением. Это также является положительным результатом для формирующейся модели российского образования. Кроме того, создание такой инфраструктуры для образовательного учреждения не всегда выполнено, т. к. зачастую оно отстает от развивающихся цифровых и IT-технологий. Решением этой проблемы может стать возможность привлечения коммерческих компаний – организаторов обучения, которые организуют информационную инфраструктуру, а учебное заведение осуществляет ее наполнение учебными курсами, соответствующими учебному плану дисциплинами. Образовательным учреждениям такие компании обеспечивают полный цикл услуг аутсорсинга бизнес-процессов по внедрению онлайн-обучения, что включает проектирование и производство курса, маркетинг и продажу, техническую поддержку и организацию процесса обучения. ; The legal aspects of the provision of educational services in the field of further education using distance learning technologies aimed at implementing social and legal guarantees and improve the quality of education are considered. The changes taking place in the modern world increase the importance of additional education required for the formation and human needs in education throughout his life. All citizens, without exception, have the opportunity of mastering scientific and professional knowledge. The increasing importance is the distance learning as the most popular forms of training in the field of training and retraining of personnel. In this connection it is important to modernize the education quality using distance learning technologies (hereinafter DOT), that corresponds to the modern requirements of science and industry. It generates the need for coordination of education policy, building on national legislation. The advantage of using DOT educational institution is to give students the possibility of development of educational programs, directly at the place of residence of the student or temporary residence (location). With the implementation of educational programs with the use of e-learning, distance learning technologies place educational activities is the location of the organization, carrying out educational activities, or its affiliate, regardless of the location of students. In addition, the implementation of programs of retraining and providing human, scientific, educational, information and logistics systems training with the use of DOT does not rule out the possibility of educational, laboratory and practical exercises, practices, monitoring, interim and final certifications by direct interaction with the students of teaching staff. The ratio of the volume of conducted educational, laboratory and practical exercises using DOT or by direct interaction with the students of teaching staff is determined by the educational institution. It is also a positive result for only the emerging model of education in Russia. Besides the creation of such an infrastructure for educational institutions are not always satisfied, since it often lags behind the emerging digital and IT-technologies. In connection with this the solution to this problem may be the possibility of the involvement of commercial companies – training providers who organize the information infrastructure and the educational institution carries out its content courses of study relevant to the curriculum subjects. Educational institutions such companies provide a full service business process outsourcing the implementation of online learning that includes the design and manufacture of the course, marketing and sales, technical support and organization of the learning process.

The management of interfaces is central in supply chain management (SCM) and logistics. An important part of SCM is coordination and collaboration with different partners such as suppliers, intermediaries, third party service providers and customers (CSCMP, 2010). Collaboration between parties in the supply chain is generally believed to decrease costs and increase efficiency as well as service. Moreover, the success of a firm is dependent on its managerial ability to integrate and coordinate the business relationships among the supply chain members (Lambert and Cooper, 2000). The supply chain linkage ought to be so tight that separate organizational units share the same purpose and suppliers and customers help each other to achieve mutually beneficial objectives (Seth et al., 2006). In the SCM literature interfaces seldom include the logistics service provider (hereafter labelled LSP). Instead, most interfaces discussed are those between a shipper and the receiver of the goods (Skjoett-Larsen et al., 2003; Stefanson, 2006). One reason for this could be that logistics firms are the least integrated link in supply chains (Lemoine and Skjoett-larsen, 2004) or that, as noted by Fabbe-Costes et al. (2009), LSPs seem to be the forgotten actors of supply chain integration. Furthermore, LSPs are often merely seen as actors that supports other members of the supply chain, providing resources, knowledge, utilities or assets for the primary members (Spens and Bask, 2002). Several logistics related trends, such as the shift towards outsourcing and increased globalisation, increase the need for strong relationships between LSPs and supplychains (Seth et al., 2006). Most of the research conducted on LSPs applies either a shipper or an LSP perspective, instead of a dyad perspective. Literature in the context of service quality in supply chains also commonly considers only one directional view (Seth et al., 2006). Knemeyer and Murphy (2005) mean that there is a need to simultaneously consider both shipper and LSP perspectives in order to decrease the risk of key perceptual differences (gaps) that can negatively influence the logistics service quality. Shippers and LSPs face an emerging and considerable challenge because of the large negative impact transports have on the natural environment and, as stated by for example the EEA (2007) and Roth and Kåberger (2002), the environmental performance of the transport sector is an increasing problem. Because of growing freight transport it is not surprising that both shippers and LSPs are pressured from different stakeholders, such as governments and customers, to lower their environmental impact from transports (McKinnon, 2003; McKinnon and Piecyk, 2009; Wolf and Seuring, 2010). This creates an opportunity for LSPs to be proactive and meet these demands by considering environmental issues in their business models and as a value adding service offering. The correspondence between customer needs and the service offerings is essential in order to succeed with the service concept (Edvardsson, 1997). However, that does not necessarily mean that supply and demand always match. For example, Wolf and Seuring (2010) found that the LSPs seem to be ahead of their customers when it comes to environmental issues, but state this with caution and call for further research in this area. With