Identidad genética y libertad de ciencia

Abstract

Los avances en Genética Humana y sus aplicaciones han abierto grandes esperanzas en términos de mejora de la salud y del bienestar, pero no cabe pasar por alto la importante preocupación que generan en los ciudadanos y los poderes públicos. En este trabajo se reflexiona sobre esta materia tomando como base la relación entre dos conceptos que con frecuencia aparecen enfrentados. De una parte la identidad genética, que a grandes rasgos nos invita a reflexionar sobre todo aquello que como valor jurídico representa el Genoma humano; de otra parte, la libertad de Ciencia, que no había conocido en la historia un nivel de intervención pública similar al actual. Tienen especial protagonisno en este análisis el cuerpo normativo creado para proteger los derechos fundamentales ante los avances y aplicaciones de la Genética Humana y el impulso que lo fraguó y terminó por alcanzar a la Carta de Derechos Fundamentales de la UE ; Advances in Human Genetics and its applications have given rise to considerable expectation with regard to improvements in health and welfare, but one cannot ignore the significant degree of concern shown by both the general public and the authorities. This work offers a reflection upon this issue base don the relationship between two concepts that often appear to be in direct opposition one to the other. On the one hand genetic identity, which broadly speaking invites us to reflect upon all that which is represented by the human genome in terms of legal status; on the other hand, Scientific freedom, currently subject to a degree of public intervention heretofore unprecedented in its history. Especially prominent in this analysis is the body of legislation created to protect fundamental rights in the face of the advances and applications of Human Genetics and the drive to forge this legislation, which culminated in the Charter of Fundamental Rights of the European Union
