Abstract
Maintenance allowances for children after divorce. Do the courts implicitly apply a calculation on the cost of the child ?
The authors use administrative data from divorce rulings to analyse whether the courts follow an economic rationale in the absence of a scale when setting maintenance allowances for children. The authors then consider whether other factors with less economic justification are involved in the ruling and finally whether there is a «judge effect » . Their analysis shows that the decisions studied obey a consistent economic rationale in terms of the parents' financial situation, but take little account of the children's specifics. Rulings are also influenced by other decisive factors which are less justified in economic and legal terms.