the aim to learn more about the interface between LSPs and shippers and how environmental issues are taken into account, the purpose of this paper is: To develop and apply a tool for the identification of matches and gaps in the interface between LSPs' green offerings and shippers' green demands. There are many ways to label the actor responsible for the supply of logistics services. In this paper, the term logistics service providers (LSPs) is applied and, inspired by Fabbe-Costes et al. (2009) and Forslund (2010), includes actors such as carriers, forwarding companies, transport(ation) companies, third party logistics providers/partners and logistics service companies/providers/suppliers. This paper is divided into five main parts. After the introduction, a literature section on the greening of the LSP-Shipper interface will be presented. This is followed by a gap section, ending with the developed gap model. Next, the survey study is explained, after which findings from the application of the model are presented. What is the role of educators, scholars, cultural and business leaders, parents, and the learners in curriculum development? Who "owns᾿ the curriculum of elementary and secondary schools in Québec? And what is the proper role of the government? Curriculum is more than a set of documents, approved textbooks, or official examinations. It is the script for a dialogue between a society and its young people, a narrative about what we think is important. Over the last half century, there have been four major models of curriculum organization in Québec: (1) prior to the 1960s, divided and centralized Catholic and Protestant structures, with authority largely outside the government; (2) the reforms of the 1960s, with direct centralized government control over policy but decentralized procedures; (3) a tightening up of control over both policy and procedures in the late 1970s, part of a general back-to-basics movement; (4) the current reforms beginning in the late 1990s, with government-directed approaches to organization, competencies and evaluation. These different reforms have exhibited a number of relatively stable characteristics: periodic rather than continuing reform, dominant role of the MEQ (now Ministry of Education, Leisure and Sport [MELS]), initial consultation on broad questions and an unclear relationship with subsequent policy decisions, extensive documentation, managerial and technical approach to curriculum, limited academic and professional influence on final decisions, stress on a single coherent system for all schools, and little emphasis on research, curriculum practices elsewhere and information technologies. At the present time, curriculum planners in Québec are facing a number of dilemmas, especially quality of standards and equality of access, centralization and adaptability, and different views about the relative roles of the public, the government and the teaching profession. For the future of Québec curriculum, a number of scenarios are worth considering: continuing the dominant role of the MELS putting all curriculum on-line, outsourcing curriculum development, forming partnerships with various education bodies, giving more authority to the education profession, accrediting schools, and creating a separate curriculum council to coordinate research and development. L'ÉTAT ET LE CURRICULUM. QUESTIONS ET OPTIONS POUR LE QUÉBEC Quel est le rôle des enseignants, des universitaires, des acteurs du domaine culturel et du monde des affaires et des apprenants dans la conception du curriculum ? Qui est le « détenteur du titre de propriété » pour le curriculum au niveau primaire et secondaire au Québec ? Quel est le juste rôle du gouvernement ? Le curriculum est bien plus qu'un ensemble de documents, de manuels scolaires approuvés et d'examens de fin d'année. Il s'agit d'un scénario pour la création d'un dialogue entre la société et la jeunesse, un récit à propos de ce que nous considérons important. Depuis la dernière moitié du siècle dernier, il y a eu quatre principaux modèles d'organisation du curriculum au Québec : 1- celui d'avant 1960 divisés en secteur catholique et protestant avec des structures centralisées; 2-les réformes des années 1960 avec un contrôle gouvernemental centralisé quant aux politiques mais avec des procédures décentralisées; 3- une prise en charge plus serrée sur les politiques et les procédures durant les années 1970 qui s'inscrivait dans un mouvement du retour à l'essentiel; 4-les réformes actuelles qui ont débutées à la fin des années 1990 avec des approches gouvernementales dirigistes à l'endroit de l'organisation, des compétences et de l'évaluation. Ces différentes réformes ont démontré plusieurs caractéristiques récurrentes : les réformes sont ponctuelles plutôt que continuelles, le rôle central du ministère de l'Éducation, du Loisir et du Sport (MELS); des consultations initiales à propos de questions très vastes et des liens plus ou moins clairs avec les grandes orientations décisionnelles; une documentation abondante; une approche gestionnaire et technique du curriculum; une influence limitée de la part des universitaires et des professionnels quant aux décisions finales; un accent important sur un seul système cohérent pour toutes les écoles et finalement peu d'importance accordée à la recherche, aux pratiques curriculaires hors-Québec et aux technologies de l'information. À l'heure actuelle, les concepteurs de curriculum au Québec font face à plusieurs dilemmes, plus particulièrement en ce qui concerne la qualité des standards et un accès équitable; la centralisation et l'adaptabilité et finalement différentes visions quant aux rôles du public, du gouvernement et de la profession enseignante. Pour l'avenir du curriculum au Québec, certains scénarios valent la peine d'être considérés : Poursuivre le rôle dominant du MELS; mettre tous les curriculums en ligne, ouvrir à la compétition le développement curriculaire; établir des partenariats avec plusieurs entités éducatives; donner plus d'autorité à la profession enseignante; accréditer les écoles et créer un conseil curriculaire autonome qui coordonne la recherche et le développement.

Aus der Einleitung: Als Michael Porter in den 80er Jahren ein Konzept vorstellt, welches auf die Entwicklung und Sicherung nachhaltiger Wettbewerbsvorteile der Unternehmen abzielt, finden Begriffe wie Globalisierung, Kernkompetenzen noch keinen großen Verbreitungsgrad. Seitdem haben sich die Rahmenbedingungen grundlegend verändert, doch der Aufbau einzigartiger Ressourcen hat mehr denn je Aktualität. Die Unternehmen sehen sich zu Beginn des 21. Jahrhunderts permanent wechselnden Unternehmenseinflüssen ausgesetzt. Dabei wird dieses Umfeld beeinflusst von verschiedenen Faktoren, wie beispielsweise: - Fortschreitende individualisierte Kundenorientierung. - Kürzere Produktlebenszyklen. - Daraus resultierender Innovationsdruck. - Zunehmende Globalisierung der Weltwirtschaft - Wandel zur wissensbasierten Gesellschaft. Im produzierenden Gewerbe wie der Konsumgüterindustrie ist in den letzten Jahren eine ausgeprägte Kundenorientierung zu verzeichnen, die in letzter Konsequenz zu einem One-to-One-Marketing führt. Die Intensivierung der Kunden-Anbieter-Beziehung macht sich auch in der Bauwirtschaft bemerkbar, da Schlüsselkunden Komplettlösungen aus einer Hand angeboten werden und diese durch Key Account Manager betreut werden. Die partnerschaftliche Zusammenarbeit zwischen Bauunternehmer und Auftraggeber wird durch alternative Vertragsformen im Rahmen von GMP-Modellen gefördert. Gleichzeitig haben sich die Produktlebenszyklen komplexer gewordener Konsumgüter verkürzt. In diesem Umfeld spüren die auftragnehmenden Bauunternehmen einen erhöhten Zeitdruck bei der Fertigstellung eines Bauauftrages. Zudem erwarten die Kunden umfassende Lösungsvorschläge, um beispielsweise eine Produktionsanlage fertig zustellen. Im Wohnungsbau sind das Zinsniveau und die Verfügbarkeit an günstigen Produktionsfaktoren für die Dauer des Lebenszyklus entscheidend. Davon hängt ab, ob renovierungsbedürftige Wohnblöcke abgerissen werden oder eine Renovierung im Vergleich zum Neubau günstiger ist. Zugleich und völlig losgelöst von der eben geschilderten Problematik ist eine zunehmende Globalisierung der Weltwirtschaft zu beobachten. Sowohl national tätige als auch internationale Bauunternehmen haben aufgrund der Liberalisierung der Märkte die Möglichkeit, ihre Geschäftsaktivitäten auszuweiten. Andererseits kann die Erschließung neuer Absatzmärkte die Folge des Markteintritts der Konkurrenz auf dem Heimatmarkt sein. Parallel dazu ist ein anhaltender struktureller Wandel von arbeits- und kapitalintensiven zu informations- und wissensintensiven Tätigkeiten zu verzeichnen. Im Rahmen der sich vollziehenden Transformation von der Industrie- über die Dienstleistungs- zur Informations- und Wissensgesellschaft ist eine zunehmende Wissensorientierung der Unternehmen zu erkennen. Hierzu stellt Ikujiro Nonaka fest: "In an economy where the only certainty is uncertainty, the one sure source of lasting competitive advantage is knowledge". Daher wird in der Literatur gern von Wissen als Produktionsfaktor, als Wettbewerbsfaktor oder als Unternehmensvermögen gesprochen. Dieses setzt eine gute IuK-Infrastruktur in den Unternehmen voraus, um die Effizienz und die Effektivität im Arbeitsprozess und in der Verwaltung zu verbessern. Tatsächlich hinkt die Bauwirtschaft hinsichtlich moderner IuK-Technologien anderen Branchen weiterhin hinterher. Problemstellung: Mit den eben beschriebenen Herausforderungen kämpft momentan die deutsche Bauwirtschaft und steht im Wettbewerb mit Marktteilnehmern insbesondere osteuropäischer Nachbarländer. Vor dem Hintergrund der aktuellen Strukturkrise und dem permanenten Wettbewerbsdruck als Folge der Globalisierung steht das Topmanagement vor der Entscheidung, diejenigen Geschäftsfelder auszuwählen, die über genügend Gewinn- und Wachstumsperspektiven verfügen. Um auf diesen Märkten bestehen zu können, muss sich die Unternehmensführung um die Konkurrenzfähigkeit des eigenen Unternehmens kümmern, indem es im Rahmen der strategischen Unternehmensplanung Wettbewerbsstrategien formuliert, die dem Unternehmen nachhaltig Wettbewerbsvorteile verschafft. Im Vergleich dazu ist der englische Baumarkt ein gutes Beispiel, wie sich die dortige Bauwirtschaft nach einer Strukturkrise Anfang der 90er Jahre nachhaltig von Strukturproblemen befreien konnte und sich die Wettbewerbsfähigkeit der britischen Bauunternehmen verbessert hat. In der Vergangenheit hat die strategische Unternehmensplanung als Gegenstück des Improvisationsverhaltens eine geringe Wertschätzung im Management eines Bauunternehmens erfahren und hat erst in den letzten Jahren in großen Baufirmen Einzug gehalten. Die systematische Gestaltung der Unternehmenszukunft kann auf unterschiedlichen Ebenen erfolgen, wobei die Unternehmens- und Geschäftsfeldstrategien im Mittelpunkt dieser Diplomarbeit stehen werden. Das Formulieren und Implementieren von Unternehmensstrategien bekommt eine reelle Grundlage und schafft echte Mehrwerte. Die Fokussierung auf bestimmte Marktsegmente, die Erweiterung des Leistungsangebots oder sich als Dienstleistungsunternehmen für global operierende Konzerne anzubieten, die Outsourcing betreiben, das sind Wege, sich von der Konkurrenz zu differenzieren. Bisher ist die europäische Bauindustrie von großer Fragmentierung und Kleinteiligkeit geprägt, die darauf zurückzuführen ist, dass Entscheidungsprozesse für die Beschaffung von Bauleistungen in der Privatwirtschaft sehr dezentral, also auf lokaler Ebene, getroffen werden, und auf den herausragenden Einfluss des Staates, der außergewöhnlich stark regulierend mittels Gesetzen, Verordnungen und Richtlinien in das Geschäftsgebaren der Marktteilnehmer eingreift. In die organisatorische Ausgestaltung übersetzt heißt dies, dass Bauunternehmungen in ihrer großen Mehrheit KMU sind, die in dem jeweiligen lokalen Marktumfeld ihr Geschäft betreiben. Der Markt ist insofern ein lokaler und kein nationaler. Erfolgsfaktoren sind primär das Beziehungsgeflecht der jeweiligen Inhaber. Klassische Einflussgrößen, die große organisatorische Einheiten fordern, haben in der Bauwirtschaft bisher eine untergeordnete Rolle gespielt. Hoher Kapitaleinsatz erzwingt für wirtschaftliches Arbeiten einen Mindestabsatz und damit eine Mindestgröße. Dies trifft auf die Bauwirtschaft mit ihrem bisher geringen Kapitalbedarf nicht zu. Das Zentralisieren von Funktionen wiederum konnte bisher aufgrund fehlender Technologien die erhofften Kosten- und Erfahrungsvorteile nicht generieren. Zielsetzung der vorliegenden Arbeit ist, die Treiber des Wandels der Bauwirtschaft zu bestimmen, deren Auswirkungen auf grundsätzliche Strategieformulierungen zu zeigen und schließlich erfolgreiche Differenzierungsstrategien zweier multinationaler Baukonzerne zu analysieren, die sich vom klassischen Bauunternehmen zu globalen Baukonzernen mit baunahen Dienstleistungen weiterentwickelt haben. Gang der Untersuchung: Die vorliegende Arbeit ist in fünf Kapitel gegliedert. Nach einer kurzen Einleitung in die wirtschaftlichen Herausforderungen der Unternehmenswelt für das 21. Jahrhundert wird in Kapitel 1 auf die Zielsetzung der Arbeit eingegangen. In Kapitel 2 erfolgt zunächst eine begriffliche Abgrenzung und Definition der Bauwirtschaft. Anschließend werden wichtige Besonderheiten dieser Branche erläutert. Weiter werden die Einflussfaktoren des Wettbewerbsumfelds beschrieben und welche Unternehmensstrategien dem Topmanagement zur Verfügung stehen. Es werden Anforderungen an die Unternehmensführung skizziert, die in der Implementierungsphase der Unternehmensstrategie notwendig sind, um eine Organisationsstruktur erfolgreich anzupassen. In diesem Kontext werden klassische Organisationsstrukturen vorgestellt. Kapitel 3 setzt sich mit den besonderen Aspekten des Strukturwandels der Bauwirtschaft auseinander und geht auf die zunehmende Tertiärisierung der Branche ein. Mit der Ausweitung der Wertschöpfungstiefe im Bauprozess verändert sich auch die Organisationsstruktur des Unternehmens. In diesem Zusammenhang wird auch die Prozessorientierung als wesentliche Tendenz in der Organisation der Bauunternehmen näher erläutert, die klassische, funktions- und objektorientierte Organisationsformen abgelöst hat. In Kapitel 4 wird anhand von zwei Fallbeispielen, HOCHTIEF und AMEC, die strategische Neuausrichtung beschrieben. Zuerst wird der europäische Baumarkt vorgestellt und gezeigt, wie unterschiedlich sich die einzelnen Baumärkte in den letzten Jahren entwickelt haben. Anschließend werden der Heimatmarkt, die Historie, das Strategiekonzept und die Strategieimplementierung erläutert. Im letzten Unterkapitel erfolgen eine Bilanzanalyse der beiden börsennotierten Baukonzerne und eine Darstellung, wie sich der Unternehmenswert entwickelt hat. Kapitel 5 fasst die Schlussfolgerungen dieser Arbeit zusammen und gibt einen Ausblick auf die zukünftige Entwicklung der europäischen Bauwirtschaft. Die Frage, warum eine Gerichtsentscheidung zum Prüfungsgegenstand eines außerordentlichen Grundrechtsschutzmittels werden sollte, ist nicht a priori zu beantworten. Um judikatives Unrecht zu sanktionieren, könnte man an Stelle des außerordentlichen Rechtsbehelfs noch einen weiteren Rechtsbehelf im ordentlichen Rechtsweg vorsehen. Der Grund, warum dieser Weg nicht vorzuziehen ist, lässt sich nicht durch die Annahme erklären, dass die Mentalität der Fachrichter für die Wahrung der Grundrechte weniger geeignet sei als die der Verfassungsrichter. Der politische Modus der Verfassungsrichterwahl gewährleistet nicht unbedingt die Qualifikation für einen Hüter der Verfassung. Die Notwendigkeit der Urteilsverfassungsbeschwerde ist ebenso wenig direkt aus dem Wesen bzw. Begriff der Verfassungsbeschwerde herzuleiten. Es kommt vielmehr auf das Spezifikum der Justizstruktur oder des Gerichtsverfahrens eines bestimmten Staates an. Viele Konzeptionen über das außerordentliche Grundrechtsschutzmittel sind gerade daran gekoppelt. Aus der genetischen Untersuchung lässt sich erkennen, dass in der Bundesrepublik Deutschland die Verselbständigung des Verfassungsgerichtswesens, dem die Normenkontrolle obliegt, einen wichtigen Ausgangspunkt für die Einführung der Verfassungsbeschwerde bildete. Nach der Vorstellung des Gesetzgebers sollte das Rechtsinstitut der Verfassungsbeschwerde vor allem dem Einzelnen ermöglichen, selbst die einem Gerichtsurteil zugrunde liegende Norm beim BVerfG vorzulegen und sie anzugreifen. Auch für den Fall, dass ein Gerichtsurteil zum unmittelbaren Beschwerdegegenstand wird, stellt sich das Verfahren der Verfassungsbeschwerde eher als ein neuer Modus der Normenprüfung dar denn als Korrektur einer unrichtigen rechtskräftigen Gerichtsentscheidung; die Entscheidung des BVerfG enthält in aller Regel eine – zumindest konkludente – Grenzziehung hinsichtlich des gesetzgeberischen Spielraums. In Korea ist das Rechtsinstitut der Verfassungsbeschwerde zweigeteilt: zum einen gibt es die Verfassungsbeschwerde gemäß § 68 Abs. 1 KVerfGG und zum anderen diejenige gemäß § 68 Abs. 2 KVerfGG. Diese Zweiteilung der Verfassungsbeschwerde hängt nicht zuletzt mit dem Ausschluss der Gerichtsurteile vom statthaften Beschwerdegegenstand zusammen; wegen des Fehlens des Instituts der Urteilsverfassungsbeschwerde musste in Korea noch eine weitere Art der Verfassungsbeschwerde eingeführt werden, damit der Betroffene die vom Ausgangsgericht unterlassene Vorlage einer entscheidungserheblichen Norm nachholen kann, was in Deutschland in der Form der sog. verdeckten Rechtssatzverfassungsbeschwerde erfolgt. Ansonsten orientiert sich die koreanische Verfassungsbeschwerde im Ganzen und Großen am deutschen Vorbild. Die Grundlage für eine solche Orientierung am deutschen Vorbild ist die Verselbständigung des Normenkontrollgerichts. In der Tat bildet die Normenprüfung das Hauptfeld der koreanischen Verfassungsbeschwerde. Aber warum sollte die Normenkontrollkompetenz dem Verfassungsgericht zugeordnet werden? Darauf gibt etwa die Cappelletti'sche Erklärung keine befriedigende Antwort. Die Auffassung Cappellettis, dass die Mentalität der gewöhnlichen Richter im Civil-Law-Rechtskreis für die Verfassungsjudikatur nicht geeignet sei, ist übertrieben; ihr kommt allenfalls eine provisorische Geltung zu. Der Grund für die Errichtung des Verfassungsgerichts liegt vielmehr darin, dass die verhältnismäßig große Struktur der traditionellen höchsten Gerichtshöfe im Civil-Law-Rechtskreis und die damit verbundene breite Anrufungsmöglichkeit der Gerichtshöfe durchaus als bewahrenswert anzusehen ist, während die Wahrung der Rechtseinheit im verfassungsrechtlichen Bereich einer kleineren Gerichtsorganisation bedarf. Eine solche Erwägung gilt auch für Korea, obwohl der KOGH bislang seine relativ kleine personelle Struktur beibehält; es gibt in Korea einen großen Bedarf an höchstinstanzgerichtlicher Rechtsprechung und somit erscheint es überaus wünschenswert, etwa durch die Aufteilung des KOGH in mehrere Senate und deren fachliche Spezialisierung die Kapazität des Gerichts zu vergrößern. Um nicht nur die Entwicklung der Verfassungsgerichtsbarkeit, sondern auch die der Fachgerichtsbarkeit zu fördern, empfiehlt sich durchaus die Zweiteilung der gesamten Gerichtsorganisation, d.h. die institutionelle Trennung der beiden Gerichtsbarkeiten. Zwischen der Verselbständigung des Normenkontrollgerichts und der Einführung der Urteilsverfassungsbeschwerde besteht eine enge Korrelation. Im Hinblick auf die Normenkontrollkompetenz des BVerfG beschloss der deutsche Gesetzgeber die Einführung der (Urteils-)Verfassungsbeschwerde. Die Befugnis des BVerfG zur authentischen Verfassungsauslegung, die auch dem Gesetzgeber gegenüber verbindlich ist, gibt ferner einen Ansatz für die Entwicklung einer differenzierten verfassungsgerichtlichen Prüfungsdichte bei der Urteilsverfassungsbeschwerde. Die Auswirkung der institutionellen Nichtzulassung der Urteilsverfassungsbeschwerde auf die verfassungsgerichtliche Normenprüfung lässt sich am koreanischen Beispiel gut erkennen: Wegen des Fehlens des Instituts der Urteilsverfassungsbeschwerde ist das KVerfG regelmäßig nicht in der Lage, seinen Prüfungsumfang auf einen individualisierten Normenteil einzugrenzen. Das Gericht kann ebenso wenig erwarten, dass ihm die Fachgerichte ihre Sachverhaltswürdigung bzw. Fallanschauung vermitteln. Wegen des Umstands, dass das Verfassungsgericht das Gesetz losgelöst von seiner konkreten Anwendung abstrakt und generell überprüfen muss, leidet die Rationalität der verfassungsgerichtlichen Entscheidung gegebenenfalls erheblich. Allerdings ist zu beachten, dass die Einführung der Urteilsverfassungsbeschwerde in Korea ein neues Problem aufwerfen könnte. Vor allem könnte das KVerfG durch die Flut von Urteilsverfassungsbeschwerde in starkem Maße überlastet werden. Die prozessualen Steuerungsmittel wie etwa die Eintragung mangelhafter Verfassungsbeschwerden in das Allgemeine Register, die Auferlegung einer Missbrauchsgebühr, die strenge Anwendung des Erfordernisses der Substantiierung bzw. des Grundsatzes der Subsidiarität der Verfassungsbeschwerde bringen ihrerseits so viele Probleme mit sich, dass sie wenig empfehlenswert erscheinen. Stattdessen wäre es besser, über ein Outsourcing eines Teils der Verfassungsbeschwerden nachzudenken, wie es von der ehemaligen Verfassungsrichterin Karin Graßhof vorgeschlagen worden ist. Daneben ist noch in Erwägung zu ziehen, ob das bestehende koreanische Vorprüfungsverfahren nicht dahin reformiert werden sollte, dass in Zukunft die Kammern nicht nur unzulässige Verfassungsbeschwerden filtern können, sondern auch offensichtlich unbegründete. Bei der Beurteilung der Erfolgsaussichten der Urteilsverfassungsbeschwerde könnte eine Differenzierung zwischen der unmittelbaren und der mittelbaren Grundrechtsverletzung dienlich sein: Für die mittelbare Grundrechtsverletzung sollte der Prüfungsmaßstab das Willkürverbot sein, wie es in dieser Arbeit rekonstruiert worden ist. Für die unmittelbare Grundrechtsverletzung wäre die Schumann'sche "Umdenken-Methode" maßgeblich; die verfassungsgerichtliche Rechtsprechung ist jedenfalls dadurch gekennzeichnet, dass sie der gesamten öffentlichen Gewalt gegenüber verbindlich sein sollte. Dies darf auch bei der Kontrolle der Zweiten bzw. der Dritten Gewalt niemals außer Acht gelassen werden. ; Why should an improper judicial decision require an extraordinary remedy for the protection of fundamental rights? This question cannot be answered in an a priori manner; instead of an extraordinary remedy, we could design another judicial process to correct a wrong decision rendered by a regular court. If this method is unpreferable, the objection should be explained substantially. But it does not seem persuasive to assume that the mentality of the regular judges is less suitable for the protection of fundamental rights than that of constitutional court judges. Political elements in the appointment of constitutional court judges do not necessarily qualify them to be guardians of the constitution. Neither can the need for an extraordinary remedy against judicial decisions be directly derived from the nature or the definition of the constitutional complaint. What is significant is rather the specific structure and jurisdiction of courts in a given state, from which various principles regarding the extraordinary remedy can be drawn. The historical approach makes it clear that the introduction of the constitutional complaint is related to the establishment of a special court for judicial review of the constitutionality of legislation. According to the prevailing opinion of the fathers of the German Federal Constitutional Court Act, the constitutional complaint was designed to be a pathway to judicial review of a statute on which the decision of a regular court was based. Even though a complaint is filed apparently against a judicial decision, its procedure represents itself mostly as another mode of judicial review of the law rather than as a reexamination of the final decision. At least in effect, the decision of the constitutional court on a constitutional issue restricts legislative discretion. In Korea, there are two types of constitutional complaint: one is regulated under Section 68.1 of the Korean Constitutional Court Act, the other under Section 68.2 of the same act. The acceptance of both types of constitutional complaint was due to the exclusion of the possibility to file a constitutional complaint against judicial decisions. This exclusion means that the unconstitutionality of a statute applied by a regular court also cannot be alleged by means of the general – i.e. the former type of – constitutional complaint. In compensation, the latter type of the constitutional complaint had to be introduced in order to give an individual a chance to allege the unconstitutionality of a statute on which a judicial decision is based. Apart from this aspect, the constitutional complaint in Korea is similar to the German model as both Germany and Korea have special courts for judicial review. Indeed, a significant number of complaints filed with the Korean Constitutional Court concern the unconstitutionality of legislation. Nevertheless, why should the task of judicial review be assigned to the constitutional court? Cappelletti did not provide a satisfactory answer to this question. His explanation, that the mentality of regular judges in civil law regions is unsuitable for the task, seems to be an exaggeration; it can serve at most as a provisional argument. The establishment of a special court for judicial review was rather due to the fact that the relatively large organization of the highest courts in civil law regions and the accordingly broad access to them were considered worth preserving while a small court is more apt to achieve legal unity, particularly in relation to constitutional issues. Regardless of the relatively small structure of the current Korean Supreme Court, such a historical precedent has significant meaning for Korea; the Korean people are longing for greater access to the highest court; thus, it seems desirable to enlarge the capacity of the court by establishing several specialized divisions. In order to promote the development not only of constitutional jurisprudence but also of other types of jurisprudence, it is highly advisable to have a separate constitutional court in addition to the regular courts. A narrow correlation exists between establishing a special court for judicial review and introducing the institution of the constitutional complaint against judicial decisions. First, with respect to the very power of the Federal Constitutional Court to control the constitutionality of statutes, the German legislature decided to introduce this institution. Second, the ability of the Court to interprete the constitution authoritatively – i.e. with binding effect even against the legislature – also gives insight into the intensity of review in dealing with constitutional complaints filed against court decisions. The situation of Korean constitutional jurisdiction shows what influence the prohibition against lodging a complaint against court decisions can have over judicial review of statues. Because of its inability to control the constitutionality of judicial interpretation – i.e. the meaning of a law as applied to a given case – the Constitutional Court is neither able to narrow the scope of review to an individualized subrule, nor can it expect the regular courts to provide their factual and legal assessment of the case. Isolated from its concrete application, a statute must always be reviewed in a general and abstract manner. This explains why the opinions of the Constitutional Court sometimes seem irrationally broad and inexpedient to solve the constitutional problem in a particular case. On the other hand, we should acknowledge that making it possible to file constitutional complaints against court decisions can also cause difficulties. Most significantly, the Constitutional Court may become overburdened by a flood of constitutional complaints against court decisions. However, procedural means such as recording defective complaints in the General Register, imposing court fees on the abuse of the constitutional complaint or strictly applying the requirement of substantiation or the principle of subsidiarity to the constitutional complaint may also have negative effects; thus, they do not seem advisable for the Korean judiciary. Instead, it would be better to consider outsourcing some constitutional complaints, as proposed by the former judge of the German Federal Constitutional Court, Karin Graßhof. In addition, we should ponder whether the present preliminary examination system should be reformed in order that the three-judge chamber can not only decide upon the inadmissibility of constitutional complaints but also dismiss obviously ungrounded ones. In deciding whether a constitutional complaint filed against a court decision should be granted, it would be useful to differentiate between a direct and an indirect violation of fundamental rights. In the latter case, the criterion for granting complaints should be the arbitrariness test as reconstrued in this dissertation. In the former case, the method proposed by Schumann – i.e. regarding a judicial decision as a legislative one – is significant. The key point is that the judgment of the constitutional court on a constitutional issue has binding effect against the entire public authority including the legislature. Even in controlling the second and the third power, this should not be disregarded.

Este trabajo analiza los vínculos materiales y simbólicos que los trabajadores y extrabajadores de la Refinería YPF-La Plata-Argentina establecen con los lugares en que viven y trabajan. Para ello se registra la importancia del trabajo industrial y los procesos socioeconómicos en los espacios de la vida cotidiana y en las representaciones espaciales que construyen los sujetos con el espacio urbano. La petrolera nacional se instaló en Ensenada en 1922, de modo que se transformaron las dinámicas urbanas y sociales de este lugar y de su ciudad vecina, Berisso. En 1993 la petrolera es privatizada, generando despidos y terciarización de mano de obra, con fuerte impacto en la estructura social y urbana. El interés de estudiar este colectivo social y sus vínculos con la ciudad radica en que la privatización generó una manifestación social que se tradujo en la apropiación de determinados espacios urbanos (fábricas, calles y barrios) y en la deconstrucción de sentidos y significados vinculados a la fuente de trabajo. Dicho escenario, atravesó parte del imaginario de los trabajadores que sobrevivieron a ese despido, pero también permanece en el recuerdo y la memoria de los más jóvenes que trabajan en la actualidad. El abordaje metodológico es cualitativo, basado en la entrevista en profundidad a los dos grupos de trabajadores, y en observación participante en los barrios circundantes a la fábrica. Se complementa con cartografías urbanas: imaginarios, huellas urbanas y mapas cognitivos, como herramientas teórico-metodológicas que permiten analizar la apropiación simbólica de la ciudad por parte de sujetos políticos y sociales con incidencia en la vida comunitaria. ; This work analyzes the material and symbolic links that the workers and former workers of the YPF-La Plata- Argentina Refinery establish with the place they live and work. For this, is recorded the importance of industrial work and socio-economic processes in the spaces of daily life and in the spatial representations that subjects build with urban space. The national oil company settled in Ensenada in 1922 changing the urban and social dynamics of this place as well as that of its neighboring city, Berisso. In 1993 the company is privatized, generating layoffs and outsourcing of labor, with a strong impact on the social and urban structure. The interest in studying this social group and its links with the city lies in the fact that privatization generated a social manifestation that resulted in the appropriation of some urban spaces (factory, streets. and neighborhoods) and in the deconstruction of meanings linked to the source of work. This scenario crossed part of the imaginary of the workers who survived the dismissal but it also settled in the memory of the youngest who work today. The methodological approach is qualitative, based on the in-depth interview with both groups of workers, and on participant observation in the neighborhoods surrounding the factory. It is complemented with urban cartographies: imaginary, urban tracks and cognitive maps, as theoretical-methodological tools that allow analyzing the symbolic appropriation of the city by political and social subjects with an impact on community life. ; Este trabalho analisa os vínculos materiais e simbólicos que os trabalhadores e extrabalhadores da Refinaria YPF-La Plata-Argentina estabelecem com o local em que vivem e trabalham. Em 1993, a petroleira foi privatizada, gerando demissões e terceirização de mão-de-obra, com forte impacto na estrutura social e urbana. O interesse em estudar esse grupo social e seus vínculos com a cidade reside no fato de que a privatização gerou uma manifestação social que resultou na apropriação de determinados espaços urbanos (fábricas, ruas e bairros) e na desconstrução de significados e significados ligados à fonte do trabalho. The migratory flows and the refugee crisis in Europe since 2015 have motivated a growing concern about the respect of human rights and European values in the actions of the EU and the Member States when confronting controls of access to European territory in the external borders. This work analyzes how borders are problematic places for the defense, application and protection of human rights of foreigners, causing what we call the 'fragility' of human rights in the EU's external air, land and maritime borders. We are witnessing a change in the very concept of border in this post-globalization era, in which certain functions are offshored and systematically placed outside a state's territory and checkpoints. However, territorial and extraterritorial actions must be differentiated from those occurring as part of external actions in or with third states for the purposes of migration policy and the control of migration flows. The reality is that a new border space south and east of the Mediterranean has been configured for migratory flows, which needs a new policy of external borders for these areas. Therefore, we must reflect on new frontier spaces, with new concepts and approaches to the border that provide other parameters of action towards migratory flows and external controls. On the other hand, the protection of human rights by European States beyond the external borders is treated to determine to what extent the control functions that are deployed outside the territory affect the human rights of migrants. For this, we differentiate between situations of Outsourcing or Externalisation, where those that act are third States; and situations with Extraterritorial action of migration controls where agents of European States intervene. Both pose problems of protection of human rights in migration controls outside the terrestrial or the maritime territory of the Member States of the EU; we conceive them as deterritorialized functions of border control. And both situations must have in our opinion differentiated mechanisms for monitoring, control and supervision of respect for human rights in the functions of migration control. Respect of human rights of foreigners in border controls is a vital issue of the identity, values and even the survival of the European integration. ; Las avalanchas migratorias y crisis de refugiados en Europa desde 2015 han motivado una preocupación creciente sobre el respeto de los valores europeos y los Derechos humanos en la actuación de la UE y los Estados miembros al afrontar flujos migratorios y controles de acceso al territorio europeo en las fronteras exteriores. Este trabajo comprueba cómo las líneas fronterizas son lugares problemáticos para la defensa, aplicación y protección de derechos humanos de los extranjeros, provocando lo que denominamos la fragilidad de los Derechos humanos en las Fronteras Exteriores aéreas, terrestres y marítimas de la UE. Estamos ante un cambio en la concepción misma de la frontera en esta era pos-globalización, donde determinadas funciones se deslocalizan y se sitúan sistemáticamente fuera del territorio y los puestos fronterizos de los Estados. Sin embargo, las actuaciones territoriales y extraterritoriales deben diferenciarse de las que se producen en actividades de acción exterior en o con terceros Estados a fines de política de inmigración y control de flujos migratorios. La realidad es que se ha configurado para los flujos migratorios un nuevo espacio fronterizo al sur y este del mediterráneo, que necesita una nueva política de fronteras exteriores para este área. Por ello debemos reflexionar sobre nuevos espacios e imaginarios fronterizos, con nuevos conceptos y enfoques de la frontera que aporten otros parámetros de actuación hacia los flujos migratorios y los controles exteriores Por otra parte, se analiza la protección de los derechos humanos por los Estados europeos mas allá de las fronteras exteriores, para determinar en qué medida las funciones de control que se despliegan fuera del territorio afectan a los derechos humanos de los inmigrantes. Para ello diferenciamos entre las situaciones de Externalizacion, donde los que actúan son Estados terceros; y de actuación Extraterritorial de controles migratorios donde intervienen agentes de Estados europeos. Ambas plantean problemáticas de protección de derechos humanos en controles migratorios fuera de territorio terrestre o marítimo de los Estados miembros de la UE, en los que concebimos como funciones desterritorializadas de control fronterizo. Y ambas deben tener en nuestra opinión diferenciados mecanismos de seguimiento, control y supervisión del respeto de los derechos humanos en las funciones de control de inmigración. El respeto de derechos humanos de los extranjeros en los controles fronterizos es una cuestión vital para la identidad, valores y pervivencia de la integración europea.

Vocational education and training presented a potentially conflicting object crossing the lines of public policies and private action. The development of a differentiated supply was based on the negociated determination of skills. The modalities of VET diverged according to professional branches. They followed different conceptions, related to the knowledge required by the industrial production and organization. Public and private VET supplies were sometimes opposed, sometimes supplemented in order to meet all needs. The case of metallurgical, metalworking and machine building industries of the region of Saint-Étienne allows us to study the motivations and the balance of forces. Since the Second Empire, the supply for vocational training grew. The sustainability of these achievements was initially fragile. They depended on municipal initiative or private organization. The vocational schools founded during the early times of the Third Republic changed the outcome. The development of a municipal supply aroused the reaction of the clerical side, supported by local catholic bourgeoisies. The evolution of these paths was due to a significant difference in the objectives of theses courses. On one hand, VET was considered as a mean for the diffusion of scientific and technical knowledge. On the other hand, it was used as a way to spread moral and hierarchical principles. Through the various strategies at work, from outsourcing to integration, the training of a workers' elite tended to place the question of authority at the heart of VET organization. With the beginning of the twentieth century, the initiated schooling process drove to the institutionalization of vocational courses, as a support for apprenticeship. The rise of workers' conflictuality, the evolution of production et organization renewed the role of scientific and technical skills. Employers, willing to reinforce their leadership in the field of industrial relations, tried to limit the intervention of the state within VET. The apprenticeship levy was a remarkable example of such a resistance. The supply of workers training, both public and private, was reinforced in its functions by the metalworking employers. Institutional innovations remained weak until the tough developpement of accelerated vocational training in the late 1930s. The Second World War confirmed the interest of metalworking employers for a traning organization less squeezed into the standards of the ministry of National Education. Finally, after the Libération, the stateization of workers' apprenticeship brought about the rallying of businesses to the schooling form. ; La formation des travailleurs présente, à l'intersection des politiques publiques et de l'action privée, un objet potentiellement conflictuel. Le développement d'une offre différenciée s'est appuyé sur la détermination d'objectifs négociés. Les modalités de la préparation au travail divergent selon les branches professionnelles et les conceptions patronales des savoirs nécessaires à la production industrielle et à son organisation. L'offre publique et l'offre privée se sont tantôt opposées, tantôt complétées, afin de répondre à l'ensemble des besoins en compétences. Le cas des industries métallurgiques et mécaniques de la région de Saint-Étienne permet d'étudier les motivations et rapports de forces à l'oeuvre. Depuis le Second Empire, l'offre de formation ne cesse de se développer. La pérennité de ces réalisations se révèle au départ fragile, par sa dépendance à l'initiative municipale ou à l'action collective privée. L'oeuvre scolaire de la Troisième République modifie la donne. Le développement, à partir de 1879, d'une offre municipale d'enseignement technique suscite la réaction des milieux cléricaux, soutenus par les bourgeoisies catholiques locales. L'évolution de ces deux offres s'explique par une différenciation dans les objectifs de ces formations scolaires entre, d'une part, savoirs scientifiques et techniques et, d'autre part, objectifs moraux et hiérarchiques. À travers ces différentes stratégies patronales, entre externalisation et intégration de la fonction formation, la préparation d'une élite ouvrière tend à placer la question de l'autorité au cœur du dispositif. Lors du début du XXe siècle, l'institutionnalisation des cours professionnels, en tant que support de l'apprentissage ouvrier, s'inscrit dans la continuité de la scolarisation des décennies précédentes. La montée de la conflictualité ouvrière, l'évolution des techniques de production et de leur organisation donnent une importance nouvelle aux compétences scientifiques et techniques. Le patronat, soucieux de ses prérogatives dans le domaine des relations sociales, tente de limiter l'intervention de l'État. La taxe d'apprentissage en est un exemple remarquable. L'offre de formation ouvrière, publique comme privée, est confortée dans ses fonctions par les dirigeants de la métallurgie. Les innovations institutionnelles demeurent faibles, jusqu'au difficile développement des formations professionnelles accélérées à la fin des années 1930. La Seconde Guerre mondiale confirme l'intérêt des employeurs pour des filières moins engoncées dans les normes de l'Éducation nationale. L'étatisation de l'apprentissage ouvrier traduit cependant, après la Libération, le ralliement du patronat métallurgique à la forme scolaire, publique comme privée.

The case of metallurgical, metalworking and machine building industries of the region of Saint-Étienne allows us to study the motivations and the balance of forces. Since the Second Empire, the supply for vocational training grew. The sustainability of these achievements was initially fragile. They depended on municipal initiative or private organization. The vocational schools founded during the early times of the Third Republic changed the outcome. The development of a municipal supply aroused the reaction of the clerical side, supported by local catholic bourgeoisies. The evolution of these paths was due to a significant difference in the objectives of theses courses. On one hand, VET was considered as a mean for the diffusion of scientific and technical knowledge. On the other hand, it was used as a way to spread moral and hierarchical principles. Through the various strategies at work, from outsourcing to integration, the training of a workers' elite tended to place the question of authority at the heart of VET organization. With the beginning of the twentieth century, the initiated schooling process drove to the institutionalization of vocational courses, as a support for apprenticeship. The rise of workers' conflictuality, the evolution of production et organization renewed the role of scientific and technical skills. Employers, willing to reinforce their leadership in the field of industrial relations, tried to limit the intervention of the state within VET. The apprenticeship levy was a remarkable example of such a resistance. The supply of workers training, both public and private, was reinforced in its functions by the metalworking employers. Institutional innovations remained weak until the tough developpement of accelerated vocational training in the late 1930s. The Second World War confirmed the interest of metalworking employers for a traning organization less squeezed into the standards of the ministry of National Education. Finally, after the Libération, the stateization of workers' apprenticeship brought about the rallying of businesses to the schooling form. ; La formation des travailleurs présente, à l'intersection des politiques publiques et de l'action privée, un objet potentiellement conflictuel. Le développement d'une offre différenciée s'est appuyé sur la détermination d'objectifs négociés. Les modalités de la préparation au travail divergent selon les branches professionnelles et les conceptions patronales des savoirs nécessaires à la production industrielle et à son organisation. L'offre publique et l'offre privée se sont tantôt opposées, tantôt complétées, afin de répondre à l'ensemble des besoins en compétences. Le cas des industries métallurgiques et mécaniques de la région de Saint-Étienne permet d'étudier les motivations et rapports de forces à l'oeuvre. Depuis le Second Empire, l'offre de formation ne cesse de se développer. La pérennité de ces réalisations se révèle au départ fragile, par sa dépendance à l'initiative municipale ou à l'action collective privée. L'oeuvre scolaire de la Troisième République modifie la donne. Le développement, à partir de 1879, d'une offre municipale d'enseignement technique suscite la réaction des milieux cléricaux, soutenus par les bourgeoisies catholiques locales. L'évolution de ces deux offres s'explique par une différenciation dans les objectifs de ces formations scolaires entre, d'une part, savoirs scientifiques et techniques et, d'autre part, objectifs moraux et hiérarchiques. À travers ces différentes stratégies patronales, entre externalisation et intégration de la fonction formation, la préparation d'une élite ouvrière tend à placer la question de l'autorité au cœur du dispositif. Lors du début du XXe siècle, l'institutionnalisation des cours professionnels, en tant que support de l'apprentissage ouvrier, s'inscrit dans la continuité de la scolarisation des décennies précédentes. La montée de la conflictualité ouvrière, l'évolution des techniques de production et de leur organisation donnent une importance nouvelle aux compétences scientifiques et techniques. Le patronat, soucieux de ses prérogatives dans le domaine des relations sociales, tente de limiter l'intervention de l'État. La taxe d'apprentissage en est un exemple remarquable. L'offre de formation ouvrière, publique comme privée, est confortée dans ses fonctions par les dirigeants de la métallurgie. Les innovations institutionnelles demeurent faibles, jusqu'au difficile développement des formations professionnelles accélérées à la fin des années 1930. La Seconde Guerre mondiale confirme l'intérêt des employeurs pour des filières moins engoncées dans les normes de l'Éducation nationale. L'étatisation de l'apprentissage ouvrier traduit cependant, après la Libération, le ralliement du patronat métallurgique à la forme scolaire, publique comme privée.
